Sentencing Regulations 1996

The Regulations rely on a small set of recurring concepts that structure how courts and agencies process sentencing matters. The clearest, most frequently used terms are "approved" (in the sense of an approved form), "court officer", "prosecutor", the CEO and CCO, and the various court order acronyms used in the Act.

• Approved form. The Regulations repeatedly require various applications and orders to be "in an approved form" (see for example rr 4B(1), 5(1), 5A(2), 6A(1), 9A(1), 10(1)). Regulation 3(1) defines "approved" as meaning approved by the CEO. Regulation 13(1) then supplies a Table and Schedule 1 containing the prescribed forms. Regulation 13(5) allows substantial compliance with a prescribed form to be sufficient. The upshot is that a procedural gateway (CEO approval) controls the particular documents used to engage many Act powers.

• Court officer. Regulation 3(1) defines "court officer" by reference to court level: in superior courts the clerk of arraigns or manager of the criminal registry, and in the Magistrates Court and Children’s Court a registrar. Many procedural tasks are allocated to a "court officer", notably issuing summonses, notifying the CEO and communicating judicial decisions (for example rr 4B(3), 4D, 5(3), 6(1), 11).

• Service and summons mechanics. A recurrent mechanism is issuance by the court officer of a summons in an approved form to "all parties concerned" after receiving an application or deciding to exercise a power on its own initiative (see rr 4B(3), 5(3), 5A(4), 9A(2), 10(3)). The Regulations precisely allocate which party must serve the summons in varying contexts: court officer, prosecutor, or CCO depending on the combination of application type and who makes it (see rr 4B(5), 4E(2), 5(4), 5A(5), 9A(4), 10(5)‑(6)).

• CEO and CCO roles. Several applications may only be made by a community corrections officer with the prior approval of the CEO (for example rr 4B(2), 10(2)). Regulation 4D and regulation 11 both require notification to the CEO when a court makes or varies an order relating to a PSO or when a court acts under particular s 84 or Part 6 provisions. The Regulations thus erect a procedural checkpoint for CEO oversight of many community corrections matters.

• Mediation in sentencing. Regulation 4 clarifies that mediation between offender and victim in the sentencing context is voluntary, that the mediator must act impartially and fairly, and that physical co‑location of victim and offender is not required. The mediation rules therefore protect voluntariness and impartiality while allowing remote or separate participation.

• Electronic warrants. Regulation 14 introduces ECMS as the electronic case management system and authorises courts to issue warrants of commitment via ECMS. The regulation prescribes authentication by name or facsimile signature or the court seal and expressly treats such warrants as authenticated and given in electronic form for the purposes of the Courts and Tribunals (Electronic Processes Facilitation) Act 2013 (r 14(2)‑(5)). This concept links court documentary practice to the state electronic process legislation.

• Forms and enforcement instruments. Schedule 1 provides the content of the principal enforcement and notice documents: warrant of commitment (Form 1), warrants related to unpaid fines and compensation orders (Forms 2, 3 and 3A), certificates of breach of community orders (Form 4), and notices alleging new offending while subject to sentence (Form 5). Those forms embed particular legal consequences such as maximum periods, cumulative or concurrent designations, and express execution fields for arrest and imprisonment.

• Offence list for community‑based orders. Schedule 2 lists the provisions in other Acts and regulations for which a court may, under s 44(1)(a)(ii) of the Sentencing Act, impose a community‑based order. The Schedule is a statutory instrument that extends the Act’s community order regime to many otherwise disparate offences by prescribing them for the s 44 mechanism.

• Enforcement costs and recovery. Regulation 8B defines "Sheriff’s costs" and authorises the Sheriff to demand those costs from a non‑complying person, and to recover them in a court of competent jurisdiction as a debt. That creates a route for cost recovery separate from the sentencing court’s penal remedy.

These concepts allocate tasks, create approvals, set minimum timing and service rules, and connect the sentencing regime to both custodial operations (Prisons Act and Sentence Administration Act references in the warrant text) and electronic court administration (ECMS). The Regulations therefore turn statutory sentencing discretion into a repeatable administrative process.

The Regulations allocate responsibilities and obligations among several groups of persons and entities. The principal affected parties are offenders, victims, mediators, community corrections officers, the Chief Executive Officer (CEO) (as defined under relevant Acts), prosecutors (the Director of Public Prosecutions or police prosecutors), court officers and registrars, judges and magistrates, the Sheriff and police officers, and the custodial authorities named in the forms.

• Offenders. Offenders are affected directly. They are the addressees of summonses, notices alleging new offending while subject to sentence (Form 5), warrants for imprisonment until fines or compensation are paid (Forms 2, 3, 3A), and certificates of breach of community orders (Form 4). The Regulations prescribe how and when an offender must be served and the consequences of non‑compliance. For example, r 6A requires that an application under s 57B to cancel an order be made in an approved form and the summons must be served on the offender by a court officer (r 6A(2)‑(3)).

