Water Efficiency Labelling and Standards (South Australia) Act 2013

The Water Efficiency Labelling and Standards (South Australia) Act 2013 is a machinery Act that adopts the Commonwealth Water Efficiency Labelling and Standards Act 2005 (and its associated regulations, guidelines, principles, standards and codes of practice) as a law of South Australia. This is a classic applied‑law model: rather than enacting a separate state scheme in identical terms, South Australia simply picks up the Commonwealth scheme, with the Commonwealth regulator (the WELS Regulator) administering both as a single set of rules. The object, stated in section 4(1), is to achieve a uniform Australian approach to water efficiency labelling and standards.

Mechanically, section 5(1) provides that the Commonwealth water efficiency laws, as in force from time to time and as modified by or under this Act, apply as a law of the State. That means future amendments to the Commonwealth Act automatically become part of South Australian law unless the SA regulations specify otherwise under section 6(2). The applied laws extend to matters within South Australia’s legislative competence, even if the Commonwealth cannot make laws on those matters (section 5(2)), and even if the Commonwealth Act itself purports to apply only to federal matters. This ensures the scheme catches every product supplied in the State, not only those falling under the Commonwealth’s constitutional heads of power.

Part 4 then treats any offence against the applied provisions as if it were an offence against a law of the Commonwealth. Commonwealth criminal laws (including the Criminal Code, procedures for investigation, arrest, bail, trial, sentencing, fines, proceeds of crime and spent convictions) apply as state laws for those prosecutions. Part 5 does the same for administrative laws: the Administrative Review Tribunal Act 2024 (excluding Part 7), the Freedom of Information Act 1982, the Ombudsman Act 1976 and the Privacy Act 1988 apply to matters arising under the adopted scheme as if it were a Commonwealth law. The result is that a single regulator enforces one set of rules across participating jurisdictions, with review, FOI, and privacy rights handled under the Commonwealth regime. Fees, penalties and fines are paid to the Commonwealth (section 19). The Act binds the Crown (section 16) and allows regulations under section 20 to modify the applied provisions or disapply certain double‑jeopardy protections.

The Act replaces an earlier standalone Act (Water Efficiency Labelling and Standards Act 2006) that was repealed upon commencement. The only amendment recorded in the legislative history is the 2025 Statutes Amendment (Administrative Review Tribunal) Act 2025, which updated references from the former Administrative Appeals Tribunal to the new Administrative Review Tribunal. The Act is now the sole South Australian legislative base for the WELS scheme, and its effectiveness depends almost entirely on the content and enforcement of the Commonwealth parent Act.

Applied provisions. Defined in section 3(1) as the Commonwealth water efficiency laws that apply as a law of this State under section 5, including any modifications made by SA regulations. Because the Commonwealth water efficiency laws include not only the Water Efficiency Labelling and Standards Act 2005 but also all regulations, guidelines, principles, standards and codes of practice under that Act, the scope of “applied provisions” is wide and dynamic. Amendments to any of those instruments at the Commonwealth level automatically flow into South Australian law unless the SA regulations expressly exclude the amendment under section 6(2).

Commonwealth water efficiency laws. The definition in section 3(1) covers the principal Commonwealth Act and everything subordinate to it: regulations, guidelines, principles, standards and codes of practice. The Commonwealth Act itself sets up the WELS Regulator, the registration system for water‑using products, labelling requirements, minimum water‑efficiency standards, record‑keeping and compliance powers. By adopting the entire package, South Australia avoids drafting its own detailed rules and instead ties its scheme to the Commonwealth’s ongoing legislative and policy choices.

Commonwealth Regulator. The WELS Regulator appointed under the Commonwealth Act is given the same functions and powers under the applied provisions as they hold under the Commonwealth scheme (section 8). Delegations by the Regulator are automatically extended to the corresponding state provisions (section 9). This centralisation means that a business dealing with the scheme anywhere in Australia deals with a single regulator, which reduces duplication but also removes any state‑level flexibility.

