Water Services Coordination (Plumbers Licensing) Regulations 2000

The Regulations rest on a few core legal and operational concepts that structure duties, risks and compliance pathways.

• Authorisation classes and role boundaries. Licences and permits are defined and limited to natural persons (reg 11; reg 14). A plumbing contractor’s licence authorises contractor‑level and, under general direction and control, trade‑level work; tradesperson licences authorise trade‑level work but generally only under the contractor’s general direction and control (regs 12, 13, 13A, 13B). Provisional licences and restricted permits limit autonomy and require supervision or specific competencies (regs 13C, 13D, 13E; Schedule 3). These allocations determine who may lawfully carry out what work (reg 9(1)) and create a two‑tier accountability model: the licensed plumbing contractor is the primary responsible person for contractor‑level work (see reg 3(4) and regs 12-13).

• Technical standards and targeted modifications. The Plumbing Code (Volume 3 of the NCC) is incorporated selectively into the “plumbing standards” (reg 48(2)(a)), and the Regulations make state‑specific modifications to the referenced plumbing standards (reg 49). The Board can also grant written declarations that a specified standard does not apply or is modified for particular work, subject to safety and public‑interest constraints (reg 54(2)-(6)). That creates a default standard (Plumbing Code, modified) with a formal exception/variation route requiring Board processes and an application fee (Schedule 1, Division 2 item 6).

• Notification and certification. Major work and work including performance solutions require pre‑commencement notice (reg 41; reg 45A) and certificates of compliance within five working days of completion (regs 42(1), 45B(1)). The Board prescribes approved forms and may require specified duplication/numbering of forms (reg 106). Certificates are retained for six years (reg 42(6); reg 45B(5)), and specific diagrams must accompany certain drainage work (regs 45D, 45DA) and can be released by the Board for specified regulatory purposes (reg 45F).

• Records and traceability. Primary contractors must keep records of persons under their direction and supervision (reg 25B). Minor work records are mandatory (reg 44A). Service providers in remote communities must keep detailed registers and records and retain them for six years (reg 39(2)-(2C)). These record‑keeping requirements create administrative compliance costs and evidence trails for audits, rectification and disciplinary processes.

• Inspection, rectification and enforcement. Plumbing compliance officers (designated employees) receive identity cards and are authorised to inspect, issue rectification notices (reg 66; reg 71), enter premises (reg 83), request documents and conduct tests (reg 85). Rectification notices state required corrections, timeframes and whether a licensed contractor must perform the work (reg 71(3)). The Board can arrange remedial action and recover costs where non‑compliance creates imminent risk (regs 72(5), 81, 89). Infringement notices and modified penalties provide a summary enforcement track (Div 3, regs 74-79; reg 75 table).

• Disciplinary system and review. The Board can deal administratively with some disciplinary complaints (caution, undertakings, penalty up to $3,000) or refer matters to SAT for allegations (reg 31; reg 30). SAT may impose penalties, order training, suspend or cancel licences (reg 34). Specified Board decisions are reviewable by SAT within 28 days (reg 100).

• Special regimes: remote Aboriginal communities and subdivided land. Part 4A authorises trained authorised workers to perform limited “permitted work” in eligible remote Aboriginal communities when licensed contractors cannot attend promptly, with specified training units and service provider obligations (regs 35-39). Part 6A prescribes minimum placement and sizing rules for connection points and service lines on subdivided land (regs 55-59), with specified distances from boundaries and depth/grade requirements (reg 56-57).

These main concepts translate into detailed procedural obligations (forms, fees, time limits), technical compliance obligations (specific Plumbing Code parts and WA modifications, reg 48-49), and enforcement tools (rectification notices, entry warrants, infringement notices). The scheme separates who carries primary responsibility from who can conduct the physical work, and it embeds administrative checks (notice/certificate reporting, record retention, inspections) to create traceability and regulatory oversight.

The Regulations allocates obligations and restrictions across several identifiable groups; I set out the practical contours and who carries what burdens.

• Licensed plumbing contractors. They are central. A plumbing contractor’s licence both authorises contractor‑level work and, subject to general direction and control rules, permits engagement with trade‑level work and supervision of other licensees and apprentices (regs 12-13). Contractors must give notices of intention for major work (reg 41), lodge certificates of compliance within five working days of completing major or performance solution work (regs 42, 45B), keep copies for six years (reg 42(6), 45B(5)), display their licence at their principal business (reg 24), include licence numbers in advertising and business documents (regs 25, 25A), and maintain records of supervised persons (reg 25B). Contractors also bear exposure to rectification notices and the Board/SAT disciplinary regime (regs 71-72; reg 31; reg 34).

