The Act builds around a small set of legal concepts that determine what is referred, who may legislate, and how continuity and evidence are handled. Key concepts that appear in the text and determine legal effect are:

• Reference and referred subject‑matters. The statute uses the constitutional vehicle of a State reference under s 51(xxxvii) of the Constitution. It defines "reference" to mean either the "initial reference" (the original insertion of specified provisions into the Commonwealth Water Act as set out in the tabled text) or the "amendment reference" (a subsequent reference to permit express amendments of the Commonwealth Water Act), see s 3 (definitions) and s 4(1). The definition of "referred subject‑matters" in s 3 is the operative list of areas the State is referring. That list includes, among other things, Commonwealth agency powers conferred by or under the Murray‑Darling Basin Agreement that relate to Basin water resources; management to meet "critical human water needs"; water charging in relation to Basin water resources with a stated exclusion; the transformation of entitlements to enable trading; application in relation to non‑Basin water resources of Commonwealth Water Act provisions dealing with charging and entitlement transformation (to the extent authorised by State law); and transfer of assets, rights and liabilities of the Murray‑Darling Basin Commission to the Murray‑Darling Basin Authority and other transitional matters (see s 3, definitions of "referred subject‑matters" and "Basin water resources").

• Initial referred provisions and tabled text. The Act anchors the content of the initial reference to a specific proposed Commonwealth Bill text: the "tabled text" (the Water Amendment Bill 2008 as tabled in the SA House of Assembly on 23 September 2008). The "initial referred provisions" are defined as the text of particular parts (1A, 2A, 4, 4A, 10A and 11A) set out in the tabled text (s 3). The State thereby pins the initial reference to a concrete legislative package rather than to an open-ended set of powers.

• Limits on effect of reference. Section 4(2) limits the effect of the reference so it has operation only to the extent that the matter being referred is not already within the Commonwealth Parliament’s legislative powers except by a reference for the purposes of s 51(xxxvii), and only to the extent the matter is within the State Parliament’s legislative powers. This clause reflects the constitutional mechanics of a State reference.

• Temporal mechanics: commencement and termination. The Act provides for commencement of certain sections (s 2) and for termination of references by proclamation of the Governor (s 5). The reference begins at commencement and ends at the day fixed under s 5. Section 6 then deals with the legal effects if the "amendment reference" terminates before the "initial reference", preserving laws made under the amendment reference and continuing operation of the Commonwealth Water Act in the State as it exists immediately before termination, subject to limited exceptions.

• Evidentiary rule. Section 7 creates a discrete, admissible form of evidence: a certificate of the Clerk of the House of Assembly certifying that a document is an accurate copy of the tabled text is admissible and is evidence of that fact. The section also clarifies it does not exclude other modes of proving tabling or accuracy.

• Repeal of prior State law. Section 8 repeals the Murray‑Darling Basin Act 1996 (No. 78), signalling a statutory displacement of the former State statutory regime in favour of the referral/ Commonwealth framework.

• Definitions that limit subject matter. "Basin water resources" is defined specifically as water resources within or beneath that part of the State comprising the Murray‑Darling Basin, and expressly excludes Great Artesian Basin groundwater (s 3). "Critical human water needs" is defined to cover core human consumption in urban and rural areas and certain non‑human uses where failure to meet them would cause prohibitively high costs (s 3). The Act also distinguishes Commonwealth Water Act instruments and expressly contemplates both express amendments (direct textual amendment) and other Commonwealth instruments that affect operation (s 3 and s 4(4)).

These concepts shape who can make law (Commonwealth Parliament acting under the reference), what the Commonwealth can legislate about (the referred subject‑matters as defined), how to prove what was referred (the Clerk’s certificate), the temporal window of the reference (commencement and Governor’s proclamation), and how the State’s prior statute is removed (repeal). The Act does not itself set out regulatory detail such as charging rates, licence conditions, or administrative procedures; those are to be made under the Commonwealth Water Act and its instruments once the reference operates.

This statute primarily affects three categories of decision‑makers and stakeholders: State institutions (including the office of the Governor and the Clerk of the House of Assembly), Commonwealth institutions and law‑makers, and holders or users of water entitlements and related infrastructure within the defined Basin area. The Act’s text identifies concrete parties and roles as follows.

