Western Australian Aged Sailors, Soldiers and Airmen's Relief Fund Act 1932

The Act rests on a concise set of statutory concepts and relationships. The defined terms in s 2 identify the key actors and activity: the annual Poppy Day appeal, the League (The Returned and Services League of Australia WA Branch Incorporated), and the State secretary (the State secretary to the League). These definitions are operative across the Act’s provisions.

The Fund’s constitution and composition are central. Section 3 establishes the Fund and specifies initial steps: the League was to remit to the Trust all moneys held in the designated account on commencement (s 3(2A)). Section 3(2B) imposes a continuing obligation on each sub‑branch to remit one‑half of the net proceeds of the annual Poppy Day appeal to the State secretary annually, initially on commencement and on or before 1 December 1933, and thereafter each year; those moneys are to be paid by the State secretary to the Trust (s 3(2B)). Section 3(3) lists other permitted Fund sources, including moneys set aside by the League’s annual State Congress and donations or bequests.

The Trust is the Fund’s legal owner and administrator. It is a three‑member body corporate appointed by the Governor, with one member nominated by the League’s State Executive (s 4(1)-(3)). The Trust, by name, is a corporate entity with a common seal and perpetual succession (s 4(3)). The Trust’s core statutory functions are investment and application of the Fund’s moneys (s 5). The Act requires investment under the Trustees Act 1900 (s 5(1)), with an explicit accumulation period up to 1 December 1940; thereafter the Trust is instructed to apply moneys, subject to regulations, at its discretion for specified beneficiaries (s 5(2)-(3)).

Beneficiaries are defined by class and domicile. Section 5(2) directs application for the benefit of aged and/or invalid sailors, soldiers, airmen and nurses eligible for membership of the League, and of a person who immediately before the death of any such sailor, soldier, airman or nurse was that person’s spouse or de facto partner. Section 5(3) limits benefits to persons domiciled in Western Australia.

Fundraising exclusivity and enforcement are concentrated in s 8. The League alone is authorised to conduct the annual Poppy Day appeal in Western Australia (s 8(1)). Conduct must follow any regulations (s 8(2)). Breach of the exclusivity is made an offence with a prescribed monetary penalty (s 8(3)), and any moneys collected unlawfully are deemed held in trust for the League and recoverable by the League as a debt (s 8(4)).

Supporting mechanisms include a regulation making power conferred on the Governor to facilitate administration and the objects of the Act (s 7), and a temporary rule allowing the League to meet Trust administration expenses from its general fund pending accumulation (s 6). The compilation table and notes record amendments and legislative context, including the 1934, 1958, 1965, 2003, 2010 and 2011 modifications noted in the statute compilation.

These concepts give rise to discrete roles: paying agents (sub‑branches, donors), an administering corporate trustee (the Trust), an executive nominator (the League’s State Executive), an appointing executive (the Governor), and enforcement mechanisms (criminal penalty and civil recovery). The Act also prescribes eligibility and geographic limits on beneficiaries (s 5(2)-(3)).

The Act creates legal obligations and entitlements that affect a small set of identifiable groups and some broader indirect stakeholders.

Directly affected parties

• The League (The Returned and Services League of Australia WA Branch Incorporated): The League is the statutory beneficiary of the exclusive right to conduct the annual Poppy Day appeal in Western Australia (s 8(1)); it is the body that inaugurates and administers the Fund through the Trust (ss 3(1), 4(1)). The League’s State Executive also has the specific power to nominate one Trust member (s 4(2)). The League is permitted to defray Trust administration expenses from its general fund pending accumulation (s 6).

• Sub‑branches of the League: Each sub‑branch is subject to a statutory remittance obligation to the State secretary of one‑half of the net proceeds of the annual Poppy Day appeal, initially on commencement and by 1 December 1933 and in every subsequent year (s 3(2B)). That is an ongoing fiscal obligation.

• The State secretary to the League: The State secretary receives remitted funds from sub‑branches and must pay them to the Trust (s 3(2B)). The State secretary therefore has an administrative collection and transmission role.

• The Trust and its members: The Trust is vested with legal ownership and administration of the Fund (s 4(1)), is a body corporate (s 4(3)), and is responsible for investing and applying the Fund under the framework established in s 5. The Governor appoints its three members (s 4(2)).