• Tradespersons, provisional licence holders and permit holders. Tradespersons and tradespersons (drainage plumbing) hold narrower authorisations to carry out trade‑level work and supervise apprentices (regs 13A, 13B). Provisional licence holders have time‑limited, supervised roles (reg 13C; reg 21(1)). Restricted plumbing permit holders are authorised only for the specified scope (water heater disconnections/connection limited by conditions in reg 13D; rainwater storage limited to external supply to a building in reg 13E). Schedule 3 sets the competency requirements for each authorisation (Schedule 3 cl 2-5, 7-8).

• Apprentices and pre‑apprentices. Apprentices and pre‑apprentices may perform work under supervision; the Regulations identify when apprentices are exempt from the licensing prohibition (reg 9(2)). Regulation 3A defines “apprentice” for transitional and application timing purposes.

• Owners and occupiers. Owners or occupiers of dwellings have narrow self‑help exceptions for minor tasks (shower head, tap repair, cistern washer replacement, clearing blockages by plunger) (reg 9(4)). Owners replacing a pump may be exempt if the water supply is not from a water services provider (reg 9(5)). However, owners may also be recipients of certificates and subject to rectification notices and inspections if plumbing work was improperly done at the dwelling (regs 42(1)(b), 71(6), 68(3)).

• Service providers and authorised workers in remote Aboriginal communities. Part 4A creates a targeted regime: service providers contract with the Health Department to provide Aboriginal environmental health services; their authorised workers, with specified AQF qualifications and completion of qualifying plumbing units, may carry out specified permitted work without a licence in eligible remote communities (regs 37-38). Service providers carry record, training and equipment obligations and may be declared ineligible by the Board if they contravene reg 10 or reg 39 (reg 39A).

• Water services and sewerage licensees. Exempted providers and sewerage service licensees have special treatment: exempt work by water services providers is excluded from the licensing requirement (reg 4(3)(a) and definition of exempt work). Regulation 9A treats relevant drainage plumbing work done by or on behalf of sewerage service licensees as not requiring licences, but applies certain recording and inspection rules as if they were licensed plumbing contractors (reg 9A(2)-(4)).

• Consumers and builders. Builders and persons named on building permits receive copies of certificates of compliance for major or performance solution work (regs 42(1)(b)(i), 45B(1)(b)(i)). Local governments receive copies for drainage plumbing not connected to a sewer (regs 42(1)(c), 45B(1)(c)). Consumers consequently receive documentary assurances and are the intended beneficiaries of certification and rectification regimes.

• The Plumbers Licensing Board and compliance officers. The Board is a decision maker, regulator and keeper of the public register (reg 5; regs 102-105; reg 106). Plumbing compliance officers are designated employees of the Department or local government and exercise inspection/enforcement powers (reg 66; regs 83-86). The Board may also publish information and disclose certain information to other regulatory agencies (regs 108-109).

Who primarily pays and bears the compliance burden. Licensed persons and their businesses will bear the administrative cost of applications, fees (Schedule 1 Division 1), record keeping (regs 25B, 44A), notices and forms, and the risk of rectification and disciplinary enforcement. Customers may indirectly bear costs through service prices, and service providers in remote communities carry training and record retention costs (reg 39(3), (2A), (2C)). When the State rectifies urgent dangerous situations it may recover costs from responsible persons (reg 89).

This section maps the principal statutory duties, the mechanisms that ensure compliance and the rights built into the scheme.

Key duties

• Licensing and authorisation: carrying out any plumbing work requires an appropriate licence or permit (reg 9(1)). Employing or engaging people to do plumbing work that would breach reg 9(1) is an offence (reg 10). Only natural persons can hold licences/permits (reg 14).

• Notices and certificates: licensed plumbing contractors and permit holders must give a notice of intention for major plumbing work at least 24 hours before commencement (reg 41(1)), and for performance solution work at least five working days before commencement (reg 45A(1)). When major or performance solution work is completed the responsible contractor must give a certificate of compliance to the Board within five working days and provide copies to builders/owners/local governments as required (regs 42(1), 45B(1)). Certificates must state compliance with plumbing standards and safety of any relied‑upon existing plumbing (regs 42(2), 45B(2)).

