Terrorism (Commonwealth Powers) Act 2002

The statute deploys a small set of structural concepts to achieve its purpose. First, “references” is the technical device: s 4(1) refers matters to the Commonwealth Parliament so it can include the “referred provisions” in the Commonwealth Criminal Code or make express amendments to the terrorism legislation or criminal responsibility legislation. The definition of “referred provisions” is the text set out in Schedule 1, but only insofar as it deals with matters within the State’s legislative powers (s 3).

Second, the Schedule introduces the substantive legal architecture for the terrorism regime. Key definitional building blocks are: “terrorist act” (Schedule 1, s 100.1), “organisation” and “terrorist organisation” (Schedule 1, s 100.1 and s 102.1), and “funds” (Schedule 1, s 100.1). The definition of “terrorist act” is a three‑part structure: conduct must (a) fall within the substantive list in s 100.1(2) and not within the advocacy/protest exclusion in s 100.1(3), (b) be done with the intention of advancing a political, religious or ideological cause, and (c) be done with the intention of coercing/influencing government or intimidating the public (s 100.1(1)(a)-(c)). The list in s 100.1(2) is intentionally wide: it captures physical harm, serious property damage, endangering life, serious risk to public health/safety and serious interference with or destruction of electronic systems, including information, telecommunications and financial systems.

Third, the Schedule sets out offences and penalties across several divisions: substantive terrorist acts and preparatory offences (Div 101, ss 101.1, 101.6, etc.), terrorist organisations and related offences (Div 102, ss 102.2-102.7), financing terrorism (Div 103, s 103.1), and transitional/regulatory provisions (Div 106). Penalties are specified numerically in the Schedule, imprisonment for life for the core terrorist act (s 101.1) and for some preparatory/financing conduct (s 103.1), with other offences carrying terms of 10-25 years depending on fault elements and conduct.

Fourth, the Schedule contains several structural rules affecting scope and interoperation: extraterritorial reach/extended geographical jurisdiction is invoked for many offences (reference to s 15.4 is frequent, e.g. ss 101.1(2), 101.2(4), 101.4(4)); the Part is intended to co‑exist with State and Territory laws (s 100.6); regulations may be made to modify the Part’s operation to avoid inconsistency with State/Territory laws (s 100.7); and express amendments to the Part or to Chapter 2 that apply only to the Part require a particular approval process (s 100.8).

Fifth, allocation of decision‑making power appears in the Schedule: the Governor‑General makes regulations to specify organisations as terrorist organisations (s 102.1(2)), but the Minister must be satisfied on reasonable grounds of a UN Security Council decision and the organisation’s involvement (s 102.1(2)(a)-(c)); such regulations cease to have effect after two years unless remade (s 102.1(3)) and cease earlier if the UN decision ceases (s 102.1(4)).

Sixth, procedural and evidential features are embedded in the offences: alternative verdict rules are expressly permitted (e.g. ss 101.2(5), 101.4(6), 101.5(6), 102.10), certain defences carry evidential or legal burdens (for example, ss 101.4(5), 101.5(5) confer an evidential burden; ss 102.3(2), 102.6(3) impose a legal burden), and a double‑punishment safeguard prevents punishment under this Part where a person has already been punished under State/Territory law (s 100.6(4)).

Those concepts produce a framework by which the Commonwealth, empowered by State referral, can operate a nationally uniform Part 5.3 offence set with extraterritorial reach, executive regulatory mechanisms for listing organisations, and specified interaction rules with State laws.

The referral and the Schedule reach a wide range of actors because the textual coverage is broad. The Act’s mechanism affects three institutional groups directly: (1) the Parliament and executive of the Commonwealth, which receive the referred subject matter and gain strengthened authority to legislate and regulate in those fields (s 4(1)); (2) the State Parliament and the State executive, in that the State’s power to terminate the reference is constrained by the process set out (s 5); and (3) individuals and organisations present in, operating from, or interacting with Western Australia, because the Schedule’s offences attach criminal liability to specified conduct.

