The Plan organises land use regulation around a set of interlocking concepts: zones and zone objectives, the Land Use Table, development consents and exemptions/compliance pathways, mapped development standards, localised clauses for specific topics and regulatory overrides or interactions with other instruments. Each concept operates by a defined mechanism in the Plan text.

Zones and objectives: The Plan establishes a set of land use zones (cl 2.1) including rural (RU1 Primary Production; RU3 Forestry; RU5 Village), residential (R1 General Residential; R5 Large Lot Residential), employment (E1 Local Centre; E4 General Industrial), special purpose (SP1 Special Activities; SP2 Infrastructure; SP3 Tourist), recreation (RE1 Public Recreation) and conservation (C1 National Parks and Nature Reserves; C4 Environmental Living). For each zone the Plan sets objectives that the consent authority must have regard to when determining applications (cl 2.3(2); see individual zone objectives in the Land Use Table). Zone objectives operate as planning criteria to guide acceptance or refusal of development proposals.

Land Use Table: The Land Use Table (Part 2 Land Use Table and the zone-specific entries) categorises types of development as “permitted without consent”, “permitted with consent” or “prohibited” in each zone (cl 2.3(1)). The consent authority must have regard to zone objectives when deciding applications (cl 2.3(2)). The Land Use Table is the primary filter determining whether an activity will require development consent.

Consent, exempt and complying development: The Plan pathways are threefold. Exempt development is identified in Schedule 2 and must meet Schedule 2 standards and the requirements of Part 3 (cl 3.1). Complying development is identified in Schedule 3 and must meet the development standards and conditions in that Schedule and Part 3 (cl 3.2). The Plan expressly relies on the State SEPP (Exempt and Complying Development Codes) for wider, state-wide exempt and complying development rules, noting that the Schedule in this Plan is additional to the State SEPP (notes to Schedules 2 and 3; cl 3.1-3.2). Development otherwise requires development consent from the consent authority (cl 2.3; cl 2.6; cl 2.7).

Mapped standards and technical maps: The Plan uses several maps with legal effect: the Land Application Map, Land Zoning Map, Lot Size Map, Height of Buildings Map, Land Reservation Acquisition Map, Additional Permitted Uses Map and Heritage Map (cl 1.3; cl 1.7; cl 2.2; various schedule notes). These maps determine zoning, minimum lot sizes (cl 4.1 and related), maximum building heights (cl 4.3), additional mapped permissions (Schedule 1) and acquisition authorities (cl 5.1). The Plan also provides for maps to be amended or replaced as permitted environmental planning instruments are made and approved by the local plan-making authority (cl 1.7).

Development standards and flexibility: The Plan prescribes particular standards such as minimum subdivision lots (cl 4.1 and related clauses 4.1AA-4.1C and 4.1B), height of buildings (cl 4.3) and strictures on subdivision in certain zones (cl 4.6(6)). It also contains an exceptions to development standards clause allowing departures where: the applicant demonstrates compliance with cl 4.6(3)(a) and (b); the consent authority records the assessment (cl 4.6(3)-(4)); and subject to certain prohibitions including not allowing departures for certain complying development standards and provisions linked to BASIX commitments (cl 4.6(8)(a)-(caa)). This mechanism creates discretionary relief from mapped standards under recorded grounds and procedural requirements.

Local topic-specific controls: The Plan contains an array of localised controls that shape behaviour on specific matters. Examples include a prohibition on canal estate development (cl 2.9); a temporary use regime allowing temporary uses up to 30 days in any 12 month period subject to conditions (cl 2.8); heritage protection rules specifying when consent is required and procedural steps such as notification of Heritage Council or local Aboriginal communities (cl 5.10); special controls for eco-tourist facilities requiring management strategies (cl 5.13); aquaculture site and operational requirements in Schedule 6 and cl 5.19; flood planning obligations referencing state guidelines and the Flood Risk Management Manual (cl 5.21); and an explicit rule preventing refusal of consent on certain subjective grounds for licensed premises playing or performing music where noise can be managed (cl 5.20).

Interactions and overrides: The Plan recognises the primacy of SEPPs where applicable (cl 1.9(1)), provides for suspension of some private covenants to enable Plan-consistent development (cl 1.9A), and requires consultation with Commonwealth authorities where development may penetrate airport obstacle surfaces (cl 6.4). It therefore establishes a hierarchy and mechanisms for cross-jurisdictional checks.

Maps, schedules and blanks: Several provisions in the Plan are implemented by reference to maps or schedules whose content is external or periodically updated. For example, Schedule 2 and Part 1 of Schedule 3 are blank within this Plan but the State SEPP is noted as the primary source for exempt and complying development (cl 3.1-3.2; Schedule notes). The Plan also shows some entries as not adopted or not applicable. Those blanks indicate reliance on state instruments or that particular optional local controls were not used in this Plan.

These concepts together structure the Plan’s regulatory logic: classification by zone and map; primary reliance on the Land Use Table and mapped standards; procedural pathways for consent, exemptions and complying development; and topic-specific local controls that inject detail and constraints into decisions. The consent authority, the Council, is the primary decision maker, with required consultations and mandatory considerations for particular types of development embedded throughout.

