Waite Trust (Vesting of Land) Act 2020

The Act is compact and uses a small number of discrete legal concepts to produce its effect. The main concepts are:

• Definitions and scope of land: s 3 defines "prescribed land" and "Waite land" by specific allotments and certificates of title. "Prescribed land" and "Waite land" overlap. Prescribed land comprises Allotments 332 and 10 (both at Register Book Vol 5540 Folio 952). Waite land comprises those two allotments and an additional Allotment 101 in Deposited Plan 12019 (Register Book Vol 5408 Folio 215). The definition of Waite Trust ties to the 26 February 1914 transfer and to the Waite Trust (Miscellaneous Variations) Act 1996 (s 3).

• Statutory variation of a charitable trust: s 4(1) operates as the statutory mechanism for varying the terms of the Waite Trust by expressly permitting vestings that would otherwise be inconsistent with the trust instrument. The Act does not purport to be an exercise under a general trustee variation power, rather it directly varies the trust terms for the specific purpose of permitting vestings.

• Ministerial power and administrative act: the Minister for Education, who is the registered proprietor in fee simple, has discretion to choose the portion of prescribed land to vest in the Commissioner, subject only to the requirement to publish a notice in the Gazette (s 4(1)). The power is administrative, triggered by Ministerial determination and publication.

• Immediate extinguishment of encumbrances and dedications: s 4(2) operates mechanically to sever vested land from the trust and to revoke dedications made under the Crown Lands Act 1929, the Crown Land Management Act 2009 or "any other Act". The effect is that, on notice, the land becomes subject to freehold ownership by the Commissioner unencumbered by the identified restrictions.

• Revesting regime by regulation: s 4(3)-(4) contemplates that if the Commissioner no longer requires vested land, there will be a regulatory scheme prescribing how revesting to the Minister occurs and what interests attach when the land is revested. The content of that scheme is not in the Act, it is to be set out in regulations under s 6.

• Property recording: s 4(5) obliges the Registrar‑General to take action, on application by the Minister or Commissioner, to record or give effect to the vesting, including issuing, noting or amending certificates of title, and empowers the Registrar‑General to take other actions considered appropriate.

• Fiscal exemption and immunity: s 4(6) removes stamp duty from the vesting transaction. s 5 provides that there is no civil or criminal liability attached to a person for acts or omissions done in good faith and without negligence under or in accordance with the Act.

• Regency of subordinate law: s 6 gives the Governor power to make regulations "contemplated by, or necessary or expedient for the purposes of" the Act, which is the vehicle for the revesting scheme and other procedural or consequential measures.

These concepts together reallocate legal ownership of defined parcels from the Minister acting under a trust to the Commissioner, for the discrete purpose of roadworks as defined by reference to the Highways Act 1926.

The Act creates immediate legal roles and affects identifiable office-holders and classes of stakeholders.

• Minister for Education: The Minister is the decision-maker. The Act authorises the Minister, who is identified as the registered proprietor in the Preamble and as "Minister" in s 3, to determine and vest portions of the prescribed land in the Commissioner by Gazette notice (s 4(1)). The Minister is also the recipient of land revested under s 4(3).

• Commissioner of Highways: The Commissioner, defined in s 3, becomes the new registered proprietor of the vested portion in fee simple. The Commissioner will be the entity to hold freehold title for "roadworks", as that term is defined by reference to the Highways Act 1926 (s 3). The Commissioner is required, if no longer requiring the land, to have it revested to the Minister "in accordance with the scheme prescribed by the regulations" (s 4(3)).

• Registrar‑General: The Registrar‑General has record-keeping and title administration duties. Under s 4(5)(a) the Registrar‑General "must, on application by the Minister or the Commissioner, take such action as the Registrar‑General considers appropriate to record or give effect to the vesting of land", including issuing or amending certificates of title. The Registrar‑General may also take other action in relation to instruments or land as considered appropriate (s 4(5)(b)), giving that office a discretionary role in how the record reflects the statutory vesting.

• Beneficiaries of the Waite Trust and institutional users: The Waite Trust is a charitable trust for establishment of an agricultural high school. The Act's variation discharges the vested portion from the trust terms (s 4(2)(a)). That means the trust beneficiaries, insofar as they have practical or institutional expectations or rights under the trust, will be affected by the permanent removal of land from the trust while vested in the Commissioner, and again by the terms that will attach on any revesting (s 4(4)).

