Water (Resource Management) Regulations 2017

The Regulations revolve around a small set of concepts that determine eligibility, cost and disclosure.

Fee units and calculation

• Fees are expressed in fee units (for example 13.57 fee units for several applications, regulation 6). The endnotes state the fee unit value for the financial year starting 1 July 2024 is $16.33 (Endnotes , Fee Units). The Regulations require the monetary conversion to be done under the Monetary Units Act 2004 and allow rounding to the nearest 10 cents. The practical implication is that monetary cost changes over time with the Treasurer’s published fee‑unit value; the Regulations set only the quantum in fee units.

Automated lodgement process

• The Regulations define an automated lodgement process as the process for enabling an application through the Victorian Water Register website (regulation 5, definition). For several application types the fee is lower if lodged through the automated lodgement process (see regulation 13 for water allocation assignments; regulation 20C and 21 for external and particular place of take approvals). The Regulations create a price incentive to use the online system.

Grouped applications

• The Regulations create labelled group application categories (regulation 5 definitions) that bundle multiple statutory applications under the Act (for example, water share change group application, water share transfer group application). Regulation 22 prescribes a single fee when an applicant makes a qualifying group application. The grouping alters the marginal cost of combining multiple transactional steps.

Waiver and exception discretions

• The Registrar may waive particular water register recording fees where special conditions exist (regulation 28(1)-(3)) and may waive Division 2 fees similarly (regulation 32). Separately, an Authority responsible for a water system may except a person from paying an application fee for certain assignment approvals (regulation 23). These are discretionary, administrative relief mechanisms.

Information privacy carve‑outs

• Part 3A (regulation 32A) prescribes which water register entries are not public. The non‑publication applies to names and addresses associated with allocations and entitlements, certain particulars of place of take approvals, and agreements to supply water. There is a defined exception where a person gives or receives more than 20 relevant assignments in a water season; then the name is not protected (regulation 32A(2)-(3)).

Prescribed purpose and occupiers

• Regulation 33 prescribes a permitted “purpose” for a licence under section 51(1) of the Act in declared water systems: watering cattle or other stock, but only where specific factual predicates hold (occupier abuts Crown land, Crown land abuts a waterway, and licence history under the Land Act 1958). Regulation 34 prescribes classes to be treated as occupiers for water‑use registration including Water Holders, incorporated supplier bodies, and persons engaged in road works or dust suppression on land requiring water use.

Interaction with the Water Act and other statutes

• The Regulations operate by reference to many sections of the Water Act 1989. They also cross‑refer to the Land Act 1958 (regulation 33(2)), the Monetary Units Act 2004 (endnotes), the Water Industry Act 1994 (definition of Rural Water Authority in regulation 32A(3)) and the Subordinate Legislation Act 1994 (sunset at 10 years, endnotes). Many defined groupings in regulation 5 expressly list combinations of Act sections.

Administrative implementation

• The regulatory architecture is operational and administrative. It sets unit prices, creates incentives to use the online system, allows the Registrar and Authorities to exercise waivers/exemptions, and determines which register fields are withheld from public access. That architecture shifts costs between applicants, the Registrar and Authorities depending on how often the waivers and exemptions are exercised.

The instrument affects multiple, identifiable classes of actors. Identify who pays, who decides, whose information is hidden, and which third parties observe changed behaviour.

Payors / applicants

• Individuals and corporate entities who apply under the Water Act for water shares, allocations, place of take approvals, or related changes pay the prescribed application fees in Part 2 (regulations 6-22). Those fees apply to issue, transfer (including limited term transfers), variation, cancellation, surrender and ministerial approvals. Applicants for water‑use licences or registrations that accompany some place of take or rationing rate applications may avoid discrete fees per the exceptions in regulations 19(2) and 20B(2).

Users of the water register

• Parties who lodge recordings in the water register (transfers of ownership, limited term transfers, transmissions on death, mortgage recordings and discharges, memoranda, arbitration referrals) pay fees in Part 3 Division 1 (regulation 24-27). Users who search the register or request corrections pay search and amendment fees in Division 2 (regulations 30-31), subject to waivers.

