Warehousemen's Liens Regulations 1952

The Regulations articulate a small number of core procedural concepts that structure the relationship between warehousemen, depositors, persons claiming ownership or interests in stored goods, courts and the Treasurer:

• Notice of claim (r 3 and Schedule 1 Form 1). This is the mechanism by which a person asserts ownership of goods or an interest in goods deposited with a warehouseman. The Regulation prescribes the textual content of that notice and authorisation for service at a stated address. The form requires particulars of the goods and a witness to the claimant’s signature (Schedule 1, Form 1).
• Notice of lien (r 4 and Schedule 1 Form 2). This is the warehouseman’s procedural step under section 6(2) of the Act to notify an identified person of a lien in respect of stored goods. The Regulation fixes the time window for giving that notice (within three months after deposit) and the required content: goods description, warehouse location, date of deposit and depositor name (r 4; Schedule 1, Form 2).
• Notice by advertisement (r 5). Where the person to be notified is unknown or lacks a known address to the warehouseman, the Regulations permit service by advertisement. The rules are prescriptive: the full copy of the notice must be published at least twice, with an interval of at least seven days between publications, in a newspaper circulating in the locality of the warehouse; if that newspaper is not daily, an additional advertisement must appear in a daily newspaper circulating in the City of Perth. The Regulations provide an objective deeming rule that the notice is treated as given on the day the last advertisement is published (r 5(1)-(3)).
• Verification and particulars for surplus payments (r 6). Duplicate copies of statements of account required by the Act must be verified by statutory declaration (r 6(1)). When the warehouseman pays any surplus into a Magistrates Court or to the Treasurer, the warehouseman must also provide a specified set of written particulars (r 6(2)(a)-(e)). Those particulars include deposit date; names and addresses of depositor, owner and every person claiming an interest, plus the grantee under any bill of sale of which the warehouseman has notice; particulars of all claims known to the warehouseman; particulars and results of any searches made under the Bills of Sale Act 1899; and any other information relating to the transaction known to the warehouseman (r 6(2)(a)-(e)).
• Offence and monetary penalty (r 7). Non‑compliance with any provision of the Regulations is an offence, punishable by a fine of $20 (r 7).

Ancillary concepts appearing in the reprint and notes include the Regulations’ status as a statutory instrument reprinted under the Reprints Act 1984 and specific amendment entries (Compilation table). The Regulations also indicate certain deletions and insertions made by the 2007 amendment, including deletion of r 2 and Forms 3-5, and insertion of r 7 (see marginal notes and compilation table).

Taken together, the Regulations focus on standardisation of documentation, objective timing rules for advertisements and a verification regime for financial reconciliations where surplus moneys are involved. The Regulations require warehousemen to gather and declare particular factual information, and impose a monetary fine for any contravention.

The Regulations identify a small cast of affected parties and institutions by the duties they impose and the information they require:

• Warehousemen. The Regulations impose most of the direct operational duties on warehousemen. They must give the notice of lien in the form set out in Schedule 1 Form 2 within three months of deposit (r 4, Schedule 1 Form 2). They must use advertisement procedures where necessary (r 5). They must verify duplicate statements of account by statutory declaration (r 6(1)) and, when paying a surplus into the Magistrates Court or to the Treasurer, must supply detailed particulars about the deposit, parties and searches (r 6(2)(a)-(e)). The requirement to include the grantee under any bill of sale of which the warehouseman has notice imposes a duty to be aware of bills of sale notified to them and to record that information (r 6(2)(b)).
• Claimants and owners. Persons claiming to be owner or to hold an interest in goods deposited with a warehouseman are bound to use the prescribed form for a notice of claim (Schedule 1 Form 1) when asserting such a claim under the Act (r 3; Schedule 1, Form 1). The form requires identification of the goods, the nature and extent of any claimed interest and an address at which notices under the Act may be served.
• Depositors. The name and address of the person who deposited the goods must be included among the details furnished by the warehouseman if a surplus is paid into court or to the Treasurer (r 6(2)(b)). Depositors are therefore a source of required information in the event of surplus payments.
• Persons claiming interests. The warehouseman must provide the names and addresses of “every person claiming to be the owner thereof or of any interest therein” when furnishing particulars under r 6(2)(b) and must set out “full particulars known to the warehouseman of all of such claims” (r 6(2)(b), (c)). Those persons are therefore indirectly affected because the warehouseman’s reporting obligations depend on the warehouseman’s knowledge of claims.
• Grantees under bills of sale. The Regulations specifically mention the grantee of goods under any bill of sale “of which the warehouseman has notice” as a person whose name and address must be furnished (r 6(2)(b)). This pulls in holders of security interests recorded or otherwise brought to the warehouseman’s attention.
• Courts and Treasurer. The Magistrates Court and the Treasurer are the recipients of surplus payments and the written particulars that must accompany them (r 6(2)). They are the agencies that receive documentary verification by statutory declaration (r 6(1)-(2)).
• Newspapers and publishers. Where service by advertisement is required, the Regulations mandate publication in a local newspaper circulating in the locality of the warehouse, and, if that local paper is not daily, in a daily newspaper circulating in the City of Perth (r 5(2)). That imposes a cost and an operational step of placing advertisements in relevant print media.
• Witnesses and persons making statutory declarations. The claimant’s signature on Form 1 is witnessed (Schedule 1, Form 1) and duplicate statements of account must be verified by statutory declaration by the warehouseman or a competent person on the warehouseman’s behalf (r 6(1)). Those are additional human participants in compliance.

