#### 353FA Recovery of monetary benefits from related persons 353FA Recovery of monetary benefits from related persons > > (1) This section applies if the Land and Environment Court finds a corporation has contravened a provision of this Act or the regulations. > > > (2) The Minister may apply to the Court for an order that a related person of the corporation pay an amount estimated to be the monetary benefit obtained by the related person as a result of the contravention. > > > (3) The Court may, in making an order under this section, take the matters in section 353F(2) into account. > > > (4) The Court may make an order under this section only if satisfied, on the balance of probabilities, that the related person obtained the estimated monetary benefit as a result of the contravention. > > **s 353FA:** Ins 2025 No 70, Sch 3\[118\].
