sec.44 Criteria and application of criteria— Act , s 39

For section 39 (c) of the Act , the criteria for establishing the elements of proposed water allocations to be granted on conversion from a water entitlement or other authorisation (each an existing authorisation ) are— to the extent a relevant water plan applies the criteria stated in subdivision 2 or 3 —the criteria; and any criteria in a relevant water plan for converting an existing authorisation to a water allocation. If there is an inconsistency between criteria mentioned in subsection (1) (a) and criteria mentioned in subsection (1) (b) , the criteria mentioned in subsection (1) (b) prevail. (sec.44-ssec.1) For section 39 (c) of the Act , the criteria for establishing the elements of proposed water allocations to be granted on conversion from a water entitlement or other authorisation (each an existing authorisation ) are— to the extent a relevant water plan applies the criteria stated in subdivision 2 or 3 —the criteria; and any criteria in a relevant water plan for converting an existing authorisation to a water allocation. (sec.44-ssec.2) If there is an inconsistency between criteria mentioned in subsection (1) (a) and criteria mentioned in subsection (1) (b) , the criteria mentioned in subsection (1) (b) prevail.

• (a) to the extent a relevant water plan applies the criteria stated in subdivision 2 or 3 —the criteria; and
• (b) any criteria in a relevant water plan for converting an existing authorisation to a water allocation.
