Western Australian Products Symbol Act 1972

The statute embeds a small-set of legal concepts that structure rights, duties and enforcement.

• Prescribed symbol: Defined by reference to the Schedule; the Act treats the Schedule’s design as the prescribed symbol irrespective of size and colour (s 4). The Act therefore fixes the visual mark and excludes variation in form, though not size or colour.

• Authorisation to use: The statutory permission to affix the symbol is conditional: it applies to a person who “sells any product the production and preparation of which is substantially carried out in the State” (s 5). The Act does not define “substantially carried out in the State” within the provided text, so the condition is a factual threshold the statute requires without a statutory metric in the Act itself.

• Broad definition of “sell”: The Act defines “sell” in s 3 broadly. The definition expressly includes placing on the market, barter, supply under contracts for work and materials, offering or exposing for sale, delivery for sale, wholesale and retail trading, hire-purchase disposal, and the supply of samples to induce purchase, among other acts (s 3). The breadth means many commercial acts can engage the statutory permission and offence provisions.

• Knowledge element for offence: The primary offence is knowledge-based. A person commits an offence if they affix or cause to be affixed the prescribed symbol, or sell a product to which it is affixed, knowing that the product is not substantially produced and prepared in the State (s 6). The mental element is therefore central to liability.

• Inspectors and enforcement architecture: The Minister appoints inspectors (s 7). Inspectors are given duties to enforce the Act and, subject to the Minister’s approval, to commence and conduct prosecutions (s 8). Inspectors have powers of entry during normal working hours, seizure of documents and goods, and to take samples; documents and goods seized must be returned if no prosecution is commenced within thirty days (s 9).

• Assistance and obstruction offences: The occupier must provide reasonable assistance and information to inspectors (s 10). Wilful obstruction, failure to provide reasonable assistance or knowingly making misstatements when required to give information are offences (s 11), with a statutory penalty and a provision protecting a maker’s statement against use in self-incrimination in prosecutions other than for the obstruction offence (s 11(3)).

• Secrecy protection and exceptions: Section 12 creates an offence for disclosure of manufacturing processes or trade secrets obtained under, or in connection with, execution of the Act, subject to three exceptions: written consent of the undertaking’s operator, disclosure in connection with execution of the Act, and disclosure for legal proceedings arising out of the Act (s 12).

• Regulatory power: The Governor may make regulations for any purpose required or permitted by the Act (s 14). That creates a route for further operational detail to be prescribed.

These concepts are the statute’s operational architecture: authorisation tied to a factual threshold; broad commercial coverage; an enforcement regime anchored in ministerial appointment and inspector powers; protections for commercial confidentiality; and a regulatory head of power for implementing detail.

The Act affects a narrow set of actors through direct duties, permissions and potential liability.

• Sellers and suppliers: Any person who sells goods meeting the statutory threshold may affix the symbol (s 5). Because “sell” is defined broadly (s 3), this reaches manufacturers, wholesalers, retailers, distributors, agents supplying samples, parties supplying goods under work-and-materials contracts, and persons disposing of goods under hire-purchase or credit sale terms. The permission benefits sellers whose production and preparation is substantially in Western Australia.

• Sellers who do not meet the threshold: Persons who affix the symbol to goods not substantially produced and prepared in Western Australia, or who sell goods so marked while knowing the goods do not meet the threshold, commit an offence (s 6). The mental element of knowledge means that liability is targeted at those who knowingly misrepresent origin.

• Inspectors and the Minister: The Minister controls appointment of inspectors (s 7) and approval for inspectors to commence prosecutions (s 8(1)). Inspectors exercise investigatory powers (s 9) and have a duty to see the Act’s provisions are observed (s 8(1)). Inspectors thus administer and enforce the scheme.

• Occupiers and persons in charge of premises: Occupiers and persons apparently in charge must provide reasonable assistance and information to inspectors (s 10). They also face the separate statutory obstruction offence if they wilfully obstruct or fail to assist (s 11).

• Persons disclosing trade secrets or manufacturing processes: Individuals who receive confidential manufacturing information in the course of executing the Act may be criminally liable for unauthorised disclosure (s 12), subject to listed exceptions.

• Prosecutors and courts: Inspectors may prosecute, subject to Ministerial approval (s 8); but the Act also preserves the right of other persons to prosecute offences under the Act (s 8(2)). Courts are given conclusive evidence rules regarding inspector appointment certificates (s 7(3)).