• Standards and workmanship: responsible persons must ensure work meets the plumbing standards set by reg 48 and the WA modifications in reg 49 and that work is carried out with reasonable care and skill (reg 50). A person must not connect non‑compliant plumbing to water/sanitary systems (reg 51(1)), and must follow manufacturer installation specifications unless inconsistent with plumbing standards (reg 52).

• Records and identification: contractors must keep supervision records (reg 25B), minor work records (reg 44A), and produce identification cards on request (reg 24A). Photographs for licence applications must meet reg 21A requirements.

• Rectification obligations: recipients of rectification notices must comply and notify when rectification completed (reg 72(1)-(2)). The person ordered to rectify is not entitled to payment for rectification work undertaken by the State (reg 72(3)-(4)).

• Special duties for service providers: service providers in remote communities must ensure authorised workers carry out only permitted work, keep registers and records and provide tools, training and PPE (reg 39(1)-(3)).

Board and compliance officer powers

• The Board can impose, change or remove licence conditions and may refuse to issue licences if photographic proof is insufficient (regs 17, 19). The Board can deal summarily with some disciplinary complaints (caution, undertakings, fine up to $3,000) or make allegations to SAT for more serious matters (regs 31, 30, 34). The Board keeps a public register (regs 102-104) and may publish information about its performance (reg 108).

• Plumbing compliance officers are designated and issued identity cards, may inspect and test plumbing, issue rectification notices, and exercise urgent powers in dangerous situations (regs 66, 68-71, 81). They may enter non‑dwelling places at reasonable times and may enter dwellings with consent, if work is in progress or under warrant (reg 83). Entry warrants may be issued by a justice where entry would otherwise be refused or impractical (reg 86).

Rights and safeguards

• Review rights: specified Board decisions (refusal to issue or renew, imposition or change of conditions, disciplinary action, declaration under reg 39A(2), and declaration decisions under reg 54) are reviewable by SAT within 28 days (reg 100).

• Procedural safeguards for declarations modifying standards: the Board must be satisfied that a declaration will not increase risk to people, property or environment and that it is in the public interest or consistent with other written law (reg 54(4)).

• Evidentiary provisions: certificates signed by the chairperson and plumbing compliance officer certificates carry evidentiary weight in proceedings (reg 107). However statutory protections exist for compelled answers with limited admissibility in subsequent criminal proceedings (reg 85(3)).

• Limits on prosecution for connecting unsafe plumbing: prosecutions under reg 51(1) require prior Board approval and the Board may only grant approval where it is satisfied that connection was unsafe or gave rise to a dangerous situation (reg 51(3)-(4)), which is a procedural check.

Together, these duties, powers and rights create an administrative model focused on gating technical competence (licences and permits), traceable reporting (notices/certificates/records), inspection and rectification enforcement, and administrative/tribunal review for licensing and disciplinary decisions.

The Regulations combine criminal penalties, administrative sanctions, rectification and cost recovery, and an infringement notice regime to secure compliance.

Criminal and monetary penalties

• The Regulations prescribe monetary fines for a range of offences (examples): carrying out plumbing work without an appropriate licence or permit (reg 9(1), penalty $5,000); employing someone to do unlicensed work (reg 10, $5,000); contravening conditions or the Regulations (reg 19(3), $5,000); false or misleading statements in applications or certificates (regs 16, 46; up to $5,000); failure to produce ID (reg 24A, $3,000); various record‑keeping failures attract fines typically from $1,000 up to $5,000 depending on the provision (see regs 25B, 39, 72, etc.). These fines are set at the regulation level rather than as fixed statute maxima beyond the specified amounts.

Administrative and disciplinary enforcement

• Board actions: The Board may caution, reprimand, accept undertakings, impose conditions, order payment of administrative penalties up to $3,000 (reg 31(2)), and, for serious matters, make allegations to SAT. On SAT determination, penalties of up to $5,000, suspension or cancellation of licences are available (reg 34(1)(e)-(g)). The Board may change licence conditions (reg 19) but must obtain SAT approval to change conditions that SAT previously changed (reg 19(2a)).