Modification power. Section 6(1) gives the Governor power to modify the Commonwealth water efficiency laws via regulations for the purposes of this Act. Section 6(2) specifically allows the regulations to provide that an amendment to the Commonwealth Act (specified in the regulations) is treated as not having taken effect for South Australia. This is a safety valve: if South Australia considers a future Commonwealth amendment undesirable, it can delay or reject it. However, the default is automatic adoption, so the burden of actively exempting an amendment falls on the state government.

No double jeopardy. Section 13 provides that if an act or omission is an offence against both the applied provisions and the Commonwealth water efficiency laws, and the offender has been punished under the Commonwealth laws, they are not liable to be punished under the applied provisions. This prevents double punishment across the two regimes, consistent with the cooperative scheme’s aim of unified enforcement.

The Act itself is an enabling statute, but the substantive obligations flow from the Commonwealth water efficiency laws it adopts. The people and entities affected are those covered by the WELS scheme: manufacturers, importers, retailers, suppliers and installers of water‑using products. Products typically caught include taps, showers, toilets, urinals, washing machines, dishwashers, flow controllers, and any other product prescribed under the Commonwealth regulations that must carry a water‑efficiency label and, for some, meet minimum standards. The Commonwealth scheme also affects trade and professional bodies that represent those industries, as well as laboratories that certify product testing.

Consumers are affected indirectly: they see the rating label on products, and the scheme influences the range of products on the market (because low‑efficiency products may be banned from sale). But the Act imposes no direct obligations on consumers; it targets those at the point of first supply.

South Australian businesses that manufacture or import WELS‑registered products face compliance costs: product testing, registration fees, label printing, record‑keeping, and the risk of penalties for non‑compliance. Because the scheme is uniform, those costs are the same regardless of which state the product is supplied in, which reduces the compliance burden for operators active in multiple states compared with having separate state schemes. However, the uniform scheme also eliminates any competitive advantage South Australia might have sought through a lighter touch, and it locks in the Commonwealth’s regulatory settings, which may not suit the local market.

The Crown in right of South Australia is bound (section 16), so government agencies that purchase or supply water‑using products must also comply, subject to any exemptions in the Commonwealth regulations. The Act also binds the Crown in all other capacities so far as the legislative power of Parliament permits, which likely covers Commonwealth and other state governments when acting in South Australia.

Lawyers, compliance officers and journalists who track regulatory developments will need to monitor Commonwealth amendments, because those amendments apply automatically in South Australia unless the SA regulations take the rare step of disapplying them. The Act’s interlocking with Commonwealth criminal and administrative laws means that enforcement, review and privacy matters are handled by Commonwealth bodies. South Australian courts and police have limited involvement: section 11(2)(b) says an offence against the applied provisions is taken not to be an offence against the laws of this State, so the South Australian criminal justice system is effectively bypassed. That may affect state revenue (fines go to the Commonwealth) and local prosecutorial priorities.

All duties under this Act derive from the Commonwealth water efficiency laws as applied. The key duties, though not spelled out in the South Australian Act itself, include:

• Registration of products. Before supplying a WELS‑regulated product in South Australia, the manufacturer or importer must register it on the national WELS register and hold a valid registration for that model.
• Labelling. Each product must display a WELS star‑rating label showing water consumption and efficiency rating, in the form and size prescribed. The label must be attached at the time of supply and must not be removed or defaced.
• Minimum water‑efficiency standards. For some product categories, the product must meet a prescribed minimum standard (e.g., maximum flow rate for showerheads). Products that do not meet the standard are banned from sale.
• Record‑keeping. Registered persons must keep records of supply, testing results, and label specifications as required by the Commonwealth regulations.
• Advertising compliance. Advertisements for WELS‑regulated products must not make false or misleading claims about water efficiency and must, where required, include the star rating.

