#### 91AA Consultation with Dams Safety NSW in relation to approvals for dams and flood retarding basins 91AA Consultation with Dams Safety NSW in relation to approvals for dams and flood retarding basins > > (1) This section applies in relation to the following kinds of water management work approvals— > > > > > (a) a water supply work approval for the construction or use of a water supply work comprising— > > > > > > > (i) a declared dam within the meaning of the [Dams Safety Act 2015](/view/html/inforce/current/act-2015-026), or > > > > > > > (ii) a dam or proposed dam that is of a class prescribed by the regulations, > > > > > (b) a flood work approval for the construction or use of a flood retarding basin that is of a class prescribed by the regulations. > > > (2) Without limiting any other provision of this Part, the Minister must, before granting a water management work approval to which this section applies or before amending any such approval— > > > > > (a) refer the application for the approval or amendment to Dams Safety NSW, and > > > > > (b) take into consideration any matters that are raised by Dams Safety NSW in relation to the application within 28 days (or such other period as is agreed between the Minister and Dams Safety NSW) after the application is referred to Dams Safety NSW. > > > (3) In this section— > > > > > (a) a reference to a water management work of any kind includes a reference to a corresponding kind of work to which Part 2 or 8 of the [Water Act 1912](/view/html/inforce/current/act-1912-044) extends, and > > > > > (b) a reference to a water management work approval includes a reference to an entitlement (within the meaning of clause 2 of Schedule 10) that confers a corresponding authority, and > > > > > (c) a reference to the Minister includes, in the case of any such entitlement that confers a corresponding authority, a reference to the Ministerial Corporation. > > **s 91AA:** Ins 2015 No 26, Sch 3.9\[2\].