Finally, the Regulations’ offence provision (r 7) makes any person who “contravenes a provision of these regulations” liable to a monetary penalty, so potentially extends exposure beyond warehousemen and claimants if others are involved in non‑compliance. The Regulations, however, do not itself specify further administrative or criminal enforcement mechanisms beyond the fine; the Act may address other enforcement matters but is not reproduced here.

The Regulations lay down discrete duties for notice content, timing, verification and record provision, and they confer the procedural right to use advertisement where direct service is impracticable. The principal duties and procedural rights are as follows, with the precise regulation references:

Duties on warehousemen

• Give notice of a lien within three months after the date of deposit, in the form set out in Schedule 1 Form 2 (r 4; Schedule 1, Form 2). The notice must state the goods, warehouse location, deposit date and the name of the person who deposited the goods.
• When the warehouseman does not know the person to be given notice, or lacks that person’s address, he or she may give notice by advertisement, but the advertisement must follow the prescribed publication pattern (r 5(1)-(3)). This is a permitted alternative method of service and is therefore a right to dispense with personal service in prescribed circumstances.
• Verify duplicate copies of statements of account required by the Act by statutory declaration, made by the warehouseman or by some competent person on the warehouseman’s behalf (r 6(1)).
• When paying any surplus into a Magistrates Court or to the Treasurer, provide in writing specified particulars: date of deposit; names and addresses of depositor, owner and every person claiming interest including any grantee under a bill of sale of which the warehouseman has notice; particulars of all claims known to the warehouseman; particulars and results of searches under the Bills of Sale Act 1899; and other transaction information known to the warehouseman (r 6(2)(a)-(e)). This lists a non‑exhaustive claim to information the warehouseman must gather and deliver.

Duties on claimants

• Give notice of claim in the form prescribed in Schedule 1 Form 1 (r 3; Schedule 1, Form 1). That includes authorising an address for service and providing particulars of the goods and the claimed interest.

Rights and procedural effect

• The right to use advertisement for service where a warehouseman does not know the person to be notified or does not know an address is a procedural concession on the usual requirement for personal service; the Regulations set the conditions under which that concession is available (r 5(1)-(3)).
• The deeming rule in r 5(3) creates certainty about when an advertised notice is treated as given, namely the day on which the last required advertisement is published.

Verification and evidentiary rules

• Duplicate statements of account must be verified by statutory declaration (r 6(1)), which elevates the documentary status of the statements when they are submitted to a court or to the Treasurer.

Sanctions

• A contravention of any provision of these Regulations is an offence subject to a fine of $20 (r 7). The Regulations do not provide other penalties or remedies within the text reproduced here.

Form and content prescriptiveness

• The Schedule’s two forms provide a standard required template for the notices, including signature and witness blocks. The mandatory nature of the forms is signalled by the regulation cross‑references (r 3 and r 4), which require that claims and lien notices “shall be in accordance with Schedule 1 Form 1” or Form 2 respectively.