• Third parties with interests, covenants, easements or dedications: s 4(2)(a) and (b) declare that vested land is freed from "any other relevant interests, conditions, covenants, easements or reservations" and revokes dedications made under specified Crown land Acts or "any other Act". Those with affected private rights, statutory dedications or easements that are extinguished by operation of the Act will experience a change in property rights, though the Act does not create compensation entitlements.

• Agencies involved in roadworks and public infrastructure: roadworks are the stated purpose in the Preamble and are defined by reference to the Highways Act 1926 (s 3). The agencies delivering roadworks, contractors, and local planning branches will be operationally affected by the availability of land held by the Commissioner and by the Minister's decisions as to what portion is vested.

• State revenue administration: the Act removes stamp duty on the vesting (s 4(6)). Revenue agencies will see one-line fiscal effect in the transaction, with the Act itself creating the exemption.

• General public: the Act enables parts of the Waite land to be put to public road use. That shifts use and ownership from a charitable trust-owner arrangement to a statutory highway-owner arrangement in the Commissioner, with consequent changes to access, maintenance obligations and land use.

In sum, the principal actors are the Minister, the Commissioner, the Registrar‑General, beneficiaries of the Waite Trust, holders of private or statutory interests in the prescribed land, and agencies responsible for roadworks and revenue administration.

The Act establishes a compact set of duties and rights distributed across the Minister, the Commissioner, the Registrar‑General and third parties. The operative provisions and their practical effect are:

Minister for Education

• Power to vest: The Minister has the unilateral administrative power to determine "a portion of the prescribed land" to vest in the Commissioner in fee simple, by Gazette notice (s 4(1)). The section imposes a procedural requirement of notice in the Gazette but no express substantive criteria or consultation obligations are specified.

• Receptive duty on revesting: If land is revested to the Minister under the regulations scheme, the Minister becomes the registered proprietor again and the land is taken to be subject to the Waite Trust and other prescribed interests at the time of revesting (s 4(3)-(4)).

Commissioner of Highways

• Right to hold fee simple: Upon publication of the Minister's notice, the Commissioner acquires the fee simple estate in the portion vested (s 4(1)). That fee simple is freed of the Waite Trust terms and other relevant encumbrances (s 4(2)(a)) and freed of certain statutory dedications (s 4(2)(b)).

• Obligation to follow revesting scheme: If the Commissioner no longer requires the land, the Commissioner must cause the land to be revested in the Minister according to the regulations scheme (s 4(3)). The Act does not prescribe the mechanics of that requirement; it delegates them to subordinate legislation.

Registrar‑General

• Recording duty: On application by either ministerial party, the Registrar‑General "must" take such action as considered appropriate to record or give effect to the vesting, explicitly including issuing, noting or amending certificates of title (s 4(5)(a)). That is a mandatory administrative duty triggered by application.

• Discretionary power: The Registrar‑General "may take any other action" in relation to instruments or land considered appropriate given the operation of the Act (s 4(5)(b)). That confers discretion as to auxiliary or consequential entries on the register.

Third-party private rights and statutory dedications

• Extinguishment on vesting: Any land vested by notice is, on publication of that notice, "freed and discharged" from trust terms and "any other relevant interests, conditions, covenants, easements or reservations" (s 4(2)(a)). Additionally, any dedication made under the Crown Lands Act 1929, the Crown Land Management Act 2009 or "any other Act" relating to the vested land is revoked (s 4(2)(b)). Those clauses are self-executing: they operate on the publication of the Minister's notice to alter legal rights attaching to the land.

General protections and limitations

• Good faith and non-negligence immunity: s 5 provides that no civil or criminal liability attaches to a person "in respect of any act or omission done in good faith and without negligence under or in accordance with this Act". That creates a defence or immunity for persons acting under the Act, conditioned on good faith and absence of negligence.

• Exemption from stamp duty: s 4(6) expressly removes stamp duty liability for the vesting. The practical effect is a statutory fiscal exemption for the transaction.

Regulatory powers

• Regulation-making head of power: s 6 allows the Governor to make regulations necessary or expedient to give effect to the Act, which will include the revesting scheme and any procedural or consequential matters not specified on the face of the Act.

The Act imposes few procedural constraints on the Minister's discretion to vest. The Registrar‑General has mandatory duties on application and discretionary powers for consequential actions. The Commissioner gains ownership rights but carries the obligation to return land if it is no longer required, subject to regulations. Third-party rights are extinguished by operation of the Act on notice.