• Victims. Victims are implicated in mediation practice (r 4) and in reparation/restitution proceedings. Regulation 8 provides that an application for a reparation order can be made orally during sentencing or in writing during sentencing or within 12 months after sentencing. When a written application is made after sentencing the court officer must issue a summons to all parties including the victim in certain circumstances (r 8(2)‑(3)(a)‑(c)).

• Mediators. Mediators involved in offender‑victim mediation must act fairly and impartially and cannot compel attendance (r 4(1)‑(2)). The Regulations also allow mediation without physical co‑presence (r 4(3)).

• Community Corrections Officers (CCOs) and the CEO. The Regulations give CCOs specific procedural roles. Some applications may be made only by a CCO with the prior approval of the CEO (r 4B(2), 10(2)). CCOs are also the prescribed server of summonses in some contexts (for example r 9A(4)(b)(ii) and r 10(6)(b)). The CEO is the approval authority for "approved forms" (r 3(1)), is to be notified when courts deal with offenders on PSOs or when courts act under specified sections (rr 4D, 11), and may be a recipient of summonses for certain applications (rr 4B(5)(a), 9A(4)(a), 10(6)(a)).

• Prosecutors. The Regulations identify "prosecutor" as the DPP or a police prosecutor (r 4B(8), 10(8)) and allocate to prosecutors the responsibility to serve summonses and notices in multiple contexts (see rr 4B(5), 4E(2), 5(4), 5A(5), 10(5)). Prosecutors are also a prescribed party to whom a summons must be issued in many review and amendment proceedings.

• Court officers, registrars and judicial officers. Court officers are given substantial administrative responsibilities: issuing summonses in approved form, notifying the CEO, and communicating judicial decisions (for example rr 4B(3), 4D, 5(3), 6(1), 6(3)). The Regulations also make clear that the court hearing an application need not be constituted by the same judicial officer who made the original order (see multiple provisions such as rr 4B(7), 4C(4), 5(6)).

• Sheriff and police. Schedule 1 forms address persons authorised to effect arrest and imprisonment, and r 8B permits the Sheriff to demand and recover enforcement costs as a debt from a non‑complying person. Police and persons authorised under the Court Security and Custodial Services Act 1999 are addressees on warrants (Forms 1, 2, 3, 3A).

• Courts and electronic systems managers. The ECMS operator and courts are affected by r 14, which authorises electronic issuance and prescribes authentication and statutory recognition of electronic warrants under the Courts and Tribunals (Electronic Processes Facilitation) Act 2013.

• Other agencies and bodies whose offences appear in Schedule 2. Entities responsible for regulatory offences listed in Schedule 2 will see those offences fall within the pool of offences for which courts may impose community‑based orders under s 44(1)(a)(ii). The Schedule captures a broad cross‑section of Acts and subsidiary legislation, so relevant regulators and counsel for affected bodies must be alert to community order exposure.

Practical distribution of costs and burdens follows these allocations. Offenders bear risk of arrest, imprisonment and enforcement costs. CCOs must obtain CEO approval before bringing certain applications. Court officers incur administrative work issuing summonses and notifications. Prosecutors and the DPP are required to serve summonses and participate in hearings. The Sheriff is empowered to take seizure actions and seek recovery of enforcement costs. The CEO controls approved forms and receives formal notifications, which creates an administrative oversight role. Schedule 2’s prescription of offences affects defendants and sentencing options available to courts in many substantive offences.

The Regulations impose a number of discrete duties on courts, court officers, mediators, community corrections officers, prosecutors and the Sheriff, and confer procedural rights on offenders and victims, principally through notice and hearing requirements.

Duties

• Issue of summonses and provision of notice. Where an application is received, or a court intends to exercise powers on its own initiative under specified Act sections, the court officer is to issue a summons in an approved form to all parties concerned to attend a hearing at a date and place fixed by the officer (see rr 4B(3), 5(3), 5A(4), 9A(2)). Multiple regulations require that the court may only deal with the application if it is satisfied that all relevant parties have been served with the summons (for example rr 4B(6), 4E(3), 5(5), 5A(6), 9A(5), 10(7)). The Regulations therefore create a duty on the court officer to issue summonses, and on the server (court officer, prosecutor or CCO depending on the provision) to effect service.

• Service allocation. The Regulations set out which actor must serve the summons or notice in each procedural context. For example, r 4B(5) requires a court officer to serve a summons on the CEO and prosecutor where the offender makes an application to amend or cancel a PSO, whereas a CCO must serve the offender when the application is made by a CCO. Regulation 12 elaborates how service can be effected , personal service or by pre‑paid post to last known address for offenders and other persons, and delivery to a prosecutor’s office or the CEO’s office for those bodies (r 12).