Limitations

• The Regulations do not set substantive lien scope, enforcement procedure beyond the fine for regulatory contravention, sale procedures, or dispute resolution processes; those matters are matters of the Act rather than these Regulations. The Regulations are limited to prescribed formats, timelines and documentary and publication requirements.

Together, these duties shape the warehouseman’s operational compliance burden: they must maintain records to populate the prescribed forms, carry out searches under the Bills of Sale Act 1899 where appropriate and be ready to verify accounts by statutory declaration. Claimants must use the prescribed form and provide a witness signature.

Enforcement within the Regulations is narrowly framed and limited to a single, specified penal consequence for contravention of any of the Regulations’ provisions. The relevant provision is Regulation 7:

• Regulation 7 states a person who contravenes a provision of these regulations commits an offence and sets the penalty as a fine of $20.

This section of the Regulations therefore establishes three linked features of enforcement:

1. Offence qualification. Any breach of a provision in the Regulations amounts to a statutory offence under the instrument (r 7). The text does not distinguish between different provisions or different levels of culpability; the provision is phrased broadly and attaches an offence label to any contravention.

2. Monetary penalty. The sole specified sanction is a monetary fine of $20 (r 7). The Regulations do not set out any range, alternative penalties, or mechanisms for increase or adjustment within the text provided. The Regulations do not state whether this fine is recoverable by the court, payable to a particular authority, or how it interacts with other civil remedies or sanctions available under the Warehousemen’s Liens Act or other law.

3. Absence of additional enforcement mechanisms in the Regulations. The Regulations do not themselves authorise seizure, compulsion of compliance by court order under the Regulations, or forfeiture. They also do not prescribe administrative enforcement avenues (such as notices, directions or cautions) distinct from the offence and penalty provision. The Regulations require the warehouseman to provide particulars to the Magistrates Court or the Treasurer when paying surplus (r 6(2)), which implies interaction with judicial or executive offices, but the Regulations do not provide a mechanism for those bodies to impose additional penalties under the Regulations themselves.

Practical inference within the instrument’s text

• Because the Regulations are procedural and prescriptive about forms and publication, the enforcement mechanism in r 7 functions primarily as a backstop for procedural non‑compliance. The Regulations do not specify civil remedies for aggrieved owners, nor the effect of failing to comply with the Regulations on the substantive validity of a lien or sale under the Act; such matters would be governed by the Act itself and by courts applying the Act. The Regulations therefore place the onus on regulated parties to comply with document and publication requirements, with a narrowly specified statutory penalty for failure.

• The Regulations also require statements of account to be verified by statutory declaration (r 6(1)). Non‑compliance with this verification requirement would be an offence under r 7, but the Regulations do not specify evidentiary consequences beyond the criminal label and the fine.

In short, enforcement within the Regulations is limited in scope: a single prescribed penalty applies to any contravention, and the Regulations rely on the Magistrates Court and the Treasurer to receive verified statements and particulars where surplus moneys are paid, without setting out broader enforcement tools within the Regulations themselves.

The Regulations explicitly reference and operate as procedural instruments in relation to the Warehousemen’s Liens Act 1952, and they require engagement with the Bills of Sale Act 1899. The compilation notes also reference the Reprints Act 1984 and the Decimal Currency Act 1965 in relation to reprinting and historical amendments. The interactions apparent from the text are the following:

Interaction with the Warehousemen’s Liens Act 1952

• Each principal regulation cross‑references specific sections of the Act: regulation 3 refers to section 6(1)(a) of the Act for notice of claim, regulation 4 refers to section 6(2) for notice of lien, regulation 5 refers to section 9(3) for notice by advertisement, and regulation 6 refers to section 10(4) for the statement of account requirements. The Regulations therefore function as subordinate procedural amplification of particular Act provisions.
• The Regulations do not reproduce the substantive text of the referenced Act sections. Instead they prescribe the procedural forms, timing and verification that accompany or discharge the procedural obligations mandated by those Act sections. Consequently the substantive consequences of compliance or non‑compliance (for example the validity of a lien, the power to sell stored goods, or priority disputes) are matters for the Act and judicial interpretation, and are not settled within the Regulation text reproduced here.

