77 Action by authority if notice or direction contravened
(1) This section applies if—
(a) the authority has reasonable grounds for believing that a person
has engaged in conduct that contravened—
(i) a prohibition or restriction under a notice given to the
person under section 71; or
(ii) a direction given to the person under this part; and
(b) the person was told, in writing, about the effect of this section
when the notice or direction was given to them.
(2) An authorised officer, or someone else authorised by the authority for
this section, may—
(a) enter the relevant land and take any action stated in the notice or
direction; and
(b) do anything else necessary to give effect to the notice or
direction.
(3) This section does not authorise entry into a part of premises that is
being used for residential purposes other than with the occupier’s
consent.
(4) A person who enters land under this section is not authorised to
remain on the land if, on request by the occupier of the land, the
person does not produce—
(a) for an authorised officer—the officer’s identity card; or
(b) in any other case—a certificate signed by the authority for this
section that the person is authorised to carry out an activity
mentioned in the certificate.
(5) The reasonable costs incurred by the authority in taking action under
this section are a debt owing to the Territory by the person to whom
the notice or direction was given.