• Governor/Executive: The Governor (on Executive advice, typically) has regulation-making power (s 14), and the Minister has administrative discretion in appointments and prosecution approvals.

The distribution of responsibilities is concentrated: sellers and occupiers bear primary compliance duties and possible criminal exposure; the Minister and appointed inspectors carry enforcement discretion; and the Governor may prescribe operational detail by regulation. The statutory design therefore places day-to-day burdens on private economic actors while vesting initiation and oversight of enforcement in the executive.

The Act allocates a small set of rights to use the prescribed symbol and imposes specific duties on private parties and inspectors.

Rights

• Conditional right to use the symbol: A person who sells a product whose production and preparation is substantially carried out in Western Australia is authorised to affix the prescribed symbol to the product or its container (s 5). This is a positive statutory permission; it is not phrased as a licence regime with application requirements in the text provided, but it does condition the right on a factual production threshold.

Duties on sellers and occupiers

• Ensure accuracy: A person who affixes the symbol or sells goods with the symbol must ensure the goods meet the “substantially carried out in the State” threshold; otherwise, if done knowingly, an offence results (s 6). The duty is therefore to validate the origin/production facts prior to using the symbol or selling marked goods.

• Assist inspectors: Occupiers and persons in charge must furnish inspectors all reasonable assistance and information they are capable of providing or as required by the inspector in relation to the inspector’s powers and duties (s 10). This imposes an evidential cooperation duty during inspections.

Duties on inspectors and executive actors

• Duty to enforce and prosecute with approval: Inspectors have the duty to see the Act’s provisions relating to prescribed symbols are being observed and, subject to Ministerial approval, to commence and conduct prosecutions for offences under the Act (s 8(1)). The Act thus imposes an enforcement duty but conditions prosecutorial action on executive oversight.

• Produce appointment certificate: Inspectors must be furnished with and produce a prescribed-form certificate evidencing appointment when required (s 7(2)). Production is conclusive proof of appointment and authority in court (s 7(3)). This duty protects the evidential basis for inspector powers.

Powers (tied to duties)

• Entry and inspection in normal working hours: Inspectors may enter premises, during normal working hours, where they reasonably believe marked products are produced, prepared or kept for sale, or where an offence is or has been committed (s 9(1)). Entry is conditional on reason to believe specific facts.

• Seizure and copies: Inspectors may take possession of, or copy, documents connected with an offence, and may take possession of goods or samples for use as evidence (s 9(2)). Seized items must be returned if no prosecution is commenced within thirty days (s 9(3)).

Limits and protections

• Business disruption mitigations: Inspectors must conform, as far as practicable, to reasonable requirements of the premises owner or user necessary to prevent obstruction to the working of the business during exercise of powers (s 9(4)). This places a statutory constraint on inspector conduct to mitigate operational disruption.

• Self-incrimination protection limited to certain prosecutions: Statements made under s 11’s requirements are not admissible in evidence in a prosecution against the person for any offence, other than the obstruction offence under s 11, if the person objected to providing the statement on self-incrimination grounds at the time (s 11(3)). This is a constrained protection for compelled statements.

Confidentiality duty

• Secrecy obligation: Persons who obtain information about manufacturing processes or trade secrets under the Act are prohibited from disclosing it except with written consent of the operator, in connection with the execution of the Act, or for legal proceedings arising out of the Act (s 12). This creates a duty to maintain confidentiality with specified exceptions.

Regulatory scope

• Power to make regulations: The Governor may make regulations for any purpose required or permitted by the Act (s 14), enabling the Executive to prescribe further duties, forms, procedures or penalties consistent with the Act’s object.

In sum, rights are narrow and conditional, duties are specific and searchable (accuracy, assistance, confidentiality), and inspector powers are qualified by time, purpose and a return obligation for seized items.

The Act uses a criminal enforcement model with fixed monetary penalties and an inspector-led investigatory regime.

Penalties

• Misuse of prescribed symbol: A person who knowingly affixes, permits to be affixed, or sells a product with the prescribed symbol when the product is not substantially produced and prepared in Western Australia commits an offence (s 6). Penalties are tiered by repeat offending: first offence $50; second $150; third or subsequent $400 (s 6).