• The Governor of the State. The Governor has exclusive statutory power under s 5 to fix by proclamation the day on which the references terminate or on which the amendment reference terminates, to revoke such a proclamation in particular circumstances, and to publish subsequent proclamations. These powers determine the temporal duration and therefore the reach of Commonwealth legislative competence acquired under the reference. The Governor’s publication in the Gazette is the operational mechanism for commencement of termination and for the legal effect of revocation (s 5(1)-(4)).

• The Parliament of the Commonwealth. The Act refers specified matters “to the Parliament of the Commonwealth” for the purposes of the Commonwealth having the legislative competence to make laws with respect to them (s 4(1)). The Commonwealth Parliament therefore can enact laws implementing the initial referred provisions and making express amendments of the Commonwealth Water Act where permitted by the reference.

• Commonwealth agencies and bodies with functions under the Murray‑Darling Basin Agreement. The definition of "referred subject‑matters" includes the powers, functions and duties of Commonwealth agencies that relate to Basin water resources and are conferred by or under the Murray‑Darling Basin Agreement (s 3). Those agencies may have roles conferred or altered by the Commonwealth Water Act and by instruments made under it. The Act also anticipates the transfer of assets, rights and liabilities of the Murray‑Darling Basin Commission to the Murray‑Darling Basin Authority established under the Commonwealth Water Act (s 3(f)).

• Water entitlement holders and water users in the Basin. The Act explicitly refers to the transformation of entitlements to enable trading in those entitlements, and to water charging in relation to Basin water resources (with a stated exclusion for urban water supply after removal from a Basin resource) (s 3(c)-(d)). These subject‑matters directly affect private rights and market functions: holders of entitlements may be subject to legal reforms enabling trading, and may be affected by charging regimes developed under Commonwealth law.

• Urban water suppliers and consumers. The definition of "referred subject‑matters" disclaims water charging for urban water supply after removal of water from a Basin water resource (s 3(c)). That carve‑out identifies urban suppliers and their customers as a group not covered by the water‑charging reference insofar as the water is supplied post‑removal.

• Entities and individuals affected by "critical human water needs". The Act defines "critical human water needs" to include core human consumption requirements in urban and rural areas and those non‑human consumption requirements the failure to meet which would cause prohibitively high social, economic or national security costs (s 3). Laws made under the reference to manage Basin water resources to meet critical human water needs will therefore affect households, communities, health and emergency services, and industries tied to essential non‑human uses.

• Legal practitioners, courts and litigants. Section 7 creates an evidentiary device: a certificate by the Clerk of the House of Assembly that a document is an accurate copy of the tabled text is admissible in proceedings and is evidence of the matters certified. Practitioners and courts engaged in disputes about the content of the initial referred provisions or about whether a particular textual package was tabled will rely on or encounter this evidentiary provision.

• State statutory bodies and holders of assets, rights and liabilities under the Murray‑Darling Basin Commission. The Act contemplates transfer of assets, rights and liabilities to the Murray‑Darling Basin Authority established under the Commonwealth Water Act, and other transitional arrangements (s 3(f)). Those with legal interests in assets and liabilities associated with the Commission are therefore affected by the potential for transfer under Commonwealth law.

• The State Parliament and the body politic of the State. The Act repeals the Murray‑Darling Basin Act 1996 (s 8), which alters the statutory landscape in which the State exercised its own water management functions in relation to the Basin. That repeal affects the legal framework within which State administrators and regulators previously operated.

Who pays, who decides and who changes behaviour: The Act does not itself impose prices or charges; the Commonwealth Parliament and Commonwealth agencies will be making substantive regulatory choices once the reference is acted upon. The State (via the Governor) decides temporal bounds of the reference and may exclude further amendments by proclamation in certain circumstances (s 5 and s 6(3)). Water entitlement holders and users will respond to Commonwealth legislative changes such as charging, entitlement transformation and trading rules, which bear on property rights, transaction costs and market participation. Courts and litigants will rely on the Clerk’s certificate for proof of what text was tabled (s 7). The repeal of the State Act transfers the statutory baseline from State to Commonwealth arrangements in the matters covered by the reference (s 8).

The Act is largely procedural: it effects a constitutional reference and provides rules about the scope, timing and evidentiary proof of that reference. It does not create broad new regulatory duties or rights for private parties in detail. The key duties, powers and rights in the statute are therefore concentrated on institutional actors and concern how authority is to be transferred, evidenced, and terminated.

• Duty of publication by the Governor. The Governor has a duty to publish proclamations in the Gazette to effect the termination of the references or the amendment reference (s 5(1)). The statutory duty is to publish; the legal effect of fixing or revoking a day depends on that publication. Revocation of a proclamation must itself be published and is effective only if published before the day fixed under s 5(1) (s 5(2)-(3)). The duty to publish is the method by which the State gives legal notice of termination matters.

