sec.58 Application of div 3

This division applies if an authorised person reasonably believes— a public potable water supplier— is contravening a provision of this Act; or has contravened a provision of this Act in circumstances that make it likely the contravention will continue or be repeated; and a matter relating to the contravention or likely repeated contravention (in either case the contravention ) can be remedied; and it is appropriate to give the public potable water supplier an opportunity to remedy the matter. s 58 amd 2012 No. 39 s 84C

• (a) a public potable water supplier— (i) is contravening a provision of this Act; or (ii) has contravened a provision of this Act in circumstances that make it likely the contravention will continue or be repeated; and
• (i) is contravening a provision of this Act; or
• (ii) has contravened a provision of this Act in circumstances that make it likely the contravention will continue or be repeated; and
• (b) a matter relating to the contravention or likely repeated contravention (in either case the contravention ) can be remedied; and
• (c) it is appropriate to give the public potable water supplier an opportunity to remedy the matter.
• (i) is contravening a provision of this Act; or
• (ii) has contravened a provision of this Act in circumstances that make it likely the contravention will continue or be repeated; and
