10 Restriction of certain infrastructure charges
A member owned operator must not, in specifying the infrastructure charges in relation to an infrastructure service of the same class, specify different infrastructure charges payable for: (a) an infrastructure service provided to a customer that holds an irrigation right against the member owned operator; and (b) an infrastructure service provided to a customer that does not hold an irrigation right against the member owned operator: if the difference between the amount of the charge referred to in paragraph (b) and the amount of the charge referred to in paragraph (a) is more than the difference between the actual costs necessarily incurred in providing each of those infrastructure services.
Civil penalty: 200 penalty units.