• Obstruction: Wilful obstruction of a person executing the Act is an offence with a penalty of $200 (s 11(1)).

• Secrecy breaches: Unauthorised disclosure of manufacturing processes or trade secrets obtained under the Act is an offence with penalty $200 (s 12), subject to listed exceptions.

Enforcement architecture and procedural features

• Inspectors: The Minister appoints inspectors (s 7). Inspectors have investigatory powers (s 9) including entry during normal working hours where they have reason to believe marked products are produced, prepared or kept for sale, or that an offence has been committed. They may take possession of documents and goods, copy documents, and take samples for use as evidence (s 9(2)). Seized documents or goods must be returned if no prosecution is commenced against the person from whose custody they were taken within thirty days (s 9(3)).

• Conduct of prosecutions: Inspectors are charged with the duty to see the Act’s provisions are observed and, subject to Ministerial approval, to commence and conduct prosecutions (s 8(1)). The Act preserves the right of other persons to prosecute offences under it (s 8(2)), so private prosecutions remain possible.

• Conclusive proof of appointment: Production of an inspector’s certificate in the prescribed form is conclusive proof in any court of appointment and authority to exercise powers under the Act (s 7(3)). That evidentiary rule simplifies the prosecution of enforcement actions relating to inspector conduct.

• Entry constraints: Inspectors may only enter during “normal working hours” (s 9(1)). The phrase is not defined in the Act as provided; it creates a temporal limitation on entry powers that courts or agencies would interpret in context.

• Business interruption constraint: Inspectors must, as far as practicable, conform to reasonable requirements of the person owning or using the premises necessary to prevent obstruction to the working of the business (s 9(4)). This is an operational constraint to reduce business disruption during inspections.

Operational consequences of penalty design

• Monetary quantum: Penalties are modest fixed amounts. The maximum listed for repeat misuse is $400 (s 6). Obstruction and secrecy penalties are $200 (ss 11, 12). The scale suggests the Act targets regulatory compliance and deterrence rather than high-value punitive fines. For many businesses, these amounts are small relative to typical commercial margins and may affect enforcement incentives and prosecutorial priorities.

• Knowledge threshold: The need to prove knowledge for the misrepresentation offence (s 6) raises evidential requirements for successful prosecution. The presence of a knowledge element may reduce the number of successful prosecutions where mis-flagging results from negligence or misunderstanding of origin.

• Ministerial control over prosecutions: Inspectors require the Minister’s approval to commence and conduct prosecutions (s 8(1)). That places an executive gate on state-led prosecutions, affecting the rate and type of enforcement. However, the Act allows others to prosecute without that approval (s 8(2)).

• Time-limited retention of seized items: The 30-day rule for return of items seized if no prosecution is commenced (s 9(3)) limits long-term operational interference from seizures but does not specify procedures for challenge during the 30-day holding period.

The Act therefore creates a criminal enforcement framework with limited fine levels, targeted investigatory powers, ministerial oversight of prosecutions, and procedural protections for businesses regarding seizure and business disruption.

The text provided is self-contained and contains limited cross-references. Interaction with other legislation is available principally via general legal relationships rather than specific cross-references in the Act.

• No express conflict or saving provisions included: The Act, as provided, does not include express savings, overlaps or conflict-resolution clauses with other Commonwealth or State statutes. The Schedule prescribes the symbol (s 4). Users must therefore consider general principles of statutory interpretation and any applicable higher-order laws (for example, consumer protection or trade description statutes) when operating under this Act. The Act itself does not purport to displace other causes of action or regulatory schemes.

• Prosecutorial concurrency: The Act permits inspectors to commence prosecutions subject to Ministerial approval (s 8(1)) and preserves the right of other persons to prosecute offences under the Act (s 8(2)). That means that private prosecutions remain available as an interacting enforcement mechanism; the Act does not create an exclusive state-only enforcement channel.

• Regulation-making power: The Governor may make regulations for any purpose required or permitted by the Act (s 14). Regulations could set out procedural interaction points with other statutory regimes, forms, or specific evidentiary or enforcement procedures. Until regulations are made, the Act’s operation will be governed by its expressed terms.

• Evidentiary and appointment rules: Production of an appointment certificate is conclusive proof of appointment and authority (s 7(3)). This evidentiary rule is an internal mechanism that could interact with general rules of evidence or administrative law challenges, but it is a statutory conclusive proof rule within the Act’s own operation.