The principal rights affected persons have under the scheme include:

• Merits review. Under the applied Administrative Review Tribunal Act 2024 (excluding Part 7), a person whose interests are affected by a reviewable decision of the WELS Regulator can apply to the Administrative Review Tribunal for merits review. Decisions covered typically include registration refusals, cancellations, and compliance notices.
• Freedom of information. The applied FOI Act gives a right to access documents held by the WELS Regulator relating to the scheme, subject to exemptions.
• Ombudsman complaints. The applied Ombudsman Act 1976 allows complaints about defective administration by the Regulator.
• Privacy protections. The applied Privacy Act 1988 regulates the handling of personal information by the Regulator and imposes obligations to protect privacy.
• No double punishment. Section 13 protects an offender from being punished twice when an act is an offence under both the state and Commonwealth versions of the scheme.

The South Australian Act does not itself set penalty amounts; those are contained in the Commonwealth water efficiency laws it adopts. The Commonwealth Act prescribes penalties for offences such as supplying an unregistered product, failing to label, making false representations, or failing to keep records. Penalties may be expressed in penalty units (which under the Commonwealth Crimes Act are adjusted periodically) and can include fines and, for serious offences, criminal prosecution. The applied provisions include the possibility of infringement notices (on‑the‑spot fines) for minor breaches.

The distinctive feature of this Act is that offences against the applied provisions are treated as if they were offences against a law of the Commonwealth for procedural purposes. Section 11(1) applies the “relevant Commonwealth laws” - which include the Criminal Code, the Crimes Act, the Commonwealth Director of Public Prosecutions Act, the Judiciary Act, the Proceeds of Crime Act and the Spent Convictions Scheme - as state laws for the investigation and prosecution of those offences. Section 11(2) deems the offence to be an offence against the laws of the Commonwealth and not against the laws of South Australia. This means:

• The Commonwealth DPP prosecutes, not the SA DPP.
• Commonwealth police (or the WELS Regulator’s inspectors, who are likely appointed as Commonwealth officers) investigate.
• Federal courts may have jurisdiction, but section 14(4) denies any provision that purports to confer jurisdiction on a federal court in relation to administrative matters. However, for criminal matters, the Commonwealth laws applied under section 11 may confer jurisdiction on federal courts (the Act does not explicitly limit that). Practitioners would need to check the interaction with the Judiciary Act and state jurisdiction.
• Fines, penalties and forfeitures are paid to the Commonwealth (section 19), not to South Australian consolidated revenue.

The object of Part 4 (section 10) is to enable seamless treatment of offences as Commonwealth offences. The justification is uniform enforcement: a single prosecutorial body, consistent procedures, and avoidance of forum‑shopping by businesses. The cost is that South Australia loses control over enforcement priorities: the Commonwealth DPP may not pursue cases the state would, and vice‑versa. The double‑jeopardy protection in section 13 ensures that if the Commonwealth has already punished an offender for the same act under the Commonwealth Act, the state cannot punish again. This is a necessary protection, but it also means that if the Commonwealth declines to prosecute, the state cannot step in under its own laws because the offence is deemed not to be a state offence.

The Act expressly overrides the South Australian Acts Interpretation Act 1915 for the interpretation of the applied provisions; instead, the Commonwealth Acts Interpretation Act 1901 applies (section 7). This avoids interpretive inconsistency when reading the adopted provisions: a word defined in the Commonwealth Act will carry the same meaning in South Australia. However, it also means that South Australian interpretive rules about, for example, the use of extrinsic materials or the effect of headings, do not apply.

The applied provisions are taken not to be an offence against the laws of this State (section 11(2)(b)). That does not remove other state laws that might apply to the same conduct, such as the Australian Consumer Law (South Australia) or the Fair Trading Act. A product that fails to meet WELS labelling requirements could also be misleading or deceptive under the ACL. The Commonwealth WELS Act does not exclude other laws, so the two regimes can run in parallel. However, the double‑jeopardy protection only applies within the WELS scheme itself; it does not prevent separate action under the ACL for the same conduct.

Section 17 provides that the validity of a licence, certificate or other thing issued under the applied provisions is not affected merely because it was also issued for the purposes of the Commonwealth water efficiency laws. This is a practical point: a single registration certificate can serve both schemes.

