113 Taking prescribed waste to landfill or other facility A person commits an offence if the person— (b) as a result of the conduct waste is taken to— (i) landfill; or (ii) a facility prescribed by regulation; and (c) the waste is waste prescribed by regulation. Note Power to make a statutory instrument (including a regulation) includes power to make different provision in relation to different matters or different classes of matters, and to make an instrument that applies differently by reference to stated exceptions or factors (see Legislation Act, s 48). Maximum penalty: 150 penalty units.
