38A Permeable structures to enhance geomorphic processes

A person is exempt in relation to the construction or use of a permeable structure on the bed of a river for the purpose of enhancing geomorphic processes to control the flow of the river, but only if—

(a) the impounding of water caused by the structure is the minimum necessary to achieve this purpose, and

(b) the structure does not obstruct the passage of fish through the river, and

(c) the work is subject to a controlled activity approval.