The Act does not create new offences nor specify civil penalties. Its enforcement architecture is administrative and declaratory rather than punitive. The principal enforcement and liability rules are as follows:

• No express criminal or civil penalties: The Act contains no provisions that penalise non-compliance by private persons or public officers with fines, imprisonment, or statutory pecuniary penalties. It does not create offences for wrongful use of land, nor does it prescribe enforcement mechanisms by which a contravention will be prosecuted.

• Immunity for good faith, non-negligent acts: s 5 creates a protective legal shield, stating that "No civil or criminal liability attaches to a person in respect of any act or omission done in good faith and without negligence under or in accordance with this Act." That does not remove remedies where actions were negligent or in bad faith. The immunity operates as a statutory defence or exclusion for acts carried out under the Act's authority.

• Administrative actions and recording: The Registrar‑General is mandated to take steps to record the vesting on application (s 4(5)(a)). The practical effect is that property title records will reflect the transfer, which is the principal operative enforcement tool for giving effect to legal ownership. The Registrar‑General's discretionary capacity (s 4(5)(b)) allows additional administrative entries or notations to support the Act's operation.

• Revesting obligation: s 4(3) requires that land no longer required by the Commissioner "must" be revested in the Minister in accordance with the regulations. Enforcement of that obligation is not detailed in the Act. Compliance will depend on the content of the regulations and on the ordinary administrative and public law checks on executive decision-making.

• Regulatory instruments: s 6 empowers the Governor to make regulations "contemplated by, or necessary or expedient for the purposes of" the Act. Regulations may create administrative duties and could provide enforcement mechanisms and procedural safeguards. Until regulations are promulgated, the Act's enforcement landscape is limited to the recording obligations and the immunity clause.

• Remedy landscape for affected third parties: The Act extinguishes certain private and statutory interests upon vesting (s 4(2)(a)-(b)). The Act does not specify compensation procedures. Where interests are removed, the available legal response would depend on general property law, trust law, and public law remedies, but the Act itself neither prescribes payment nor creates a private right to compensation. The s 5 immunity may limit claims against officials acting under the Act if those officials acted in good faith and without negligence.

In short, the Act enforces the transfer of title by administrative steps and title recording rather than by penal sanctions. Immunity protects those acting under the statute from civil or criminal liability where they meet the good faith and non-negligence threshold.

The Act explicitly cross-references and displaces provisions in several other statutory frameworks and a prior trust variation statute. The interaction points are:

• Waite Trust and prior variation history: The Act defines "Waite Trust" as the charitable trust arising from the 1914 transfer and as varied by the Waite Trust (Miscellaneous Variations) Act 1996 (s 3). The 2020 Act operates as a further statutory variation of the trust by authorising vesting of part of the prescribed land and by declaring that vested land is freed from the trust terms (s 4(1) and s 4(2)(a)). The Act therefore sits in the chain of legislative instruments that have modified the original trust terms.

• Highways Act 1926 definition linkage: The term "roadworks" in the Act is given the meaning it has in the Highways Act 1926 (s 3). That definition constrains the purpose for which the Commissioner will hold the vested land and aligns the Act to the operational regime of the Highways Act. Any use outside the definition of "roadworks" would fall outside the statutory purpose recorded in the Preamble and the s 4(1) vesting power.

• Crown Lands Act 1929 and Crown Land Management Act 2009: s 4(2)(b) expressly revokes "any dedication made under the Crown Lands Act 1929, the Crown Land Management Act 2009 or any other Act in relation to the land vested in the Commissioner by the notice". That provision directly alters land status under those Crown land regimes by removing statutory dedications on the vested land. Where dedications previously restricted use or required particular management, those restrictions are revoked by operation of s 4(2)(b).

• Land registration regime: s 4(5) empowers and obliges the Registrar‑General to take steps to record the vesting, including amending certificates of title. That interacts with the general Torrens land registration system and with the Registrar‑General's statutory powers and duties. The Act delegates to the Registrar‑General the administrative means of effecting the change in title, consistent with land registration legislation.

• Stamp duty and revenue law: s 4(6) exempts the vesting from stamp duty. This creates an express carve-out from State revenue law, and operates to prevent collection of stamp duty that would ordinarily be payable on transfers of land. The Act therefore modifies the fiscal interaction of the vesting with the revenue statutes administering stamp duties.