• Rectification notices and remedial action: Plumbing compliance officers can issue rectification notices (reg 71) when work fails to meet plumbing standards, with a six‑year window in most cases (reg 71(2)). Failure to comply with a rectification notice is an offence (reg 72(1)); the Board, with plumbing compliance officer assistance, may carry out urgent remedial work and recover costs from the person given the rectification notice (regs 72(5), 89). For dangerous situations, compliance officers have immediate powers to act and recover costs from persons who carried out the plumbing work (reg 81; reg 89).

• Entry, inspection and evidence: compliance officers may enter non‑dwelling places at reasonable times and dwellings with consent or under warrant (reg 83); obtain documents and take samples and photographs (reg 85). Entry warrants may be issued by a justice where necessary (reg 86). Certificates by the chairperson and compliance officers are given evidentiary weight (reg 107).

Infringement notice scheme

• The Regulations list prescribed offences that can be dealt with by infringement notice (reg 75). The Schedule in reg 75(3) sets the modified penalty amounts (from $200 to $1,000, depending on the offence). The infringement notice must be issued within 12 months of the alleged offence (reg 75(1)). Payment prevents court proceedings to the same extent as conviction for that offence (reg 78(2)).

Operational levers and recovery

• The Board can charge fees for re‑inspections and for notices/certificates (reg 73; Schedule 1 Division 2), recover costs for remedial action by the State in court (reg 89(1)), and refuse to renew or re‑issue licences where fitness or compliance requirements are not met (reg 17, 20, 20A). The Board may also revoke service provider status under Part 4A where providers contravene reg 10 or reg 39 (reg 39A).

Procedural protections and review

• SAT review for specified Board decisions is available within a 28‑day period (reg 100). The Board must give reasons and written notice for refusal to issue licences (reg 18) and for SAT determinations there are time limits on notice and an obligation to return cancelled/suspended licences and ID cards (reg 34(2)-(4)). Procedural provisions (eg. notice periods for inspections, minimum notice for entering dwellings, and the right to request particulars of power of entry) provide limited safeguards for affected persons (regs 68(1)(e), 84, 88).

The enforcement framework thus mixes civil‑administrative remediation and pecuniary fines with a streamlined infringement scheme and tribunal review. The design places initial enforcement emphasis on rectification and documentation compliance (notices/certificates/records), with escalation through Board processes and SAT for serious or contested disciplinary matters.

The Regulations operate as part of an interlocking regulatory architecture. The text expressly cross‑references multiple statutes, codes and agencies; these interactions define technical scope, institutional responsibilities and data‑sharing arrangements.

References to Commonwealth and State technical and licensing instruments

• Plumbing Code and Australian Standards: The Regulations incorporate parts of the Plumbing Code (NCC Volume 3) and Australian Standards (reg 48(2)(a) and definitions at reg 3(1)) and then make state modifications (reg 49). Compliance therefore requires reading the Regulations in conjunction with the Plumbing Code and the listed AS/AS‑NZS standards.

• Water services and sewerage statutes: Multiple definitions are pulled from the Water Services Act 2012 (definitions of water supply service, water services provider, sewer, sewerage service licensee) and the Water Agencies (Powers) Act 1984 (wastewater) (reg 3(1) and definitions). The Regulations carve out “exempt work” done by water service providers (reg 4(3)(a) and definitions), and give sewerage service licensees a specific operational exclusion with record and inspection obligations treated as if they were licensed contractors for certain property sewer tasks (reg 9A).

• Building regime interface: Certificates of compliance must be provided to the person named as the builder on a building permit where the plumbing relates to building work (regs 42(1)(b)(i), 45B(1)(b)(i)). The Regulations also reference the Building Act 2011 definitions and the Building Services (Complaint Resolution and Administration) Act 2011 in relation to remedy orders and co‑operation with the Building Commissioner (reg 3(1) definitions; reg 27(g)).

• Energy and gas safety frameworks: Permit requirements for water heater work require electrical and gas qualifications (Schedule 3 cl 7(2)(b)(i)-(ii) and reg 13D(2)), linking the plumbing authorisation to licences under the Electricity (Licensing) Regulations 1991 and Gas Standards regulations (Schedule 3 cl 7). Information sharing provisions permit compliance officers to disclose to the Director of Energy Safety, gas inspectors and WELS inspectors for their regulatory functions (reg 109(2)-(3)).