• CEO approval for certain CCO applications. Regulations 4B(2) and 10(2) require CCOs to have prior approval of the CEO before making particular applications to amend or cancel PSOs, conditional suspended imprisonment or community orders. This creates a gatekeeping duty at the executive agency level.

• Mediation duties. Regulators place two duties on mediators: they must not compel attendance (r 4(1)) and must act fairly and impartially when mediating between offender and victim (r 4(2)).

• Notification duties. Court officers are required to notify the CEO of orders made by the court in respect of PSOs (r 4D) and where courts act under specified sentencing breach or amendment sections (r 11). Regulation 6 stipulates the materials a registrar must transmit to a magistrate when a sentence imposed by a justice or justices in the Magistrates Court requires magistrate review (r 6(1)(a)‑(b)).

• Form and filing duties. Many applications must be in an approved form (r 3(1) definition of "approved" and repeated in rr 4B(1), 5(1), 5A(2), 6A(1), 9A(1), 10(1)). Regulation 13 provides the Table of prescribed forms and Schedule 1 supplies the forms’ content.

• Electronic warrant authentication. Where a court issues a warrant in ECMS the court must ensure the warrant bears the name or facsimile signature of the judicial officer or the court seal or facsimile, and the warrant is treated as authenticated and as being given in electronic form under the relevant Courts and Tribunals Act (r 14(2)‑(5)).

• Sheriff enforcement costs. If the Sheriff seizes or attempts to seize property under a restitution order the Sheriff may demand payment of reasonable enforcement costs and may recover those costs in court as a debt (r 8B(2)‑(3)).

Rights and protections

• Right to notice and hearing. A recurrent procedural right is the entitlement to be served with a summons and to have at least the minimum notice period before the hearing date in particular contexts. The Regulations require in several places that the hearing date fixed by the court officer must be at least 7 days after the date of the application (rr 4B(4), 9A(3), 10(4)). The court is empowered to deal with the matter only if it is satisfied that the parties have been served.

• Right to non‑compulsory mediation. Regulation 4(1) protects persons from compulsion to attend mediation or attempted mediation between offender and victim.

• Right to magistrate review. Regulation 6 implements the Act’s s 38 requirement that magistrates review certain Magistrates Court justices’ decisions, and mandates the papers that must be forwarded to the magistrate, the communication obligations after the review, and the steps to be taken if the magistrate cancels the original sentence (r 6).

• Procedural options for applications. The regulations allow offenders, victims and prosecutors to make certain applications (for example reparation under r 8) and set time windows and acceptable modes (oral during proceedings or written within 12 months of sentencing).

• Substantial compliance. Regulation 13(5) allows substantial compliance with a prescribed form to be sufficient, providing some relief from strict formality in document preparation.

The duties allocate decision and action among administrative actors; the rights are principally procedural protections of notice, hearing and non‑compulsion in mediation. Operationally, the interplay of CEO approval, mandatory service by particular actors, and minimum notice periods creates a tightly sequenced process that assigns responsibilities and opportunities for participation in all major post‑sentencing and amendment procedures.

The Regulations themselves do not create new substantive criminal penalties. Instead they provide the administrative architecture for enforcing penal outcomes conferred by the Sentencing Act and other statutes. The enforcement instruments and mechanisms the Regulations prescribe include warrants of commitment, warrants relating to unpaid fines and compensation orders, seizure and seizure cost recovery for restitution orders, certificates alleging breach, and processes that can lead to imprisonment or other sanctioning outcomes under the Act.

Key enforcement mechanisms

• Warrants of commitment. Schedule 1 (Forms 1, 2, 3, 3A) sets out the forms and textual content of warrants used to effect imprisonment ordered under the Act. Form 1 is a warrant of commitment where an offender has been sentenced to imprisonment. Form 2 is a warrant of commitment until a fine is paid, and Form 3 is a warrant of commitment for not paying a fine under s 59. Form 3A covers imprisonment for breach of a compensation order under s 119A. Those forms are the tangible instruments authorising police, the Sheriff and custodial authorities to arrest and imprison offenders in accordance with sentencing orders.

• Conversion of unpaid fines to imprisonment. Regulation 6BA prescribes the amount to be used for the purposes of s 59(3)(a) of the Act as $250 per day. Form 3 reflects the Act’s mechanism to set the period of imprisonment by reference either to a period set by the court or to a period calculated under s 59(3), with the appropriate reductions under ss 59(6) and (7) noted on the form. The Regulations therefore specify both the conversion rate and the documentation for execution.

• Imprisonment for default in compensation orders. Form 3A implements s 119A by authorising imprisonment until the ordered compensation is paid or until the maximum period specified is served. Form 3A expressly notes that service of the term of imprisonment does not reduce or discharge the liability to pay compensation (Form 3A note).

