#### 232 Powers of entry and inspection 232 Powers of entry and inspection > > (1) A private water trust may, by its employees or agents, enter onto land on which trust works are situated, or any other land, for the following purposes— > > > > > (a) to carry out any of the trust’s functions in relation to trust works, > > > > > (b) to read a meter that measures water supplied by the trust or monitors drainage for quantity or quality or both, > > > > > (c) to carry out investigations or inspections, take levels, drill test bore-holes, dig trenches, make surveys and marks, and fix pegs and stakes, for the purposes of designing, constructing or determining the site of a proposed trust work, > > > > > (d) to remove samples of materials from the land for the purpose of carrying out trust functions, but only if the landholder has been consulted and the views of the landholder have been considered, > > > > > (e) to exercise any other powers that are incidental to the trust’s functions that are reasonably necessary for carrying out those functions. > > > (2) The powers of entry conferred by this section are not to be exercised for a purpose referred to in subsection (1) (a), (c) or (d) without prior notice to the landholder of the land. > > > (3) The trust must ensure that as little damage as possible is caused by the exercise of powers under this section and must repair any damage caused or pay compensation for the damage. > > **s 232:** Am 2007 No 94, Sch 2; 2009 No 17, Sch 3.22 \[2\].