Operationally, the Schedule reaches natural persons and bodies corporate wherever situated: definitions extend references to “any person or property wherever situated, within or outside Australia” (Schedule 1, s 100.1(4)(a)) and the Part applies to actions or threats that constitute terrorist acts no matter where they occur (s 100.4(1)(a)). The extraterritorial reach is reinforced by multiple provisions referring to extended geographical jurisdiction (for example, s 101.1(2) and recurring references to s 15.4). The Schedule explicitly covers constitutional corporations (s 100.1(1) definitions and s 100.4(5)(c) and (g)), Commonwealth places (s 100.1 definition reference and s 100.4(5)(d)-(e)), and conduct that affects Commonwealth interests, trade and commerce, banking and insurance, and obligations under international law (s 100.4(5)(a), (j), (k), (l)).

Organisations are specifically reached in Division 102. “Organisation” is defined to include bodies corporate and unincorporated bodies, whether based in Australia or overseas and whether or not their members are Australian citizens (s 100.1 definition). “Terrorist organisation” covers both organisations that are directly or indirectly engaged in terrorist activity (s 102.1(1)(a)) and organisations specified by regulation after the Minister’s satisfaction that UN Security Council action links the organisation to terrorism (s 102.1(1)(b), (2)). Membership, directing activities, recruitment, training, funding and provision of support to such organisations are criminalised in Div 102 (ss 102.2-102.7). The statutory formulations broaden “membership” to include informal membership and steps to become a member, and for corporate organisations to include directors and officers (s 102.1(1) definitions).

Persons handling funds or documents are affected by broad definitions: “funds” encompasses property and assets of every kind, including electronic or digital forms and legal instruments evidencing title (s 100.1). Offences in Division 103 and Division 102.6 criminalise receiving or making funds available, with exceptions narrowly defined (s 102.6(3)).

Public and private sector entities are implicated where their systems are targeted: the definition of terrorist act includes serious interference with electronic systems used for information, telecommunications, financial systems, essential government services, utilities and transport systems (s 100.1(2)(f)(i)-(vi)). That means operators of such systems may be affected both as potential victims and, where alleged complicity exists, as objects of investigation and potential criminal liability.

Executive actors are affected in decision and regulation roles: the Minister’s satisfaction on reasonable grounds is required before an organisation can be specified under the regulations (s 102.1(2)); the Governor‑General makes regulations; and the Governor of the State acts on Parliament’s recommendation when fixing a termination day (s 5(6)). Finally, the Schedule’s interaction rules directly affect persons charged in multiple jurisdictions by preventing double punishment where a person has already been punished under a State or Territory law for the same conduct (s 100.6(4)).

The Act itself does not impose positive regulatory duties on private actors; rather, it creates the legal infrastructure by which the Commonwealth may impose criminal duties through the Commonwealth Criminal Code Part 5.3 text reproduced in the Schedule. The key duties and criminal prohibitions therefore arise from the Schedule and include the following principal obligations and consequential rights.

Principal criminal prohibitions and duties (Schedule 1):

• Engaging in a terrorist act is an offence punishable by imprisonment for life (s 101.1). This is the primary substantive prohibition.
• Providing, receiving, or being reckless about training connected with terrorist acts is an offence (s 101.2) with penalties of up to 25 and 15 years depending on fault.
• Possessing things connected with terrorist acts (s 101.4) and collecting or making documents likely to facilitate terrorist acts (s 101.5) are criminalised with maximum penalties set out (15/10 years depending on fault).
• Doing acts in preparation for or planning terrorist acts is an offence punishable by life imprisonment (s 101.6(1)).
• Terrorist‑organisation related offences criminalise directing activities, membership (in limited respects, see 102.3), recruiting, training and receiving or making funds available to organisations, and providing support or resources (ss 102.2-102.7). Penalties range from 10 to 25 years depending on the offence and fault.
• Financing terrorism is criminalised where a person provides or collects funds while reckless as to their use for terrorist acts (s 103.1), with a penalty of life imprisonment in the Schedule.

