105 Proceedings for offences (1) A prosecution for an offence against this Act must be commenced within 12 months after the later of: (a) the date on which the offence was committed; or (b) the date on which evidence of the offence first came to the attention of the Controller or an authorised officer. (1A) Proceedings for an offence against section 40, 42, 44, 46, 48, 50, 53, 55, 56, 58, 59, 61, 62, 64, 65, 66, 68, 71, 71L, 76 or 88D must not be commenced without the approval of the Controller. (2) A document purporting to record the consent of the Controller to proceedings for an offence against this Act and to be signed by the Controller is admissible and is prima facie evidence of the Controller's consent to the commencement of the proceedings.