• Power to revoke and to re‑publish. The Governor may revoke a proclamation previously published under s 5(1) and may publish a further proclamation (s 5(2)-(4)). The statute prescribes the legal consequences of revocation: a revoked proclamation is taken (for the purposes of s 4) never to have been published (s 5(2)). That legal fiction affects whether the reference is treated as having been terminated for the purposes of s 4.

• Commonwealth Parliament’s legislative competence and duty to legislate within reference. Once the reference is made (and subject to its temporal bounds), the Commonwealth Parliament is empowered to make laws with respect to the matters referred (s 4(1)). The Act also contemplates express amendments of the Commonwealth Water Act by Commonwealth Acts under the amendment reference (s 4(1)(b)). The Commonwealth’s power is however statutory and constitutionally conditioned: s 4(2) states the reference has effect only to the extent the matter is not already within Commonwealth legislative powers other than by reference and only to the extent the matter is within the State’s legislative powers.

• Right to have initial referred provisions included in the Commonwealth Water Act. The initial reference is framed so that the initial referred provisions are to be included in the Commonwealth Water Act in the terms, or substantially in the terms, set out in schedule 1 of the tabled text (s 4(1)(a)). That gives the Commonwealth a right to insert that text in the Commonwealth Water Act, subject to constitutional validity and the temporal operation of the reference.

• Evidentiary right and rule. Section 7 grants that a certificate of the Clerk of the House of Assembly that a document is an accurate copy of the tabled text is admissible in evidence in any proceedings and is evidence of the matters certified, including that the text was tabled in the House. This is a procedural right available to parties seeking to prove the content or tabling of the bill text. Section 7(2) clarifies that this does not exclude other methods of proof.

• Preservation of laws and instruments after termination of amendment reference. Section 6 protects Commonwealth laws and Commonwealth Water Act instruments made under the amendment reference before termination: they are not affected by termination of the amendment reference. Relatedly, the State’s recognition of the continued operation in the State of the Commonwealth Water Act as in operation immediately before termination, or as subsequently amended or affected by laws referred to in s 6(1)(a) or s 4(4), is a right of legal continuity for those laws to remain operative in the State even if the amendment reference terminates (s 6(1)-(4)).

• Exclusion by proclamation. The Governor may exclude particular amendments of the Commonwealth Water Act from the operation of s 6 by specifying them in the proclamation that terminates the amendment reference (s 6(3)). That is a procedural control and results in a right of the State to limit the retrospective or ongoing effect of particular Commonwealth amendments made under the amendment reference.

• Repeal of the State act. Section 8 removes the Murray‑Darling Basin Act 1996 from the State statute book, extinguishing the duties, powers and statutory rights that Act previously created in the State. The consequence is that any rights or duties that depended on that Act as the operative statutory source are no longer found in State law, and the Commonwealth framework (as enacted under the reference) will be the available statutory source for matters covered by the reference.

What the Act does not do: it does not set out substantive regulatory duties such as licensing requirements, charging rates, detailed property rights, enforcement powers directed at private parties, criminal offences or administrative penalties. Those matters are left to the Commonwealth Water Act and to Commonwealth Water Act instruments that can be made once the Commonwealth has been empowered to act under the reference.

The Act contains no provisions creating criminal offences, civil penalties, administrative sanctions or an enforcement regime directed at private persons. Its enforcement‑related content is limited to institutional and evidentiary mechanisms and to the legal consequences that follow the Governor’s proclamations.

• No new private‑facing penalties. The statute does not prescribe fines, imprisonment, civil penalties, or regulatory sanctioning mechanisms for individuals, corporations or licence holders. It is a constitutional and legislative referral instrument; therefore the enforcement mechanisms that might apply to water charging, entitlement transformation, trading, or Commonwealth agency powers will have to be created under the Commonwealth Water Act or other Commonwealth laws and instruments, not by this Act.

• Proclamation publication as the compliance mechanism for termination. The Act makes Gazette publication the operative mechanism for fixing and revoking the days on which references terminate (s 5(1)-(4)). Publication is the means by which legal force is attached to termination or revocation. Failure to publish a proclamation would therefore defeat the statutory effect. The statute treats a revoked proclamation as if never published (for purposes of s 4) where the revoking proclamation is published before the fixed day (s 5(2)-(3)). Practitioners dealing with compliance or enforcement windows should therefore track Gazette notices closely.