Fault elements and burdens:

• The Schedule distinguishes between knowledge (actual knowledge) and recklessness as fault elements. Many offences carry higher penalties for knowledge than for recklessness (e.g. ss 101.2, 101.4, 101.5, 102.2, 102.6).
• Certain provisions reverse or allocate evidential and legal burdens. For example, subsections 101.4(5) and 101.5(5) create an evidential burden on a defendant to raise evidence that possession or collection was not intended to facilitate terrorist activity (note cross‑reference to s 13.3(3) for evidential burden rules in the Criminal Code). Section 102.3(2) and s 102.6(3) explicitly shift legal burdens onto defendants to prove, on the balance of probabilities, particular matters (see statutory note that these are legal burdens; the Schedule itself states “A defendant bears a legal burden…”).
• Alternative verdicts are authorised in certain prosecutions: the trier of fact may convict for a lesser alternative offence if the elements of the higher offence are not satisfied but the alternative offence is, provided procedural fairness has been accorded (e.g. ss 101.2(5), 101.4(6), 101.5(6), 102.10).

Rights and procedural limits:

• Double punishment safeguard: where a person has been punished for an act under a State or Territory law, they cannot be punished for the same act under this Part (s 100.6(4)).
• Regulatory listing of terrorist organisations under s 102.1 is subject to ministerial satisfaction on reasonable grounds and is time-limited: regulations specifying organisations cease after two years unless remade, and will cease if the UN Security Council decision underpinning them ceases to have effect (s 102.1(2)-(4)). That creates a temporal and executive control on designation.
• The Schedule authorises regulations to limit or modify the Part’s operation to avoid inconsistency with State/Territory laws, including exempting persons, bodies or circumstances (s 100.7). That is an administrative pathway for tailoring application.

Institutional duties:

• The State retains institutional duties in termination: the Governor may only fix a termination day for the references where both Houses have recommended the making of the proclamation (s 5(6)). This imposes a State parliamentary check on terminating the referral.
• For express amendments to the Part or to Chapter 2 where those amendments apply only to this Part, s 100.8 requires approval by a majority of the group consisting of the States plus the two Territories and by at least four States. This imposes a collective States/Territories constraint on certain Commonwealth express amendments.

In short, the key duties imposed on private actors are the criminal prohibitions and their related fault and burden rules found in the Schedule. Rights include the double punishment protection, procedural fairness in alternative verdict situations, and statutory controls on executive designation of organisations and on express amendment processes.

The Schedule specifies numerical custodial penalties for each offence it creates and links many offences to provisions enabling extended geographical jurisdiction (via repeated cross‑reference to s 15.4). Enforcement is therefore through Commonwealth criminal processes once the offences operate as Commonwealth law in relation to Western Australia by virtue of the State’s referral and the Commonwealth’s enactment and operation of Part 5.3.

Principal penalties (Schedule 1):

• Terrorist act (s 101.1): imprisonment for life.
• Preparation/planning of terrorist acts (s 101.6(1)): imprisonment for life.
• Financing terrorism (s 103.1(1)): imprisonment for life (note Schedule comment that intention is the fault element for paragraph (1)(a); see s 103.1(1) Note).
• Providing/receiving training connected to terrorism (s 101.2): maximum 25 years where knowledge exists, 15 years for recklessness.
• Possessing things connected with terrorist acts (s 101.4): maximum 15 years where knowledge exists, 10 years for recklessness.
• Collecting/making documents likely to facilitate terrorist acts (s 101.5): 15/10 years depending on fault.
• Directing activities of a terrorist organisation (s 102.2): 25 years for knowledge, 15 years for recklessness.
• Membership of a terrorist organisation, where applied as in s 102.3(1) (see the statutory limitation to organisations specified by regulation under paragraph (b) of the definition) carries up to 10 years.
• Recruiting for a terrorist organisation, training with a terrorist organisation, getting funds to or from a terrorist organisation, and providing support to a terrorist organisation attract penalties up to 25 years (ss 102.4-102.7).

