17A Hydraulic fracturing waste and water
(ii) serious environmental harm; and
(c) the person has knowledge of the result.

(5) A person commits an offence if the person engages in conduct that
results in, directly or indirectly, hydraulic fracturing waste coming
into contact with water.

(6) Strict liability applies to subsection (5).