Administrative and tribunal interactions

• State Administrative Tribunal: The SAT is the review and decision arena for allegations made by the Board and for review of specified Board decisions (reg 30; reg 34; reg 100). The Board must provide written reasons for refusals and is constrained where SAT has previously altered a condition (reg 19(2a)).

• Inter‑agency data and operational cooperation: The Board may disclose property plumbing details to a water services provider under arrangements (reg 109(1)(b)). Compliance officers may disclose to the Building Commissioner and energy/gas regulators for investigative and enforcement purposes (reg 109(2)).

Regulatory precedence and modifications

• The Board may declare that specified standards do not apply or may modify a standard for specified work, subject to safety and public‑interest tests (reg 54). The Regulations therefore create a centralised administrative exception process which interacts with statutory standards and technical obligations.

Transitional and amendment interactions

• The Regulations themselves have been amended to reflect changes in definitions and to implement the Commerce Regulations Amendment (Plumbing) Regulations 2024, with transitional provisions preserving the legal character of work commenced before changes (regs 110-115). That indicates how the plumbing regulatory regime must be read together with other subordinate instruments.

In practice this means compliance requires cross‑reference to: the Plumbing Code and referenced Australian Standards; the Water Services Act 2012 and related water/sewer statutes for exclusions and definitions; building permit and building law frameworks for coordination on building‑related plumbing work; energy and gas safety licensing regimes where competencies overlap; and the SAT/BPA mechanisms for review and dispute resolution. The Regulations anticipate information exchange and shared enforcement with these other public bodies (reg 109).

The Regulations have been subject to iterative change over 2000-2025. The compilation table in the source lists amendment instruments and commencement dates; several amendments are substantive for scope, standards, and administrative detail.

Key amendment milestones reflected in the text

• Initial and early changes (2000-2005): The instrument commenced in 2000 and was re‑titled and amended in the early 2000s as regulatory frameworks evolved (Compilation table entries for 2000, 2001, 2003, 2004 and 2005). The 2004 re‑titling produced the Plumbers Licensing and Plumbing Standards Regulations 2000 version (see compilation notes).

• Consolidation of procedural and disciplinary provisions (2004-2016): Amendments across 2004-2016 added or refined disciplinary, inspection and certification requirements (for instance regs 41-46, 66-90 were developed and consolidated in that period, per the compilation table entries and Gazette amendments).

• Introduction of modernised certification, records and performance solution processes (2015-2016): Parts governing performance solutions and certificates were introduced and refined (regs 45A-45C; reg 42) with changes around 2015-2016 (Gazette and SL entries as per the compilation table).

• Remote communities regime (Part 4A, 2016): The specific regime for basic plumbing work in remote Aboriginal communities was inserted in December 2016 (regs 35-39A), establishing qualified authorised workers and service provider obligations (see Gazette 13 Dec 2016).

• Plumbing standards modernisation and WA modifications (2019-2024): From 2019 onwards the Regulations updated which parts of the Plumbing Code apply (reg 48), specified WA modifications to AS/NZS standards (reg 49), and added transitional provisions (reg 110-112). In 2024 the Commerce Regulations Amendment (Plumbing) Regulations 2024 made definitional changes, introducing separate definitions for water supply, sanitary and drainage plumbing (regs 4, 4A, 4B) and related transitional provisions (regs 113-115). These 2024 amendments are referenced throughout the body (see insertion notes, SL 2024/12).

• Licensing, fees and administrative updates (2024-2025): Recent statutory instruments in 2024 and 2025 updated fee schedules (Schedule 1 updated in SL 2025/89) and made changes to licence classes, restricted permits (rainwater storage and water heater), and regulatory processes (SL 2024/12; SL 2025/70; SL 2025/89). The source shows multiple amendments with insertion/renumbering, e.g., Schedule 3 was updated (Schedule 3 clauses and reg 13E) and Schedule 1 now lists application/issue/renewal fees.

Transitional provisions

• The Regulations include a series of transitional provisions that preserve the legal status of work started under previous formulations of the rules: reg 110 preserves plumbing standards applicable to work commenced before May 2019; regs 111-115 deal with transitions from the 2019, 2022 and 2024 amendments. The 2024 Commerce Regulations amendments prompted explicit transitional rules treating plumbing commenced before the change as major/minor or of the former type if it so commenced (regs 113-114).