Extended jurisdiction and cross‑references:

• Numerous offences include the phrase “Section 15.4 (extended geographical jurisdiction, category D) applies to an offence against” the relevant section (for example ss 101.1(2), 101.2(4), 101.4(4), 101.5(4), 101.6(3), 102.9 and 103.1(3)). Although s 15.4 itself is not printed in this Schedule, the repeated cross‑references indicate that the drafters intended that the available extended jurisdiction categories apply to these offences, enabling Commonwealth jurisdiction beyond local territorial borders in certain cases.

Enforcement mechanisms and decision points:

• The Governor‑General (executive) makes regulations to specify organisations as terrorist organisations, but the Minister must be satisfied on reasonable grounds that a relevant UN Security Council decision identifies or provides a mechanism to identify the organisation, and that the organisation is engaged in terrorist activity (s 102.1(2)). That gives the executive a gatekeeping role for listing.
• Regulations that specify organisations expire after two years unless remade (s 102.1(3)) and cease to have effect if the underpinning UN Security Council decision ceases to have effect (s 102.1(4)). This creates a temporal enforcement context for offences tied to a regulationally‑specified organisation.
• The Schedule contains a power for regulations to modify the operation of the Part so that no inconsistency arises between it and specified State/Territory laws, and to provide carve outs for persons, bodies or circumstances (s 100.7). That provides an administrative route to limit or tailor enforcement in certain situations.

Evidential and legal burdens affect enforcement strategy:

• Evidential burdens on defendants in respect of particular exemptions (for example ss 101.4(5), 101.5(5)) mean that once the prosecution adduces prima facie evidence of an element, the defendant must raise evidence pointing to the fact they did not intend to facilitate terrorism in order to place the matter in issue.
• Legal burdens in ss 102.3(2) and 102.6(3) require defendants to prove certain matters on the balance of probabilities (for example, that they took reasonable steps to cease membership as soon as practicable, or that funds were received solely for legal representation or to assist compliance with law). These legal burden shifts alter the standard prosecution/defence allocation of issue proof.

Limitations and protections:

• The Schedule’s non‑exclusivity clause confirms the Part is not intended to exclude concurrent operation of State or Territory law, and loss of criminal exposure under this Part occurs if a person has already been punished under State/Territory law for the same act (s 100.6(1)-(4)). That provides a statutory double‑punishment protection and recognises concurrent jurisdiction.
• Regulations may create exceptions or carve outs to prevent inconsistency with State laws (s 100.7).

Practically, law enforcement agencies will enforce these offences under Commonwealth criminal procedure and sentencing frameworks (which are not set out in this Act), using the definitions and fault elements in the Schedule. The Act structures the legal consequences, the executive designation pathway for organisations and the interplay with State laws and defence burdens that all shape prosecutorial decisions.

The Act is premised on cooperative federalism: it refers matters from the State to the Commonwealth so that Commonwealth law , the Commonwealth Criminal Code Part 5.3 text reproduced in Schedule 1 , can apply in relation to the State. The Act and the Schedule themselves set multiple rules governing interaction with State, Territory and other Commonwealth laws.

Primary interaction principles:

• Conditional referral: The references in s 4 have effect only “if and to the extent” the matters are not already within Commonwealth legislative powers and are included in the State’s legislative powers (s 4(2)). That frames the referral as supplementing rather than supplanting existing Commonwealth powers.
• Non‑exclusion and concurrency: Schedule 1, s 100.6(1) states that this Part is not intended to exclude or limit the concurrent operation of any State or Territory law. Subsection 100.6(2) specifically confirms that State/Territory laws creating offences that mirror or overlap with provisions of this Part may operate concurrently. Subsection 100.6(3) allows differences between State and Commonwealth provisions (penalties, fault elements, defences) without displacing concurrent operation. This recognises dual criminality and potential duplications between jurisdictions.
• Double punishment bar: If a person has been punished under a State/Territory law for the same act, the person is not liable to be punished under this Part (s 100.6(4)). That statutory protection establishes a choice-of-forum consequence for dual prosecutions.

Regulatory modification to avoid inconsistency:

• Schedule 1, s 100.7 gives regulation‑making power to modify the operation of the Part so that provisions do not apply to matters dealt with by specified State/Territory laws or so that no inconsistency arises. Regulations may specify persons, bodies, circumstances or exemptions. That provides a mechanism for the Commonwealth to accommodate State law regimes and prevent legal clashes.