• Secrecy and legal proceedings: Section 12 permits disclosure of trade secrets in connection with the execution of the Act and for the purposes of legal proceedings arising out of the Act (s 12(c)). That exception establishes a direct interface between the confidentiality obligation created by the Act and the needs of litigation under the Act.

• Repeals and omissions flagged in compilation notes: Section 2 is omitted under the Reprints Act 1984 s 7(4)(f). Section 13 was deleted by No. 9 of 2023 s 167 and is noted in the Act compilation. The compilation table records amendments and commencement dates, which help track which provisions interact with other amending legislation.

Practical implications

• Compliance with the Act does not obviate obligations under broader consumer protection, trade description or misleading conduct laws. Sellers should treat the Act as a specific source of authority and risk for origin claims, while other statutes may also regulate representations to consumers.

• The Act’s enforcement design allows private parties to enforce the Act by prosecution (s 8(2)), creating an additional enforcement pathway that can interact with contractual disputes, consumer complaints, or other regulatory strategies.

• Because the Act leaves the term “substantially carried out in the State” undefined, interaction with other laws that define origin or country-of-origin rules may be relevant in practice, but the Act itself contains no cross-reference to those schemes. Legal advisers will need to reconcile factual standards across instruments when advising clients or structuring marketing claims.

The compilation material included in the provided text lists the Act’s original enactment and at least one later amendment reference.

• Original enactment: The Western Australian Products Symbol Act 1972 (No. 54 of 1972) received assent on 2 October 1972 and commenced on the same date, 2 October 1972, according to the compilation table.

• Reprints and omissions: The compilation notes record a Reprint 1 as at 12 September 2003. Section 2 of the Act is omitted under the Reprints Act 1984 s 7(4)(f) (this is noted in the Act text immediately following s 1).

• More recent amendment entry: The compilation table records that the Directors’ Liability Reform Act 2023 (No. 9 of 2023), Part 3 Division 68, is associated with the Act, with assent on 4 April 2023 and commencement 5 April 2023 (see s 2(j) of that amending Act). The compilation table recognises that amendments have been made by other written laws; however, the specific changes effected by the 2023 Act are not described in the provided excerpt beyond the compilation table entry.

• Deletion of s 13: The Act text indicates that section 13 has been deleted by No. 9 of 2023 s 167. The content of s 13 prior to deletion is not reproduced in the provided text. The Act’s notes explicitly mark the deletion and reference the amending instrument.

• Reprints Act cross-reference: The omission of s 2 is expressly noted as effected under the Reprints Act 1984 (s 7(4)(f)). The compilation table and notes form part of the Act’s legislative history as reprinted.

How to read the history from the provided materials

• The compilation table provides enactment and amendment markers but does not supply the full text of amendments or their policy materials. The deletion of s 13 by the 2023 amending law is the only provision in the main text explicitly shown as deleted. Without the amending Act text, one cannot specify whether substantive changes were made to offence provisions, penalties, or inspector powers beyond what is shown.

• The Act as presented includes the Schedule and the current operative sections (including s 4’s prescribed symbol and s 14’s regulation power). Any detailed change introduced by the cited amending laws would need to be read in the amending instruments themselves to see precisely what text was inserted, removed or modified.

For advice or litigation purposes, consult the amending instruments referenced in the compilation table to trace precise textual changes. The compilation notes are authoritative for the existence of amendments, but not for their detailed content in the excerpt provided.

The provided materials do not include any judicial decisions, reported litigation, or case law interpreting the Western Australian Products Symbol Act 1972. The Act’s text and compilation notes list enactment and amendment details but do not record any cases or judicial consideration.

Implications for practitioners and researchers

• Absence of recorded cases in the provided text means that there is no binding judicial interpretation included here for key open terms such as “substantially carried out in the State”, “normal working hours” for entry, or the evidential standard for proving a respondent’s knowledge under s 6. Where contested, these terms would require courts to interpret the Act; however, no such interpretations are provided in the Act excerpt.

• Because the Act preserves private prosecutions (s 8(2)), private enforcement may have generated litigation not captured in this document. The compilation materials do not summarise such litigation.

• Advisers must therefore treat ambiguous elements in the Act,most notably the substantiality threshold and the knowledge requirement,as fact-intensive questions with no recorded statutory gloss in the materials supplied. Where litigation history is material to a client’s risk assessment, a search of court records and legal databases beyond the provided text will be necessary.