• Certificates and notices for breaches. Form 4 is a certificate of breach of community order. Form 5 is a notice alleging the commission of an offence while subject to a sentence and includes fields for the sentencing and subsequent offending particulars. Those instruments trigger the court processes enabling the court to consider enforcement consequences such as additional monetary orders, forfeiture conditions, or additional terms.

• Restitution enforcement and Sheriff's costs. Regulation 8B allows the Sheriff to seize property that is the subject of a restitution order under s 120A of the Act and to demand payment of "Sheriff’s costs" from the non‑complying person. If the non‑complying person does not pay, the Sheriff may recover those costs in a court of competent jurisdiction as a debt due to the Sheriff (r 8B(2)‑(3)). That provides a civil recovery pathway for enforcement expenses incurred by the Sheriff.

• Electronic warrant authenticity. Regulation 14 prescribes that warrants issued electronically via ECMS must bear the name or facsimile signature of the issuing judicial officer or the court’s seal, and confirms that such warrants are authenticated and are "given in electronic form" for the purposes of the Courts and Tribunals (Electronic Processes Facilitation) Act 2013 (r 14(2)‑(5)). That links electronic issuance to statutory recognition and reduces uncertainty about enforceability of electronic warrants.

Enforcement practice implications

• Execution responsibility. The forms routinely address the addressees of warrants, which include police officers and persons authorised under the Court Security and Custodial Services Act 1999, and the Chief Executive Officer under the Prisons Act 1981 (see Forms 1, 2, 3, 3A). That allocates execution of custodial orders to operational custodial and policing authorities.

• Recovery of enforcement costs. The Sheriff's right to demand and sue for enforcement costs creates a separate civil enforcement exposure for non‑complying persons beyond the penal sanction, and requires collection action through ordinary debt recovery processes.

• Procedural prerequisites. Courts are repeatedly restricted from dealing with matters until they are satisfied that all relevant parties have been served with summonses (for example rr 4B(6), 5(5), 9A(5), 10(7)). Failure to comply with such procedural prerequisites could render enforcement action contestable on procedural grounds.

• Interaction with the Act’s substantive powers. The Regulations repeatedly tie back to specific Act sections (for example s 37 correction, s 59 fine enforcement, s 119A compensation enforcement, s 33M PSO amendments). The Regulations therefore shape the way statutory penalties are operationalised and enforced but do not themselves expand criminal liability.

In summary, the Regulations prescribe the instruments and processes through which the penal consequences created by the Act and other statutes are executed and enforced, provide a rate for the fine‑to‑imprisonment calculation, enable custody via electronically issued warrants, and supply civil recovery machinery for enforcement costs. For practitioners advising clients, the Regulations primarily determine process and documentation that must be correctly observed to effect or challenge enforcement outcomes.

The Regulations are heavily cross‑referential and designed to operate in conjunction with the Sentencing Act 1995 and a range of other statutes and subsidiary instruments. The Regulations both implement elements of the Act and link sentencing procedural work to other statutory regimes.

Direct interaction with the Sentencing Act 1995

• The Regulations enact procedural rules for a number of specific Sentencing Act provisions. Examples include procedural routes for PSO amendments under s 33M and s 33N (rr 4B, 4C, 4D), correction and re‑sentencing under s 37 and s 37A (rr 5, 5A, 5B), magistrate review under s 38 (r 6), fine enforcement under ss 58 and 59 (Forms 2 and 3 and r 6BA), restitution and reparation under Part 16 (rr 8, 8A, 8B, 9), conditional suspended imprisonment and community orders (rr 6B, 10), and breach procedures referenced in r 11 (which lists Act sections such as s 84F, 84I, 84K, 84L, 127, 130, 132 and 133). The Regulations therefore fill in the Act’s procedural detail.

Cross‑references to other statutes and instruments

• Courts and Tribunals (Electronic Processes Facilitation) Act 2013. Regulation 14 expressly invokes that Act to authenticate and give legal form to electronic warrants issued via the ECMS. The Regulations therefore make electronic warranting functionally equivalent to paper warrants where the statutory authentication requirements are satisfied.

• Criminal Procedure Regulations 2005. Regulation 13(2)‑(4) imports Forms 1 and 2 and a warrant to commit a person to another court from the Criminal Procedure Regulations 2005 Schedule 1 as the prescribed forms for arrests and remands, and modifies Form 5 as a complaint for s 84E purposes. That cross‑citation aligns sentencing enforcement forms with criminal procedure instruments.

• Court Security and Custodial Services Act 1999 and Prisons Act 1981. The Schedule 1 forms name the authorities and persons authorised to execute warrants and direct the issuance to the CEO under the Prisons Act 1981, and refer to persons authorised under specified clauses of Schedule 2 to the Court Security and Custodial Services Act 1999. Forms thereby interact with custodial service regimes and prison management responsibilities.