Authorities and the Registrar

• The Registrar administers the register and fee collection. The Registrar has explicit waiver powers for recording and search/amendment fees (regulations 28 and 32). An Authority responsible for a water system can, subject to its discretion, except a person from paying a fee for certain assignment approvals (regulation 23). The Minister remains the decision‑maker for approvals that the Water Act allocates to the Minister; these Regulations only prescribe fees and related mechanics.

Water Holders, suppliers and occupiers

• Regulation 34 prescribes particular persons as occupiers for the purpose of water‑use registration: the Water Holder; incorporated bodies that supply or deliver water to members; persons conducting road construction or maintenance requiring water; and persons using water for dust suppression. Those prescribed persons acquire registration duties under the Water Act by prescription in these Regulations.

People whose register information is private (and those affected by the exception)

• Part 3A (regulation 32A) designates the names and addresses of persons authorised to take water under allocations, bulk entitlements or environmental entitlements as not publicly available in the water register (subject to subregulation 2). This affects individuals and entities holding or receiving assignments. The subregulation 2 carve‑out makes names public where a person gives or receives more than 20 relevant assignments in a water season. The definition of “relevant assignment” targets assignments of allocations that may be taken in the Goulburn or Murray water systems (regulation 32A(3)).

Indirectly affected actors

• Legal advisers, accountants, brokers and financiers will be affected by the fee schedule and confidentiality rules. Mortgagees and financiers must note recording fees (regulation 25) and that the registrar may waive certain mortgage discharge fees where a mortgage was deemed under Schedule 15 and the recording is lodged within 6 months of the appointed day (regulation 28(2)). Bodies managing community water schemes (incorporated committees) are explicitly within the scope of the occupier prescription (regulation 34(b) note).

Temporal and geographic scope

• The Regulations apply across Victoria by reference to the Water Act 1989 and include special definitions for the Goulburn and Murray water systems (regulation 5 definitions as inserted by S.R. No. 62/2024). The confidentiality exception for “relevant assignments” is explicitly tied to assignments in those systems (regulation 32A(3)).

Who decides

• Payment obligations are set by the Regulations. Administrative discretion lies with the Registrar (waivers) and Authorities (fee exceptions). The Minister and the Act‑based decision makers retain statutory decision functions over the substantive merits of applications; these Regulations prescribe the fees and procedural adjuncts to those decisions (regulation 2).

The Regulations impose payment duties, confer limited administrative rights, and specify non‑publication rights for certain register fields. They also create procedural entitlements to fee waivers and online lodgement discounts.

Payment duties

• Applicants for the listed Act sections must pay the prescribed fee stated in fee units when initiating the application, unless a specific exception or waiver applies. For example, the prescribed fee for an application under section 33L(1) or 33M of the Act (issue of a water share) is 13.57 fee units (regulations 6-7). The prescribed fees for varying or dividing water shares, consolidations, surrender, cancellation and various place of take approvals are all set out in regulations 8-21 and 20A-20C. The amount to be paid in dollars is the fee‑unit multiple set under the Monetary Units Act 2004 (Endnotes).

Online lodgement entitlement and fee differentials

• Applicants have the right to use the automated lodgement process (the Victorian Water Register website) for qualifying processes (definition in regulation 5). Where the Regulations specify, an application lodged via the automated lodgement process attracts a lower prescribed fee than a non‑automated application (for example, regulation 13(a) v (b); regulation 20C(b)). That creates a non‑mandatory procedural entitlement that affects cost.

Registrar waiver right and discretion

• The Registrar has the right (discretion) to waive a fee specified in Division 1 or Division 2 (regulations 28 and 32). The Registrar must be “satisfied that there are circumstances justifying the waiver, including any hardship affecting the person liable to pay the fee” (regulation 28(3); regulation 32). For Division 1, the Registrar may also waive fees where the recording is a result of reaching an agreement under clause 17(2) of Schedule 15 to the Act (regulation 28(1)) or where a mortgage discharge relates to a mortgage deemed under clause 26 and lodged within 6 months of the appointed day (regulation 28(2)).