• The absence of litigation history in the provided text also means there is no authoritative guidance within the Act materials on the limits of inspectors’ entry powers, the practical interpretation of “business interruption” considerations (s 9(4)), or the scope of the secrecy offence’s exceptions in s 12.

In short, the Act stands in the provided materials as a statutory scheme without reported judicial development included here; practitioners should assume factual uncertainty on contested terms unless other sources document cases.

The Act is short and straightforward on its face, but several features create practical compliance, enforcement and interpretive pitfalls.

• Undefined “substantially carried out in the State”: Section 5 conditions the right to affix the symbol on products “the production and preparation of which is substantially carried out in the State”. The Act does not define “substantially” in the provided text. That absence leaves a factual and legal threshold open to interpretation. Practitioners advising clients on origin claims must assess production steps, component sourcing, assembly, finishing and packaging to determine whether the substantiality threshold is likely met; the Act’s text offers no bright-line test.

• Broad definition of “sell”: The definition of “sell” in s 3 is comprehensive, covering not only sale but barter, supply under contracts for work and materials, supplying samples to induce purchase, hire-purchase disposal, and causing or permitting sale. That breadth means inadvertent uses of the symbol in samples, promotional distribution, or contracts for work could engage the Act. Businesses often treat samples as promotional and not “sales”; the Act treats supply of a sample to induce purchase as falling within “sell” (s 3(i)), exposing sample distribution to the Act’s reach.

• Knowledge mens rea narrows some enforcement but raises evidential issues: Liability under s 6 requires knowledge that the product is not substantially produced/prepared in the State. That requires proof of subjective awareness, which may make prosecutions harder where mislabelling is careless rather than deliberate. Conversely, businesses cannot rely solely on an ignorance defence; if evidence shows actual knowledge, penalty applies.

• Low monetary penalties may affect enforcement incentives: Penalties are small (first offence $50, escalating to $400 for third/subsequent, s 6). For many commercial actors, these amounts are trivial relative to turnover or marketing gains from origin claims. That creates a risk that the deterrent effect is modest and that private prosecutions, rather than state action, may drive enforcement. The Act does allow others to prosecute (s 8(2)), which could be used strategically by competitors or consumer groups.

• Ministerial gatekeeping for prosecutions: Inspectors may commence prosecutions only with Ministerial approval (s 8(1)). This shifts control over public prosecutions to the executive and may slow or limit state-led enforcement. However, private prosecutions remain available (s 8(2)), creating a parallel enforcement pathway.

• Secrecy offence and evidence handling: Section 12 criminalises disclosure of manufacturing processes or trade secrets obtained under the Act, with limited exceptions. Businesses providing access to processes during inspection must be aware of the statutory confidentiality protections but also of the exception that allows disclosure in connection with the execution of the Act and for legal proceedings (s 12(b)-(c)). Practically, parties should document consents and legal disclosures to avoid contravening s 12.

• Inspectors’ entry limited to “normal working hours”: Inspectors’ entry powers are limited to “normal working hours” (s 9(1)). The Act does not define that term. Practitioners need to assess what constitutes normal working hours for the specific premises and operations to identify valid entry times.

• Return of seized materials in 30 days: Goods or documents seized for evidence must be returned if no prosecution is commenced within thirty days (s 9(3)). Businesses should be prepared to seek prompt action or recovery of property if seizures occur, and to preserve copies for their own records.

• Conclusive proof of appointment: An inspector’s certificate is conclusive proof of appointment and authority in court (s 7(3)). This makes procedural challenges to an inspector’s authority difficult if the certificate is properly produced.

• Deleted provisions: Section 13 has been deleted (noted in text). Practitioners should not assume that any prior rights or exceptions formerly in that section remain; they should consult amending legislation to identify what was removed.

• Regulations may add obligations: The Governor’s regulation-making power (s 14) allows further operational detail to be prescribed. Absence of regulations in the provided text does not mean none exist; ensure current regulations are checked when advising clients.

These features mean that compliance is not limited to sticking the symbol on qualifying products; businesses must assess production processes, promotional practices, record-keeping for origin claims, and responses to inspection with awareness of the Act’s confidentiality rules and inspector powers.