The Plan affects a range of stakeholders through its zoning, consent requirements, mapped standards and specific local clauses. The most directly affected groups are land owners and developers within the Plan area, the Council as consent authority and land manager, certain State and Commonwealth agencies identified in mapped acquisition and airspace clauses, holders of private covenants and instruments affected by the suspension clause, and users or operators of heritage sites, aquaculture, tourist opal mines and licensed premises.

Land owners and prospective developers: The Plan determines lawful land uses, the need for development consent, minimum lot sizes and permitted densities (cl 2.3; cl 4.1; Land Use Table). Owners of land in zones where a use is “permitted with consent” must apply to Council for development consent; development that is “permitted without consent” but subject to environmental assessment and Part 5 requirements may still require other approvals (cl 2.3(1) note). Subdivision applications are widely constrained: subdivision requires development consent (cl 2.6) and must meet minimum lot sizes shown on the Lot Size Map, or fit within specified exceptions (cl 4.1; cl 4.1AA-4.1C; cl 4.1B).

Residents and occupiers: Residential amenity and use rights are affected by the Land Use Table and specific prohibitions. R1 General Residential allows a broad set of residential and associated uses with many commercial exceptions treated as prohibited (Land Use Table entries under R1). R5 Large Lot Residential includes different permitted uses and a set of prohibitions that limit change of use and higher intensity residential development (R5 entries). The Plan’s flood planning clause (cl 5.21) requires consideration of flood risks and evacuation, which affects owners/occupiers in flood planning areas. Aircraft noise clauses (cl 6.5) impose siting and acoustic compliance obligations for development within specified ANEF contours.

Commercial operators and industry: Local businesses, industrial operators and tourism businesses are affected by zoning and additional permitted uses. E4 General Industrial sets out industrial uses permitted with consent and many commercial uses are excluded (Land Use Table E4). The Plan establishes mapped additional permitted uses for parcels at Lightning Ridge (Schedule 1), enabling particular commercial uses that would otherwise be prohibited or require rezoning. Eco-tourism proposals require management strategies and specific environmental and design satisfactions (cl 5.13). Farm gate and farm stay uses are regulated with environmental and compatibility tests (cl 5.24-5.25).

Heritage custodians and Aboriginal communities: Scheduled heritage items and areas in Schedule 5 and the Heritage Map are subject to consent requirements for demolition, moving or alteration (cl 5.10(2)). The Plan requires notification and consideration of the Heritage Council for archaeological sites and of local Aboriginal communities for Aboriginal places of heritage significance before granting consent (cl 5.10(7)-(9)). These procedural duties directly affect proponents proposing works that may interact with heritage items or Aboriginal places.

Public authorities and utilities: The Council is the consent authority (cl 1.6). The Plan identifies which State authority will act as the “relevant acquisition authority” under owner-initiated acquisition provisions for mapped land (cl 5.1(2) and table). It protects certain State and Crown instruments from the suspension of covenants provision (cl 1.9A(2) and (3)). The Plan also provides that Crown infrastructure development allowed under SEPP (Transport and Infrastructure) is not restricted (cl 5.12). Where development may penetrate airport limitation surfaces, the consent authority must consult the relevant Commonwealth body and accept or refuse consent based on that advice (cl 6.4).

Holders of private covenants and instrument beneficiaries: Clause 1.9A allows a covenant, agreement or similar instrument that restricts development to be suspended to the extent necessary to enable development carried out in accordance with the Plan or development consent, subject to key exceptions. This directly affects private parties who rely on restrictive covenants for land control; however, the clause explicitly excludes covenants imposed by the Council and certain conservation instruments and does not affect rights of public authorities under registered instruments (cl 1.9A(1)-(3)).

Community groups and local users: The Plan’s temporary use clause (cl 2.8) enables short-term uses up to 30 days, offering local event organisers and community groups an avenue for temporary activity, but requires Council satisfaction on restoration and amenity impacts (cl 2.8(2)-(3)). Location rules for sex services premises require consideration of proximity to child-frequented places and residential zones (cl 6.7), affecting operators and community interests.

Specific industry sectors: Aquaculture operators are affected by detailed site and operational standards in cl 5.19 and Schedule 6, which specify excluded conservation zones and design and discharge rules. Intensive livestock operators face thresholds for when consent is not required and detailed consent considerations where consent is required (cl 5.18). Licensed premises operators and live music promoters receive an express protection against refusal based on music characteristics, subject to noise manageability (cl 5.20).

In sum, the Plan’s zoning, mapped standards, specific local clauses and administrative mechanics change the regulatory environment for landholders, developers, industry operators, cultural and heritage custodians, public authorities and holders of covenants. The Council is the primary decision maker; State and Commonwealth bodies have roles in particular subject areas; and certain private rights may be curtailed or suspended by the Plan within the clauses’ limits.

This section sets out the principal statutory duties, decision-making rights and procedural obligations the Plan imposes or creates, with specific clause references.