• Other substantive Acts. Schedule 2 lists a lengthy set of Acts and subsidiary legislation provisions whose offences are prescribed for the purpose of s 44(1)(a)(ii) of the Sentencing Act to permit community‑based orders. Those Acts include, by way of example, the Bail Act 1982, Misuse of Drugs Act 1981 (via r 4A prescription of offenders abusing prohibited drugs or plants), The Criminal Code (various sections), Fish Resources Management Act 1994, Mental Health Act 2014, Police Act 1892, and many others. The interaction here is that the sentencing options available under the Sentencing Act are made applicable to offences under the listed statutes by regulation.

• Courts and administrative process. The Regulations place administrative duties on registrars and clerks which intersect with court rules and practice, noting in multiple places that some applications to superior courts must comply with the rules of court (see rr 4C(2), 5B(2), 4F(1)). That creates an operational interface between these Regulations and court rules.

• Debt recovery and civil procedure. Regulation 8B makes the Sheriff’s enforcement costs recoverable "in a court of competent jurisdiction as a debt due to the Sheriff". That draws on civil procedure and debt recovery pathways outside the sentencing statutes for enforcement cost recovery.

Interpretative and practical implications

• Implementation coherence. Because the Regulations prescribe forms and service methods that reference other statutes and court rules, practitioners must navigate multiple instruments: the Sentencing Act, these Regulations, Criminal Procedure Regulations, the Courts and Tribunals (Electronic Processes Facilitation) Act 2013, custodial and prison statutes, and court rules. The Regulations themselves sometimes require compliance with "relevant rules of court" before a superior court may exercise particular powers (rr 4C(2), 5B(2), 4F(1)).

• Administrative checkpoints. The requirement that a CCO may only make certain applications with CEO approval cross‑links the administrative practices of the Department responsible for community corrections with the courts’ procedural machinery. This creates a deliberate supervisory touchpoint in the multi‑agency enforcement chain.

• Electronic processes. The ECMS provisions align sentencing warrant practice with the statewide electronic processes facilitation legislation. Where ECMS is used and the prescribed authentication is attached, warrants are treated as valid electronic instruments under federal state legislation.

The Regulations thus both implement the Sentencing Act’s procedural dimensions and knit them into the broader statutory environment governing courts, prison administration and electronic court processes. Practitioners must read the Regulations alongside the Act and the other identified statutes and court rules to determine full compliance and enforceability.

The Regulations include an extensive amendment history recorded in the compilation table and in marginal notes beside affected provisions. The original Sentencing Regulations 1996 commenced on 4 November 1996. Since then the Regulations have been subject to numerous amendments that have added new procedural provisions, new forms and schedules, and electronic process rules. Key steps in the amendment timeline evident from the compilation table and marginal notes include:

• 2000: Multiple amendments in 2000 added or revised forms and procedural rules. Notable amendments were the Sentencing Amendment Regulations 2000, Sentencing Amendment Regulations (No. 4) 2000 and (No. 3) 2000 which updated Forms in Schedule 1 and other procedural matters. Reprint of the Regulations as at 3 September 2002 incorporated those amendments.

• 2003: The Sentencing Amendment Regulations 2003 (Gazette 29 Aug 2003) inserted Part 2A dealing with Pre‑sentence orders and introduced Regulation 4A prescribing speciality courts and the class of drug‑abusing offenders for PSO purposes. Regulations 4B, 4C, 4D, 4E and 4F concerning PSO amendment or recall procedures were inserted in that amendment (see marginal notes for r 4A and the r 4B‑4F insertion).

• 2004: The Sentencing Amendment Regulations (No. 2) 2004 (Gazette 14 May 2004) inserted Regulation 6AA and Schedule 2, prescribing the list of offences for which a community‑based order may be imposed under s 44(1)(a)(ii). This was a substantial expansion of the Act’s sentencing option coverage.

• 2005-2006: Multiple amendments in 2005 and 2006 refined forms and processes, added procedural rules (re‑sentencing and other steps), and updated definitions. Reprint 2 as at 25 Aug 2006 incorporated those changes.

• 2008: The Sentencing Amendment Regulations 2008 (Gazette 27 Mar 2008) added Part 3B and prescribed the rate for converting unpaid fines to imprisonment in r 6BA ($250 per day). The 2008 amendments also reshaped provisions for conditional suspended imprisonment.

• 2012-2013: Further amendments in 2012 and 2013 updated Schedule 2, the forms and certain procedures. Reprint 3 as at 12 Jul 2013 compiled those amendments.

