Western Australian Aged Sailors and Soldiers' Relief Fund Act 1932

This Act establishes and governs a statutory trust, the Western Australian Aged Sailors, Soldiers and Airmen’s Relief Fund (the Fund), to receive, invest and apply part of the proceeds of the annual Poppy Day appeal and other moneys for the benefit of certain ex‑servicemen and related persons. The Fund is vested in a corporate Trust of three members appointed by the Governor, one member to be nominated by the State Executive of The Returned and Services League of Australia WA Branch Incorporated (the League) (s 3(1); s 4(1)-(3)). On commencement the League was required to remit existing Fund moneys to the Trust (s 3(2A)), and each sub‑branch of the League must remit annually one half of the net proceeds of the annual Poppy Day appeal to the State secretary for payment to the Trust (s 3(2B); s 3(3)(a)).

The Trust is directed to invest Fund moneys under and subject to the Trustees Act 1900 and to accumulate them with interest until 1 December 1940 (s 5(1)). After that date the Act authorises the Trust, subject to regulations, to apply the moneys in its discretion for the benefit of aged and/or invalid sailors, soldiers, airmen and nurses who are eligible for membership of the League, and for persons who immediately before the death of any such person were the spouse or de facto partner, provided the beneficiary is domiciled in Western Australia (s 5(2)-(3)). The League may meet Trust administration expenses from its general fund while the Fund accumulates (s 6).

The Act also grants exclusive statutory authority to the League to hold, manage and conduct the annual Poppy Day appeal in Western Australia and creates an offence for unauthorised persons who conduct or participate in such an appeal (s 8(1)-(3)). Where an unlawful appeal is conducted, amounts collected are held in trust for the League and are recoverable as a debt (s 8(4)). The Governor may make regulations for administration and the conduct of the appeal (s 7; s 8(2)). The statute has been amended at several points since 1932; the compilation table records those amendments and reprints.

The Act’s architecture rests on several discrete legal concepts: a statutory Fund; a corporate Trust to hold and administer the Fund; mandated remittances from League sub‑branches; investment and accumulation rules; discrete eligibility criteria for beneficiaries; an exclusive statutory privilege to conduct an annual public fundraising appeal; and a small criminal sanction plus civil recovery rights for unauthorised fundraising.

Statutory Fund and sources: the Fund is created in statutory form and comprises one half of the net proceeds of the annual Poppy Day appeal remitted by League sub‑branches (s 3(2B); s 3(3)(a)), moneys set aside by the annual State Congress of the League (s 3(3)(b)), and donations or bequests (s 3(3)(c)). The term “annual Poppy Day appeal” is defined by reference to the historic appeal previously conducted by or under the authority of the League on Armistice Day (s 2).

Trust structure and corporateness: the Fund is vested in a three‑member Trust that is a body corporate with a common seal and perpetual succession (s 4(1), (3)). Members are appointed by the Governor, with one member to be nominated by the State Executive of the League (s 4(2)). The appointment mechanism gives the executive government the formal selection power for the trust, subject to the single nomination right for the League.

Investment and discretion: the Trust must invest moneys “under and subject to the Trustees Act 1900” and, as originally drafted, accumulate with interest until 1 December 1940 (s 5(1)). After that date, subject to regulations, the Trust may apply funds “in its discretion” for specified classes of beneficiaries (s 5(2)). The statutory discretion is therefore bounded by the category of eligible recipients, domicile requirement (s 5(3)), and any regulations made under s 7.

Exclusive fundraising authority and enforcement: the League alone is empowered to hold the annual Poppy Day appeal in Western Australia (s 8(1)). Conducting or participating in an unauthorised Poppy Day appeal is an offence carrying a specified monetary penalty (s 8(3)), and any monies raised in breach are held in trust for the League and recoverable as a debt (s 8(4)). The Governor may make regulations regarding the appeal (s 8(2)).

Regulations and ancillary provisions: the Governor may make regulations necessary for administration or to facilitate the objects of the Act (s 7). The Act provides a transitional expense rule allowing the League to defray Trust administration costs from its general fund pending accumulation of the Fund (s 6).

The Act creates legal duties and entitlements that directly affect a limited set of actors, and indirectly affect members of the public who donate or participate in Poppy Day activities.