Direct beneficiaries

• Aged and/or invalid sailors, soldiers, airmen and nurses eligible for League membership: The Trust may apply the Fund for their benefit, at its discretion and subject to regulations (s 5(2)).

• Spouses or de facto partners: A person who immediately before the death of an eligible sailor, soldier, airman or nurse was the spouse or de facto partner of that person may also be a recipient, subject to domicile in Western Australia (s 5(2)-(3)).

Persons deterred or constrained

• Any other body or person wishing to conduct a Poppy Day style appeal in Western Australia: The Act removes the ability to lawfully hold the annual Poppy Day appeal except by the League (s 8(1)). Unauthorised persons who conduct or assist in such an appeal commit an offence (s 8(3)) and are subject to civil recovery of moneys collected (s 8(4)).

Indirectly affected parties

• Donors and members of the public who give to the Poppy Day appeal: The statutory allocation of one‑half of net proceeds to the Fund changes how donations are distributed between sub‑branches and the Fund (s 3(2B), (3)(a)). Donors may therefore indirectly influence the Fund’s corpus through their contributions.

• Administrators in government: The Governor has appointment power (s 4(2)) and the executive has a role in regulation‑making (s 7), which may involve government resource allocation to regulatory oversight.

• Courts and enforcement agencies: The League has a statutory right to recover moneys collected unlawfully, giving courts jurisdiction to enforce the debt obligation (s 8(4)). Criminal enforcement for contravention of s 8(3) implicates prosecutorial agencies.

Geographic and membership constraints

• Residency/domicile limitation: Only persons domiciled in Western Australia are eligible to receive benefits (s 5(3)). That restricts the beneficiary pool to persons with that domicile.

• Eligibility tied to League membership: Beneficiaries must be eligible for membership of the League (s 5(2)). The Act relies on the League’s membership eligibility criteria as a limiting mechanism.

In summary, the Act channels fundraising proceeds from the League’s Poppy Day appeal into a Trust for a defined beneficiary class, binds sub‑branches to an annual remittance schedule, centralises administration in a small, Governor‑appointed Trust, and forbids third parties from running the named appeal. Who pays: sub‑branches and donors; who decides: Governor (appointments, regulations) and the Trust (investment and discretionary application), with a nominating role for the League’s State Executive; who benefits: a defined group of aged/invalid defence‑related personnel and immediate widow/partner, domiciled in Western Australia.

The Act creates specific duties and rights distributed among the League, its sub‑branches, the State secretary, the Trust, the Governor and members of the public.

Duties imposed by the Act

• Sub‑branch remittance duty: Each sub‑branch of the League must remit one‑half of the net proceeds of the annual Poppy Day appeal to the State secretary annually, initially on the commencement date and on or before 1 December 1933, and in every subsequent year. The State secretary is required to pay those moneys to the Trust (s 3(2B)). This is an ongoing statutory remittance obligation.

• State secretary transmission duty: The State secretary must receipt and pass on remitted funds to the Trust (s 3(2B)). That creates an administrative pipeline and a fiduciary transmission obligation.

• Trust investment and application duties: The Trust is required to invest the Fund’s moneys under the Trustees Act 1900 and to accumulate them with interest until 1 December 1940 (s 5(1)). Thereafter, subject to regulations, the Trust must apply moneys in its discretion for the benefit of specified classes (s 5(2)). The Trust therefore has a statutory duty to manage, invest and apply the Fund according to the Act and any applicable regulations (s 5).

• Regulation compliance duty: Persons conducting the annual Poppy Day appeal must do so in accordance with the regulations, where regulations exist (s 8(2)).

• Criminal prohibition and civil liability for unauthorised conduct: Any person who conducts or assists in conducting the annual Poppy Day appeal in contravention of s 8(1) commits an offence and faces the prescribed penalty (s 8(3)). Additionally, any money collected in contravention is treated as held in trust for the League and recoverable by the League as a debt (s 8(4)).

Rights created by the Act

• Exclusive conduct right for the League: The League alone is lawfully authorised to hold, manage and conduct the annual Poppy Day appeal in Western Australia (s 8(1)). That is a statutory monopoly over that particular appeal.

• Recovery right for the League: Where funds are collected unlawfully in contravention of s 8(1), the League has a statutory right to demand payment and to recover the moneys as a debt in any court of competent jurisdiction (s 8(4)).

