What it does
This statutory instrument removes the requirement for a Part 8 permit under the Water Management Act 1999 for a defined list of dam works. Clause 4(1) provides an exhaustive list of specified categories of works in relation to dams and spillways for which a Part 8 permit is not required. The exemptions include limited repair activities to dam walls and spillways, specified maintenance and protection works, vegetation removal, de-silting (subject to constraints), certain fish-pass works subject to fisheries consent, placement of protective materials to prevent erosion, repairs to outlet pipes or control valves that do not reduce flow capacity, and installation of devices to measure water flow where required by statute or installed by a government agency for resource management (cl 4(1)(a)-(j)). The order defines terms that are used to delimit the exemptions, including batter slope, earth-fill embankment dam wall, flood capacity, main dimensions of a dam wall, and spillway (cl 3(1)).
Mechanically, the order operates by creating a negative regulatory effect: it removes an administrative prerequisite (a Part 8 permit) that would otherwise apply under the Water Management Act 1999. The commencement provision makes the order effective on publication in the Gazette (cl 2). The order is expressed to be administered by the Department of Primary Industries, Water and Environment, and its publication details are recorded (notified 31 August 2005). The Acts Interpretation Act 1931 is expressly applied to the interpretation of this order, as if the order were by-laws (cl 3(3)). The order does not itself create offences or penalty provisions; it simply states that a permit under Part 8 of the Act is not required for the listed works (cl 4(1)). Works that fall outside the stated categories remain subject to the permit regime under Part 8 of the Water Management Act 1999.