Practical consequence of the amendment history

• Over time the regime has trended toward greater specification of technical standards, clearer documentation and retention obligations, targeted exceptions (remote communities), and an administrative process for deviations from the plumbing standards (reg 54). Recent amendments (2024-2025) adjust definitions (water supply/sanitary/drainage) and add specific permit classes and fee adjustments that practitioners must account for when advising clients or designing compliance processes.

For a practitioner this means always checking the current consolidated version and the compilation table entries for the most recent SL number, as the Regulations have been amended frequently and several operational rules (notice timings, certification requirements, fees, and the scope of minor vs major work) have been altered by those amendments (see compilation table and the r.‑by‑r. amendment notes in the source).

The source document does not identify any court or tribunal decisions. The Regulations themselves create a tribunal review pathway and envisage litigation processes; the following points summarise those built‑in mechanisms and practical litigation touchpoints, drawing only from the Regulations.

Tribunal and court pathways provided by the Regulations

• State Administrative Tribunal (SAT). The Board may make an allegation to SAT in respect of disciplinary matters (reg 30(d)), and if SAT determines a disciplinary matter exists it has powers to caution, order training, change licence conditions, impose a penalty up to $5,000, suspend or cancel licences (reg 34(1)). A person aggrieved by specified Board decisions (including refusals, imposition or change of conditions, disciplinary action under reg 31(2), or certain declarations under Part 4A or reg 54) may apply to SAT for review within 28 days (reg 100). SAT is thus the primary decision review forum set out in the instrument.

• Courts and debt recovery. The Board may recover amounts ordered under reg 31(2)(c) as a debt in a court of competent jurisdiction (reg 31(6)). The State may recover costs for remedial action undertaken under reg 72(5) or 81 in court (reg 89(1)). Infringement notices, if unpaid and not withdrawn, may be prosecuted in court (regs 75-79).

Evidentiary and procedural rules relevant in proceedings

• Evidentiary presumptions: certificates signed by the chairperson and compliance officer certificates are admissible and carry presumptions in proceedings (reg 107). Compelled answers given to compliance officers are not admissible in criminal proceedings except for specified offences (reg 85(3)), which creates a limited evidentiary privilege for compelled testimony.

• Procedural time limits: the Regulations set time limits for giving notice (eg. notice of intention 24 hours for major work, five working days for performance solutions) and for certificates (five working days after completion), which may be material facts in disciplinary or prosecution contexts (regs 41, 45A, 42, 45B).

Absence of named cases in source

• The compiled text does not include any reported cases, tribunal decisions or litigation summaries. If you require case law interpreting particular provisions (eg. Board powers to modify conditions, SAT decisions on disciplinary standards, or judicial treatment of rectification cost recovery), you would need to search WA SAT decisions and court databases because the Regulations themselves do not supply that jurisprudence.

Practical note for litigators and advisers

• Because the Board has both administrative and quasi‑disciplinary functions, litigation will commonly involve SAT reviews of Board decisions or civil recovery actions for remedial costs. Evidentiary certificates from the Board and compliance officers are designed to streamline proof of facts in proceedings (reg 107) and may change evidentiary tactics. The Regulations also place pre‑conditions on prosecutions for some offences (eg. reg 51(3) requiring Board approval to commence a prosecution for connecting unsafe plumbing), which is a procedural nuance to watch for in enforcement litigation.

In short, the statutory framework creates multiple administrative avenues that can culminate in tribunal or court proceedings, but the source provided contains no litigation history or reported decisions to cite.

This section lists practical pitfalls and rules that frequently cause compliance exposure or operational friction; each is rooted in the Regulations.

1. Licence holder must be a natural person (reg 14). Corporations cannot hold licences or permits. Businesses that trade under company names must have a natural person licensed to carry the work. This affects contracting, insurance and who appears before SAT.

2. Carrying out work without the correct authorisation is a direct offence (reg 9(1), penalty $5,000). The definition changes in 2024 (regs 4, 4A, 4B and transitional regs 113-114) mean that what constitutes water supply, sanitary or drainage work may have shifted for work commenced at different times, check the transitional provisions (regs 113-114).

3. Delegation and supervision traps. Tradespersons and provisional licence holders are authorised only under a plumbing contractor’s general direction and control in many cases (regs 13A(2), 13B(2), 13C). Contractors who fail to properly exercise general direction and control or supervision can be the subject of disciplinary matters (reg 27(h)-(i)) and face rectification notices.