• 2016-2018: Amendments in this period added specific offences into Schedule 2 and updated the prescribed courts for conditional suspended imprisonment (r 6B amended 29 Sep 2017). The Sentencing Amendment Regulations (No. 2) 2016 and further instruments in 2017 and 2018 updated the Regulations. Reprint 4 as at 21 Sep 2018 compiled these changes.

• 2019-2020: The Attorney General Regulations Amendment (Case Management System) Regulations 2019 and related instruments (Gazette 31 Dec 2019) and the Attorney General Regulations Amendment (Infringement Notices) Regulations 2020 affected forms and electronic process interactions. These changes prefigured the formal insertion of the ECMS warrant rules.

• 2024-2025: Recent updates include the Sentencing Amendment Regulations 2024 (SL 2024/129) with effect 1 July 2024, the Attorney General Regulations Amendment (Family Violence Reform) Regulations 2024 which commenced 18 December 2024, and two 2025 instruments , Attorney General Regulations Amendment (Births, Deaths and Marriages) Regulations 2025 (commenced 30 May 2025) and Attorney General Regulations Amendment Regulations 2025 (commenced 1 July 2025). Marginal notes show amendments were made across various years to Schedule 2 as late as SL 2025/117 r 6.

• Regulation 6AA and Schedule 2 (offence list for CBOs) were inserted 14 May 2004 and subsequently amended multiple times (marginal notes show amendments 2006, 2009, 2012, 2013, 2015, 2016, 2017, 2018, 2019 and 2021 through 2025 entries).
• Regulation 6BA (fine conversion rate) was inserted 27 Mar 2008 (marginal notes).
• Regulation 6B (prescribed courts for conditional suspended imprisonment) was inserted 12 May 2006 and amended 29 Sep 2017 (marginal notes).
• Regulation 9A was inserted 29 Sep 2017 and later amended by SL 2020/162 r 10.
• Regulation 14 (warrants issued electronically) was inserted 30 Oct 2018 and amended 31 Dec 2019 (marginal notes).

Compilation table

The compilation table appended to the Regulations records the sequence of amending instruments, their Gazette citations and commencement dates, and lists various reprints carried out after clusters of amendments. The compilation table is the primary internal record in the instrument showing the Regulations’ changes over time and the most recent listed amendment entries include SL 2025/117 with commencement 1 July 2025.

For practitioners or compliance professionals tracking change, the Regulations’ marginal notes and the compilation table identify where procedural regimes were added (notably PSO procedures and Schedule 2) and where electronic process integration was introduced. Because many procedural requirements depend on later inserted rules (for example r 14 ECMS rules), reliance on an up to date compilation is necessary to ensure current practice aligns with the latest amendments.

The statutory text supplied is a consolidation of the Sentencing Regulations 1996 and includes marginal notes and a compilation table listing all amending instruments to date. The Regulations themselves do not record case law applying or interpreting them. The compilation materials and Schedule notes do not name any judicial decisions or identify litigation outcomes that directly construe the Regulations.

What the source shows

• No cases are cited in the Regulations. The document contains no judicial authority, reported decisions, or references to litigation involving these Regulations. The Regulations do cross‑reference specific sections of the Sentencing Act and other Acts that themselves could be the subject of litigation, but the Regulations do not supply any litigation history.

Practical significance for practitioners

• Absence of recorded regulatory litigation in this source does not mean there have been no court disputes involving procedural points such as adequacy of service, the validity of electronically issued warrants, or the application of form content in Schedule 1. It only means the Regulations’ text and compilation do not record such cases. Practitioners should therefore check case law databases and relevant court reports for decisions interpreting or applying the Regulations in particular factual contexts, for example:

  • disputes about whether service was properly effected under r 12 where decisions turned on "last known address" or postal receipt;
  • challenges to the validity of ECMS issued warrants under r 14 where authentication form or system operation was contested;
  • judicial interpretation of the scope of "approved form" and CEO approval where an application was rejected for non‑compliant documentation; and
  • enforcement cost recovery actions taken by the Sheriff under r 8B where proportionality or reasonableness of "Sheriff’s costs" was litigated.

• Because the Regulations prescribe procedural steps that courts must observe before exercising certain statutory powers, litigation can arise where a party alleges procedural non‑compliance. Examples would include challenges that a court dealt with an application without proper service, or that a superior court failed to observe relevant rules of court before allowing an application under rr 4C(2) or 5B(2). Those procedural points are ordinary fodder for judicial review or appeal, and practitioners should search for decisions in the relevant jurisdiction.

Given the lack of explicit litigation history in the instrument, this regulation text should be treated as a procedural skeleton. For any contentious or borderline procedural issue it is prudent to consult the latest case law and the courts’ practice directions and rules of court that interact with the Regulations, particularly where the Regulations make compliance conditional on rules of court.

