49 Hydro-electric generation
Subject to this Act, a person who has lawful access to a watercourse or lake may use water from the watercourse or lake for the purpose of generating electricity if the use does not –
(a) [Section 49 Amended by No. 49 of 2002, s. 9, Applied:01 Mar 2003] cause material environmental harm or serious environmental harm or significant detrimental effects to other users; and
(b) contravene any other Act.