The Act binds the Crown (section 16), so the South Australian government must comply. That overrides any common law immunity the Crown would otherwise have regarding the scheme.

The interaction with Commonwealth criminal laws is extensive because of section 11. That means the Commonwealth Criminal Code’s fault elements, complicity provisions, corporate criminal responsibility, and extended jurisdiction rules apply. For example, a company that supplies a product without a label may face the Code’s corporate liability framework (which attributes knowledge of officers to the company). Practitioners need to be familiar with the Code to advise clients on potential defences.

The administrative laws applied in Part 5 overlay the Commonwealth regime on the state activity. The decision‑maker for merits review is the Administrative Review Tribunal, which is a Commonwealth tribunal. The South Australian Civil and Administrative Tribunal (SACAT) is given no role under this Act. Similarly, FOI requests go to the Commonwealth Information Commissioner, privacy complaints to the OAIC, and Ombudsman complaints to the Commonwealth Ombudsman. This centralisation streamlines process for persons affected, but it also means South Australian oversight bodies (Ombudsman SA, SA Privacy Committee) have no jurisdiction over WELS enforcement in this state.

The original Act was assented to on 1 August 2013 and commenced on 12 September 2013. It repealed the earlier standalone Water Efficiency Labelling and Standards Act 2006. The only substantive amendment appears in the legislative history: the Statutes Amendment (Administrative Review Tribunal) Act 2025 (No 54 of 2025), which amended Part 5 sections 14(1) and 14(5) to replace references to the former Administrative Appeals Tribunal Act 1975 with the Administrative Review Tribunal Act 2024, and also updated the definition of “Commonwealth administrative laws”. The amendment commenced on 20 November 2025.

In addition, the legislative history notes that the long title and Part 1 section 2 were amended “under Legislation Revision and Publication Act 2002”, which is a standard South Australian machinery provision for updating punctuation and formal references. Schedule 1 was omitted under the same process. These are not substantive changes.

No other amendments are recorded. The Act has remained structurally intact since 2013, with the 2025 change updating the applicable review tribunal to reflect the Commonwealth’s establishment of the Administrative Review Tribunal.

Because the Act operates by applying the Commonwealth Act as in force for the time being, any amendment to the Commonwealth WELS Act automatically becomes effective in South Australia without a corresponding state amending Act. This means the “amendment history” of the applied provisions is really the amendment history of the Commonwealth Act, which is not reproduced here. However, for the South Australian Act itself, the amendment record is thin.

The Act has not generated any reported litigation in the South Australian courts, according to the source (which does not mention any cases). The nature of the applied‑law scheme may reduce litigation because the Commonwealth regulator’s decisions are challenged in the Commonwealth system (Administrative Review Tribunal, Federal Court) rather than in state courts. Section 14(4) expressly provides that provisions of Commonwealth administrative laws that purport to confer jurisdiction on a federal court are taken not to have that effect, so judicial review of administrative actions under the applied provisions would likely go to the Supreme Court of South Australia or the Federal Court depending on the basis of review. The exact division of jurisdiction is unclear from the text.

The double‑jeopardy provision in section 13 has not been tested in South Australia (as per source). However, if it were, the courts would need to decide whether a penalty imposed under the Commonwealth Act for a breach that also constitutes a breach of the applied provisions precludes further action under the applied provisions. The section appears to require that the offender has “been punished”, which might require a final determination: an infringement notice that has been paid may constitute punishment.

Because the Act ties to the Commonwealth scheme, any litigation on the interpretation of the Commonwealth Act would have direct effect on the state provisions, given that the Acts Interpretation Act 1901 applies. There is no record of any case challenging the constitutionality of the applied‑law model in South Australia for WELS, but similar models have been upheld in other contexts.

Overall, the litigation history is minimal. This could reflect the scheme’s effectiveness, or it could mean that non‑compliance is rarely detected or pursued. The lack of reported cases means lawyers have little judicial guidance on how the South Australian Act interacts with the substantive Commonwealth provisions, and may need to rely on Commonwealth jurisprudence.