Interpretation anchor:

• Schedule 1, s 100.5 applies the Acts Interpretation Act 1901 as it was in force at the date the Schedule commenced and prevents later amendments of that Commonwealth Act from applying to this Part. That fixes interpretative rules for the Part to a particular version of the Acts Interpretation Act, which can affect how provisions are read alongside other Commonwealth statutes.

Constitutional basis:

• The Schedule expressly sets out the constitutional bases for operation in different jurisdictions (s 100.3). In referring States (like Western Australia under this Act), operation is based on Commonwealth powers under s 51 other than paragraph 51(xxxvii), together with powers arising from the State’s reference under paragraph 51(xxxvii) (s 100.3(1)). In non‑referring States or Territories, operation is based on other heads of Commonwealth power and, for Territories, section 122 (s 100.3(2)-(3)). The Schedule notes that the State reference “fully supplements the Commonwealth Parliament’s other powers” (note to s 100.3(1)). These cross‑references frame potential constitutional overlap.

Interaction with international obligations:

• Subsection 100.4(5)(l) and (m) include as jurisdictional hooks actions or threats in relation to which the Commonwealth is obliged to create offences under international law. That means the Part is designed to engage with Commonwealth obligations under international law and to permit Commonwealth action in those areas.

Interaction with Commonwealth criminal provisions:

• The Schedule repeatedly cross‑references s 15.4 (extended geographical jurisdiction, category D) and other provisions of the Commonwealth Criminal Code (for example, evidential and legal burden rules under the Commonwealth Criminal Code are referenced by notes). These internal cross‑references tie the Part into the Commonwealth criminal law architecture, meaning that State actors, defendants and courts must navigate the Commonwealth Code’s procedural and substantive frameworks.

Practical consequences for State law:

• Because the Part expressly contemplates concurrent operation and provides for regulatory modification to avoid inconsistency, States retain the operational possibility of their own laws dealing with similar subject matter. However, the referral effectively allows the Commonwealth to exercise criminal law competence in Western Australia for the referred matters, which may standardise offences and penalties at a national level, subject to the safeguards in the Act and Schedule.

Overall, the Act and its Schedule construct a framework enabling Commonwealth law to sit alongside State law, with mechanisms to prioritise single punishment, to modify operation where needed, and to fix interpretative rules. They also place express constraints on express amendments to the Part via s 100.8 (approval by a majority of States/Territories group and at least four States), thereby structuring future intergovernmental change.

The Act’s compilation table in the Notes records only the original short title, number and dates: Terrorism (Commonwealth Powers) Act 2002, No. 53 of 2002, assented 14 January 2003, and commenced 3 May 2003 (see s 2 and Gazette entry referenced). The content printed here contains the original substantive referral provisions (ss 1-5) and the Schedule reproducing Part 5.3 of the Commonwealth Criminal Code. The Schedule includes a “Transitional provisions” Division (Div 106, s 106.1) dealing with saving regulations made for the purposes of the definition of terrorist organisation under pre‑commencement law.

Express amendment constraints:

• Schedule 1, s 100.8 imposes a procedural constraint on express amendments to the Part or to Chapter 2 that apply only to this Part. Such express amendments are not to be made unless approved by a majority of the group consisting of the States and the two Territories and by at least four States. This is an internal amendment control mechanism embedded in the text of the referred provisions, and it functions as a constitutional/diplomatic check on unilateral Commonwealth alteration of the core referred provisions.

Interpretation Act lock:

• Schedule 1, s 100.5 locks the application of the Acts Interpretation Act 1901 to the version in force on the day the Schedule commenced, and explicitly prevents later amendments of the Acts Interpretation Act from applying to this Part. That means that subsequent changes to Commonwealth interpretative rules will not automatically affect the Part unless the Part is itself expressly amended.