• Delegated legislation: s 6 authorises the Governor to make regulations necessary for the Act's operation. The yet-to-be-made regulations will determine procedural interactions, for example, the scheme for revesting required by s 4(3). Those regulations will be made and operate within the normal subordinate law framework, and will need to be interpreted in light of the Act's headings and purposes.

• Interaction with private rights and covenants: s 4(2)(a) releases vested land from "any other relevant interests, conditions, covenants, easements or reservations". Where those interests have origin in private agreements, easement instruments, planning approvals or statutory instruments, the Act's operation will alter property rights by statutory displacement. The Act does not label its effect as compensation-bearing, and makes no express provision to preserve or protect affected private rights.

Overall, the Act is drafted to clear title and statutory constraints on the prescribed portion so that it can be held in fee simple by the Commissioner for roadworks. It does so by explicitly revoking dedications under named Crown land statutes and by directing land-recording agencies to reflect the new ownership, while exempting the transaction from stamp duty. The Act leaves several consequential and procedural matters to subordinate regulation.

The Act's legislative history as provided in the text is brief and singular. The key milestones recorded in the Legislative history box are:

• Assent: 30 July 2020. The Act received royal assent on 30 July 2020.

• Commencement: The Act's commencement was fixed by proclamation and recorded in the Gazette as 10 September 2020 (Gazette 10.9.2020 p4558). Section 2 specifies the Act "comes into operation on a day to be fixed by proclamation", and the Legislative history notes that commencement date.

• Principal Act identifying citation: The Act is cited as Waite Trust (Vesting of Land) Act 2020 and designated No 24 of 2020.

No amendments subsequent to assent are indicated in the provided Legislative history. The Act itself references an earlier statutory variation, the Waite Trust (Miscellaneous Variations) Act 1996, as part of the definition of "Waite Trust" (s 3). That reference records prior legislative intervention on the trust, but the 2020 Act is a standalone, self-contained measure effected by the 2020 Parliament.

There are no entries in the text indicating later amending Acts, regulation-making dates, or legislative reviews. The absence of further amendment entries in the provided text indicates that, as at the cut-off of the Legislative history as printed, no subsequent amendments had been recorded in the Act text supplied.

For users requiring chronological detail beyond assent and commencement, the Act points to official sources for subordinate legislation and updates, for example the Index of South Australian Statutes or the state legislation website as noted in the Notes appended to the Legislative history.

The Act text contains no recorded or cited litigation history. It does not reference any court decisions, nor does it list disputes, injunctions or declaratory judgments in relation to its operation. The only judicially relevant content in the statute is the statutory statements that may be functional in litigation contexts, such as s 4(2) extinguishing certain interests upon Gazette notice, s 4(3)-(4) preserving the status on revesting, and s 5 providing an immunity for acts done in good faith and without negligence.

The absence of named cases in the provided source means there are no precedent lines recorded in the Act about challenges to the Minister's discretion to vest, to the revocation of dedications, to the Registrar‑General's entries, to the revesting scheme, or to the immunity provision. The Act does, however, create situations that are ordinarily capable of generating litigation in property and public law contexts, for example:

• Disputes about whether a Gazette notice validly described the portion of prescribed land intended to be vested, which would involve statutory interpretation of the Gazette notice requirement in s 4(1) and the definitions in s 3.

• Claims by parties who assert rights under covenants, easements, dedications or other interests that have been extinguished by operation of s 4(2). The Act extinguishes those interests, but where private parties consider the extinguishment improper or seek compensation, litigation could be contemplated under general law causes of action or constitutional or statutory compensation principles. The Act itself contains no compensation scheme.

• Judicial review of administrative decisions, including the Minister's exercise of the s 4(1) power, or the Registrar‑General's discretionary actions under s 4(5)(b). Public law principles could be engaged if procedural fairness, jurisdictional error, or statutory misinterpretation is alleged. The Act makes the Minister's decision-making power explicit, but does not set out internal decision criteria or consultation procedures.

• Allegations of negligence or bad faith by officials are constrained by s 5, which exempts liability when acts are done in good faith and without negligence. Actions alleging negligence would require proof that the requisite standard was not met.

Because the Act itself contains wide discretionary provisions and extinguishes certain rights on publication, it sets up some of the typical factual and legal issues that lead to litigation in property, administrative and trust law. The Act supplies the statutory text that a court would need to interpret, but the provided source contains no judicial interpretation or reported litigation to date.

Researchers seeking any subsequent litigation will need to consult court databases, the South Australian consolidated legislation annotations, and case law repositories for events after the Act's commencement.