Automatic adoption of Commonwealth amendments. Section 5(1) picks up the Commonwealth water efficiency laws “as in force for the time being”. This means that any future amendment to the Commonwealth Act (including new product categories, stricter standards, or higher penalties) becomes law in South Australia without any transparency or debate in the state parliament. The only safeguard is section 6(2), which allows the SA regulations to disapply a specific amendment, but that puts the onus on the state to act. If the state fails to notice or respond to an amendment, it will be bound. This is a significant delegation of state legislative power.

No state enforcement control. Because offences are treated as Commonwealth offences and are not offences against state law (section 11(2)), South Australia cannot choose to enforce the scheme leniently or vigorously. Enforcement priorities are set by the Commonwealth DPP and the WELS Regulator. A business operating only in South Australia may find itself subject to prosecution under a national policy that may not reflect local conditions. Conversely, if the Commonwealth deprioritises WELS enforcement, breaches in South Australia may go unpunished.

Fees and fines go to the Commonwealth. Section 19 requires that all fees, penalties, fines and other money payable under the Act be paid to the Commonwealth. This means the South Australian government forgoes revenue that it would have received if it had enacted its own fee‑charging scheme. The rationale is that the Commonwealth administers the scheme, but the trade‑off is a loss of state revenue and a reduction in the incentive for the state to actively support the scheme (since it does not keep the proceeds).

Right to review is through Commonwealth tribunal. A person aggrieved by a WELS decision in South Australia must apply to the Administrative Review Tribunal, which may be based in another state. This increases travel and representation costs for South Australian complainants compared with using a local tribunal like SACAT. The option of a local hearing is not guaranteed.

Interaction with the Australian Consumer Law. Nothing in this Act exempts a person from the ACL (South Australia). If a WELS‑registered product is mislabelled, the Commonwealth could prosecute under the WELS Act, and the ACCC or state consumer affairs could also take action under the ACL for misleading conduct. There is no double‑jeopardy protection across the different acts. A business could face two separate proceedings for the same labelling error.

Compliance with the South Australian WELS scheme is effectively compliance with the Commonwealth WELS scheme. Because the Act automatically applies the Commonwealth Act and its subordinate instruments, a business that complies with the Commonwealth Act is automatically complying with the state law. There is no separate state registration or state label.

The steps to comply are as follows:

1. Determine product coverage. Check the Commonwealth regulations (currently the Water Efficiency Labelling and Standards Regulations 2006, as amended) to see if your product is a “WELS product”. Covered categories include taps, showers, toilets, urinals, flow controllers, washing machines, dishwashers, and any other product prescribed. Future amendments may add new categories.

2. Product testing. Have the product tested by an accredited laboratory to determine its water consumption and efficiency rating. Testing must follow the relevant Australian Standard (e.g., AS/NZS 6400 for water efficiency). The test report must demonstrate compliance with any applicable minimum standard.

3. Registration. Register each product model on the national WELS register managed by the WELS Regulator. Registration is online via the Commonwealth’s portal. You will need to provide product details, the test report, and pay the registration fee. The registration is valid for a period (typically 5 years) and requires renewal.

4. Labelling. Once registered, you will receive a label template (or can generate it). Print and affix the label to the product or its packaging as required by the regulations. Labels must be durable, legible, and not tampered with. For some products (e.g., toilets), the label is required on the product itself; for others, on the packaging.

5. Advertising and online sales. Ensure any advertisement, catalogue, or website listing includes the WELS star rating and water consumption (if required). Do not make false or misleading claims about water efficiency.

6. Record‑keeping. Keep records of all registrations, test reports, label artwork, and supply records for at least 5 years (or as required by the Commonwealth regulations). These records must be produced to the WELS Regulator on request.

7. Monitor Commonwealth amendments. Because the applied provisions change automatically, you should track amendments to the Commonwealth WELS Act and regulations. Industry associations can help. If the Commonwealth introduces a new product category or raises minimum standards, you will need to comply by the deadline.
