Schedule 2 is conducted or is to be conducted. (5) The NT EPA may, by notice in writing, declare that subsection (1) or (2) does not apply in relation to an activity specified in Part 1 of Schedule 2 conducted at specified premises if a development permit has been granted under section 53 of the Planning Act in relation to the activity. (6) The NT EPA may, by notice in writing, declare that subsection (1), (2) or (3) does not apply in relation to premises or an activity if satisfied that the risk of environmental harm resulting from pollution from the premises or arising from the activity is insignificant.