Duties on proponents/applicants

• Obtain development consent where required, including for subdivision, demolition, most new development and development in heritage places (cl 2.6; cl 2.7; cl 5.10(2)). Where the development proposes to contravene a development standard, the application must include the document required by the Environmental Planning and Assessment Regulation 2021 setting out grounds to demonstrate that compliance is unreasonable or unnecessary and environmental planning grounds to justify contravention, because cl 4.6(3) requires the applicant to demonstrate those matters.
• For exempt or complying development, meet the applicable requirements in Schedule 2 or Schedule 3 and the Part 3 conditions, including Building Code of Australia provisions and any other statutory permits (cl 3.1(2)-(5); cl 3.2(2)-(4)). The Plan notes that the State SEPP (Exempt and Complying Development Codes) has State-wide application and is the main source for many exempt/compliant pathways (Schedule notes).
• When proposing works on or near heritage items, archaeological sites, Aboriginal places or within a heritage conservation area, provide adequate heritage assessments, potentially including a heritage management document or heritage conservation management plan if required (cl 5.10(4)-(6)). Notify relevant bodies as required: the Heritage Council must be notified for archaeological sites (cl 5.10(7)); local Aboriginal communities must be notified for Aboriginal places of heritage significance (cl 5.10(8)); the Heritage Council must be notified for demolition of nominated State heritage items (cl 5.10(9)).
• For eco-tourist facilities, submit management strategies addressing a detailed checklist of environmental protection, low-impact design, waste and monitoring (cl 5.13(3)(k)(i)-(v) and cross-referenced clauses).
• For certain intensive livestock and aquaculture developments, supply thorough statements of environmental effects including the matters identified (cl 5.18(3); cl 5.19(2) and Schedule 6).

Duties on the consent authority, primarily the Council

• Determine development applications in accordance with the Plan and have regard to zone objectives when deciding applications (cl 2.3(2); cl 1.6).
• For temporary use applications, be satisfied as to restoration, amenity, environmental attributes and absence of hazard impacts before granting consent (cl 2.8(3)).
• Keep a record of assessments where a development standard is contravened under the exceptions clause (cl 4.6(4)).
• Consult and not grant consent in certain airspace cases unless the relevant Commonwealth body raises no objection (cl 6.4(2)-(4)).
• Before granting consent on archaeological sites and nominated State heritage item demolition, notify the Heritage Council and consider any response within 28 days (cl 5.10(7) and (9)). For Aboriginal places of heritage significance, notify local Aboriginal communities and take responses into account (cl 5.10(8)).
• Ensure essential services availability before granting consent (cl 6.6).

Rights created or preserved

• Property owners have rights to develop land in accordance with permitted uses in the Land Use Table and with development consent where required; they may also rely on exempt and complying development pathways where applicable (cl 2.3; cl 3.1-3.2).
• The Plan preserves the rights of public authorities under any registered instrument when it suspends private covenants (cl 1.9A(3)). It also protects particular Crown and conservation instruments from suspension (cl 1.9A(2)(a)-(g)).
• The consent authority retains discretion to grant development even where the Plan would otherwise not permit a use if it is satisfied certain conservation or heritage incentives are met, for example conservation incentives that permit otherwise non‑permitted uses if conservation works are secured under a heritage management document (cl 5.10(10)).
• Under cl 5.20 the consent authority must not refuse consent for licensed premises on particular subjective grounds related to music or dancing if it is satisfied noise can be managed to an acceptable level. This creates a right for licensed premises proponents to have music or performance activities considered without refusal on artistic or format grounds.
• Landholders have the right for owner-initiated acquisition of land under the Land Acquisition Act to be pursued by the specified State authority in cl 5.1, with the right to seek acquisition under section 23 of that Act where hardship requires acquisition to proceed expeditiously.

Procedural and evidentiary duties

• The Act’s requirements on environmental assessment and the Regulation’s requirements for contravention documentation are invoked by cl 4.6(3) and the notes under cl 3.1-3.2; proponents proposing to contravene standards must supply the necessary material.
• For development in flood planning areas, the consent authority must be satisfied the development is compatible with flood function and behaviour and takes into account climate change projections and evacuation considerations; proponents may need to demonstrate compliance with the Considering Flooding in Land Use Planning Guideline and the Flood Risk Management Manual referenced in cl 5.21.

Limitations and prohibitions

• Canal estate development is expressly prohibited (cl 2.9).
• Clause 4.6(8) precludes the exceptions mechanism from being used to contravene certain development standards including those for complying development, BASIX commitments, cl 5.4 and cl 5.5. This prevents ad hoc bypassing of particular environmental or sustainability commitments.
• Certain local provisions are “not adopted” or “not applicable” in the Plan, meaning the absence of a local alternative does not create any duty in those areas.

In short, the Plan creates a structured set of duties for applicants, procedural duties for the Council and conditional rights for proponents to develop provided they meet mapped standards, procedural requirements and subject-specific provisions. The Plan also grants the Council discretion to allow departures in limited circumstances but imposes record-keeping and consultation obligations where particular sensitivities are engaged.

The Plan itself sets the land use permissions, standards and procedural requirements; enforcement and penalties arise under the Act and associated regulations rather than being specified as criminal penalties within the Plan text. The Plan imposes obligations that trigger enforcement mechanisms of the Environmental Planning and Assessment framework by setting conditions precedent for lawful development.

Legal consequences of non-compliance

• Development carried out without required development consent remains unauthorised and subject to the enforcement provisions in the Environmental Planning and Assessment Act and its regulations. The Plan repeatedly identifies development that may be carried out only with development consent (for example cl 2.6 subdivision; cl 2.7 demolition; Land Use Table entries). Those acts, if undertaken without consent where the Plan requires consent, are within the enforcement remit of the Act.
• Where compliance with development consent conditions, mapped standards, schedules or the Building Code of Australia is required for exempt or complying development (cl 3.1(2)-(5); cl 3.2(2)-(4)), breaches may attract enforcement action and remedies available under planning law, including orders, fines and injunctions under the Act and relevant regulations. The Plan itself flags those dependencies.