• Appointment and nomination rights: The Governor has the appointment right for Trust members (s 4(2)); the League’s State Executive has an explicit nomination right for one Trust member (s 4(2)). The Trust, as a corporate body, has succession and sealing rights (s 4(3)).

• Beneficiary entitlement: Eligible aged/invalid sailors, soldiers, airmen and nurses and qualifying spouses or de facto partners domiciled in Western Australia have a statutory entitlement to be recipients of the Trust’s discretionary benefits (s 5(2)-(3)). The entitlement is not a fixed payment right but a class‑based claim that the Trust may satisfy in its discretion and subject to regulations.

Delegations and discretion

• Trust discretion over application: Section 5(2) explicitly vests the Trust with discretion to apply funds for the benefit of eligible classes, subject to regulations. The Trust thereby has a broad decision space on allocation and levels of assistance, constrained only by the Act and any regulations made under s 7.

• Governor regulation power: The Governor may make regulations necessary or convenient to administer the Act and facilitate its objects (s 7), creating a delegated lawmaking channel that may narrow or specify duties and rights in practice.

Practical duties not explicitly stated but implied by the Act

• Administrative duties associated with remittance and accounting: While not prescriptive about accounting standards, s 3(2A)-(2B) and s 3(3) imply recordkeeping and accounting duties for sub‑branches, the State secretary, the League and the Trust to identify net proceeds, remit shares, manage donations and apply funds.

• Obligation to act within investment law: The Trust’s investment duty is framed as being under and subject to the Trustees Act 1900 (s 5(1)), thereby importing any statutory constraints or duties on trustees under that legislation as applied at the time; the compilation notes indicate legislative changes to the Trustees Act over time.

Consequences for non‑performance

• Criminal sanction for unauthorised appeal conduct (s 8(3)): The statutory penalty is a monetary fine of $200.

• Civil liability for misappropriated proceeds (s 8(4)): Unauthorised collectors hold funds in trust for the League and owe a debt recoverable by the League.

In sum, the Act imposes clear remittance and transmission duties on sub‑branches and the State secretary, confers administrative and discretionary duties on a Governor‑appointed Trust, centralises fundraising rights in the League, and creates enforcement rights for the League against unauthorised collectors.

The Act provides both a criminal penalty for unauthorised conduct and a civil recovery mechanism for funds collected in contravention of the fundraising exclusivity. Enforcement arrangements are statutory in form rather than detailed procedural regimes.

Criminal enforcement: unauthorised conduct (s 8(3))

• Section 8(1) creates an exclusive statutory authority: from the commencement of s 8, only the League may hold, manage and conduct the annual Poppy Day appeal in Western Australia. Section 8(3) makes it an offence for any person who, in contravention of this section, conducts, attempts to conduct, permits or suffers to be conducted, aids in, abets, takes part in, or engages in the conduct of the annual Poppy Day appeal, whether with or without reward, to be guilty of an offence. The prescribed penalty for that offence is $200.

• The Act sets the penalty as a fixed monetary amount rather than a range or imprisonment. The Act does not create ancillary offences or a graduated penalty structure; the sole penalty specified is the $200 fine.

Civil enforcement: trust and debt recovery (s 8(4))

• Section 8(4) treats any moneys collected by a contravening Poppy Day appeal as held in trust for the League. The person in possession of such moneys is required, on demand, to pay them to the League. Until payment, the amount is a debt owing to the League and is recoverable by action in any court of competent jurisdiction.

• This provision effectively converts miscollected funds into an enforceable proprietary claim in favour of the League, and a personal debt claim against the collector. The Act does not prescribe a priority scheme among creditors, but the wording "held ... in trust" imposes a fiduciary quality that, in practice, will affect recovery and insolvency outcomes (the Act does not itself specify insolvency consequences).

Mechanisms and enforcement actors

• Criminal enforcement presupposes prosecutorial discretion and court availability. The Act provides the offence and penalty but does not identify the prosecuting agency or any administrative enforcement process; enforcement would proceed under the ordinary criminal justice processes of Western Australia.

• Civil recovery is vested in the League, which may commence proceedings in any court of competent jurisdiction to recover amounts due. The Act does not set temporal limits or specify procedural steps for demand or recovery.

Limitations and practical enforcement considerations in the text

• The Act does not provide an express administrative inspection or audit power over sub‑branches, the State secretary or the Trust. Enforcement therefore depends on detection by the League or by prosecuting authorities acting on complaint or tip‑off.