The Regulations create a number of points where procedural complexity, rigid sequencing or inconsistent practice can cause unintended consequences if not handled carefully. The following are concrete traps or friction points that appear from the Regulations’ text and forms.

Approved form and CEO control

• Many applications must be "in an approved form" and "approved" means approved by the CEO (r 3(1)). Practitioners should note that an application will be invalid if made in an unapproved form and that substantial compliance is permitted only under r 13(5). Where forms have been revised and an older version is used without CEO approval, the application could be vulnerable to being struck out for non‑compliance. Always verify the current approved form with the CEO or court registry.

CCO applications require CEO prior approval

• Regulations 4B(2) and 10(2) make several types of applications permissible only if the CCO has the CEO’s prior approval. Failure to obtain that approval nullifies the procedural legitimacy of the CCO‑initiated application. Practitioners representing offenders or CCOs should explicitly confirm and document CEO approval before filing.

Different serving parties depending on context

• Service obligations are not uniform. Who must serve varies with the application type. For example, r 4B(5) requires a court officer to serve the CEO and prosecutor for offender applications to amend/cancel PSOs, whereas a CCO must serve the offender for CCO applications. Regulation 9A(4) provides different service routes for CROs than for CBOs, CSIs, ISOs and PSOs. Misidentifying the required server can leave a court unable to act because it is not satisfied that all parties have been served (see multiple "satisfied" clauses such as r 4B(6), r 9A(5), r 10(7)). Check the exact regulation for the application in issue.

Minimum notice periods

• Several regulations impose a minimum 7 day notice between application and hearing for particular applications (rr 4B(4), 9A(3), 10(4)). Failing to allow the minimum period may render the hearing procedurally defective. The requirement that the court be satisfied that parties were served creates a gatekeeping function that can delay hearings.

Summons and service modes

• Regulation 12 allows service by pre‑paid post to a "last known address". In cases where an offender relocates and does not update the record, service by post may be contested. Conversely, personal service may be required for contentious matters. For critical applications, prefer personal service or obtain proof of actual receipt.

Magistrate review materials

• Regulation 6(1) mandates immediate transmission to a magistrate of the papers that were before the justice or justices, including prosecution notice, statement of facts or transcript, criminal record, pre‑sentence report and written reasons. Failure to include any of those documents may hamper the magistrate review or create procedural challenges on appeal.

Electronic warrant authentication

• Regulation 14 requires electronic warrants to bear the name or facsimile signature of the issuing judge or magistrate, or the court’s seal or facsimile. ECMS operators and court registries must ensure the authentication meets r 14(3) otherwise the warrant’s authentication and the statutory protections under the Courts and Tribunals (Electronic Processes Facilitation) Act 2013 may be contested. Practitioners should confirm that the ECMS process produces the required visible authentication.

Fine conversion arithmetic and form contradictions

• Regulation 6BA prescribes $250 per day for s 59(3)(a) purposes. Forms 2 and 3 contain notes about reductions for part payment and time served under s 59(6) and (7). There is potential for confusion and error when calculating the period of imprisonment and any reductions. Ensure calculations are documented and reconcile the $250 rate with any court‑set period or reductions required by the Act.

Sheriff’s costs as a debt

• Regulation 8B allows the Sheriff to demand costs and to recover them as a debt. Practitioners for non‑complying persons should note that the recovery mechanism is civil rather than penal and may involve separate proceedings. Also note that the regulation uses "reasonable costs" without setting standardised caps. Challenging the reasonableness of those costs will be a factual inquiry.

Time limits for reparation applications

• Regulation 8(1) allows a reparation application to be made orally during sentencing or in writing during sentencing or within 12 months after sentencing. Claims made outside that window will likely be rejected unless there is some other statutory basis. Keep careful docket control to protect reparation rights.

Superior court rule compliance

• Regulations 4C(2), 5B(2) and 4F(1) require that superior court applications be made in accordance with rules of court. Practitioners must therefore not assume that compliance with the Regulations alone suffices when a superior court is involved. Confirm the relevant rules of court as well.

Schedule 2 breadth and currency risk

• Schedule 2 is an extensive list of Acts and provisions prescribed for the CBO mechanism. The Schedule is amended frequently. Counsel should verify the current Schedule before advising that a particular offence falls within the s 44(1)(a)(ii) prescription, because an omission or out‑of‑date list could materially affect sentencing options.

Practical mitigation

• Obtain CEO approval when required, use the latest approved forms, serve parties in the manner mandated for the specific application, allow minimum notice periods, document receipt of service and proof of CEO approvals, confirm ECMS authentication practice, and double‑check fine conversion math with r 6BA. Maintain a practice of cross‑checking the Regulations with the current Sentencing Act provisions and applicable rules of court to avoid procedural missteps.