4. Notices and certificates timing. Major work requires a notice of intention at least 24 hours before commencement (reg 41(1)); performance solutions require five working days’ notice (reg 45A(1)). Certificates of compliance must be lodged within five working days of completion for major or performance solution work (regs 42(1), 45B(1)). Late or absent certificates expose the contractor to fines (see reg 42(1) penalty) and can trigger further enforcement.

5. Certificates can require coverage of other contractors’ uncompleted work. If the principal plumbing relies on earlier, incomplete work for which a certificate has not been given, the current contractor’s certificate must cover the earlier plumbing (reg 42(5); reg 45B(4)). Practically, this can transfer responsibility and commercial disputes.

6. Rectification has no payment right. A person ordered to rectify plumbing cannot demand payment for rectification carried out by the State and must not request payment for rectifications ordered by a rectification notice (reg 72(3)-(4)). That alters commercial dynamics when contractors or owners must arrange rectification.

7. Record‑keeping duration and production. Certificates and records of work must be kept for six years in many circumstances (reg 42(6); reg 45B(5); reg 39(2A); reg 44A(5)). Primary contractors must keep supervision records at the principal place of business and produce them on Board request (reg 25B).

8. Manufacturer specifications vs standards. Installers must comply with manufacturer installation specifications and operating conditions unless they conflict with the plumbing standards (reg 52). Failure here is a specific ground for rectification notices (reg 71(1)(c)).

9. Photographs and identity compliance. Licence and renewal applications require recent photographs (<1 month old) in an approved format with proof (reg 21A); the Board can refuse issues/renewals based on unsatisfactory photographic proof (reg 17(3), 19A(3)). Identification cards must be produced on request (reg 24A), and licences must be displayed at the principal place of business (reg 24).

10. Limited scope of restricted permits. For example, the water heater restricted permit authorises only disconnection/connection of specified components and excludes cases where pipe configuration changes or existing pipes are not in safe order (reg 13D(2)-(3)). Permit holders must advise that a licensed contractor be engaged where work falls outside the permit (reg 13D(4)).

11. Board discretion on declarations. The Board can declare standards inapplicable or modified but only if it is satisfied there is no increased risk and it is in the public interest or consistent with other law (reg 54(2)-(4)). Applications incur a fee (Schedule 1 Division 2 item 6). The declaration may be conditional and can be revoked (reg 54(5)-(7)).

12. Limited class of Plumbing Code that applies. The Regulations only bring in specified Plumbing Code sections and parts of AS/NZS standards (reg 48(2)(a) and reg 49). Assuming full PCA coverage may be incorrect; check the specific incorporated provisions and WA modifications.

13. Entry powers and dwellings. Compliance officers can enter dwellings without consent in certain circumstances (inspections under prior notice, ongoing work, or entry warrant) (reg 83). Practitioners should plan client communications to avoid obstruction offences (reg 90(2)).

14. Transitional cut‑offs for new permit classes. For the restricted plumbing permit (rainwater storage) there are strict application and transitional windows (Schedule 3 cl 8(2); reg 13E note). Missing the application window can preclude eligibility under transitional terms.

15. Infringement notice time limit. An authorised person must issue an infringement notice within 12 months of the alleged offence (reg 75(1)). If that period expires, the enforcement route may need to be by prosecution, subject to other procedural checks.

Being alert to these “gotchas” reduces operational risk, avoids avoidable fines, and helps manage who should sign contracts and carry the legal responsibility on projects.

This is a practical compliance checklist and workflow for a plumbing contractor, tradesperson, or adviser handling plumbing projects in WA. Citations point to the governing regulations for each step.

1. Determine scope and licence class

• Before work commences, determine whether the task is water supply, sanitary or drainage plumbing as defined in regs 4, 4A and 4B. Check the 2024 transitional provisions if the work commenced before the Commerce Regulations Change (regs 113-114).
• Confirm whether the work is major or minor plumbing work per reg 3(1) definitions and Part 5 Division 1-2 thresholds.

2. Confirm personnel authorisation and supervision

• Ensure the person performing the work holds the appropriate licence/permit (reg 9(1); regs 11-13B; Schedule 3 for competence requirements).
• If employing apprentices, ensure they work under permitted supervision (reg 9(2)).
• Maintain the primary contractor’s record of persons under general direction and control or supervision in approved form and retain at principal place of business for at least one year after the relevant period (reg 25B(1)-(4)).