• The penalty amount is fixed in the statutory text ($200) and the compilation table notes a Decimal Currency Act entry in 1965; the Act as compiled retains the $200 figure. The Act does not provide for indexation or escalation of the monetary penalty.

• The Act gives the Governor a regulation power (s 7) and requires the appeal to be conducted in accordance with regulations (s 8(2)), so regulatory detail could enable more specific enforcement mechanisms if regulations have been made. The statutory text supplied does not include any regulations, so the enforcement contours depend on whether and how regulations exist.

• The Act creates a combination of criminal deterrence and civil restitution: a contravener faces a monetary fine and the obligation to surrender collected moneys to the League. The civil trust/debt route allows the League to recover proceeds independently of any criminal penalty.

In short, enforcement tools are a statutory fine for unauthorised participation in the Poppy Day appeal and a statutory trust/debt claim in favour of the League for any funds collected in breach. The act relies on ordinary criminal and civil processes for enforcement and anticipates that regulations may specify further administrative detail.

The Act contains internal references to other instruments and the compilation notes record subsequent legislative changes that affect statutory cross‑references. The interactions in the text are primarily through cross‑references to trustee law, regulatory powers, and the legislative history set out in the compilation table.

Trust law reference (s 5(1))

• Section 5(1) directs that moneys to the credit of the Fund "shall be invested by the Trust, under and subject to the Trustees Act 1900" and accumulate with interest until 1 December 1940. That language imports whatever investment powers, duties and constraints applied under the Trustees Act 1900 into the Trust’s investment function. The compilation notes indicate that the Trustees Act 1900 was subsequently repealed by the Trustees Act 1962 (note 2), which is part of the compilation table material provided with the Act. Thus the Trust’s investment duties were originally to be exercised under the Trustees Act 1900; after repeal and through statutory succession, any operative trustee‑law duties would be determined by later trustee legislation and judicially developed trustee principles, as informed by the compilation note.

Regulation‑making and administrative law (s 7)

• Section 7 confers a regulation‑making power on the Governor to make regulations necessary or convenient for administration of the Act and to facilitate its objects. Where regulations exist they will form delegated legislation that operationalises administrative detail, including potentially defining how the Poppy Day appeal must be run (s 8(2)), specifying recordkeeping or remittance procedures, or setting other compliance mechanisms. The Act’s enforcement and operation would therefore interact with the delegated legislation regime, but no specific regulations are included in the supplied text.

Criminal and civil procedure interaction (s 8)

• The offence in s 8(3) will engage the ordinary criminal procedure code for charge, prosecution, sentencing and fine collection. The civil recovery remedy in s 8(4) interacts with ordinary civil procedure and remedies; it expressly allows the League to recover moneys in any court of competent jurisdiction. The Act does not prescribe a special tribunal or procedure for recovery.

Compilation table references and temporal interaction

• The compilation table records amendment statutes (1934, 1958, 1965, 2003, 2010, 2011) and commencement dates. These indicate that the Act’s text has been updated across time, including a 1958 amendment that changed the name to include "airmen" (see s 3(2C) and note), a 2003 amendment in the Acts Amendment (Equality of Status) Act, and formatting and minor amendment Acts in 2010 and 2011. The compilation notes therefore signal that the Act’s present wording reflects those amendments. Any interpretation of the Act in practice must therefore assume those amendments are in effect; the compilation table is the supplied record of that temporal interaction.

Currency and penalties (compilation note re Decimal Currency Act 1965)

• The Decimal Currency Act 1965 appears in the compilation table. That Act affected many penalties and monetary figures at the time of decimalisation; the compiled Act shows a retained $200 penalty figure in s 8(3). If precision is required about the penalty’s real‑world value or conversion history, that would rely on the Decimal Currency Act and subsequent statutory practice, but the supplied compilation keeps the $200 figure.

Interplay with League governance and membership rules

• The Act ties beneficiary eligibility to persons eligible for League membership (s 5(2)). The Act itself does not define League membership rules; therefore the Act operates in concert with the League’s own membership criteria, which determine the pool of eligible beneficiaries. That creates an interaction between the statutory grant and private association rules: the Trust’s discretion to grant benefits is limited to persons who meet the League’s membership eligibility.

Geographic law interaction

• The domicile requirement in s 5(3) constrains benefits to persons domiciled in Western Australia, which will interact with general private international and inter‑State domicile principles in wider law when determining eligibility. The Act does not define "domiciled" so ordinary legal doctrines will supply that meaning.

