71S Water extraction licence to prevail in event of inconsistency (1) If there is an inconsistency between a water extraction licence and a mining management plan approved under the Mining Management Act 2001 or a mining management plan forming part of a deemed mining licence as defined in section 303 of the Environment Protection Act 2019 in relation to the amount of water that may be extracted for a mining activity, the water extraction licence prevails to the extent of the inconsistency. Water Act 1992 68 (2) If there is an inconsistency between a water extraction licence and an environment management plan approved under the Petroleum Act 1984 in relation to the amount of water that may be extracted for a petroleum activity, the water extraction licence prevails to the extent of the inconsistency.