Authority exception right

• An Authority responsible for a water system can determine it is “appropriate” for a person to be excepted from paying an application fee for an assignment under section 33X(1)(c) of the Act (regulation 23). That is an administrative discretion residing in the System Authority and not automatically available to applicants.

Non‑publication and its limits

• The Regulations confer a non‑publication entitlement for specific fields in the register (regulation 32A(1)), so that certain names, addresses and particulars are not publicly available. That entitlement is subject to a concrete limit: if a person gives or receives more than 20 relevant assignments in a water season, the non‑publication does not apply to their name (regulation 32A(2)). The definition of “relevant assignment” is set out (regulation 32A(3)) and limits the scope to assignments in the Goulburn and Murray water systems.

Correction and amendment duties

• The Registrar may accept applications to correct or amend entries under section 84ZB of the Water Act; in most cases a prescribed fee applies (regulation 31). No prescribed fee is payable to correct or amend an address on the water register (regulation 31(1)(a)), but all other corrections attract the 8.71 fee‑unit fee unless waived under regulation 31(2).

Search fees and modes

• The Regulations create two modes for searching the register with different costs: an online search facility initiated by the applicant (1 fee unit) or a search performed by the Registrar with a hard‑copy result (1.91 fee units for current or non‑current information; 1 fee unit for documents) (regulation 30).

Sunset and amendment constraints

• The Regulations are subordinate legislation with a built‑in sunset rule under the Subordinate Legislation Act 1994: they will sunset 10 years after making (endnotes). The Regulations are already amended by S.R. No. 110/2023 and S.R. No. 62/2024; the making and commencement dates for those amendments are recorded in the endnotes. That creates a duty on administrators and stakeholders to monitor legislative changes and fee‑unit updates.

The Regulations primarily prescribe fees, confidentiality categories and administrative discretions; they do not themselves create standalone criminal offences or specify penalty rates. The enforcement posture is therefore administrative and relies on the underlying Water Act 1989 and the administrative machinery it establishes.

No express penalties in the instrument

• A review of the Regulations shows no provisions imposing fines, imprisonment or civil penalties; the instrument’s text sets out prescribed fees, waiver powers and non‑publication lists (Parts 2, 3, 3A, 4 and 5). Penalty types and enforcement mechanisms for non‑compliance with substantive obligations under the Water Act are matters of the Act, not these Regulations. Regulation 2 records that the Regulations are made under section 324 of the Water Act 1989, which is the legal base for subordinate fee and procedural prescriptions.

Administrative enforcement: Registrar and Minister actions

• Fee collection and register management are operationally controlled by the Registrar; the Registrar administers fee receipt and has discretion to waive specified fees (regulations 28 and 32). If an applicant does not pay the prescribed fee where required, the Registrar and the Minister may be able to refuse to accept or process an application , that is an inference from the Regulations’ role in prescribing conditions for applications, but any formal consequence for non‑payment will be governed by the Water Act and the Registrar’s practice directions, not by a penalty clause within these Regulations.

Authority exceptions and discretion

• An Authority may except an applicant from an application fee for certain assignment approvals (regulation 23). The Regulations do not prescribe a review right or appeal route against the exercise of that discretion within the instrument; appeal mechanisms, if any, will be those in the Act or administrative law (judicial review) principles. The Regulations do not create internal appeal processes for fee waivers or Authority exceptions.

Record confidentiality enforcement

• The prescribed non‑publication list (regulation 32A) is an instruction to the Registrar about which entries are not to be made publicly available under section 84X of the Act. The Registrar’s compliance with that prescription is an administrative duty. The Regulations do not elaborate enforcement or penalty mechanisms for wrongful disclosure; the Act may provide remedies or administrative sanctions beyond this instrument.

Practical enforcement considerations

• In practice, enforcement will be realised by the Registrar’s processes: refusal to record or to accept an application without payment; withholding public access to prescribed fields; and exercising waiver/exception discretions where applicable. Those procedural controls create practical sanctions (for example, inability to register a transfer until a fee is paid). These practical effects are created by the operational relationship between these Regulations and the Water Act.