The League and its sub‑branches: The Returned and Services League of Australia WA Branch Incorporated is central. The League must transfer to the Trust the Fund account balance on commencement (s 3(2A)). Each sub‑branch is required to remit annually one half of the net proceeds of the annual Poppy Day appeal to the State secretary on or before 1 December each year (s 3(2B)). The State secretary (a defined term at s 2) receives those remittances and must pay them to the Trust (s 3(2B)). The League retains an operational role, including being the only body lawfully permitted to conduct the Poppy Day appeal (s 8(1)) and being able to defray administration costs pending accumulation (s 6).

The Trust and its members: The Trust (named Western Australian Aged Sailors, Soldiers and Airmen’s Relief Fund Trust) holds, invests and applies the Fund (s 4(1); s 5(1)-(2)). Governance is defined: three members appointed by the Governor, one nominated by the State Executive of the League (s 4(2)). As a corporate body with a common seal, the Trust will be the legal owner of the Fund moneys (s 4(3)) and exercise investment and distribution powers, but always subject to the Act and any regulations (s 5(2); s 7).

Beneficiaries: Beneficiary classes are specified narrowly. After the accumulation period the Trust may apply funds for aged and/or invalid sailors, soldiers, airmen and nurses eligible for membership of the League, and for persons who immediately before the death of such persons were the spouse or de facto partner (s 5(2)). Eligibility requires domicile in Western Australia (s 5(3)). The Act therefore limits eligibility to persons with a specified connection to the League and to WA domicile.

The Governor and executive government: The Governor appoints the Trust’s members (s 4(2)) and has regulation‑making power under s 7. Those powers shape who decides key aspects of administration and the form the Poppy Day appeal must take.

Members of the public and unauthorised organisers: Persons or organisations other than the League who attempt to conduct, organise, or otherwise participate in an annual Poppy Day appeal are directly affected. An unauthorised person who conducts or participates in such an appeal commits an offence (s 8(3)), faces a fixed penalty ($200 as stated), and any moneys collected are held in trust for the League and are recoverable by the League (s 8(4)). Donors are affected because statutory rules allocate one half of net proceeds to the Fund and because an unauthorised appeal could result in funds being redirected to the League (s 3(3)(a); s 8(4)).

The Act spells out a small set of positive duties, permissive powers and rights, and some procedural obligations.

Duties to remit and pay: Each sub‑branch of the League must remit to the State secretary one half of the net proceeds of the annual Poppy Day appeal on or before 1 December each year, and the State secretary must pay those moneys to the Trust (s 3(2B)). The initial transfer of the pre‑existing Fund balance was mandated on commencement from the League to the Trust (s 3(2A)). These provisions create clear, recurring financial flows into the Fund.

Trust investment and application obligations: The Trust is required to invest all moneys to the credit of the Fund “under and subject to the Trustees Act 1900” and to accumulate them with interest until 1 December 1940 (s 5(1)). After that date the Trust is empowered, but not compelled, to apply funds for eligible beneficiaries “in its discretion” and subject to the regulations (s 5(2)). The Act therefore creates both an investment duty and a discretionary distribution power bounded by specified beneficiary categories and domicile (s 5(2)-(3)).

Governance and appointment: The Governor must appoint the three Trust members, and the League’s State Executive is explicitly entitled to nominate one member (s 4(2)). The Trust is a body corporate with perpetual succession and a common seal (s 4(3)), which confers legal personality to hold property and sue/ be sued in the Trust’s name.

Regulation‑making authority: The Governor may make regulations necessary or convenient for effective administration and to facilitate the Act’s objects (s 7). The annual Poppy Day appeal must be conducted in accordance with those regulations (s 8(2)). That gives the executive the ability to shape procedural and operational requirements governing how the Trust applies funds and how fundraising is conducted.

Exclusive conduct right and enforcement: The League alone has the right to hold the annual Poppy Day appeal in Western Australia (s 8(1)). Persons who contravene s 8(1) by conducting, attempting to conduct or participating in the appeal are guilty of an offence and face a penalty of $200 (s 8(3)). Further, where unlawful fundraising occurs, the moneys collected are to be held in trust for the League and, on demand, must be paid to the League; until so paid the amount is a debt owing to the League and is recoverable in court (s 8(4)). That creates both criminal and civil enforcement routes centred on the League’s remedial rights.

Permissive expense provision: The League may defray Trust administrative expenses from its general fund while the Fund accumulates under the accumulation rule (s 6). That grants the League a permissive cost‑bearing right but does not compel such payment.

The Act contains a concise enforcement regime focused on protecting the League’s exclusive statutory right to conduct the annual Poppy Day appeal and on enabling recovery of improperly raised funds. Enforcement options are both criminal and civil.

