What it does
These 2005 Regulations revoke the 2003 instrument that originally declared the Marne River and Saunders Creek area a prescribed water resources area, add an adjoining area described as area A, and consolidate both into a single declared area called the Marne Saunders Prescribed Water Resources Area. The regulations accomplish three concrete mechanical changes.
First, Schedule 1 expressly revokes the Water Resources (Marne River and Saunders Creek,Prescribed Water Resources) Regulations 2003 (Schedule 1). The Preamble records the 2003 Regulations and their prior effects (Preamble paras 1-3). The revocation removes the earlier regulations from the statute book and replaces them with the present instrument.
Second, the instrument defines and names the geographic scope of regulation. Regulation 3 provides definitions. The term area A is the land bounded by the bold black line on GRO plan No 115/2004 (reg 3). The Marne River and Saunders Creek Area is carried forward as the area declared by the revoked regulations (reg 3 and Preamble note). The Marne Saunders Prescribed Water Resources Area is defined as the combination of the Marne River and Saunders Creek Area and area A (reg 3). The Preamble expressly states the government purpose-claim to add area A and to rename the combined area (Preamble para 4(a)-(b)).
Third, the regulations, pursuant to section 8 of the Water Resources Act 1997, declare the water resources status of the combined area. Regulation 4 declares all watercourses in the Marne Saunders Prescribed Water Resources Area to be prescribed watercourses, all wells in that area and wells drilled there after commencement to be prescribed wells, and the whole area to be a surface water prescribed area (reg 4(a)-(c)). The instrument therefore brings those specified water features and the geographic area within the statutory category of “prescribed” under the Act, by operation of the regulation and with the statutory basis identified in the instrument (reg 4 states it is made pursuant to s 8 of the Act).