Regulatory and temporal limits on designations:

• Regulations made under s 102.1 to specify organisations for paragraph (b) of the definition of “terrorist organisation” have automatic temporal limits: they cease to have effect on the second anniversary of their taking effect unless remade; they cease earlier if the underpinning Security Council decision ceases to have effect (s 102.1(3)-(4)). That is a legislative design feature that limits the permanence of regulatory listings unless renewed.

Termination mechanism:

• Section 5 of the State Act gives the Governor a power to fix the day on which the referral terminates and to revoke a termination proclamation under prescribed conditions; it also prescribes a minimum three‑month notice period between publication and the day fixed (s 5(1)-(4)). The Governor acts only where both Houses of the State Parliament have recommended the proclamation (s 5(6)). These procedural requirements are themselves amendment‑resistant in the sense they embed parliamentary concurrence into termination.

Transitional saving:

• Schedule 1, s 106.1 provides a saving for regulations made prior to the Schedule’s commencement that were made under earlier versions of the “terrorist organisation” definition: such regulations are to have effect after commencement as if made for the amended paragraph (b) of the definition. That is the Schedule’s transitional continuity mechanism.

The compilation table lists no subsequent amendments in the printed material provided. The Schedule itself sets out mechanisms and constraints that shape how the referred provisions may be amended, how regulations operate and how transitional matters are handled. Any future amendment to the referred provisions will have to navigate the procedural approval constraints in s 100.8 and operate within the regulatory and interpretative boundaries that the Schedule has set.

The text provided does not record any judicial decisions or litigation history. The Act and its Schedule do not cite or summarise any cases, nor do they include annexed judicial materials. The Schedule refers to procedural concepts (for example, evidential and legal burdens) that in practice will engage courts and tribunal processes, but the instrument as printed contains no appellate or trial decisions.

Because the Schedule reproduces Commonwealth Criminal Code provisions (Part 5.3), litigation about the meaning, operation and constitutional validity of those provisions could in time arise in relation to prosecutions under the Code as applied in a referring State. The Schedule itself notes constitutional bases for operation in referring and non‑referring States and Territories (s 100.3) , material that would be relevant to any constitutional challenge about the Parliament’s power to legislate or about the operation of the Part in a particular jurisdiction. The Schedule also sets out procedural allocation of burdens, the standard for ministerial satisfaction for listing organisations, temporal limits on regulations specifying organisations, and interaction rules with State laws; each of those features could be the subject of litigation if challenged in practice.

The Act’s termination procedure (s 5) involves parliamentary recommendation and an executive proclamation. Disputes about termination would be political and administrative rather than judicial in nature, based on the text provided. The Schedule’s constraints on express amendment (s 100.8) could be invoked in litigation challenging amendments if the required approvals were not secured, but no decisions are recorded in the statute itself.

In short, the statutory text does not provide any recorded litigation history. Users seeking judicial treatment of these provisions will need to consult external case law databases and court reports for decisions interpreting Part 5.3 of the Commonwealth Criminal Code or litigation specifically engaging the State’s referral enacted by this Act.

Several features of the Act and Schedule are likely to surprise or trip up practitioners because they produce non‑obvious legal consequences or procedural shifts.

1. Referral, not standalone offences: The State Act itself does not create criminal offences; it refers matters to the Commonwealth so the Commonwealth can legislate. Yet the Schedule reproduces the Commonwealth text of Part 5.3. The operative legal force of that text in respect of Western Australia depends on the Commonwealth’s enactment and the constitutional mechanics of the reference (s 4(1); s 3 “referred provisions”). Practitioners should not assume the Schedule alone is an independent State penal code.

2. Broad extraterritorial reach: The Schedule applies to “actions or threats of action” that constitute terrorist acts “no matter where the action occurs, the threat is made or the action, if carried out, would occur” (s 100.4(1)(a)). Multiple provisions incorporate extended geographical jurisdiction (cross‑reference to s 15.4). That broad reach means conduct overseas or transnational conduct may fall within the Part’s scope where jurisdictional hooks in s 100.4(5) are met (for example, affecting Commonwealth interests, constitutional corporations, postal or electronic communications, trade between Australia and places outside Australia, banking/insurance disruption, obligations under international law). The GOTCHA is that what may look like a foreign conduct issue can be prosecuted domestically.