In sum, the Act interacts with trustee legislation and general civil and criminal procedure, delegates detail to regulations under the Governor’s power, depends on League membership criteria to define beneficiary classes, and its monetary provisions sit within the currency and penalty regimes addressed in the compilation history. The supplied text does not include regulations or detailed cross‑refs beyond those noted, so operational interaction will depend on those external instruments and bodies.

The Act’s compilation table and notes provided in the supplied text record a sequence of amendments and reprints that have modified language, scope and references since enactment. The compilation particulars are part of the Act’s official record in the supplied material.

Key legislative milestones recorded in the compilation table

• Enactment and commencement: The original statute, titled the Western Australian Aged Sailors and Soldiers’ Relief Fund Act 1932, received assent on 30 December 1932 and commenced 1 January 1933 (see s 1 and the compilation table entry for 1932).

• 1934 Amendment: The Western Australian Aged Sailors and Soldiers’ Relief Fund Amendment Act 1934 (No. 10 of 1934) is noted in the Act’s compilation as an early amendment. Section 2 of that Act appears to have inserted s 8 (as the text shows s 8 was inserted in 1934), introducing the exclusive authority for the League to conduct the Poppy Day appeal and associated enforcement mechanisms (s 8 and the insertion note).

• 1958 Amendment: The Western Australian Aged Sailors and Soldiers’ Relief Fund Act Amendment Act 1958 (No. 24 of 1958) made changes to language and to the name of the account and Fund to include "airmen" (see s 3(2C) and note 3). The compilation notes describe specific textual substitutions made by s 6 of that amending Act, including substitution of the passage to include "airmen" (note 3 references inconsistency resolved in compilation).

• 1965 Decimal Currency adjustments: The Decimal Currency Act 1965 (No. 113 of 1965) is recorded in the compilation table and affects commencement timing of s 4-9 to 14 February 1966. The compilation table entry for 1965 indicates that the Act has been adapted to decimal currency contexts. The text itself retains the $200 penalty figure in s 8(3).

• Reprints: The compilation records reprints of the Act as at 7 February 1989 and as at 1 June 2007, incorporating the amendments up to those dates. These reprints are administrative consolidations of the statute as amended.

• 2003 Amendment: The Acts Amendment (Equality of Status) Act 2003 (No. 28 of 2003), Part 60, is recorded with assent 22 May 2003 and commencement 1 July 2003. The compilation records that this amending Act made changes to Part 60 of that Act affecting this statute (the precise textual change is incorporated in the reprint).

• 2010 Standardisation of Formatting Act: Section 51 of the Standardisation of Formatting Act 2010 (No. 19 of 2010) is recorded as an amending provision with commencement 11 September 2010; this is a formatting and standardisation amendment.

• 2011 Statutes (Repeals and Minor Amendments) Act: Section 17 of the Statutes (Repeals and Minor Amendments) Act 2011 (No. 47 of 2011) is included in the compilation table with commencement 26 October 2011. This likely reflects minor textual adjustments in the reprint process.

Specific textual amendment notes included in the supplied material

• Note 3 explains that the 1958 amendment substituted the passage to include "sailors, soldiers and airmen" and that one of the 1958 amending provisions was inconsistent with another; the compilation incorporated the latter. The Act’s current text thus reflects the inclusion of "airmen" in the Fund’s name and beneficiary description.

• Note 2 records that the Trustees Act 1900 (the statutory reference used in s 5(1)) was repealed by the Trustees Act 1962. That indicates the Act’s trustee reference is historic and that later trustee statutes would now govern trustee investment duties.

What the amendment history shows in practice

• The Act has been amended for nomenclature changes to reflect the inclusion of airmen, adjusted for currency changes at decimalisation, subjected to equality‑of‑status language modernisation in 2003, and updated in formatting and minor amendment rounds in 2010 and 2011. These amendments are recorded in the compilation table and notes and are the statutory record of how the Act evolved.

• The 1934 insertion of s 8 materially altered the Act by granting the League exclusive authority to run the Poppy Day appeal and by imposing sanctions for unauthorised conduct. That remains a key structural element in the Act.

• References to external legislation (Trustees Act 1900) are noted as historically accurate but revised by later trustee statutes; the compilation notes confirm the repeal of the 1900 Act.