Enforcement mechanisms and decision-maker obligations

• The consent authority, the Council, is the primary decision maker and also has enforcement responsibilities under the broader statutory framework. The Plan requires the Council to keep records of assessments where development standards are contravened under cl 4.6(4); that record obligation supports transparency and administrative review routes.
• Procedural duties such as notification to the Heritage Council or local Aboriginal communities (cl 5.10(7)-(9)) are preconditions to lawful consent in the specified circumstances; failure to follow these procedural steps could render a decision vulnerable to internal review or merits/legal challenge under the Act.

Limits to Plan-based relief and prohibitions

• The Plan specifies absolute prohibitions in certain contexts, such as canal estate development (cl 2.9). Undertaking such a prohibited development would not be authorised by the Plan and would expose the proponent to enforcement action.
• The exceptions to development standards clause (cl 4.6) contains strict limitations: it cannot be used to contravene development standards for complying development, BASIX certificate commitments, cl 5.4 or cl 5.5 (cl 4.6(8)(a)-(caa)). Use of the exceptions mechanism contrary to these prohibitions would be inconsistent with the Plan and could be a basis for enforcement or challenge.

Consultation and referral outcomes as de facto enforcement checks

• Clauses requiring consultation with external bodies act as safeguards which may effectively prevent approval. For example, in airspace matters the consent authority must consult the relevant Commonwealth body and must not grant consent where that body advises the development should not be constructed (cl 6.4(2)-(4)). Compliance with such consultation requirements is enforced through the decision-making record and the lawfulness of a consent decision.

Implicit compliance costs and monitoring

• The Plan places a range of documentary and assessment obligations on applicants for sensitive uses: heritage assessments and management plans (cl 5.10(5)-(6)); heritage and Aboriginal community notification with statutory consultation windows (cl 5.10(7)-(9)); aquaculture site and operational requirements (cl 5.19; Schedule 6); flood planning considerations (cl 5.21). These generate monitoring needs and compliance costs that enforcement bodies (primarily the Council supported by State agencies) will use to vet applications and enforcement.

Remedies and acquisition

• Clause 5.1 identifies the State authority that will be the relevant acquisition authority under owner-initiated acquisition provisions of the Land Acquisition (Just Terms Compensation) Act 1991 for certain reservation categories. That mechanism can produce compulsory acquisition outcomes under the acquisition Act, which in turn have statutory compensation and enforcement procedures outside the Plan.

In sum, the Plan defines permissions and prohibitions; enforcement and penalties flow from the broader Environmental Planning and Assessment legal regime, with the Plan supplying the substantive standards and procedural steps the Council and other bodies must enforce. The Plan also embeds referral and consultation mechanisms which can functionally block development, while the exceptions clause and other procedural record-keeping requirements provide administrative bases for review and challenge.

The Plan is not a standalone statute; it is framed to operate within a hierarchy of planning, environmental, local government and other sector-specific laws. The instrument repeatedly references interactions, delegations and limitations with other Acts and policies.

State environmental planning policies and the Act

• The Plan is subject to any SEPP that prevails over it under section 3.28 of the Act (cl 1.9(1)). The Plan expressly defers to State-level exempt and complying development rules: the Schedule 2 and Schedule 3 entries are supplemental to the State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 which has State‑wide application (cl 3.1-3.2 notes). The Plan therefore operates as a local layer that complements and must yield to controlling State policy where conflicts arise.

Environmental and fisheries laws

• The Plan cross‑references biodiversity, marine and fisheries instruments when excluding environmentally sensitive areas from exempt/compliant development (cl 3.3 and references), and Schedule 6 and cl 5.19 set out aquaculture requirements that refer to aquaculture industry development plans and the Fisheries Management Act 1994 framework (cl 5.19(7) and Schedule 6 Notes). The Plan’s aquaculture constraints operate alongside fisheries licensing regimes.

Heritage and Aboriginal heritage laws

• The Plan uses the Heritage Act 1977 framework in several ways: it requires development consent for works affecting items on the State Heritage Register or subject to an interim order under the Heritage Act (cl 3.1(3)(d)). It also requires notification to the Heritage Council in specific archaeological or demolition situations and engages local Aboriginal community consultation for Aboriginal places of heritage significance (cl 5.10(7)-(9)). The Plan therefore operates alongside and invokes protections under the Heritage Act and related Aboriginal heritage provisions.

Local Government Act and public land management

• Clause 5.2 explicitly authorises classification or reclassification of public land as “operational land” or “community land” for the purposes of Part 2 of Chapter 6 of the Local Government Act 1993 and notes section 30 of that Act enables the Plan to discharge trusts effected by reclassification (cl 5.2). The Plan’s Schedule 4 provides the format for listing such public land; in practice, reclassification affects council powers over public reserves, consistent with the Local Government Act. The Plan also notes the need for Governor approval for certain discharges of trusts under Local Government Act section 30(2) (cl 5.2(5) note).