• Preservation and legal continuity as a risk‑management and enforcement consideration. Section 6 preserves the operation in the State of laws made under the amendment reference before its termination. That clause reduces risk of legal uncertainty for existing Commonwealth laws and instruments: enforcement actions taken under such laws will not be abrogated by termination of the amendment reference. From an enforcement perspective, Commonwealth law and instruments that came into operation prior to termination continue to provide the legal basis for enforcement even after termination (s 6(1)).

• Evidentiary facility for litigation. Section 7 gives courts and litigants a straightforward admissible form of proof that the tabled text is an accurate copy of the proposed Commonwealth Bill and that it was tabled in the House of Assembly. This assists enforcement and litigation where the content of the initial referred provisions is disputed or relevant to legal questions. The certificate is "evidence" of the matters certified; the clause does not make it conclusive evidence.

• No procedural enforcement within this Act regarding transfers of assets or rights. Although the Act contemplates transfer of assets, rights and liabilities of the Murray‑Darling Basin Commission to the Murray‑Darling Basin Authority (s 3(f)), it does not itself prescribe mechanisms or enforcement remedies for compulsory transfer. Those matters will arise under Commonwealth legislation and instruments that give effect to the transfers.

In sum, enforcement and penalties applicable to water charging, entitlement transformation, trading and agency functions are not specified in this State Act. The Act’s enforcement‑adjacent provisions provide certainty about publication, continuation of Commonwealth laws made under the references, and a limited evidentiary shortcut in litigation.

This Act is explicitly designed to operate in conjunction with the Commonwealth Water Act and to replace the State’s prior legislative framework in relation to the Murray‑Darling Basin. The statute contains specific clauses about interplay, limitations and continuity.

• Relationship with the Commonwealth Water Act. The Act identifies the Commonwealth Water Act (the Water Act 2007) as the central Commonwealth statute into which the initial referred provisions are to be included (s 3). Section 4(1)(a) refers to inclusion of the initial referred provisions in the Commonwealth Water Act in the terms, or substantially in the terms, set out in schedule 1 of the tabled text. Section 3 defines "Commonwealth Water Act instrument" to include any instrument made or issued under the Commonwealth Water Act. Section 4(4) expressly records the State’s intention that the Commonwealth Water Act may be amended or otherwise affected by Commonwealth Acts based on separate Commonwealth legislative powers, and that the Commonwealth Water Act may at any time have its operation affected otherwise than by express amendment, by Commonwealth Water Act instruments. The statutory architecture therefore anticipates close legal interaction: the State grants the Commonwealth power to legislate about the referred matters, and the Commonwealth will use the Commonwealth Water Act and its instruments to do so.

• Limits imposed by constitutional voice and State competence. Section 4(2) makes clear that the reference has operation only if and to the extent the matter is not already included in the Commonwealth’s legislative powers otherwise than via a s 51(xxxvii) reference, and only if and to the extent the matter is included in the State’s legislative powers. This clause codifies the constitutional constraint on the State’s capacity to confer power and the scope of the reference. It means overlap with existing Commonwealth powers must be considered, and the effective content of Commonwealth legislation made pursuant to the reference remains subject to constitutional limits.

• Interaction with the Murray‑Darling Basin Agreement. The "referred subject‑matters" specifically include powers, functions and duties of Commonwealth agencies that relate to Basin water resources and are conferred by or under the Murray‑Darling Basin Agreement (s 3). The Act therefore anticipates that Commonwealth agencies’ functions under that Agreement may be given legislative backing or altered by Commonwealth law made under the reference. The Act also contemplates transfer of assets, rights and liabilities from the Murray‑Darling Basin Commission to the Murray‑Darling Basin Authority (s 3(f)), implying a statutory transformation of institutional arrangements.

• Repeal of State statute and statutory displacement. Section 8 repeals the Murray‑Darling Basin Act 1996 (No. 78). The repeal displaces the State’s statutory basis for managing the Basin that was previously set out in that Act. The practical legal effect is that State law ceases to be the primary statutory source for the matters covered by the reference; that role shifts to the Commonwealth Water Act and Commonwealth laws made under the reference, subject to any preserved State regulatory functions not covered by the reference.