Limitations of the supplied amendment record

• The compilation table summarises the amending Acts and reprints but does not reproduce the full text of those amending Acts or any regulations made under s 7. Operational reality will depend on the content of any regulations and any unlisted subordinate instruments. The supplied material reflects the consolidated legislative text as at the latest reprint and the listed amendments.

In short, the Act shows a modest amendment chronology: initial enactment (1932), early insertion of enforcement provisions (1934), name and beneficiary updates (1958), currency and procedural updates (1965), equality and formatting amendments (2003, 2010) and a minor amendments clean‑up (2011). The compilation table in the supplied text is the authoritative record of those changes included in the current reprint.

The supplied Act text and compilation notes do not record any judicial decisions, appeals or case law arising under the statute. There are no cases named in the Act or in its compilation notes. Consequently, the primary source supplied does not include recorded litigation, judicial interpretation or precedent applying the Act’s provisions.

What the Act does provide that could generate litigation

• Civil recovery actions: Section 8(4) gives the League an express statutory right to recover moneys collected in contravention of s 8(1) "in any court of competent jurisdiction." That provision contemplates litigation by the League against persons alleged to have collected funds unlawfully. The Act does not itself list cases, but the statutory remedy is litigation‑capable.

• Criminal prosecutions: Section 8(3) establishes an offence for unauthorised conduct with a specified penalty. Prosecutions under that provision would be processed in criminal courts; again, the supplied text does not include any prosecutions or judicial outcomes.

• Trust administration disputes: The Trust’s discretionary application of funds (s 5(2)), investment duties under trustee law (s 5(1)) and the appointment function of the Governor (s 4(2)) create fault lines that could lead to disputes about fiduciary duties, proper exercise of discretion, or appointment validity. The Act permits, in theory, judicial review or civil proceedings in cases of alleged maladministration, but the supplied material does not record any such proceedings.

• Interpretation questions: Several textual features could give rise to interpretative litigation in practice, such as the meaning of "net proceeds" in s 3(2B), the meaning of "eligible for membership of the League" in s 5(2), the qualification "domiciled in the State of Western Australia" in s 5(3), and whether the Trust’s investment obligations are governed by the repealed Trustees Act 1900 or successor legislation. The supplied Act text does not contain judicial gloss on these points.

Absence of recorded litigation in the supplied material

• The compilation notes and reprints summarise amendments and structural changes but do not include records of litigation. Without external case law or reports appended to the supplied text, one cannot identify judicial interpretations, enforcement trends, or litigation outcomes from the statute alone.

What a researcher should do next (procedural note, not an invocation of external authority)

• To identify litigation history one would need to search court databases, law reports and consolidated statutory annotations beyond the supplied text. The compiled Act itself provides the legal foundation and remedies that could generate litigation, but the supplied material contains no litigation narrative.

In summary, the statute contains mechanisms that permit both civil and criminal enforcement and therefore could be the subject of litigation, but the supplied text contains no recorded litigation history or named judicial decisions.

The Act is short and specific, but several features can create practical traps or operational surprises for those implementing or affected by it. The following are concrete points to watch, as evident from the statute text.

Statutory remittance timing and obligation

• Sub‑branches must remit one‑half of net proceeds "on the commencement of this Act, and on or before 1 December 1933, and in every subsequent year" (s 3(2B)). The clause ties to a historic commencement date, but its structure establishes an annual remittance obligation. Misunderstanding the remittance timing or the definition of "net proceeds" could create compliance gaps; the Act does not define "net proceeds", so disputes could arise about deductions and accounting before the one‑half calculation.

Exclusive right to conduct the annual Poppy Day appeal

• Section 8(1) gives sole authority to the League to conduct the appeal "but for no other body or person." That language is absolute. Any third party running a Poppy Day style appeal risks criminal liability (s 8(3)) and civil recovery obligations (s 8(4)). Organisers and fundraisers must be careful not to use the same form of appeal, name or local practice that might fall within the statutory description of the "annual Poppy Day appeal", particularly because the Act ties the appeal to a historical practice ("similar to the appeal heretofore known as 'the Poppy Day appeal'... on Armistice Day") in s 2. The Act does not provide a statutory test for distinguishing permissible forms of fundraising.