Compliance under the Act requires both substantive and procedural measures to ensure authorised use and to limit exposure to the offences in ss 6, 11 and 12.

Establish an origin-assessment process

• Document production stages: Because the statutory trigger is that production and preparation be “substantially carried out in the State” (s 5), businesses should map and document each step of production, preparation and finishing, including where each step occurs. Keep contemporaneous records showing the proportion of value-added or labour performed in Western Australia to support a claim of substantial production.

• Define internal thresholds: In the absence of a statutory definition of “substantially”, adopt an internal, documented policy on what “substantial” means for your operations (for example, a defined percentage of value added or key manufacturing stages carried out in-state). Ensure policy is legally defensible and reflected in marketing claims.

Records and evidence management

• Maintain purchase, manufacturing and logistics records: Retain supplier invoices, work orders, time and labour records, batch records and shipping manifests that corroborate the site and extent of production and preparation. Those materials will be relevant both to proving compliance and to resisting allegations of knowledge if a misuse allegation arises under s 6.

• Control use of the symbol: Implement approval procedures for any packaging, labelling, promotional materials and samples that use the prescribed symbol. Centralised sign-off will reduce the risk of unauthorised or mistaken use that could create a knowledge-based offence.

Responding to inspections

• Identify an internal liaison: Designate a person to liaise with inspectors and to produce requested documents. The occupier must furnish reasonable assistance and information the person can provide (s 10). That liaison should understand the limits of what can be lawfully disclosed and how to assert protected positions, such as objecting to self-incrimination where appropriate (s 11(3)).

• Manage entry and working hours: Be ready to verify what constitutes “normal working hours” for the premises and to request that inspector activity be scheduled to minimise disruption, consistent with s 9(4) which requires inspectors to conform, as far as practicable, to reasonable requirements to prevent business obstruction.

• Protect trade secrets: If manufacturing processes or trade secrets may be disclosed during inspection, ensure that records of what was disclosed and the basis for disclosure are kept. Section 12 criminalises unauthorised disclosure; secure written consent where third-party disclosure is necessary and rely on the statutory exceptions only when applicable (s 12).

Dealing with seized items

• Request receipts and prompt resolution: If documents or goods are seized under s 9(2), ensure a receipt is obtained and monitor the 30-day period for commencement of prosecution (s 9(3)). If no prosecution commences, demand immediate return. If a prosecution is commenced, preserve copies of seized materials where lawful to do so.

Legal and marketing controls

• Legal review of promotional materials: Have legal counsel approve marketing and labelling that uses the prescribed symbol to verify the substantive production criteria are met and the symbol is used in the prescribed form (s 4), noting the Act allows variation in size and colour but fixes the symbol’s form.

• Train staff on “sell” definition: Because “sell” is broadly defined (s 3) and includes supply of samples to induce purchase (s 3(i)) and supply under contracts for work and materials (s 3(c)), train commercial, sales and product development teams on risks associated with distributing samples, supplying under contract, or bartering while using the symbol.

Prosecution risk management

• Avoid knowledge exposure: The offence in s 6 requires proof of knowledge that the product is not substantially produced/prepared in Western Australia. Avoid internal communications that could be read as indicating knowledge of non-compliance. Ensure compliance processes and approval records are maintained to demonstrate absence of knowledge should enforcement arise.

• Consider insurance and indemnities: Where appropriate, consider insurance for regulatory risk and contract clauses that shift origin-claim liabilities to suppliers, with warranty and indemnity provisions calibrated to the compliance obligations under this Act.

Regulatory watch and updates

• Check for regulations and amendments: Monitor for any regulations made under s 14 and for further amendments (the compilation table indicates past amendments and a deleted s 13). Ensure policies and procedures are updated to reflect regulatory changes.

• Document consents for disclosure of trade secrets: If third parties require disclosure of processes, obtain written consent where possible to rely on s 12(a) as a defence against the secrecy offence.

Records retention policy

• Keep records for a sufficient period to respond to investigations or prosecutions, remembering seized items must be returned after thirty days if no prosecution starts (s 9(3)); however, internal copies may be critical for defence if prosecution is brought.

By combining careful factual documentation of where production and preparation occur, centralised approval for use of the symbol, staff training on the Act’s broad reach, robust records and responsive procedures for inspections and seizures, businesses can manage the practical risks the statute creates.