Monitoring and temporal constraints

• The Regulations are subject to amendment (S.R. No. 110/2023 and S.R. No. 62/2024 are examples) and to the Subordinate Legislation Act 1994 sunset rule (endnotes). Compliance risk therefore includes keeping up with amending instruments and current fee‑unit values published by the Treasurer (Endnotes on Fee Units).

These Regulations are subordinate to, and operationally linked with, several other Acts which determine their legal effect and scope. The text cross‑references and relies on the Water Act 1989 and borrows definitions and enforcement architecture from other statutes.

Primary relationship: Water Act 1989

• The Regulations are made under section 324 of the Water Act 1989 (regulation 2). Nearly every application fee and register recording fee prescribed is tied to a specific Water Act provision (for example, prescribed fee for an application under section 33L(1) , regulation 6; recording a transfer under section 84J(1)(a) , regulation 24(a)). The Regulations do not alter substantive rights under the Water Act; instead they operationalise cost, registration and disclosure mechanics that plug into the Act’s decision and registry processes.

Monetary Units Act 2004 and fee calculation

• The Regulations use fee units as the currency of prescribed fees; the Endnotes instruct that fees are calculated by multiplying the number of fee units by the fee unit value as fixed under the Monetary Units Act 2004. The endnotes specify the fee unit value for the financial year commencing 1 July 2024 as $16.33 and provide for rounding to the nearest 10 cents.

Land Act 1958

• Regulation 33(2) draws on the Land Act 1958 definitions of licences and water frontage to determine eligibility for the prescribed licence purpose (watering cattle or other stock) in declared water systems. The prescribed purpose in regulation 33 is therefore conditional on historical or current licences under the Land Act.

Water Industry Act 1994 and Rural Water Authority

• Regulation 32A(3) adopts the Water Industry Act 1994 definition of Rural Water Authority for the purposes of prescribing non‑public water register information. That links the confidentiality rules to organisational structures defined by the Water Industry Act.

Subordinate Legislation Act 1994 and Interpretation of Legislation Act 1984

• The Endnotes record that the Regulations will sunset 10 years after making under the Subordinate Legislation Act 1994. The document also notes interpretation and style changes authorised by the Interpretation of Legislation Act 1984. These cross‑references change how headings, notes and punctuation are treated for legal interpretation.

Relationship to Schedule provisions of the Water Act

• Several waiver conditions and recording categories reference Schedules to the Water Act, notably Schedule 12A (mortgage clauses) and Schedule 15 (arbitration, clause 17 agreements, deemed mortgages and appointed day consequences). For example, recording a mortgage follow the Schedule 12A clauses and the Registrar may waive discharge recording fees where the mortgage was deemed and discharged within time under Schedule 15 (regulation 28(2); regulation 25(1)-(6)).

Interaction with electronic service infrastructure

• The automated lodgement process is the Victorian Water Register website; the Regulations provide an explicit cost differential to encourage use of the online facility for certain filings (see definitions and regulations 13, 20C, 21). That operational link implies interaction with the Victorian Government’s digital service provisions and policies (not set out in the Regulations).

Amendment and revocation history

• The Regulations revoke earlier Water (Resource Management) regulations as listed in regulation 4 and have themselves been amended by S.R. No. 110/2023 and S.R. No. 62/2024 (Endnotes, Table of Amendments). Users must therefore treat these Regulations as part of an evolving subordinate law set interacting with the Water Act and other Acts cited above.

The Regulations have been amended since first made and the instrument records those changes in regulation headings and in the Endnotes.

Original making and commencement

• The Water (Resource Management) Regulations 2017 were made on 28 November 2017 under section 324 of the Water Act 1989 and commenced on 29 November 2017 (regulations 2-3; Endnotes). They replaced the earlier Water (Resource Management) Regulations 2007 and several amending instruments (regulation 4 lists the revoked instruments).

Notable amending instruments recorded in the Endnotes

• Water (Resource Management) Amendment (Fees) Regulations 2023, S.R. No. 110/2023:

  • Date of making: 24 October 2023
  • Date of commencement: 20 November 2023 (Endnotes, Table of Amendments)
  • This amending rule altered fee provisions (multiple regulations bear substitution or insertion notes e.g. regulations 19-21, 20A-20C, definitions in regulation 5, and the insertion of certain group application definitions), as indexed in the text by “amended by S.R. No. 110/2023”.

