sec.21 Granting of water permits
This section applies to an application for the granting of a water permit to take water from a waterhole or lake. If a person applies for a water permit to take water from a waterhole or lake mentioned in schedule 5 , section 1 , the person must provide the chief executive with information about the total volume and current water level of the waterhole or lake. In deciding the application for a water permit, the chief executive must consider the following— the purpose for which the water is required; the total volume and current level of the waterhole or lake; the extent to which water is being taken from the waterhole or lake by existing authorisations; the availability of an alternative water supply for the purpose for which the water is required; the impact the proposed taking of, or interfering with, the water may have on— the drawdown level of the waterhole or lake; and the ecological values of the waterhole or lake; and any cultural values associated with the waterhole or lake, including, for example, cultural values of local Aboriginal communities. s 21 amd 2016 SL No. 216 s 146 sch 20 (sec.21-ssec.1) This section applies to an application for the granting of a water permit to take water from a waterhole or lake.