Land acquisition law

• Clause 5.1 identifies the relevant State authority to acquire land under owner-initiated acquisition provisions of the Land Acquisition (Just Terms Compensation) Act 1991 for land shown on the Land Reservation Acquisition Map. That connects planning reservation mechanisms in the Plan with compulsory acquisition procedures, compensation rules and timelines in the acquisition Act.

Crown land and Crown management acts

• The Plan excludes certain instruments from the covenant suspension clause where they are “relevant instruments” under the Crown Land Management Act 2016 or conservation agreements under the National Parks and Wildlife Act 1974, and notes that the clause does not affect the rights or interests of public authorities under any registered instrument (cl 1.9A(2)-(3)). This preserves Crown land management and conservation statutory regimes from local override.

Building law and BASIX

• Exempt and complying development require compliance with the Building Code of Australia (cl 3.1(3)(a); cl 3.2(3)(b)). Clause 4.6(8)(b) excludes using the exceptions mechanism to contravene BASIX commitment-derived standards, tying Plan discretion to State sustainability commitments made under BASIX and the associated regulation.

Transport, airports and Commonwealth aviation law

• For developments that may penetrate airport Limitation or Operations Surfaces for Walgett, Collarenebri or Lightning Ridge Airports, the Plan requires consultation with the relevant Commonwealth body and defers to that body where it advises against construction (cl 6.4). The Plan also references AS 2021,2000 for aircraft noise siting and design requirements (cl 6.5). These clauses integrate Commonwealth aviation planning and safety considerations into local planning decisions.

Rural and primary production legislation

• The Plan cross-references the Forestry Act 2012 and Local Land Services Act 2013 where RU3 Forestry uses or private native forestry may be authorised without consent (cl 2.1 note; RU3 permitted without consent list). It also references the Native Vegetation Act and property vegetation plans among instruments excluded from the covenant suspension (cl 1.9A(2)(e)).

Environmental protection and coastal laws

• Clause 3.3 excludes exempt or complying development on a list of environmentally sensitive areas including coastal wetlands, Ramsar sites, World Heritage areas and areas identified for high Aboriginal cultural or biodiversity significance. This cross-references the Coastal Management Act 2016 and Biodiversity Conservation Act 2016.

Interplay with State SEPPs and other instruments

• The Plan repeatedly reserves the operation of State instruments and provides that some matters (e.g., sewerage approvals under Local Government Act, water infrastructure approvals) require or are subject to external approvals (cl 3.2(3)(c); cl 5.12). Where the Plan has “not adopted” or “not applicable” elements, State instruments fill the gaps.

In practical terms, the Plan is part of a nested regulatory system. It exercises local regulatory power while preserving the primacy of State and Commonwealth instruments, ensuring that local permissions are interoperable with sectoral regimes for heritage, fisheries, aviation, building and Crown land management. Where the Plan imposes obligations or prohibitions, compliance typically requires coordination with the relevant State or Commonwealth licensing, consent or consultation processes identified in the Plan.

The Plan text contains a number of amendment notations that indicate incremental changes since the Plan’s original making. The clauses include amendment footnotes with year and schedule references. The Plan also flags when particular clauses were added, repealed or substituted. Below are the Plan‑internal traces of amendment events and the clauses they changed.

Commencement and name: The Plan commenced on publication to the NSW legislation website (cl 1.1AA as the commencement clause). The Plan identifies itself in cl 1.1 as Walgett Local Environmental Plan 2013.

Noted amendments in specific clauses and schedules:

• Clause 1.8A, the savings provision relating to development applications, is shown as amended in 2019: “cl 1.8A: Am 2019 (621), Sch 5[1]”.
• Clause 1.9A, the suspension of covenants, agreements and instruments, carries amendment notes: “cl 1.9A: Am 2019 (621), Sch 5[2]-[4]”.
• Clause 2.1 and the zones have an amendment notation: “cl 2.1: Am 2022 (832), Sch 1.28[1]”.
• Clause 4.2A concerning erection of dual occupancies, dwelling houses or secondary dwellings in certain zones is amended in 2022: “cl 4.2A: Am 2022 (832), Sch 1.28[3] [4]”.
• Clause 6.2 is shown as repealed and with amendment history “cl 6.2: Am 2017 (587), Sch 1 [6] [7]. Rep 2021 (225), Sch 1.” The Plan therefore records deletion of a local clause in 2021.
• Clause 5.4 (controls relating to miscellaneous permissible uses) was amended in 2018: “cl 5.4: Am 2018 (406), Sch 1.144 [1] [2]”.
• Clause 6.7 (location of sex services premises) was amended in 2017: “cl 6.7: Am 2017 (493), Sch 1.2 [1]”.
• Clause 5.24 (farm stay accommodation) and cl 5.25 (farm gate premises) were substituted in 2023: “cl 5.24: Subst 2023 (458), Sch 1[4]”; “cl 5.25: Subst 2023 (458), Sch 1[4]”.
• Schedule 1 (Additional permitted uses) has amendment entries: “sch 1: Am 2017 (587), Sch 1 [8]; 2019 (621), Sch 2.39.”
• The Land Use Table shows multiple amendments from 2016 through 2023: “Land Use tbl: Am 2016 (168), Sch 1 [2]; 2017 (493), Sch 1.1 [1]; 2017 (587), Sch 1 [1]-[5]; 2019 (137), Sch 6 [1]; 2022 (314), Sch 1; 2022 (832), Sch 1.28[2]; 2023 (458), Sch 2.81[1] [2].”
• Schedule 5 (Environmental heritage) shows amendment notes referencing 2017 adjustments: “sch 5: Am 2017 (587), Sch 1 [9] [10].”
• There is a note that map updates responsibility changed in July 2021 when responsibility for map updates moved to the Department of Planning, Industry and Environment: “Maps: Am 2017 (587), cl 4. Entries discontinued from July 2021 when responsibility for map updates moved to Department of Planning, Industry and Environment.”

