280 Suspension of decision pending appeal or review

(a) [Section 280 Subsection (1) amended by No. 36 of 2023, s. 22, Applied:11 Dec 2023] a decision to which this Division or Division 1 applies has been made, given or imposed by the Minister, an irrigation entity as defined in section 226A or a water entity; and
(b) [Section 280 Subsection (1) amended by No. 56 of 2008, s. 117, Applied:11 Feb 2009] [Section 280 Subsection (1) amended by No. 36 of 2023, s. 22, Applied:11 Dec 2023] the Minister, entity or Appeal Tribunal is satisfied that an appeal or review against the decision has been instituted or is intended –
the Minister, entity or Tribunal may suspend the operation of the decision until the determination of the appeal or review.
(2) [Section 280 Subsection (2) amended by No. 36 of 2023, s. 22, Applied:11 Dec 2023] The suspension may be terminated by the Minister, entity or Tribunal at any time.