• Continuity of Commonwealth laws and instruments after termination of amendment reference. Section 6 provides that if the amendment reference terminates before the initial reference, laws made under the amendment reference before termination continue to operate in the State, and the Commonwealth Water Act remains in operation in the State as in force immediately before that termination or as subsequently affected by relevant laws or instruments (s 6(1)-(2)). This guard ensures that Commonwealth measures enacted under the amendment reference are not automatically invalidated by subsequent State action to terminate the amendment reference.

• Evidentiary interaction with legal proceedings. The certificate of the Clerk under s 7 is admissible evidence in any proceedings and is evidence of the matters certified, including that the tabled text was tabled in the House. That evidentiary provision facilitates cross‑jurisdictional litigation where a court must determine the content of the initial referred provisions. It does not, however, bind a court on constitutional validity questions.

• Interaction with State powers concerning non‑Basin water resources. The definition of "referred subject‑matters" includes the application, in relation to water resources that are not Basin water resources, of provisions of the Commonwealth Water Act dealing with water charging and entitlement transformation, but only to the extent such application is authorised by State law (s 3(e)). This clause recognises the State’s ability to authorise application of Commonwealth provisions beyond the Basin, but conditions it on State legal authorisation.

Overall, the Act effectively permits the Commonwealth to step into, and legislate within, areas previously managed under State law, while setting out continuity measures, limits on scope via constitutional constraints, and an evidentiary device to support the transition. It does not itself create regulatory detail; the detail will come from Commonwealth law and instruments that interact with State and existing Commonwealth law.

The text provided contains limited material about amendments to this Act itself. What the statute does include that bears on amendment, and which should be noted by counsel and compliance officers, is as follows.

• References to an "amendment reference". The Act contemplates an "amendment reference" as distinct from the "initial reference". The amendment reference is the reference under s 4(1)(b): referred subject‑matters, but only to the extent of the making of laws with respect to any such matter by making express amendments of the Commonwealth Water Act (s 4(1)(b) and s 3 definition of "amendment reference"). The Act therefore distinguishes two discrete referral tracks: initial insertion of specific provisions via the initial reference, and authority to make express textual amendments later via the amendment reference.

• Commencement caveat. Section 2 states that sections 8 and 17 commence on a day to be fixed by proclamation. The provided text contains section 8 but does not contain section 17. The presence of a commencement provision referring to section 17 indicates either that the Act as presented is an excerpt (with s 17 elsewhere) or that there is a drafting anomaly in the version provided. For amendment tracking, this is material because it affects which provisions are in force at what times. Any practitioner relying on this text should confirm the complete Act, the existence and content of s 17, and the dates on which proclamations were made.

• Governor’s power to terminate the reference and to revoke proclamations. Section 5 gives the Governor power, by proclamation in the Gazette, to fix a day as the day on which references terminate or on which the amendment reference terminates, to revoke such proclamations, and to publish further proclamations. Those powers effectively allow the State to terminate the references (or only the amendment reference) at a time of its choosing and to make or rescind that decision publicly via Gazette. That is a mechanism for later constitutional or legal change: the State can curtail the scope of the amendment reference by proclamation, and can thereby alter the legal fielded by the referenced Commonwealth legislative competence. Section 6 records consequences of termination of the amendment reference before the initial reference.

• Effect of termination on laws made under the amendment reference. Section 6 protects laws made under the amendment reference before termination (s 6(1)(a)). It also preserves the continued operation in the State of the Commonwealth Water Act as in operation immediately before termination or as subsequently amended or affected by laws referred to in s 6(1)(a) or by Commonwealth Water Act instruments (s 6(1)(b) and s 6(4)). Section 6(3) provides that the proclamation which terminates the amendment reference may exclude, from the operation of s 6(1), particular amendments of the Commonwealth Water Act. Thus, the Act provides both a mechanism for termination and a statutory choice about whether pre‑termination Commonwealth amendments should continue to operate in the State.

• Evidentiary facilitation for proof of the tabled text. Section 7 creates a certificate mechanism to prove the content and tabling of the proposed Commonwealth Bill in a State House. That evidentiary measure reduces litigation friction when disputes arise over the exact text of the initial referred provisions.

• Repeal of the Murray‑Darling Basin Act 1996. Section 8 effects a substantive legislative change by repealing the prior State Act. That repeal is an immediate amendment to the State statute book effected by this Act.