The Act is short and functional, but it contains several drafting points, operational features and delegated-legislation dependencies that practitioners should note. These "gotchas" are concrete mechanics that can affect implementation, rights and administration:

• Broad ministerial discretion with minimal procedural safeguard: s 4(1) allows the Minister to vest "a portion of the prescribed land as may be determined by the Minister" by Gazette notice. The Act prescribes no substantive criteria, no consultation obligations with beneficiaries of the Waite Trust, and no specification of planning, environmental, or heritage processes. The sole procedural requirement is publication in the Gazette. That means the Minister's selection of portion and timing are tightly within executive discretion as the Act is drafted.

• Prescribed land versus Waite land: The definitions in s 3 specify two overlapping concepts. Prescribed land is the two allotments in Vol 5540 Folio 952, while Waite land includes those two allotments and an additional allotment in Vol 5408 Folio 215. The Act authorises vesting only of "prescribed land", not the whole of the Waite land, except that revested land is taken to be subject to the Waite Trust at revesting time under s 4(4). Practitioners must therefore carefully identify parcel boundaries and titles before action is taken.

• Self-executing extinguishment of interests: On publication of the Minister’s notice, s 4(2)(a) frees the vested land from the Waite Trust and "any other relevant interests, conditions, covenants, easements or reservations". The statute does not require inquiry into or extinguishment steps against registered interests beyond the Registrar‑General's recording duties. The effect is statutory displacement of property rights on publication, which may surprise holders of existing private easements or covenants.

• Wide revocation of dedications: s 4(2)(b) revokes any dedication made under the Crown Lands Act 1929, the Crown Land Management Act 2009 or "any other Act" relating to the vested land. The broad phrase "any other Act" means dedications under obscure or older statutes may be revoked as well. This produces potential legal and administrative complexity if multiple statutory regimes have previously dedicated the land for particular uses.

• Lack of compensation provision: The Act neither stipulates compensation nor preserves procedures for compensation where private or public statutory interests are extinguished. The Act's silence leaves open questions about the availability of compensation under general law or other statutes. The immunity at s 5 may limit claims against officials acting under the Act, but it does not address proprietary or constitutional remedies that affected parties might pursue outside actions against individual officials.

• Revesting details deferred to regulations: s 4(3) says revesting must occur "in accordance with the scheme prescribed by the regulations", and s 4(4) takes revested land to be subject to Waite Trust terms and "any other relevant interests, conditions, covenants, easements, reservations or dedications prescribed by the regulations". Practically all mechanics for returning land from the Commissioner to the Minister, and the precise interests to be reinstated, are left to subordinate legislation. Until those regulations are made, there is uncertainty about timing, conditions, process and any compensation or restoration obligations.

• Registrar‑General discretion: While s 4(5)(a) mandates action on application, s 4(5)(b) gives the Registrar‑General latitude to "take any other action" considered appropriate. That degree of discretion may lead to variation in how entries are made, and may require coordination between legal advisers and the land titles office to ensure the registry reflects the statutory operation correctly.

• Stamp duty exemption scope: s 4(6) states "No stamp duty is payable with respect to the vesting of land under this section." The clause appears to be a straight exemption, but practitioners should note it applies only to the act of vesting under s 4, and not necessarily to other consequential transactions involving the land unless covered by regulation or separate statutory provision.

• Immunity threshold: s 5 conditions immunity on acts or omissions being done "in good faith and without negligence". That is narrower than an absolute indemnity. Parties seeking to rely on s 5 must be prepared to show both good faith and absence of negligence in their conduct under the Act.

• Technical title description requirement: The Gazette notice is the instrument effecting vesting. In practice, defective or ambiguous descriptions in the Gazette notice could raise disputes about which part of the prescribed land was intended to be vested. The Act does not prescribe a minimum content or form for the Gazette notice beyond publication.

• Interaction with planning and environmental law not specified: The Act is focused on title and dedications. It makes no express provision about planning approvals, environmental assessments or statutory permits that may otherwise be required for roadworks. Those obligations may remain applicable to the roadworks themselves under separate legislation and administrative regimes.

These features mean that a successful implementation requires careful drafting and coordination between the Minister's office, the Commissioner, the Registrar‑General, and any agencies responsible for planning, environment, heritage and revenue. The Act centralises the vesting power but delegates critical procedural and remedial detail to regulations and administrative practice.

For each principal actor the Act creates a small number of clear steps and administrative obligations. The following checklist is drawn directly from the Act’s text and its operative mechanics.

