6 Limitations on functions of Regulatory Authority
(1) For the Act, section 64AA(a), the Regulatory Authority must not exercise the functions of a regulatory authority in relation to the following—
(a) activities authorised under an environment protection licence,
(b) a non-scheduled activity authorised or controlled by an environment protection licence.
Note—
The appropriate regulatory authority in relation to the activities listed in this subsection will generally be the EPA.
(2) The Regulatory Authority must not exercise the functions of a regulatory authority in relation to the activities of Water NSW if the regulatory authority for the functions is Water NSW.
