113 Application to mining and petroleum activity The former Act continues to apply in relation to a mining activity or petroleum activity if: (a) the activity is not related to hydraulic fracturing; and (b) the activity involves interfering with a waterway, taking surface water, taking groundwater, bore work or recharging an aquifer; and (c) the activity is conducted in accordance with: (i) a mining management plan approved under the Mining Management Act 2001; or (ii) an environment management plan approved under the Petroleum Act 1984; and (d) the activity started: (i) before the end of the transition period; or (ii) after the transition period, but the application for the management plan was made before the end of the transition period and was approved without change.