Compliance with these Regulations requires a mix of form accuracy, procedural sequencing and inter‑agency coordination. The following checklist is practical and directly grounded in the Regulations’ provisions.

1. Use approved forms and confirm CEO approval where required

   • Ensure every application required to be "in an approved form" is completed on the current approved form as defined by r 3(1) and listed in r 13(1) and Schedule 1. Where a CCO intends to make an application that requires CEO prior approval (see r 4B(2) and r 10(2)), obtain and document that approval before lodging the application.

2. Lodge with the correct court and, for superior courts, comply with rules of court

   • Lower court applications under rr 5A(3) and 4B(1) should be lodged with the court that imposed the sentence. Superior court applications must be made "in accordance with rules of court" as required in rr 4C(2), 5B(2) and 4F(1). Confirm the relevant court rules prior to filing.

3. Issue summonses and allow minimum notice periods

   • When an application triggers a summons requirement, the court officer must issue a summons in an approved form to all parties to a hearing on a date and at a place fixed by the officer (see rr 4B(3), 5(3), 5A(4), 9A(2), 10(3)). Where the Regulations specify a minimum hearing date interval, for example at least 7 days after the application (rr 4B(4), 9A(3), 10(4)), schedule accordingly. The court should only proceed if satisfied all parties have been served (see rr 4B(6), 5(5), 9A(5), 10(7)).

4. Serve summonses and notices correctly

   • Follow the particular service allocation for each application: some summonses must be served by the court officer, some by the prosecutor, some by a CCO. Regulation 12 sets permissible service methods: personal service or pre‑paid post to last known address for offenders and other persons, and delivery to the prosecutor’s office or the CEO’s office for those bodies. Keep proof of service or postal evidence.

5. Mediation practice

   • If mediation is used, ensure participants understand it is voluntary (r 4(1)) and that the mediator behaves impartially (r 4(2)). Document attendance and any written communications where remote participation is used, as r 4(3) permits mediation without contemporaneous physical co‑presence.

6. Magistrate review documents

   • Immediately after a justice or justices in the Magistrates Court impose a relevant sentence, the registrar must forward to a magistrate the approved review form and the papers before the justice including prosecution notice, statement of facts or transcript, criminal record, pre‑sentence report (if any), and written reasons (r 6(1)). Ensure those documents are complete and transmitted promptly.

7. Fine conversion and warrant preparation

   • For unpaid fines convertible to imprisonment under s 59, apply the rate prescribed in r 6BA ($250 per day) when calculating the period under s 59(3). Use Form 3 (warrant for not paying a fine) or Form 2 for imprisonment until fine is paid (Schedule 1). Ensure the warrant clearly states the amount outstanding, amount paid to date and whether the period is cumulative or concurrent. Document reductions where s 59(6) and (7) apply.

8. Restitution enforcement and Sheriff's costs

   • When engaging with restitution enforcement, use the approved restitution order form (r 8A). If the Sheriff is seizing property or attempting seizure under s 120A, expect a demand for Sheriff’s costs under r 8B(2). Non‑payment may lead to civil proceedings to recover costs as a debt (r 8B(3)). Keep records of seizure attempts and communications regarding costs.

9. Electronic warrant issuance (ECMS)

   • If the court issues warrants via ECMS, verify the warrant bears the name or facsimile signature of the judicial officer or the court seal or a facsimile (r 14(3)), and ensure that ECMS produces a document that meets r 14(4)‑(5) so it will be authenticated and treated as an electronic instrument under the Courts and Tribunals (Electronic Processes Facilitation) Act 2013.

10. Reparation and restitution timelines

    • For reparation orders under Part 16 of the Act, ensure applications are made either orally during sentencing or in writing during the sentencing proceedings or within 12 months after sentencing (r 8(1)). For written applications made after sentencing, the court officer must issue a summons and ensure service according to r 8(2)‑(3).

11. Notifications to CEO

    • Where the Regulations require notification to the CEO on courts dealing with PSOs or breaches of certain orders, ensure the court officer sends the requisite notification and records the notification in the court file (rr 4D, 11).

12. Schedule 2 checks

    • When advising on sentencing options or anticipating community‑based orders under s 44, check Schedule 2 to confirm whether the offence is prescribed for CBO purposes (r 6AA). Schedule 2 is subject to frequent amendment; confirm the current version before relying on it.

13. Document retention and proof

    • Given the Regulations’ emphasis on service, CEO approvals and authenticated documents, maintain robust records of CEO approval emails or letters, proof of service, ECMS output evidencing authentication, and all forms filed. These records will be decisive if a party later alleges procedural non‑compliance.

Following this checklist will address the principal technical compliance points created by the Regulations. Practitioners should also cross‑check the Regulations against the Sentencing Act 1995 provisions they operationalise and consult court rules where the Regulations require compliance with rules of court for superior court applications.