• No amendment history recorded in the supplied text. The supplied copy does not show that this Act has been amended since its enactment, nor does it provide schedules of amendments or notes of repeals or substitutions to the text of this Act. It does not list dates of subsequent amendments. For full amendment history a practitioner must consult consolidated legislative databases, the Government Gazette for proclamations under s 5, and any parliamentary records of subsequent amendments. The Act itself provides mechanisms by which its operative effect can be changed (Governor’s proclamations to end the reference; proclamation to exclude specified amendments), but those mechanisms are not the same as textual amendments to the Act.

Practical implication for research and compliance: because the Act contemplates a dynamic legal environment , Commonwealth laws and instruments affecting the operation of the Commonwealth Water Act may be enacted at any time (s 4(4)) , practitioners must monitor both State proclamations under s 5 and Commonwealth legislative and delegated instrument activity under the Commonwealth Water Act. The Act’s own text does not show later amendments to itself; however, its mechanics permit significant downstream change by executive proclamation and by Commonwealth legislative action following the reference.

The provided text contains no judicial decisions, reported litigation or references to cases. It does, however, create legal points that could be (or have been) the subject of litigation. From the statutory text alone, the following litigation‑relevant features can be identified and should be borne in mind by litigators and courts:

• Justiciability of the reference and of validity of Commonwealth laws made under it. The Act authorises the Commonwealth to legislate on referred matters. Questions that could arise in litigation include whether a Commonwealth law enacted pursuant to the reference stays within the scope the State actually referred, whether the reference as made meets the constitutional requirements of s 51(xxxvii), and whether the Commonwealth law is otherwise constitutionally valid. The statute itself preserves the Commonwealth Water Act as in operation in the State and protects laws made under the amendment reference from being disturbed by termination of that reference (s 6). Any court considering challenges will need to interpret the initial referred provisions and the content of the tabled text; section 7’s certificate evidentiary rule is directly relevant.

• Evidentiary role of the Clerk’s certificate. Section 7 provides that a certificate from the Clerk certifying the tabled text is admissible and is evidence that the document is an accurate copy and that the text was tabled as claimed. Litigation about the content or the provenance of the initial referred provisions will likely rely on s 7 evidence. Section 7(2) notes that this does not affect other ways of establishing tabling or accuracy, which leaves open the possibility of adducing additional evidence.

• Potential disputes over temporal effects and proclamations. Litigation may arise over whether a proclamation fixing a termination day was validly published or validly revoked. Section 5 creates particular legal consequences (for example, revocation is taken never to have been published for the purposes of s 4 if the revocation is published before the fixed day), and courts may be called upon to interpret and apply those rules in disputes about the effective timing of Commonwealth legislative competence.

• Transfer of assets, rights and liabilities. The Act contemplates transfer of assets, rights and liabilities from the Murray‑Darling Basin Commission to the Murray‑Darling Basin Authority (s 3(f)). Litigation could arise about the legality, scope or procedural fairness of particular transfers effected under Commonwealth law, including disputes about property and contract rights. The Act itself does not set out the precise transfer mechanism; those mechanisms will be in Commonwealth law and instruments and in any transitional arrangements.

• Repeal consequences. Section 8 repeals the Murray‑Darling Basin Act 1996. Litigation may concern transitional rights or obligations under the repealed Act, or the impact of repeal on ongoing legal relationships. Because the Act provides limited transitional direction, courts may be asked to resolve disputes arising from the interaction of prior State law, Commonwealth action under the reference, and the repeal.

Because no cases are cited or included in the provided text, readers must consult case law databases to determine whether litigation has in fact arisen around this Act and the Commonwealth Water Act changes it enables. The statutory evidentiary provision, the Governor’s proclamation powers, and the cross‑jurisdictional nature of the reference are all features likely to produce litigation points.

The Act contains several drafting and practical features that can produce unexpected legal and operational consequences if overlooked. These are points to flag to clients, regulators, and counsel.

• The Act is a referral; it does not itself specify substantive regulatory detail. Practitioners sometimes expect a State Act that addresses water management to set out licensing, charges, penalties and administrative processes. This Act does not. It merely enables the Commonwealth to legislate in the specified areas. The substantive law that affects water users will therefore be found in the Commonwealth Water Act and in Commonwealth instruments made under it, after the reference operates (s 3 and s 4(1)). Parties must look to Commonwealth law for the operative regulatory rules.

• Reliance on the "tabled text". The initial referred provisions are defined by reference to a specific "tabled text" (the Water Amendment Bill 2008 as tabled in the SA House of Assembly on 23 September 2008) (s 3). Practitioners must obtain and rely on the certified tabled text (or other proof) when interpreting what was actually referred. Section 7 facilitates this by making the Clerk’s certificate admissible evidence. A "gotcha" is treating the initial referred provisions as generic or assuming they exactly match later Commonwealth legislation; the Act ties the initial reference to that specific textual package.

