113 Surviving allocations—surrender by holder no longer
owner or occupier of land
(1) This section applies to the holder of a surviving allocation (other than
a water utility) if the holder is not the owner or occupier of the land
to which the allocation relates.
(2) The holder may surrender the allocation to the authority and request
a water access entitlement under section 111 before the end of the
later of—
(a) 6 months after the day the person ceases to be the owner or
occupier of the land; and
(b) 6 months after the commencement day.
(3) If the holder does not surrender the allocation to the authority before
the end of that 6-month period, the allocation is taken to be
surrendered to the authority and the holder must not be granted a
water access entitlement under section 111 in relation to the
allocation.