Nature of amendments and governance signals:

• The amendment annotations show the Plan has been updated iteratively to reflect State policy, local priorities and statutory changes. Examples include adding cl 1.8A in 2019 (a savings provision for development applications), adding cl 1.9A suspending covenants to enable Plan‑consistent development (2019), and updating specific local provisions such as cl 4.2A and cl 5.4 through 2018-2022. The presence of multiple amendments to the Land Use Table and Schedule 1 indicates periodic refinement of permitted uses, especially at Lightning Ridge.
• Some clauses have been repealed or left “not adopted”, signalling that the local plan-making authority chose not to implement particular optional local controls or that State instruments have filled those roles (for example cl 4.4 and 4.5 “Not adopted”; cl 5.9 “Not adopted”; cl 6.2 repealed).
• The mapping governance change in 2021 indicates a transfer of practical map maintenance responsibilities to a state department. That operational change affects how maps are updated and maintained and may influence how quickly local zoning or mapped standards are updated.

What the amendment record does not show

• The Plan text records amendment references but does not include detailed explanatory memoranda, second reading speeches or the full text of the amending instruments in this copy. The Plan therefore documents amendment events and the clauses affected but not the policy rationales beyond what individual amending instruments state in their own instruments.

Overall, the recorded amendment history indicates the Plan is actively maintained and that key local policy areas, such as heritage lists, additional permitted uses at Lightning Ridge, minimum lot size rules and special local controls (music, sex services location, aquaculture, farm stay) have been the focus of revisions over time.

The Plan text provided does not include any judicial decisions or litigation history. It names no cases and contains no citations to judicial processes. The instrument records procedural obligations, referral mechanisms and consultation duties that could generate administrative or judicial review in practice, for example:

• the requirement for the consent authority to keep a record of assessments under cl 4.6(4) when a development standard is contravened is a decision‑record duty that in other contexts supports merits or judicial review claims under the Act;
• heritage notification obligations to the Heritage Council and local Aboriginal communities (cl 5.10(7)-(9)) create procedural steps that, if not followed, could be grounds for challenge to a consent decision; and
• consultation with the relevant Commonwealth body where airport obstacle surfaces may be penetrated (cl 6.4) creates an external referral obligation that may produce material administrative consequences.

However, the Plan itself contains no recorded litigation, and the provided text does not name or summarise any court or tribunal decisions, appeals to the Land and Environment Court, or litigation about the Plan’s clauses. Where judicial interpretation would be material to practitioners, the Plan’s procedural and discretion clauses , for instance cl 4.6 (exceptions to standards), cl 5.10 (heritage procedural duties) and cl 1.9A (suspension of covenants) , present the kinds of legal questions that commonly attract litigation under the Environmental Planning and Assessment Act, but any such cases are outside the scope of the Plan text supplied.

Practitioners should therefore treat the Plan’s silence as neutral: the instrument creates administrative pathways and statutory duties but does not itself document any contested decisions or rulings. For precedent or case law interpreting equivalent LEP provisions, counsel should look to decisions under the Environmental Planning and Assessment Act and cases that examine similar LEP clauses in other instruments, noting that cl 4.6 incorporates the standard exception-to-standard approach that elsewhere has produced case law on the “unreasonable or unnecessary” test; the Plan itself, however, does not provide those cases.

This section flags concrete traps, procedural pitfalls and friction points that follow directly from the Plan’s text. Each “gotcha” is a mechanism or rule in the Plan that commonly causes unexpected outcomes for practitioners, owners or applicants.

1. Repeal and savings interplay for pending development applications (cl 1.8; cl 1.8A)

• If a development application was made before the Plan commenced and had not been finally determined before commencement, cl 1.8A requires it to be determined as if the Plan had not commenced. Practitioners must check lodgement dates to know whether the Plan’s rules apply. The saving clause interacts with the Act’s Division 3.5 mechanisms allowing an application to be dealt with concurrent with a draft instrument; timing and procedural choices can therefore be critical.

2. Suspension of covenants has limits and does not affect public authority rights (cl 1.9A)

• Clause 1.9A suspends private covenants to the extent necessary to permit development under the Plan, but it excludes covenants the Council imposed, conservation agreements under statutory Acts, property vegetation plans, biobanking agreements and planning agreements (cl 1.9A(2)(a)-(g)). The clause also preserves public authority rights under registered instruments (cl 1.9A(3)). Practitioners should not assume all covenants can be sidelined simply because the Plan allows development.

3. Exempt and complying development schedules are blank; State SEPP is the operative route (cl 3.1-3.2; Schedule notes)

• Schedule 2 and Schedule 3 in this Plan are largely empty and refer to the State SEPP (Exempt and Complying Development Codes) for the majority of such pathways. Users must rely on the State SEPP text and regulations; local “exempt” labels are not supplied in the Plan. Practitioners must therefore cross‑check State provisions for exempt/compliant rights rather than relying on a local Schedule.