Interaction with the Bills of Sale Act 1899

• Regulation 6(2)(d) requires the warehouseman to provide “full particulars of all searches made by or on behalf of the warehouseman under the Bills of Sale Act 1899 and of the results of such searches” when paying surplus moneys to the Magistrates Court or Treasurer. That makes searches performed under the Bills of Sale Act a required component of the warehouseman’s reporting duties, and it draws the warehouseman into the bills of sale registration/search regime to the extent those searches are relevant.
• The text thereby creates a documentary link between warehouseman reporting duties and any recorded bills of sale that might affect the goods; the regulation also requires the name and address of the grantee of goods under any bill of sale “of which the warehouseman has notice” (r 6(2)(b)). The Regulations do not themselves create or govern the bill of sale regime; they simply require the warehouseman to disclose what he or she has discovered under that separate Act.

Interaction with courts and the Treasurer

• Regulation 6(2) directs that the written particulars accompany payment of surplus moneys into a Magistrates Court or to the Treasurer. This creates a documentary reporting interface with judicial and executive institutions that will receive the surplus and the statutory declarations. The Regulations do not elaborate how the Magistrates Court or Treasurer are to use or verify the particulars once received.

Reprints, amendments and other statutory instruments

• The compilation notes state that the Regulations are reprinted under the Reprints Act 1984 and record amendment activity, including the Warehousemen’s Liens Amendment Regulations 2007 (24 Aug 2007) and a prior gazettal in 1953 (Compilation table). The Decimal Currency Act 1965 is referenced in the compilation table as affecting currency provisions historically; the current text reflects those reprints and amendments as at 2 November 2007.
• Several deletions and insertions recorded in the marginal notes (for example deletion of r 2 and Forms 3-5 and insertion of r 7) show that the Regulations have been edited over time, but the Regulations do not explain how those edits interact with other statutory provisions beyond the cross‑references already noted.

Limitations of interaction set out in the text

• The Regulations are procedural and do not purport to displace substantive rights and obligations created by the Warehousemen’s Liens Act 1952. Any question about substantive rights (for example the existence, priority, or enforceability of liens, or the consequences of sale) must be sourced in the Act and relevant judicial authority, which are not contained within this instrument.
• The Regulations refer to statutory declarations, newspapers, the Magistrates Court and the Treasurer as participants in the procedural architecture they establish. They do not prescribe how disputed factual claims are to be determined, nor do they prescribe remedies for harm caused by non‑compliance beyond the small statutory fine.

In sum, the Regulations operate as a subordinate procedural layer sitting on top of the Warehousemen’s Liens Act 1952, with evidence and reporting touchpoints into the Bills of Sale Act 1899 and the Magistrates Court/Treasurer processes. They standardise how procedural steps in the Act are to be performed and evidenced.

The Regulations include a brief but explicit amendment trail in the compilation notes and marginal annotations. The instrument as reprinted at 2 November 2007 incorporates several editorial and substantive edits, with the compilation table and marginal notes documenting key dates and instruments:

• Original gazettal. The instrument was originally gazetted as the Warehousemen’s Liens Act Regulations and Rules of Court 1952 on 20 February 1953 (Gazette reference: 20 Feb 1953 p. 368‑71). The compilation table records this original citation and commencement date.
• Decimal currency adjustments. The compilation notes record that the Decimal Currency Act 1965 affected the instrument (the note indicates that the citation changed and some provisions’ commencement dates were affected by the transition to decimal currency). The compilation table includes the Decimal Currency Act 1965 entry and notes about commencement of different parts of that Act (compilation table footnote).
• 2007 amendment package. The Warehousemen’s Liens Amendment Regulations 2007 were gazetted on 24 August 2007 (Gazette 24 Aug 2007 p. 4319‑21). Marginal notes in the text show several small but concrete changes associated with that 2007 revision:
  • Several headings and provisions were deleted or altered with the 2007 Gazette references noted in the marginal notes (for example the heading preceding reg 1 was deleted, reg 2 was deleted, and Part III was deleted , see the marginal notes following the relevant provisions).
  • Regulation 1 was amended (marginal note: “Regulation 1 amended: Gazette 24 Aug 2007 p. 4320”).
  • Regulations 3, 4, 5 and 6 were each amended (marginal notes referencing Gazette 24 Aug 2007 p. 4320‑1).
  • Regulation 7 was inserted by the 2007 amendment (marginal note: “Regulation 7 inserted: Gazette 24 Aug 2007 p. 4321”).
  • Forms 3‑5 were deleted by the 2007 Gazette (marginal note indicating “Forms 3‑5 deleted: Gazette 24 Aug 2007 p. 4321”).
• Reprint. The Regulations were reprinted as at 2 November 2007 , this reprint incorporates the amendments listed above, and the compilation table notes that Reprint 1 reflects the Regulations as at that date.

