#### 28 Leaving Australia permit 28 Leaving Australia permit > > (1) The Commissioner may, on application by a person who is about to leave Australia, issue a prohibited weapons—leaving Australia permit that authorises the person to possess a prohibited weapon to which the permit relates. > > > (2) The Commissioner must not issue a prohibited weapons—leaving Australia permit unless satisfied that the applicant is about to leave Australia. > > > (3) A prohibited weapons—leaving Australia permit is subject to the following conditions— > > > > > (a) the permit only authorises possession of the prohibited weapon by having the weapon in the custody of an authorised weapons dealer or customs authority, > > > > > (b) the permit remains in force, unless sooner surrendered or revoked, until the expiration of 7 days from the date of its issue. > > > (4) In this clause, customs authority means a person exercising functions under the [Customs Act 1901](http://www.legislation.gov.au/) of the Commonwealth.
