38 Notice where private land disturbed (1) If in the exercise of a power by virtue of a permit under this Part the holder of the permit wishes to enter land, the holder must given written notice to the owner or occupier of the land of the holder's intention to enter the land. (2) A notice required under subsection (1) to be given shall be served not later than 10 business days before the exercise of the power and shall specify the land on which entry is to be made, the work Water Act 1992 38 proposed to be carried out on the land and the name and place of business of each person who will enter on the land to carry out the work.