Broad description of prohibited conduct

• Section 8(3) criminalises a wide range of conduct: conducting, attempting to conduct, permitting, suffering, aiding, abetting, taking part in, or otherwise engaging in the conduct of the annual Poppy Day appeal. Even ancillary participation with or without remuneration is captured. Volunteers, agents, or contractors asked to assist in a Poppy Day style fundraising could inadvertently commit an offence if the activity is not lawfully authorised.

Fixed monetary penalty; no indexation

• The penalty is fixed at $200 in s 8(3). The Act does not provide for indexation. The real‑world deterrent effect and proportionality will depend on currency value and any later statutory amendments not supplied here. The compilation table references decimalisation but does not indicate indexing. Practitioners should not assume the penalty has been modernised unless confirmed in current legislative consolidation.

Funds collected unlawfully treated as trust property

• Section 8(4) deems unlawfully collected moneys to be held in trust for the League and recoverable as a debt. That creates immediate fiduciary obligations on collectors. An organiser who is unaware of the statutory exclusivity may find all collected sums held on trust and personally liable to repay them, even if the organiser believed proceeds were lawfully obtained.

Narrow beneficiary eligibility and domicile requirement

• The Trust may apply funds only for persons "eligible for membership of the League" and domiciled in Western Australia (s 5(2)-(3)). The Act therefore excludes aged or invalid defence personnel who are not eligible for League membership, or who are not domiciled in Western Australia. This can surprise applicants and administrators if national or interstate mobility is not considered. The Act does not define "eligible for membership", leaving determination to League rules and potential contestation.

Trust investment reference to repealed statute

• Section 5(1) requires investment "under and subject to the Trustees Act 1900". The compilation notes state that the Trustees Act 1900 was repealed by the Trustees Act 1962 (note 2). That historical cross‑reference may create uncertainty about which statutory trustee regime applies contemporaneously to investment duties; administrators should confirm the current trustee statutes that govern investment powers rather than assume the 1900 Act still applies.

Governor appointments and League nomination

• The Governor appoints Trust members, but one member must be nominated by the State Executive of the League (s 4(2)). This creates a mixed appointment dynamic where the League has a formal influence over composition. Stakeholders should note that appointments are formalised by the Governor and the Trust is constituted as a corporate body (s 4(3)), with associated legal status and obligations.

Regulatory blank‑space risk

• Section 7 provides a regulation‑making head of power and s 8(2) requires the appeal to be "conducted in accordance with the regulations." The Act as supplied contains no regulations. Where regulations are absent or vague, there is execution risk: unclear operational rules for the appeal, remittance procedures and enforcement mechanisms. Practitioners should not assume the existence of regulations without checking the current statutory instruments.

Potential tension between charitable purpose and League control

• The Fund is designed to benefit a defined class, but the League controls nomination and initial remittance structures. Beneficiaries must be eligible for League membership. This creates a structural dependency on the League’s membership rules to define eligibility; that can cause exclusionary effects absent statutory safeguards.

No express auditing or oversight provisions

• The Act does not set out auditing, reporting, or ministerial oversight requirements for the Trust or the State secretary’s handling of remittances. That absence means procedural and transparency obligations may depend on regulation or ordinary corporate and trustee law rather than statutory prescription.

In practice, the "gotchas" are concrete: remittance accounting, exclusive conduct prohibition, broad criminalisation of assisting or taking part in an appeal, trust treatment of unlawfully raised funds, domicile and membership limits for beneficiaries, reliance on external trustee law, and potential regulatory gaps. Each of these arises from explicit statutory language in ss 2-8 and the compilation notes.

Compliance obligations fall primarily on League sub‑branches, the State secretary, the Trust, anyone proposing to run a Poppy Day style appeal, and the League itself. The Act’s text specifies duties and pathways; the following is a practical, source‑grounded checklist based on the statutory provisions.

For sub‑branches of the League

• Calculate "net proceeds" accurately: Section 3(2B) requires each sub‑branch to remit one‑half of the net proceeds of the annual Poppy Day appeal. The Act does not define "net proceeds," so sub‑branches should keep clear accounts of gross collections, authorised deductions (costs of collection, fees, etc.), and the resulting net figure. Maintain contemporaneous records to substantiate the remitted amount in case of dispute.

• Observe remittance timing: The statutory schedule requires remittance "on the commencement of this Act, and on or before 1 December 1933, and in every subsequent year" (s 3(2B)). That establishes an annual remittance obligation; ensure a reliable internal timeline that aligns with any current administrative practice or regulations that set precise dates.