The marginal annotations within the reprint show where specific insertions and deletions occurred as a result of the 2007 amendments. The specific changes visible in the reprint text include:

• Insertion of r 7 (offence and penalty) into the Regulations in 2007 (r 7 did not appear in the original 1952 text as reprinted).
• Deletion of certain numbered provisions and forms (r 2 and Forms 3-5) as part of the 2007 amendment.

The compilation table supplies formal citation, gazettal and commencement information for the original instrument and the later amendment(s). The reprint note clarifies that this is a compilation as at 2 November 2007 and includes the amendments identified in the compilation table.

The reprint and amendment annotations show that the Regulations have been kept current to at least 2 November 2007 and that the most recent recorded change in the reprint was an amendment package in August 2007 which, among other things, inserted the explicit offence provision and deleted some now‑obsolescent forms and provisions.

The Regulations themselves do not include or reference any judicial decisions, nor does the reprint record any litigation history. The text provides procedural prescriptions, forms and an offence provision but does not contain case citations, reported decisions or summaries of judicial interpretation.

Practical implications of the absence of recorded litigation in the instrument

• The Regulations set out mandatory procedural forms and processes and an offence for contravention, but the instrument does not describe how courts have interpreted those requirements. Questions as to the legal effect of compliance or non‑compliance with the Regulations , for example whether strict compliance with the forms is necessary to preserve rights under the Act, or how courts treat notices given by advertisement under r 5 , are matters outside the Regulations’ text and would need to be sourced from case law applying the Warehousemen’s Liens Act 1952 or interpreting the Regulations in context.
• The Regulations require certain evidence (statutory declarations, particulars to Magistrates Court/Treasurer) and prescribe times for notice, but the instrument does not say how courts have resolved disputes about the adequacy of notices, the sufficiency of particulars, or the truth of statutory declarations. Those are judicial matters not captured in the Regulations.
• Because the Regulations require searches under the Bills of Sale Act 1899 to be reported, disputes concerning the accuracy or sufficiency of those searches, the weight to be accorded to their results, and interaction with bill of sale priorities would be decided by courts or tribunal bodies under the substantive law and are not addressed in the Regulations themselves.

If a practitioner needs authoritative judicial treatment of the procedural issues governed by these Regulations (for example the effect of a failure to comply with r 5 advertising rules, or evidentiary weight of a statutory declaration under r 6(1)), the Regulations themselves do not supply that material and the relevant case law under the Warehousemen’s Liens Act and related statutes would need to be located. The instrument as reprinted contains no litigation history and does not name any cases.

The Regulations are concise, but they embed several concrete operational and evidential traps for practitioners and warehouse operators. The following points are grounded in the text and identify areas where failure to follow the Regulations’ prescriptions could produce unintended procedural or evidentiary consequences:

