102D Liability of joint approval holder (1) If a joint holder of an approval commits an offence against this Act involving contravention of the approval, each other joint holder of the approval is taken to have committed the offence. Water Act 1992 90 (2) It is a defence to a prosecution for an offence taken to have been committed under subsection (1) if the defendant took reasonable steps and exercised due diligence to prevent the commission of the offence. (3) The defendant has a legal burden of proof in relation to a matter mentioned in subsection (2). (4) In this section: approval means a licence, permit or other authorisation granted under this Act.