• Remit to the State secretary: Section 3(2B) directs that sub‑branches pay the one‑half share to the State secretary. Obtain and retain receipts or written acknowledgements from the State secretary to evidence compliance.

For the State secretary

• Receive and forward funds to the Trust: The State secretary must pay the moneys received from sub‑branches to the Trust (s 3(2B)). Establish an administrative process for receiving remittances, recording amounts, issuing receipts, and transferring funds promptly to the Trust’s account, together with supporting documentation.

For the Trust

• Organise investment and accumulation per s 5(1): The Trust must invest moneys "under and subject to the Trustees Act 1900" and accumulate with interest until 1 December 1940. Given the Trustees Act 1900 has been repealed (compilation note), confirm the current trustee statutory framework that governs investment powers and duties and comply with its requirements when investing Fund moneys.

• Apply funds in accordance with s 5(2)-(3): After the accumulation period specified in s 5(1) (historical), the Trust applies moneys, subject to regulations and at its discretion, for the benefit of eligible beneficiaries. The Trust should create and document internal policies consistent with the Act and any regulations to govern eligibility assessment, application processing, and recordkeeping, ensuring recipients meet the domicile requirement (s 5(3)) and are eligible for League membership (s 5(2)).

• Corporate governance and appointments: The Trust is a corporate body; ensure proper use of the common seal and minute and record appointments made by the Governor (s 4(2)-(3)). Keep clear records of Governor appointments and the League State Executive nomination.

For the League generally

• Only the League may conduct the annual Poppy Day appeal: Do not permit other bodies or persons to run an appeal "similar to the appeal heretofore known as 'the Poppy Day appeal'" in Western Australia; s 8(1) grants exclusivity. Ensure contracted partners, volunteers and fundraisers are authorised and instructed about the statutory limitation.

• Use the League’s general fund provision appropriately: Section 6 allows the League to defray Trust administration expenses from its general fund pending accumulation. That should be recorded as an internal allocation and documented in minutes and accounts.

For third parties and other charities

• Do not conduct Poppy Day style appeals without express authority: Section 8(1) makes it unlawful for other bodies or persons to conduct the annual Poppy Day appeal in Western Australia. If in doubt, seek clarification from the League and review any regulations. Unauthorised conduct risks criminal penalty (s 8(3)) and civil recovery (s 8(4)).

Records and transparency

• Maintain robust financial records: The statutory remittance and trust obligations create an evidentiary trail requirement. Sub‑branches, the State secretary and the Trust should keep ledgers, bank records, receipts and minutes that demonstrate compliance with remittance and trust obligations.

• Check for applicable regulations: Section 7 empowers the Governor to make regulations and s 8(2) requires that the annual Poppy Day appeal be conducted in accordance with the regulations. Practically, confirm whether regulations have been made under s 7 and, if so, comply with their procedural and reporting requirements.

Risk management and legal advice

• Seek legal clarification on ambiguous terms: Terms such as "net proceeds," "eligible for membership," and "domiciled in the State of Western Australia" may be subject to interpretation. Where exposure to enforcement or beneficiary denial exists, obtain legal advice or the League’s policy guidance that operationalises those terms.

• Ensure authorised participants are properly documented: Because s 8(3) criminalises a wide net of participation, ensure volunteers, agents and contractors are formally engaged under League authority and that their roles are documented. Avoid informal arrangements that could be construed as unauthorised participation.

• Prepare for enforcement actions: The League has remedies to recover unlawfully collected funds (s 8(4)), and criminal sanctions apply (s 8(3)). Maintain audit trails to defend against or support enforcement actions.

Administrative checklist summary

• Sub‑branches: calculate net proceeds; remit one‑half to State secretary annually; retain receipts.

• State secretary: receive remittances; transfer to Trust; keep records.

• Trust: confirm governing trustee legislation for investment; invest and apply funds per Act and any regulations; document decisions and eligibility assessments.

• League: maintain exclusive control over the appeal; document authorisations; manage temporary defrayment from general fund if needed (s 6).

• Third parties: do not conduct Poppy Day appeals without League authority; if engaged to assist, confirm in writing the League’s authorisation.

Following the statute’s explicit provisions (ss 2-8), checking for any regulations under s 7, and ensuring transparent recordkeeping and formal authorisations are the central compliance steps derived from the Act’s text.
