42 Determination of application S. 42(1) amended by No. 32/2010 s. 27(1)(a). (1) The Minister may deal with an application under section 36(1) in any of the following ways— (a) refuse it; S. 42(1)(b) repealed by No. 32/2010 s. 27(1)(b). S. 42(1)(c) amended by No. 32/2010 s. 27(1)(c). (c) approve it. S. 42(2) amended by Nos 5/2002 s. 15, 32/2010 s. 27(2). (2) The Minister must not approve an application under subsection (1)(c) unless he or she considers that the allocation of water under the entitlement is not likely to have any significant impact in terms of the matters required to be considered and given effect to under section 40. S. 42(3)–(6) repealed by No. 32/2010 s. 27(3).