Criminal offence and fixed penalty: Section 8(3) creates an offence for any person who, contrary to s 8(1), conducts, attempts to conduct, permits, suffers, aids, abets, takes part in, or otherwise engages in the conduct of the annual Poppy Day appeal. The statutory penalty for that offence is $200, as stated in s 8(3). The Act does not specify who prosecutes the offence; the text simply creates the offence and penalty. The Act also does not specify maximum penalties or imprisonment, nor does it contain procedural detail such as enforcement agency or time limits for prosecution.

Civil recovery and constructive trust: Section 8(4) provides a civil remedy where an unauthorised appeal is conducted. Any moneys collected by such an appeal are declared to be held by the collector in trust for the League. On demand, the collector must pay the moneys to the League; until payment, the amount is a debt owing to the League and recoverable by the League in any court of competent jurisdiction (s 8(4)). This clause supplies the League with a proprietary claim (constructive trust) and an ordinary contractual/debt claim if payment is withheld. The Act does not prescribe limitations periods or evidentiary rules; recourse would be under normal court processes.

Regulatory oversight: The Governor may make regulations for the effective administration of the Act and for the conduct of the Poppy Day appeal (s 7; s 8(2)). Regulations can potentially stipulate procedural requirements, authorisations, approvals or other administrative controls for the appeal that would affect enforcement in practice. The Act itself does not enumerate regulatory contents; it leaves that to subordinate instrument.

Trust discretion and legal obligations: The Trust’s duty to invest under and subject to the Trustees Act 1900 (s 5(1)) implies legal standards for investment and fiduciary conduct, though the referenced statute is noted in the compilation as repealed (see compilation note 2). Practitioners must therefore identify the contemporary statutory framework governing trustees to determine applicable standards. The Trust’s power to apply funds “in its discretion” (s 5(2)) is bounded by the Act and regulations; misuse of that discretion could, in principle, be subject to judicial review or equitable challenge, although the Act does not set out enforcement mechanisms for misapplication of trust funds.

The Act contains several explicit and implicit points of interaction with other statutory instruments and legal regimes. The text itself cross‑refers, and the compilation notes record later legislative amendments.

Reference to trustees law: Section 5(1) requires the Trust to invest “under and subject to the Trustees Act 1900”. The compilation notes state that the Trustees Act 1900 was repealed by the Trustees Act 1962 (note 2). The Act as printed therefore refers to antecedent trustees legislation; practitioners must determine which modern trustees/statutory trust provisions apply by reference to the current statutory landscape beyond this compilation. The Act does not itself update or restate the applicable trustees statute.

Regulation‑making and subordinate instruments: The Governor’s regulation‑making powers under s 7 and the requirement that the Poppy Day appeal be conducted in accordance with regulations (s 8(2)) create a subordinate legislative layer that will interact with the Act’s application. Any regulations made under s 7 may impose procedural, accounting and governance requirements that interact with other regulatory regimes, for example state fundraising or incorporated association rules, though those are not mentioned in the Act.

Amendment and equality of status: The compilation table records the Acts that have amended this statute. Of particular note is the Acts Amendment (Equality of Status) Act 2003 Pt. 60 (28 of 2003), which is shown in the table as amending s 5 (see s 5 amended: No. 28 of 2003 s. 206). The reprint and notes also indicate that amendments in 1958 altered the Act’s long title and the words describing beneficiaries (insertion of “airmen”, and later incorporation of changes). These amendments show direct interactions between this Act and subsequent statutory changes addressing terminology and beneficiary scope.

Decimal currency and reprints: The Decimal Currency Act 1965 is recorded in the compilation table and notes specific commencement timings for parts of this Act (s 4-9 commenced on 14 February 1966). Reprint instruments (1989, 2007) and the Standardisation of Formatting Act 2010 (s 51) have adjusted textual presentation and possibly section numbering. Those archival and formatting interactions affect interpretation only insofar as they change the printed text and references.

Intersections with property, charity and fundraising law: The Act creates a statutory trust and confers proprietary interests in moneys raised. Although the Act does not mention charities law, incorporated associations law, income tax or fundraising licensing regimes, practitioners should note that the Trust’s operations and the League’s fundraising activities may intersect with those external legal regimes in practice. The Act does not itself displace or modify application of other state or federal laws affecting property, tax, charity registration, or criminal law; it operates alongside them.

The compilation table and section notes in the source provide a concise chronicle of legislative changes, reprints and related instruments affecting the Act. The following summarises the recorded amendments and reprints as set out in the source.

Original enactment and commencement: The Western Australian Aged Sailors and Soldiers’ Relief Fund Act 1932 (No. 39 of 1932) received assent 30 December 1932 and commenced 1 January 1933 (s 1) (compilation table).