• Water (Resource Management) Amendment Regulations 2024, S.R. No. 62/2024:

  • Date of making: 25 June 2024
  • Date of commencement: 1 July 2024 (Endnotes, Table of Amendments)
  • This amending instrument inserted Part 3A (regulation 32A) prescribing records not publicly available, and added Goulburn and Murray water system definitions (regulation 5 defns) and other textual changes noted in several places.

Revocations and prior instruments

• Regulation 4 explicitly revokes prior instruments, including the 2007 Regulations and various amendment Regulations up to 2014. The Endnotes re‑state the revocations and mention earlier S.R. numbers.

Textual amendment notes

• Throughout the text, multiple regulations show marginal notes indicating substitution, insertion or amendment by S.R. No. 110/2023 or S.R. No. 62/2024 (for example regulation 19 substituted by S.R. No. 110/2023 reg. 9; regulation 32A inserted by S.R. No. 62/2024 reg. 8). These marginal notes record the legislative edit trail embedded in the consolidated version.

Fee‑unit value updates and rounding

• The Endnotes include an explanatory detail about fee units and explicitly list the value of a fee unit for 2024-25 as $16.33, and state that the Treasurer will fix future values under the Monetary Units Act 2004 and they must be published before 1 June in the preceding financial year. That endnote is part of the instrument’s operative explanatory material and is directly relevant to understanding monetary charges.

Sunset

• The Endnotes record the statutory sunset under the Subordinate Legislation Act 1994: the Regulations will sunset 10 years after the day of making (28 November 2027), requiring renewal or replacement unless otherwise extended.

Practical effect of amendments

• The 2023 and 2024 amending rules changed the fee schedule, inserted non‑publication rules and adjusted definitions. Practitioners must treat the consolidated instrument as the operative law but should be mindful of the discrete amendments (S.R. No. 110/2023; S.R. No. 62/2024) that altered fees and confidentiality rules, and monitor any further instruments before the sunset date.

The consolidated text of the Regulations, including endnotes and the table of amendments, does not cite or record any litigation, judicial determinations or appellate review of these Regulations. The instrument contains no cases, judicial notes or references to litigation outcomes.

Accordingly:

• There is no litigation history recorded in the Regulations themselves.
• Any challenge to the way the Registrar or an Authority applies these Regulations (for example, refusal to waive a fee, denial of an Authority fee exemption, or alleged wrongful public disclosure contrary to regulation 32A) would proceed under the Water Act’s administrative review mechanisms or general judicial review channels in public law, but the Regulations do not record or attach case law or reported decisions.

Practitioners should therefore treat the absence of cited litigation as an absence of precedent recorded within the instrument. For decisions, appeal rights and case law relating to application of these fee, recording and disclosure rules, one must look to decisions under the Water Act 1989, administrative law authorities and any reported cases external to this Regulations text.

The Regulations contain several operational traps and practical conditions that can catch practitioners and applicants if not attended to carefully. These are granular, statutory and procedural, not policy judgements.

Fee differentials for automated lodgement

• Several fees are materially lower if lodged via the automated lodgement process (Victorian Water Register website) rather than by other means: regulation 13 (water allocation assignment), regulation 20C (external place of take approval regarding a relevant water allocation), regulation 21 (particular place of take approval) and regulation 22(h) (water allocation group application). The fee differentials can be substantial relative to small filings. Failure to use the online route where it is available will increase direct transaction cost.

Complex group‑application definitions

• Group application categories in regulation 5 are defined by cross‑reference to many Water Act sections (e.g. sections 33X(1)(a) with 33TB, 33R, 64FZK etc.). Mistakenly classifying an application as a group application (or failing to identify a qualifying group) can lead to overpayment (or underpayment and processing issues). Reg 22 prescribes single fees for qualifying group applications; practitioners must map the specific combination of statutory applications precisely to the defined group.

Authority discretion for fee exceptions

• Regulation 23 allows an Authority to except a person from paying an application fee for certain assignment approvals. That is discretionary and requires the Authority to “consider it appropriate”. There is no procedural checklist in the Regulations. Applicants relying on an Authority exception should secure written confirmation from the Authority before assuming fee relief.