• Strict timing for notice of lien. Regulation 4 mandates that “the notice of the lien given by the warehouseman within 3 months after the date of the deposit of the goods shall be in accordance with Schedule 1 Form 2.” The three month period is an objective deadline in the regulation. A warehouseman who fails to give the prescribed Form 2 within that timeframe will have contravened the Regulations and therefore be guilty of an offence under r 7. The Regulations do not provide a mechanism for extension, cure by later service, or discretion; the text requires adherence to the timeframe.
• Advertisement timing and deeming rule. When service is by advertisement under r 5, the advertisement must be published at least twice with at least seven days between publications, and the notice is “deemed to have been given on the day upon which the last of the advertisements was published” (r 5(2)-(3)). Practically, this means that any Act‑based timing that depends on notice being “given” will start to run from the date of the final advertisement. If a warehouseman miscalculates the interval between advertisements or uses an inappropriate newspaper, the deemed date may be delayed or contested.
• Newspaper selection requirements. Regulation 5 requires publication in a newspaper “circulating in the locality where the premises of the warehouseman is situated,” and if that newspaper is not a daily, a simultaneous advertisement in a “daily newspaper circulating in the City of Perth.” Misunderstanding this two‑paper rule or using an unsuitable paper could render the advertisement non‑compliant.
• Verification by statutory declaration. Regulation 6(1) requires duplicate copies of any statement of account under the Act to be verified by statutory declaration made by the warehouseman or a competent person on his behalf. Failure to verify duplicates by statutory declaration may expose the warehouseman to the r 7 offence. The regulation does not define “competent person,” so warehousemen will need to ensure the person making the declaration is authorised to do so and understands statutory declaration formalities.
• Broad particulars when paying surplus. Regulation 6(2) imposes an extensive written particulars obligation when paying surplus moneys into the Magistrates Court or to the Treasurer. The warehouseman must provide names and addresses of depositors, owners and “every person claiming” interest including grantees under bills of sale “of which the warehouseman has notice.” Warehousemen must therefore take positive steps to identify and record claimants and to make searches under the Bills of Sale Act 1899 and record the results (r 6(2)(b), (d)). Omissions or incomplete searches can result in non‑compliance.
• Low fixed penalty, but criminal label. Regulation 7 creates an offence for any contravention of the Regulations with a fine of $20. While the monetary amount is small, the offence label may carry criminal consequences and possible collateral impacts (for example reputational or licensing effects) that the Regulations do not address. The Regulations do not explain whether the fine is the only consequence or how it interacts with civil liability or with the Act.
• Mandatory prescribed forms. Regulations 3 and 4 require that notices “shall be in accordance with” the forms in Schedule 1. Departing from the prescribed wording, format or signature/witnessing requirements in Schedule 1 could be non‑compliant. For example, Form 1 requires the claimant to authorise an address for service and to have a witness sign; omission of those elements would not be consistent with the prescribed form requirement.
• Deletion of other forms. The reprint shows Forms 3-5 were deleted in the 2007 amendments. Users relying on earlier practice guides or templates that reference the now‑deleted forms should update their procedures to reflect the current Schedule 1 Forms 1 and 2 only.
• Reliance on knowledge. Several obligations (for example furnishing particulars of “all of such claims” and listing “grantee … of which the warehouseman has notice”) depend on what the warehouseman knows. The Regulations do not set out the standard for “notice” or how constructive notice operates here; this raises evidential challenges where a warehouseman claims ignorance or incomplete knowledge.
• Interaction with the Act not reproduced. The Regulations are procedural and make multiple references to the Act (sections 6, 7, 9(3), 10(4)), but the Regulations do not reproduce the substantive or procedural consequences contained in those Act sections. Practitioners must therefore ensure they consult the Act itself for the full legal picture; relying on the Regulations alone risks missing substantive rights or mandatory steps set out in the Act.

These “gotchas” are not theoretical , they follow directly from the text: precise time limits (r 4), prescriptive publication steps and deeming rules (r 5), statutory declaration verification (r 6(1)), and extensive particulars obligations tied to bills of sale searches (r 6(2)(b), (d)). Non‑compliance triggers the offence provision in r 7.

Practitioners and warehouse operators can follow a concise compliance checklist directly derived from the Regulations’ prescriptions. Below are concrete steps aligned with the exact regulatory text, followed by documentary and practical suggestions to reduce risk of contravention.

Operational checklist (step‑by‑step, regulation references included)