1934 amendment: The Western Australian Aged Sailors and Soldiers’ Relief Fund Amendment Act 1934 (No. 10 of 1934) is recorded as an amendment; s 2 was amended by this Act (see s 2 amended: No. 10 of 1934 s. 2) and s 8 was inserted by No. 10 of 1934 s. 3 (section note). The 1934 amendment therefore added the exclusive Poppy Day appeal provisions and offence provisions in s 8.

1958 amendment: The Western Australian Aged Sailors and Soldiers’ Relief Fund Act Amendment Act 1958 (No. 24 of 1958) effected multiple changes. The long title was amended (note at head), s 1 amended (short title/commencement, No. 24 of 1958 s. 1), s 2 amended (definitions, No. 24 of 1958 s. 3), s 3 amended (s 3(2C) renaming the account as “Western Australian Aged Sailors, Soldiers and Airmen’s Relief Fund”, No. 24 of 1958 s. 4), and s 4 amended (No. 24 of 1958 s. 5). Section 5 was also amended by the 1958 Act (s 5 amended: No. 24 of 1958 s. 6), and the notes record that an amendment substituted a passage inserting “airmen” into beneficiary descriptions; note 3 records an inconsistency between different parts of the 1958 amendment and states that the latter inconsistent part has been incorporated in the reprint.

1965/decimal currency reprint: The Decimal Currency Act 1965 (No. 113 of 1965) is recorded in the compilation table, with commencement timing noting that sections 4-9 of the Decimal Currency Act commenced on 14 February 1966. A reprint of the Act as at 7 February 1989 is listed.

2003 amendment on equality of status: The Acts Amendment (Equality of Status) Act 2003 Pt. 60 (28 of 2003) amended s 5 (see s 5 amended: No. 28 of 2003 s. 206) and the compilation table records commencement 1 July 2003. The 2003 amendment is reflected in the current text by the inclusion of “nurses” and references to de facto partners and the requirement of domicile, which align with equality‑oriented changes to beneficiary language.

2010 formatting reprint: The Standardisation of Formatting Act 2010 s. 51 (19 of 2010) is recorded in the compilation table (reprint 2 as at 1 Jun 2007, and formatting changes effective 11 Sep 2010). Section 2 was amended by the 2010 Act (see s 2 amended: No. 19 of 2010 s. 51).

The source text and compilation notes do not list any case law, judicial decisions, or litigation history. No cases are named in the statute or the compilation notes supplied. The Act itself provides mechanisms (a criminal offence under s 8(3) and a civil recovery right under s 8(4)) that could give rise to litigation, but the text does not record any instances.

Consequences of absence of litigation in the source: Because the statute does not include reported judicial interpretation, practitioners must rely on the Act’s text, any regulations made under s 7, and the general law to resolve ambiguities. For example, issues likely to arise in practice and that would be decided by courts (but are not addressed in the text) include: the proper legal test for “net proceeds” in s 3(2B); the scope of “the annual Poppy Day appeal” where the Act defines it as an appeal “of a kind similar to” the historic Armistice Day appeal (s 2); the meaning and practical scope of “de facto partner” and temporal tests for survivors “immediately before the death” (s 5(2)); the evidentiary standard and remedy in relation to moneys collected in contravention of s 8(1) (s 8(4)); and the application of contemporary trusteeship standards where s 5(1) refers to the Trustees Act 1900, a statute noted as repealed in the compilation notes (note 2).

Practical implications for litigators and compliance advisers: In the absence of statutory case law in the provided material, parties and advisers would need to look to (a) any regulations made under s 7 and s 8(2) for procedural detail; (b) contemporaneous statutory provisions that now govern trustees in Western Australia (successor trustees acts and trust law), given the historical reference to the Trustees Act 1900; and (c) general equitable principles, statutory interpretation principles and analogous case law in related domains such as fundraising, constructive trusts and charitable trust administration. None of these sources are included in the supplied text.

Potential dispute areas flagged by the Act: The Act’s referral of investment duties to trustees legislation, its grant of executive appointment power for Trust members, the lack of internal governance detail (term lengths, quorum, audit/reporting) and the enforcement regime for unauthorised Poppy Day appeals all present practical points where litigation could arise, but no litigation history is provided in the statute or compilation notes supplied.

This compact statute contains a number of drafting and operational features likely to create practical traps for trustees, the League, sub‑branches and third parties if not anticipated.