Waiver discretion and evidentiary thresholds

• The Registrar may waive recording and search fees if satisfied there are circumstances justifying the waiver, including hardship (regulations 28 and 32). However, the Regulations do not stipulate exact evidentiary thresholds or timelines. Expect case‑by‑case administrative discretion and document hardship or error (for example, where the Registrar made an error) as part of any waiver application.

Non‑publication exceptions tied to activity thresholds

• Regulation 32A protects name and address fields for many allocation holders, but subregulation (2) removes protection if the person gives or receives more than 20 relevant assignments in a water season. The “relevant assignment” definition is limited to assignments of allocations that may be taken in the Goulburn or Murray water systems (regulation 32A(3)). Practitioners often assume confidentiality is absolute; here it is conditional on a numerical activity threshold tied to specific systems. That creates a transparency threshold for high‑frequency traders or brokers.

Mortgage discharge and appointed day timing

• The Registrar may waive the prescribed fee for recording a discharge of a mortgage if the discharge relates to a mortgage deemed to be a mortgage over a water share under clause 26 of Schedule 15 and the discharge recording is lodged within 6 months after the appointed day within the meaning of the Act (regulation 28(2)). Missing that 6‑month window would forfeit the waiver even where the mortgage was deemed. Practitioners must note the appointed day reference in the Schedule to the Act.

Search modes and fees

• Searching online costs 1 fee unit (regulation 30(a)), whereas a Registrar‑conducted search that yields a hard copy of current or non‑current information costs 1.91 fee units (regulation 30(b)(i)-(ii)). If a searcher requires a Registrar to perform or certify the search, expect higher fees. Also, a Registrar search for documents is 1 fee unit (regulation 30(b)(iii)). Distinguish between “current information”, “non‑current information” and “documents” when instructing searches.

Address corrections are free; other corrections attract fee

• No prescribed fee applies to correction or amendment of an address recorded on the water register (regulation 31(1)(a)). All other corrections attract the 8.71 fee‑unit fee unless they result from Registrar error or clause 17(2) Schedule 15 agreement (regulation 31(2) and 28(1)). That creates a specific small relief avenue but leaves other corrections chargeable.

Fee‑unit volatility and rounding

• The monetary amount of each prescribed fee changes as the Treasurer fixes the fee‑unit value each financial year (Endnotes). The instrument also allows rounding to the nearest 10 cents. Practitioners must confirm the current fee‑unit dollar value before quoting clients or transferring funds.

Sunset risk

• The Regulations are subject to a sunset under the Subordinate Legislation Act 1994 (endnotes). They will cease operation on 28 November 2027 unless re‑made or extended. That introduces a temporal compliance risk: transitional or replacement rules may apply if the instrument is not renewed.

Interconnectedness with the Water Act and Schedules

• Many waiver and recording provisions are tied to Schedules in the Water Act (Schedule 12A and Schedule 15). Failing to check the Schedules (for appointed day, deemed mortgage rules, clause 17(2) agreements) can result in missed waiver eligibility.

No internal appeal mechanics for fee decisions in the Regulations

• The Regulations do not contain specific appeal routes for refusals to waive fees or for Authority decisions on exceptions. Administrative review or judicial review under general law may be the only recourse; plan for potential time and cost of external review where disagreements arise.

This section lists concrete steps and documentary checks to minimise cost, obtain confidentiality protection where eligible, and take advantage of waiver and grouping options. All references below relate to the cited Regulations.

1. Identify the correct statutory application(s) under the Water Act

• Map the intended transaction to the exact Water Act section(s) referenced in the definitions and fee schedules (for example, issue of a water share: s 33L(1) , reg 6; particular place of take approval: s 64FZK , regs 20C and 21). Use the group application definitions in regulation 5 to determine whether multiple applications made together qualify for a single prescribed fee under regulation 22. Precise mapping avoids overpayment and prevents wrong‑category filings.