• Carve‑out for urban water charging. The definition of "referred subject‑matters" excludes water charging for urban water supply after removal of the water from a Basin water resource (s 3(c)). It is easy to misread the reference as covering all water charging; it does not cover post‑removal urban charging. Where charges are levied by local or private suppliers after removal of water, the State has not referred that subject matter to the Commonwealth under this Act.

• Existence of an apparently missing provision. Section 2 provides that "Sections 8 and 17 commence on a day to be fixed by proclamation." The provided text contains s 8 but not s 17. This suggests either that s 17 is elsewhere in the full Act (not included in the supplied excerpt), or that the drafting as supplied is incomplete. That is a practical "gotcha": reliance on this excerpt without checking the complete Act and any proclamations risks missing operative provisions or commencement timings.

• Termination and revocation timing traps. Section 5 allows the Governor to revoke a proclamation under s 5(1) but provides that the revocation is effective only if published before the day fixed under s 5(1) (s 5(3)). That timing requirement creates a narrow window for the revocation to have legal effect. Failure to publish the revocation in time results in the original proclamation standing, with legal consequences for the continuation or termination of the reference. Parties must monitor the Gazette carefully to determine the operative day.

• Continuity of Commonwealth laws after termination of the amendment reference. Section 6 protects laws and Commonwealth Water Act instruments made under the amendment reference prior to termination. That protection reduces legal uncertainty but also creates a potential regulatory patchwork if the amendment reference is later terminated and the initial reference remains. Parties should not assume termination of the amendment reference wipes out earlier Commonwealth changes.

• Evidentiary provision is helpful but not exclusive. Section 7 makes the Clerk’s certificate admissible and evidence; it does not make it conclusive and explicitly preserves other methods of proof. Litigants should use the certificate but also be prepared to produce contemporaneous parliamentary or legislative records where necessary.

• Repeal of the Murray‑Darling Basin Act 1996. Section 8 repeals the prior State statute. Practitioners should not assume the old State regulatory structures remain in force. Existing licences, rights and administrative arrangements that depended on the repealed Act may now rely on Commonwealth measures; clients should be alerted to the need to identify what has been preserved, what has been transferred, and where transitional arrangements are contained in Commonwealth instruments.

• The ability of Commonwealth instruments to affect operation without express amendment. Section 4(4) expressly contemplates that Commonwealth Water Act instruments may at any time affect the Commonwealth Water Act's operation, and therefore the legal regime within the State, without express textual amendment. This means that significant regulatory consequences could follow from delegated instruments at Commonwealth level, not only from primary legislation. Stakeholders should therefore monitor both primary legislation and subordinate instruments.

• State’s retention of some control. Section 4(2) and s 3(e) make clear that the reference’s legal operation is limited by constitutional allocation and by any State law authorising application beyond the Basin. Parties should not assume the Commonwealth can unilaterally legislate beyond the scope the State actually referred.

These are practical pitfalls: regime‑scope misunderstandings (thinking the Act creates direct regulatory obligations), failure to track Gazette proclamations (timing traps), over‑reliance on the excerpted text (missing s 17), and underestimating the regulatory effect of Commonwealth instruments. To avoid these, practitioners should obtain the certified tabled text, track Gazette notices for proclamations under s 5, and monitor Commonwealth primary and delegated legislative activity under the Commonwealth Water Act.

Compliance under this Act is largely institutional and monitoring‑based because the statute itself delegates substantive regulation to the Commonwealth. The practical compliance checklist divides into State/agency responsibilities; obligations for Commonwealth and State entities implementing transfers and instruments; and steps private parties should take to protect and exercise their rights.

For State authorities and lawyers

• Monitor and act on Governor’s proclamations. The Governor’s Gazetted proclamations under s 5 determine the day on which the references or the amendment reference terminate. State agencies must track the Gazette for proclamations and any revocations. Publication in the Gazette is the trigger for legal effect (s 5(1)-(4)). Ensure processes are in place to detect and respond immediately to any proclamation affecting the reference’s duration.

• Keep records of tabling and obtain the Clerk’s certificate. Section 7 makes a Clerk’s certificate admissible evidence of the tabled text. The State’s parliamentary office should maintain and provide certified copies of the tabled text when requested. Agencies should maintain archival copies of the tabled text and any schedule 1 referred provisions to support interpretation and to provide to Commonwealth counterparts and courts.