4. Exceptions to development standards require explicit demonstration and recordkeeping; some standards cannot be bypassed (cl 4.6)

• The exceptions mechanism allows departures only if the applicant demonstrates that compliance is unreasonable or unnecessary and provides environmental planning grounds (cl 4.6(3)(a)-(b)). It also forbids departure from certain standards such as complying development standards and BASIX-related standards (cl 4.6(8)(a)-(b)). The consent authority must keep a record (cl 4.6(4)). Failing to include the regulatory documentation required by the Regulation when seeking a variation can render an application defective.

5. Minimum lot sizes and multiple layered clauses (cl 4.1, 4.1AA, 4.1A-4.1C, 4.1B)

• Minimum lot sizes are shown on the Lot Size Map and various strata, community title and split-zone exceptions apply. There are specific carve-outs and special case exceptions (Lightning Ridge Lot 57 DP 705026 in cl 4.1C). Multiple overlapping provisions govern strata and community title subdivisions and split-zone lots (cl 4.1AA; cl 4.1A; cl 4.1B). Practitioners must map the parcel to the Lot Size Map and check applicable exception clauses; misreading which clause applies can lead to invalid expectations about subdivision potential.

6. Canal estate development prohibition is absolute (cl 2.9)

• Canal estate development is prohibited. The Plan’s definition is wide and includes use of fill to raise land in flood planning areas or excavation to create waterways (cl 2.9(2)). Proponents contemplating water-based residential developments should not expect the Plan to permit canal estate modalities.

7. Heritage consents and mandatory notifications (cl 5.10)

• Work affecting heritage items, Aboriginal places or archaeological sites often requires consent and statutory notification to the Heritage Council or local Aboriginal communities with 28-day windows (cl 5.10(7)-(9)). Failure to complete these notifications before decision-making may render approvals vulnerable to challenge and cause delays.

8. Music protections for licensed premises may not remove noise obligations (cl 5.20)

• Clause 5.20 prevents refusal based on a range of subjective music characteristics and prohibits refusal on noise grounds if the consent authority is satisfied the noise can be managed to an acceptable level (cl 5.20(1)-(2)). This creates a conditional entitlement; proposers must be prepared to demonstrate noise mitigation measures and Council must be satisfied. The clause does not automatically relieve operators of general noise or nuisance regulation under other laws.

9. Airspace and aircraft noise consultation obligations are obligatory and potentially determinative (cl 6.4-6.5)

• If proposed development penetrates mapped Limitation or Operations Surfaces, the consent authority must consult the relevant Commonwealth body and must not grant consent if that body advises against construction (cl 6.4(2)-(4)). For developments in ANEF contours of 20 or greater, the consent authority must consider AS 2021,2000 siting criteria and indoor design sound levels (cl 6.5(3)). Developers near the three named airports should anticipate substantive Commonwealth input and potential site rejection.

10. Aquaculture and intensive livestock specifics impose operational constraints (cl 5.18; cl 5.19; Schedule 6)

• Aquaculture and intensive livestock provisions set out geographic exclusion zones, discharge and design requirements and capacity thresholds below which consent is not required (cl 5.18(4)-(5); cl 5.19; Schedule 6). For example, poultry and pig farm proximity thresholds and intensive aquaculture freshwater discharge limits are detailed. Operators need to reconcile these with fisheries, water and environmental licensing regimes.

11. Essential services requirement is precondition for consent (cl 6.6)

• The consent authority must be satisfied that essential services (water, electricity, sewage, stormwater, vehicular access) are available or adequately arranged before granting consent (cl 6.6). Applications lacking clear service arrangements risk refusal or conditional consent.

12. Mapping and map update responsibility changes

• The Plan delegates map amendment approvals to the local plan-making authority and states that maps are to be kept and made available as required by the Minister (cl 1.7). Map updates responsibility moved to a State Department in July 2021; practitioners must check the current published maps on the NSW Planning Portal as the authoritative source.

These are practical points where the Plan’s text creates timing, procedural, evidentiary and substantive traps. Each follows directly from a Plan clause and requires explicit checking of maps, notification duties, exceptions, and external statutory overlays.

This section sets out practical, clause‑based steps and a compliance checklist for proponents, practitioners and decision makers working with development or land use questions under the Walgett Local Environmental Plan 2013.

Step 1 , Confirm the applicable maps and zoning

• Identify the land on the Land Application Map and Land Zoning Map (cl 1.3; cl 2.2). Maps are authoritative and may have been updated by the Department of Planning, Industry and Environment; verify the current maps on the NSW Planning Portal as required by cl 1.7 (maps kept and made available).
• Check the Lot Size Map and Height of Buildings Map where subdivision or building height is under consideration (cl 4.1; cl 4.3).

Step 2 , Determine permissible uses and consent pathway

• Consult the Land Use Table entries for the zone to determine whether the proposed use is permitted without consent, permitted with consent or prohibited in the zone (cl 2.3). If the use is not listed, it is treated as prohibited except where Schedule 1 or other specific clauses allow otherwise.
• For uses that may be allowed without consent, confirm exempt/compliant status via Schedule 2 and Schedule 3 in the Plan and, crucially, via the State SEPP (Exempt and Complying Development Codes), which is the primary source for exempt and complying development rights referenced by the Plan (cl 3.1-3.2 notes). Do not assume local schedule blanks mean no pathway exists; refer to the State SEPP.