2. Use the automated lodgement process where possible

• Where the fee is lower for automated lodgement (regulation 13(a), 20C(b)(i), 21(a), 22(h)(i)), submit via the Victorian Water Register website. Confirm the online form supports the specific combination of applications you need (automated lodgement applies to particular filing types). The automated lodgement process is defined at regulation 5 and the website is publicly identified in the note.

3. Calculate fees using current fee‑unit value

• Multiply the prescribed fee in fee units by the fee‑unit dollar value fixed under the Monetary Units Act 2004 and published by the Treasurer for the relevant financial year (Endnotes , Fee Units). Round to the nearest 10 cents as permitted. Check the Treasurer’s Gazette notice before lodging payments to avoid underpayment.

4. Bundle qualifying applications into group applications when advantageous

• If multiple statutory applications qualify as a water share change group, consolidation, divide, issue, transfer, water limited term transfer group, or water allocation group (definition in regulation 5), lodge them together to take advantage of the single prescribed fee under regulation 22. Document the grouping in the lodgement so the Registrar can apply the correct fee.

5. Prepare documentary evidence for waiver or Authority exception

• If seeking a Registrar waiver under regulation 28 or 32 (hardship, Registrar error, clause 17(2) Schedule 15 agreement), prepare a concise statement of facts and supporting documents explaining hardship or error. For an Authority exception under regulation 23, obtain written evidence from the Authority that it “considers it appropriate” to except the fee and keep that on file before relying on the exception.

6. For confidentiality, check the 20‑assignment threshold and system coverage

• If you expect names and addresses to be non‑public under regulation 32A(1), confirm whether the person gives or receives more than 20 relevant assignments in a water season. If the threshold is exceeded, the name will be public (regulation 32A(2)-(3)). Note that “relevant assignment” is linked to the Goulburn or Murray systems (regulation 32A(3)). If confidentiality is critical, monitor assignment counts and consider structuring trades accordingly, subject to legal and tax advice.

7. Register occupiers correctly

• For water‑use registration, identify whether you are a prescribed occupier under regulation 34 (Water Holder; incorporated supplier/delivery body; road construction/maintenance operator; dust suppression operator). Ensure registration records reflect the correct occupier identity and, where necessary, supporting documentation (for example proof of incorporation for supply bodies).

8. Use the free address correction rule where applicable

• If the only amendment required is correction of an address on the register, no prescribed fee applies (regulation 31(1)(a)). For all other corrections, budget for the 8.71 fee‑unit prescribed fee unless the circumstances meet waiver conditions in regulation 31(2) or 28.

9. Mortgage and finance transactions: note recording fees and potential waivers

• Mortgage recordings and variations have set fees (regulation 25). If dealing with a mortgage that was deemed under Schedule 15 clause 26, and a discharge is to be recorded within the 6‑month appointed day window, document timing carefully to rely on the Registrar’s potential waiver (regulation 28(2)).

10. Choose search mode to control cost

• For internal due diligence, use the online search facility (1 fee unit, regulation 30(a)). If a certified search or hard copy is required, expect the Registrar‑conducted search fees (1.91 fee units for current or non‑current information, regulation 30(b)). Confirm whether “documents” classification applies (1 fee unit under regulation 30(b)(iii)).

11. Keep records of fees, waivers and Authority decisions

• Maintain copies of fee payments, fee unit calculations, waiver applications and Authority exception confirmations. The Regulations do not provide a bespoke appeals procedure for fee decisions; administrative documentation helps preserve review options under the Act or judicial review.

12. Monitor legislative changes and the sunset timetable

• The instrument has already been amended (S.R. No. 110/2023; S.R. No. 62/2024) and will sunset in November 2027 unless re‑made (Endnotes). Assign responsibility internally to check for amending instruments and the Treasurer’s fee‑unit notice each year.

13. Seek confirmation before relying on nuanced provisions

• For borderline issues (for example, whether a set of filings constitutes a group application or whether a person qualifies as a prescribed occupier), obtain written confirmation from the Registrar or Authority in advance where possible. Where uncertainty persists, document the legal basis relied upon in lodgement materials.

Following those steps aligns practical filing conduct with the prescriptions and discretionary pathways established in the Regulations (see regulations 6-33, 24-32A, and related definitions).