1. Record deposit details on intake.
   • Record date of deposit, description of goods, name and address of the depositor, and the location of the warehouse where goods are stored. These items appear in the required Form 2 and in r 6(2)(a)-(b).
2. If a person claims ownership or an interest, require the claimant to deliver Schedule 1 Form 1.
   • Ensure the claimant completes the prescribed Form 1 (r 3; Schedule 1, Form 1), including the claimant’s name, particulars of goods, extent of interest (if partial), an address for service and a witness signature.
3. If asserting a lien, give the prescribed notice within three months.
   • Prepare and serve Schedule 1 Form 2 and ensure it is given within three months after the deposit date (r 4; Schedule 1, Form 2). Include: description of goods, warehouse location, deposit date, and depositor name.
4. When the person to be notified is unknown or no address is known, use advertisement procedure.
   • Publish the full copy of the notice at least twice, with an interval of at least 7 days between publications, in a newspaper circulating in the locality of the warehouseman’s premises (r 5(1)-(2)). If that local paper is not a daily, also publish in a daily newspaper circulating in the City of Perth (r 5(2)).
   • Treat the notice as given on the date of the last required advertisement (r 5(3)). File and retain proofs of publication showing publication dates and newspapers used.
5. Preserve evidence of searches under the Bills of Sale Act 1899.
   • Where relevant, undertake searches under the Bills of Sale Act 1899, retain records of those searches and their results, and be prepared to include that information in the particulars required when paying surplus (r 6(2)(d)).
6. When paying surplus into a Magistrates Court or to the Treasurer, prepare and verify statements and particulars.
   • Prepare duplicate copies of the statement of account required by the Act and verify those duplicates by statutory declaration made by the warehouseman or a competent person on the warehouseman’s behalf (r 6(1)).
   • At the time of paying the surplus into a Magistrates Court or to the Treasurer, furnish in writing the particulars specified in r 6(2)(a)-(e): deposit date; names and addresses of depositor, owner and every person claiming interest including any grantee under bills of sale of which the warehouseman has notice; full particulars of all such claims known to the warehouseman; particulars and results of any Bills of Sale Act searches; and any other transaction information known to the warehouseman (r 6(2)(a)-(e)).
7. Keep accurate records and witness signatures.
   • For Form 1, ensure the claimant’s signature is witnessed per Schedule 1 Form 1. For Form 2, ensure the warehouseman signs the notice (Schedule 1, Form 2). Maintain contemporaneous records for evidentiary purposes.
8. Understand the legal consequences of non‑compliance.
   • Be aware that contravening any provision of the Regulations is an offence carrying a fine of $20 (r 7). Although the monetary penalty is specified, the contravention is nonetheless an offence and should be avoided by strict procedural compliance.

Documentary practices and risk mitigation

• Use the prescribed Schedule 1 templates verbatim when issuing notices to reduce arguments about non‑compliance with form requirements (r 3, r 4; Schedule 1).
• When relying on advertisement for service, procure and retain publisher affidavits or statutory declarations showing exact publication dates and content to establish compliance with r 5(2) and the seven‑day interval requirement.
• Institute an intake checklist that captures all r 6(2) particulars at the time of deposit or as claims develop, including fields for bill of sale searches and outcomes.
• Ensure statutory declarations required by r 6(1) are prepared in accordance with statutory formalities and executed by persons who are authorised to make such declarations; keep originals and copies with the payment into court file.
• Train staff to note the three month deadline for giving Form 2 notices and to escalate any potential late notices for legal review before they are issued.
• Maintain a log of all claimants and claimed interests, with contact details and dates of receipt of Form 1 notices, to facilitate the preparation of particulars should surplus be paid to court or to the Treasurer.
• Where knowledge of third‑party interests is in dispute, document inquiries and search steps taken (r 6(2)(c)-(d)). The Regulations make the warehouseman’s “knowledge” central to the particulars required.
• Review procedural changes arising from the 2007 amendments, for example the insertion of the explicit offence provision (r 7) and deletion of obsolete forms (Forms 3-5), and discard reliance on older forms or processes superseded by the reprint.

Practical note about cross‑reference to the Act and other legislation

• These Regulations are procedural adjuncts to the Warehousemen’s Liens Act 1952 (see marginal notes and r headings that reference sections of the Act). Practitioners must consult the Act itself for substantive rights and for the full statutory scheme governing lien creation, sale, priority, and other remedies. The Regulations do not displace those substantive provisions or cure defects that the Act might treat as fatal.
• Where bills of sale may affect the goods, follow the procedural search and reporting steps required by r 6(2)(d) and preserve evidence of those searches under the Bills of Sale Act 1899.

By implementing the above checklist and documentary practices, a warehouseman or legal advisor will address the main procedural obligations the Regulations impose and reduce risk of contravening the specific provisions, thereby avoiding the statutory offence embedded in Regulation 7.