3. Definition traps , electronic systems and funds: “Terrorist act” includes serious interference with electronic systems used for information, telecommunications, financial systems, essential government services and transport systems (s 100.1(2)(f)(i)-(vi)). “Funds” includes intangible assets, electronic forms and legal documents evidencing title (s 100.1 definition). That means digital asset transfers, cryptographic instruments, or control of electronic resources can be captured by the definitions.

4. Membership offence limitation: Section 102.3(1) criminalises membership only where “the organisation is a terrorist organisation because of paragraph (b) of the definition of ‘terrorist organisation’” , paragraph (b) is the regulationally‑specified organisation route under s 102.1. By contrast, subsection 102.1(1)(a) makes an organisation a terrorist organisation if it is directly or indirectly engaged in terrorist activity. The Schedule therefore distinguishes between organisations designated by regulation and those that are otherwise “terrorist organisations”, and certain offences (notably the membership offence in s 102.3(1)) apply only in the regulationally‑specified case. That drafting nuance can materially affect what conduct is captured under the membership offence.

5. Evidential and legal burden shifts: The Schedule places evidential burdens on defendants in respect of some defences (ss 101.4(5), 101.5(5)) and legal burdens in other contexts (ss 102.3(2), 102.6(3)). These reverse common law presumptions and change trial dynamics. The “note” cross‑references to sections of the Criminal Code governing burdens must be followed carefully.

6. Ministerial satisfaction and temporal regulatory listings: Regulations specifying terrorist organisations require ministerial satisfaction on reasonable grounds that there is a UN Security Council decision and the organisation is identified under that decision (s 102.1(2)). Those regulations expire after two years unless remade (s 102.1(3)) and cease if the UN decision ceases (s 102.1(4)). Practitioners should note that a regulationally‑specified organisation can be a moving target; offences tied to such specification can therefore change in applicability over time.

7. Express amendment constraint: Section 100.8 requires approval by a majority of the group of States plus Territories and at least four States before certain express amendments may be made. That is an unusual lock on Commonwealth amendment of the Part when affecting States’ referred interests. It is a constitutional/political constraint that must be checked before relying on Commonwealth express amendments.

8. Acts Interpretation Act lock: The Schedule freezes the application of the Acts Interpretation Act 1901 to the version in force at commencement (s 100.5). Subsequent changes to Commonwealth interpretative law do not apply. That can affect statutory construction and interaction with later Commonwealth statutes that rely on updated interpretative principles.

9. Double punishment safeguard: Where a person has been punished under State/Territory law for an act that is an offence under the Part, that person is not liable to be punished under this Part (s 100.6(4)). However, this safeguard requires an actual punishment to have been imposed. The practical effect is that parallel investigations and prosecutions can proceed until final punishment is imposed, which introduces potential for complex coordination.

10. Termination requires parliamentary recommendation: The Governor may only fix a termination day for the references where both Houses of the State Parliament have recommended the proclamation (s 5(6)). That embeds a political constraint on unilateral executive termination. Practitioners advising governments should not assume quick unilateral termination is possible.

These drafting features produce interplay between executive designation, temporal regulation, extended jurisdiction, burden allocations and intergovernmental checks. Each creates implementation and compliance complexity that must be traced in practice.

Complying with the legal framework the Act enables requires paying attention to the Schedule’s substantive offences, the definitional scope, the fault elements and burden allocations, and the regulatory listing mechanisms. The Act itself is a referral instrument; therefore, practical compliance focuses on the Commonwealth Criminal Code Part 5.3 text reproduced in the Schedule as it applies in the State.

1. Understand whether the Commonwealth Part applies to your activities:

   • Determine whether the offence elements apply to your conduct, including extraterritorial aspects. The Part applies to terrorist acts “no matter where the action occurs” (s 100.4(1)(a)) and many offences have extended geographical jurisdiction (see repeated cross‑references to s 15.4). Consider whether your activities affect Commonwealth interests, constitutional corporations, Commonwealth places, postal or electronic services, trade, banking/insurance, or implicate international law obligations (s 100.4(5)(a)-(m)). If so, there is an increased risk the Commonwealth Part applies.