3. Application and licence administration

• Apply in the approved form with the application fee and photograph complying with reg 21A (reg 15). Fees are in Schedule 1 Division 1 (for example, plumbing contractor issue fee $806 item 5; tradesperson $284 item 6; check current Schedule 1 for exact amounts).
• Upon issue, display the licence at the principal place of business (reg 24) and ensure the licence or permit number appears in advertisements and business documents (regs 25, 25A).

4. Pre‑commencement notices and fees

• For major plumbing work, give a notice of intention to the Board at least 24 hours before work commences (reg 41(1)); pay the new installation fee where relevant (reg 45). Check the Schedule 1 Division 2 fee for the new installation fee (reg 45 and Schedule 1).
• For work including a performance solution, give a notice of intention at least five working days before commencement and pay the lodgment fee where required (reg 45A; Schedule 1 Division 2 items 1-2).

5. Conduct work to applicable plumbing standards

• Apply the plumbing standards defined in reg 48 (selected Plumbing Code parts plus WA modifications in reg 49). Follow manufacturer installation specifications and operating conditions unless inconsistent with plumbing standards (reg 52). Document compliance testing and any deviations.

6. Certificates, diagrams and record retention

• On completion of major or performance solution work, give a certificate of compliance to the Board within five working days and copy to the builder or owner, and local government where relevant (regs 42(1), 45B(1)). Retain copies for six years (reg 42(6), 45B(5)).
• For drainage plumbing that is not readily accessible once installed, provide a drainage plumbing diagram to the Board with the certificate (reg 45D). For drainage plumbing service lines/connection points on subdivided land, provide diagrams per reg 45DA.

7. Minor work record keeping

• Keep records of minor plumbing work in the approved form at the principal place of business and retain until the rectification notice window expires (reg 44A(1), (4)-(5)). Produce records on Board or compliance officer request (reg 44A(6)).

8. Respond to inspections and rectification notices

• If given a notice of inspection, ensure appropriate equipment and personnel are available and arrange consent for dwelling inspections where necessary (reg 68(4); reg 69).
• If issued a rectification notice, comply within the specified time, notify the issuing officer when rectified, and note you are not entitled to payment for rectification ordered by the notice (regs 71-72). If you do not comply and the Board authorises remedial action, expect costs recovery per reg 89.

9. Manage advertising and representation

• Ensure all advertising and business documents contain the licence or permit number (regs 25, 25A). Do not represent yourself as holding authorisations you do not possess (reg 25(3)-(4)).

10. Handle disciplinary and review pathways

• Keep records to show fitness and competence; if the Board refuses issue or renewal, you have 28 days to apply to SAT for review under reg 100. If a disciplinary complaint is made, the Board may deal with it administratively (reg 31) or make an allegation to SAT (reg 30).

11. Special regimes and transitional rules

• If operating in eligible remote Aboriginal communities consider the Part 4A pathway: ensure authorised workers meet qualification and unit requirements and service providers meet record, training and PPE obligations (regs 35-39). Be aware of service provider enforcement and possible declaration under reg 39A.
• If the work relates to subdivided land, follow Part 6A rules for connection point positioning, pipe size and location (regs 55-59).
• Check transitional regs (110-115) for projects that started before recent amendments; transitional treatment can affect classification as major/minor, and whether the new definitions apply.

12. Administrative hygiene

• Keep licence/permit renewals within the renewal period (reg 19A) to avoid gaps. Provide up‑to‑date contact details to the Board within 14 days of change (reg 105).
• Maintain a copy of the register details and be prepared to respond to Board requests for information (reg 104).

13. Budget for fees and possible re‑inspections/penalties

• Factor Schedule 1 fees into quotes and cashflow: application and issue fees (Schedule 1 Division 1), lodgment fees for performance solutions, new installation fees and re‑inspection fees (Schedule 1 Division 2). Infringement penalty risk should be added to compliance cost planning (reg 75 table).

14. Liaison and disclosure

• Expect the Board and compliance officers to coordinate with building, energy and water regulators. Ensure client consent and data handling complies where information sharing may occur under reg 109.

Following this operational checklist and citing the specific regulations when designing internal compliance manuals will reduce enforcement risk and protect businesses and practitioners from the common procedural and technical missteps set out elsewhere in this note.