Step 3 , Check overlay and local provisions that impose additional requirements

• Heritage overlays: If the site is in Schedule 5 or within a heritage conservation area, plan for heritage assessments, possible heritage management documents or conservation management plans and statutory notification to the Heritage Council and local Aboriginal communities where relevant (cl 5.10(4)-(9)).
• Flood planning: For land within a flood planning area, ensure the proposal is compatible with flood function and behaviour, addresses climate change projections and evacuation, and meets the matters in cl 5.21 including reference to the Considering Flooding guideline and Flood Risk Management Manual.
• Airspace and aircraft noise: For sites near Walgett, Collarenebri or Lightning Ridge Airports or within ANEF contours, check Obstacle Limitation Surface and Noise Exposure Forecasts and prepare acoustic design statements as required under cl 6.4 and cl 6.5.
• Aquaculture and intensive livestock: For aquaculture proposals, use Schedule 6 to check conservation exclusion zones, discharge rules and pond design; for intensive livestock, use cl 5.18 to test capacity thresholds and location restrictions.

Step 4 , Identify required documentation and specialist reports

• Where contravening mapped development standards, prepare the documentation required by the Regulation to show compliance with cl 4.6(3)(a)-(b); the consent authority must be satisfied and keep a record (cl 4.6(3)-(4)).
• Prepare statements of environmental effects addressing the matters listed in cl 5.18(3) for intensive livestock developments and cl 5.19(2) for pond/tank aquaculture where consent is needed.
• For heritage sites, prepare heritage assessments/heritage impact statements, and where required, heritage management documents or conservation management plans (cl 5.10(5)-(6)).

Step 5 , Plan consultation and notification steps into the application timetable

• For archaeological sites or nominated State heritage items, allow at least 28 days for Heritage Council responses after notification (cl 5.10(7) and (9)).
• For Aboriginal places of heritage significance, engage and notify local Aboriginal communities and allow 28 days for responses (cl 5.10(8)).
• For airport impact proposals, arrange early referral/contact with the relevant Commonwealth body because their advice can be decisive and the consent authority may not grant consent if the body advises against the development (cl 6.4(2)-(4)).

Step 6 , Check private covenants and Crown instruments

• Review registered covenants and other instruments. Although cl 1.9A allows suspension of covenants to the extent necessary to enable Plan-consistent development, it excludes certain covenants, and it does not affect public authority interests. Confirm whether the covenant is excluded under cl 1.9A(2) and whether the Council imposed it (cl 1.9A(2)(a)-(c)); do not rely on the suspension clause until the legal status of the instrument is established.

Step 7 , Ensure essential services and site servicing are addressed

• Before application, obtain evidence that essential services can be provided or show acceptable arrangement plans (cl 6.6). The consent authority must be satisfied that water, electricity, sewage and access will be available when required.

Step 8 , Consider temporary use options where relevant

• If the intended use is temporary, consider cl 2.8’s regime which permits temporary uses for up to 30 days in any 12 months subject to Council satisfaction on amenity, restoration and environmental impacts. For sales offices in new estate releases different limits may apply (cl 2.8(4)-(5)).

Step 9 , Anticipate special restrictions and prohibitions

• Avoid proposing canal estate development in any form as cl 2.9 prohibits it.
• For certain special zones and mapped additional permitted uses at Lightning Ridge, consult Schedule 1 to see if an additional use has been mapped and what conditions apply; Schedule 1 contains multiple site‑specific additional permissions.

Step 10 , Prepare for conditions, monitoring and compliance obligations

• Expect conditions on consents addressing heritage conservation, environmental protections, noise management for licensed premises, waste and water handling for eco-tourism and aquaculture, and ongoing maintenance or monitoring plans (cl 5.13; cl 5.19; cl 5.20).
• Where a consent authority allows variation under cl 4.6, it must keep a record of its assessment and those records will be consequential for any review or challenge (cl 4.6(4)).

Practical checklist for submission

• Confirm zone and mapped controls (Land Zoning, Lot Size, Height of Buildings, Heritage Map).
• Confirm whether development is permitted without consent, permitted with consent or prohibited (Land Use Table).
• Verify whether the proposal is exempt or complying under the State SEPP and gather all required compliance documentation.
• Identify and commission required specialist reports: heritage, flood, acoustic, environmental impact statements, agricultural viability for rural workers’ dwellings (cl 4.2B(3)), or aquaculture design reports (Schedule 6).
• Prepare contravention documentation if relying on cl 4.6 exceptions, including the planning grounds and an environmental assessment.
• Map and document essential services arrangements per cl 6.6.
• Allow statutory consultation timeframes for heritage and aviation referrals and ensure notifications are done before lodgement where required.
• Check registered covenants and Crown instruments for exclusion under cl 1.9A.
• Provide an implementation plan for restoration where temporary uses are sought per cl 2.8(3)(d).

Following these steps will align proposals with the Plan’s procedural and substantive requirements and anticipate the principal checks the Council will apply when assessing an application.