For the Minister for Education (decision-maker and registered proprietor)

• Identify parcels: Confirm the exact parcels listed as "prescribed land" in s 3, namely Allotment 332 in Filed Plan 12138 and Allotment 10 in Deposited Plan 39536 as recorded at Register Book Volume 5540 Folio 952. Verify current titles and any encumbrances for clarity.

• Determine portion: Exercise the statutory discretion under s 4(1) to determine the portion to be vested, consistent with the stated purpose of carrying out roadworks. Document the factual and legal basis for the Minister’s determination to create a clear administrative record.

• Prepare Gazette notice: Prepare and publish the notice of vesting in the Gazette as required by s 4(1). Ensure the description in the notice unambiguously identifies parcels, area and relevant instruments, to avoid title uncertainty.

• Apply to the Registrar‑General: Following publication, make application to the Registrar‑General under s 4(5)(a) to record or give effect to the vesting, including any required certificate of title issuances or amendments.

• Record and archive files: Retain administrative records proving good faith and absence of negligence, given the immunity provision in s 5 conditions immunity on those factors.

For the Commissioner of Highways (recipient and holder of fee simple)

• Accept vesting: On Gazette notice, the Commissioner becomes the fee simple owner of the vested portion (s 4(1)). Ensure the Commissioner has internal procedures to accept title, insurances and land management plans consistent with holding property for roadworks.

• Apply to Registrar‑General: Make application to the Registrar‑General to ensure the title record is amended to reflect the Commissioner as registered proprietor in fee simple (s 4(5)(a)).

• Use for roadworks: Ensure use aligns with the meaning of "roadworks" as defined in the Highways Act 1926 (s 3). Maintain records demonstrating that the land is required for those purposes.

• Revesting procedure: If the land is no longer required, follow the revesting procedure "in accordance with the scheme prescribed by the regulations" (s 4(3)). Monitor and prepare for the requirements once regulations are published.

• Maintain records for immunity: Document actions and decisions to show they were done in good faith and without negligence, to invoke protection under s 5 if engaged.

For the Registrar‑General (land titles office)

• Respond to applications: On application by either the Minister or the Commissioner, take the action the Registrar‑General considers appropriate under s 4(5)(a), including issuing or amending certificates of title.

• Make appropriate notations: Consider whether additional entries or notations are appropriate under s 4(5)(b) to reflect statutory vesting, revocation of dedications, and any special conditions attaching to revested land (s 4(4)).

• Coordinate with revenue office on stamp duty: Note s 4(6) exempts stamp duty for the vesting. Ensure registration practice aligns with the statutory exemption and that documentary systems do not automatically generate stamp duty assessments for such vestings.

For trustees, beneficiaries and holders of covenants, easements or dedications

• Monitor Gazette: Watch the Gazette for notices under s 4(1) to identify any vesting affecting their interests.

• Check legal status: If notified or affected by a vesting, verify whether the Act extinguished the interest under s 4(2)(a)-(b) and assess legal options or remedies in light of extinguishment and the absence of compensation clauses in the Act.

• Preserve evidence: Retain documentation of any prior rights to support any claim, should that be pursued under general law or in negotiations about reinstatement on revesting.

For agencies responsible for roadworks, planning and environment

• Confirm statutory authority: Ensure the use of the land for roadworks is consistent with the Highways Act 1926 definition. Seek any separate planning approvals or environmental permits required for the actual construction works, since the Act does not displace other regulatory regimes governing the physical works.

• Coordinate with title office and Minister: Ensure timing of Gazetting, title transfer, and project start dates are aligned to avoid commencing works before legal title and required approvals are in force.

General compliance considerations

• Document good faith and non-negligence: The immunity in s 5 requires actions be in good faith and without negligence. Maintain contemporaneous records, approvals, advice and internal approvals to demonstrate those elements.

• Track and implement regulations: The Act delegates material procedural detail to regulations under s 6, including the revesting scheme under s 4(3). Parties should monitor the regulations made under the Act and incorporate their requirements into standard operating procedures.

• Engage legal advisers early: Because the Act extinguishes interests and revokes dedications, legal counsel should be involved at the drafting stage of Gazette notices, in liaison with the Registrar‑General, and before works commence, to avoid title defects or inadvertent extinguishment of rights that might cause downstream disputes.

By following these steps and documenting decisions, the principal actors can implement the statutory vesting, record it correctly, and prepare for any revesting obligations that regulations later prescribe.