2. Funding, assets and digital instruments:

   • The definition of “funds” is broad and includes electronic/digital and intangible assets (s 100.1). Organisations and individuals handling financial transfers, tokens, custodial arrangements or legal instruments should adopt enhanced due diligence, documentation and audit trails to establish lawful purpose and to be able to prove lawful provenance where necessary.

3. Training, documents and possession risk:

   • Activities involving training, possession of materials, or collection/creation of documents should be critically assessed against s 101.2, s 101.4 and s 101.5. Those offences attach criminal liability even where the terrorist act does not occur (subsections 101.2(3), 101.4(3), 101.5(3)). Practitioners should advise organisations to implement policies controlling access to potentially sensitive materials and to maintain contemporaneous records evidencing lawful intent. Note evidential burden rules in ss 101.4(5) and 101.5(5) require defendants to adduce evidence on lack of intent, so keeping documentary and testimonial evidence to show lawful purpose is important.

4. Organisational exposure and membership:

   • Because “organisation” includes bodies corporate and unincorporated bodies irrespective of location (s 100.1), corporate actors should assess whether any part of their structure, subsidiaries or partners could be “terrorist organisations” under either the conduct‑based definition (s 102.1(1)(a)) or the regulationally‑specified route (s 102.1(1)(b)). For membership or officer exposure, note the membership offence in s 102.3 is limited to organisations that are terrorist organisations because of paragraph (b) of the definition (i.e. regulationally‑specified organisations). Directors and officers of corporate entities may meet the definition of “member” for some purposes; internal governance and compliance policies should manage potential risk from informal association.

5. Monitor regulatory listings and renewals:

   • Because regulations specifying organisations under s 102.1 are time‑limited (cease after two years unless remade) and dependent on UN Security Council decisions, in‑house compliance and legal teams should subscribe to governmental updates and maintain watchlists for regulatory listings and remakings. Absence or expiry of a listing may affect whether conduct meets an offence’s statutory terms.

6. Legal representation and permitted exceptions:

   • Section 102.6(3) exempts receipt of funds if the defendant proves they received funds solely for legal representation or for assisting the organisation to comply with law. That is a legal burden, practitioners working for clients should maintain rigorous client intake, retainer letters, accounting records and attestations to demonstrate the purpose of funds received.

7. Training and policy for staff of critical systems:

   • Operators of information, telecommunications, financial and essential services should implement security and incident reporting protocols, and train staff to avoid actions that could be characterised as “seriously interfering with” such systems (s 100.1(2)(f)). Where third parties request access, system administrators should require legal authorisation and document purpose to mitigate allegations of facilitating terrorist acts.

8. Interaction with State law and double punishment:

   • Firms and advisers must recognise that State offences may overlap. Where a person has been punished under State law, s 100.6(4) bars punishment under the Commonwealth Part. However, parallel investigations can occur. Coordination with State prosecutors and seeking clarity on potential prosecution forums is prudent.

9. Prepare for evidential and legal burden practicalities:

   • Because some defences carry evidential or legal burdens (ss 101.4(5), 101.5(5), 102.3(2), 102.6(3)), maintain documentary and witness material to meet those burdens. Defence strategies must take these reversed burdens into account, and practitioners should advise clients early about record‑keeping and the standards of proof that will apply.

10. Track amendment and termination mechanisms:

• Because s 100.8 requires a particular intergovernmental approval before certain express amendments, and s 5 requires both Houses’ resolutions before the Governor may fix a termination date, entities should monitor intergovernmental processes and parliamentary resolutions that could affect the Part’s future operation.

In concrete compliance terms: implement robust KYC and AML procedures consistent with the broad “funds” definition; restrict and log access to potentially sensitive materials and training; maintain governance records showing steps taken to distance officers or members if association with an organisation becomes suspect; monitor regulatory listings; and engage early with legal counsel if investigations commence because the burden allocations and extraterritorial features materially affect defence posture.
