#### 328 Stop work order regarding unlawful controlled activity or aquifer interference activity 328 Stop work order regarding unlawful controlled activity or aquifer interference activity > > (1) This section applies to a controlled activity or aquifer interference activity that, in the Minister’s opinion, is being carried out, or is about to be carried out, in contravention of this Act. > > > (2) The Minister may, by order in writing served on any person carrying out the controlled activity or aquifer interference activity, direct the person to take specified measures— > > > > > (a) to prohibit or discontinue that activity, or > > > > > (b) to carry out that activity only as specified. > > > (3) Without limiting subsection (2), the landholder on whose land a controlled activity or aquifer interference activity is being carried out, or is proposed to be carried out, is taken to be carrying out that activity. > > Note. > > See also section 11 (1) (e) of the [Natural Resources Access Regulator Act 2017](/view/html/inforce/current/act-2017-064) and Schedule 2 to that Act. > > **s 328:** Subst 2008 No 73, Sch 2 \[2\].