Net proceeds undefined: The Act requires each sub‑branch to remit “one‑half of the net proceeds of the annual Poppy Day appeal” to the State secretary (s 3(2B)). The Act does not define “net proceeds”. That raises questions about which costs are deductible (printing, collection costs, payments to volunteers, venue hire, merchandising costs, merchant fees) and whether timing (gross receipts less expenses in the same year) or accounting conventions apply. Absent regulation or internal policy, this is a point of ambiguity.

Timing and annual deadline: The statutory deadline is “on or before 1 December 1933, and in every subsequent year remit to the State secretary one‑half …” (s 3(2B)). Although the 1933 date is historical, the ongoing “in every subsequent year” language creates an annual deadline of 1 December. Failure to remit by that date could give rise to breaches, but the Act does not specify sanctions for late remittance, leaving remedies to internal League processes or civil recovery mechanisms.

Exclusive conduct and broad offence language: Section 8(3) makes it unlawful for any person who “conducts, or attempts to conduct, or permits or suffers to be conducted, or who aids in, abets, takes part in, or whether with or without personal reward … engages in the conduct of the annual Poppy Day appeal” to be guilty of an offence. The breadth of the list risks ensnaring volunteers, fundraisers or charitable organisations that are not strictly sure whether their activities are within the statutory definition of the annual Poppy Day appeal. The statutory definition at s 2 refers to an appeal “of a kind similar to the appeal heretofore known as ‘the Poppy Day appeal’”, which is imprecise and potentially open to interpretation. The $200 penalty is fixed (s 8(3)), but the provision also creates civil recovery liability under s 8(4).

Constructive trust + debt: Money collected in contravention is “held … in trust for the League” and is a debt until paid (s 8(4)). This dual description gives the League both proprietary and personal claims. Practically, that means funds may be traced and recovered, but the Act leaves open issues as to priority vis‑à‑vis other creditors or insolvency situations because the statute does not describe detailed procedures for recovery.

Investment law reference out of date: Section 5(1) mandates investment “under and subject to the Trustees Act 1900”. The compilation notes indicate the Trustees Act 1900 was repealed by the Trustees Act 1962 (note 2). The statutory reference therefore points to an historical enactment and may require interpretation as to the contemporary trustees statutory regime that governs the Trust. That is a drafting mismatch practitioners must resolve by reference to successor law.

Compliance obligations flow principally to League sub‑branches, the State secretary, the Trust and anyone involved in fundraising activities resembling the Poppy Day appeal. The Act itself is short; compliance primarily requires following remittance, governance, investment and fundraising rules set out in the statute and in any regulations promulgated under s 7 and s 8(2).

For League sub‑branches and volunteer organisers

• Calculate net proceeds carefully and consistently, document the methodology, and remit one half of net proceeds to the State secretary on or before 1 December each year (s 3(2B); s 3(3)(a)). The Act does not define “net proceeds”, so maintain contemporaneous records of gross receipts and all deductible expenses to demonstrate the basis for the remittance.
• Ensure local fundraising events and materials fall within the League’s authorised Poppy Day appeal framework. Only the League is authorised to hold the annual Poppy Day appeal in WA (s 8(1)). Individuals or sub‑branches acting independently must ensure they have formal authorisation from the League before conducting any activity that might be characterised as the Poppy Day appeal.

For the State secretary

• Receive remittances from sub‑branches and ensure prompt payment of those moneys to the Trust (s 3(2B)). Maintain clear records and a reconciliation process linking sub‑branch remittance statements to bank deposits and receipts given to donors.

For the Trust and its members

• Observe the Trust’s corporate formalities: maintain a bank account for the Fund, use the Trust’s common seal for documents as required (s 4(3)), and keep minutes of meetings and resolutions.
• Invest Fund moneys “under and subject to the Trustees Act 1900” as the statute states (s 5(1)). Given the Trustees Act 1900 is recorded as repealed in the compilation notes, identify the current trusteeship statute and applicable investment standards, and document that investment decisions comply with the contemporary law and any regulations made under s 7.
• Apply funds only for eligible beneficiaries: aged and/or invalid sailors, soldiers, airmen and nurses eligible for League membership, and spouses or de facto partners who were such immediately before death, and only for persons domiciled in Western Australia (s 5(2)-(3)). Implement a clear social‑welfare eligibility assessment process and retain documentary evidence of domicile and League membership eligibility.
• If the Trust intends to allocate funds in a particular way, consider making internal policies consistent with the Act and with any regulations. Although the Trust has discretion under s 5(2), that discretion is subject to the Act and regulations.
