23B ACCC must notify Part 6 operators and prospective Part 6 operators of its view
If the ACCC: (a) receives a notice under rule 23A; or (b) otherwise becomes aware that an infrastructure operator is a Part 6 operator, or is likely to become one from a specified date; the ACCC must: (c) form a view as to whether the infrastructure operator is a Part 6 operator, or will become a Part 6 operator from a specified date; and (d) notify the infrastructure operator of the ACCC’s view; and (e) if the ACCC is of the view that the operator is, or will be, a Part 6 operator—advise the operator that the ACCC will decide whether the operator should be granted an exemption under rule 23C.