• Prepare for repeal consequences. Section 8 repeals the Murray‑Darling Basin Act 1996. State agencies should identify all statutory instruments, licences, contracts, and administrative arrangements that relied on the repealed Act and map them against Commonwealth instruments and transitional provisions to ensure continuity. Where gaps exist, coordinate with Commonwealth authorities to ensure legal continuity and to protect parties’ rights.

For Commonwealth and State entities implementing transfers and instruments

• Inventory assets, rights and liabilities tied to the Murray‑Darling Basin Commission. Because the Act contemplates transfer of assets, rights and liabilities to the Murray‑Darling Basin Authority (s 3(f)), both the transferring and receiving bodies should prepare complete inventories, identify title and contract documentation, and identify any State law consents or processes that must be engaged for the transfers to be effective. Ensure that Commonwealth instruments include clear transitional provisions consistent with s 6 where relevant.

• Draft and publish Commonwealth instruments with clear cross‑referencing. Section 4(4) expressly contemplates that Commonwealth Water Act instruments may at any time affect the Commonwealth Water Act’s operation. To minimise legal uncertainty, drafters of Commonwealth instruments should expressly state their relationship to the initial referred provisions and to any Commonwealth laws enacted under the reference. Cross‑reference State proclamations and any exclusions made under s 6(3) to avoid conflict.

• Ensure constitutional and statutory scope is respected. The Commonwealth should ensure laws enacted under the reference are confined to matters actually referred and are constitutionally defensible. The text of the reference is limited by s 4(2) to matters not already within the Commonwealth’s legislative powers other than by reference and to matters within the State’s legislative powers. Legal advice should be obtained on the precise contours of the referral to limit litigation risk.

For private parties, entitlement holders and water suppliers

• Monitor Commonwealth legislative developments and subordinate instruments. The Act vests substantive regulatory detail in the Commonwealth Water Act and in Commonwealth Water Act instruments. Affected parties must track amendments to the Commonwealth Water Act and the making of instruments that deal with charging, entitlement transformation, trading and asset transfers. Do not assume the State Act remains the operative source of law (s 8).

• Check whether the charging and trading reforms apply to you. The referred subject‑matters include water charging and transformation of entitlements to enable trading (s 3(c)-(d)), but with a stated exclusion of urban water charging after removal from a Basin resource. Parties should review whether their activities fall within the Basin water resources definition or the excluded post‑removal urban supply category, and whether the State has authorised application beyond the Basin where relevant (s 3(e)).

• Obtain and retain documentary proof of rights. Where the Commonwealth or State law is changing, preserve original titles, lease documents, licence instruments, contracts and correspondence. If a dispute over what was referred or what text applies arises, s 7 identifies the Clerk’s certificate as admissible evidence; but parties should also secure documentary evidence of historical arrangements.

• Engage in administrative processes when instruments are made. When the Commonwealth enacts charges, trading rules or entitlement transformations, affected parties may need to engage in application, registration, conversion or other administrative processes. Early legal advice can identify whether statutory rights to consultation or compensation apply under the Commonwealth measures.

• Seek clarification on transitional arrangements. If you hold rights under the repealed Murray‑Darling Basin Act 1996 (s 8), or if assets or liabilities are proposed to be transferred from the Commission to the Authority, seek written clarification from the administering Commonwealth body about how your rights will be treated and whether there are steps you must take to preserve them.

Operational practices for all stakeholders

• Maintain a Gazette monitoring routine. Because proclamations under s 5 are published in the Gazette and determine termination and revocation, implement an automated Gazette monitoring function to capture any notice under s 5 as soon as it is published.

• Map the statutory chain. For legal compliance, map how State repeals and Commonwealth enactments and instruments interact. Identify which statutory source governs each matter relevant to your operations (charging, trading, asset ownership, emergency critical human water needs) and update internal compliance matrices accordingly when new Commonwealth measures appear.

• Legal review before and after major instrument changes. Prior to making significant operational changes (such as trading entitlements or engaging in infrastructure transfer), obtain legal advice on the current Commonwealth Water Act regime and on the existence of any proclamations under s 5 or exclusions under s 6(3) that might affect the legal basis for those transactions.

Compliance under this Act is therefore primarily about monitoring, legal mapping, record‑keeping and proactive engagement with Commonwealth instruments rather than about complying with new State‑imposed operational duties created by this Act itself.
