Prisoners (Interstate Transfer) Regulations 1984

The Regulations implement and operationalise a set of core concepts essential to interstate prisoner transfer under the Prisoners (Interstate Transfer) Act 1983. These concepts, and where the Regulations treat them, are:

• Prisoner’s request and supporting material: A prisoner’s written request for transfer (Form 1; r 5(1)) must be signed and sent through the superintendent (r 5(2)) and accompanied by a statement of convictions and sentences, non‑parole period and estimated release by remission, a comprehensive conduct/behaviour report (r 5(3)(a)-(b)), and statements addressing family support, accommodation availability, medical reasons and employment prospects (r 6).

• Ministerial discretion and consultation: The Minister for Corrective Services makes welfare transfer decisions, but the Regulations prescribe who supplies reports and what material the Minister may consider (r 7(1)-(3)). For requests to Western Australia from other jurisdictions, the Minister may request reports from the Prisoners Review Board, the Department and the Commissioner of Police (r 11).

• Attorney General role for transfers for trial: Where a transfer is sought so a prisoner can be dealt with according to law in another State, the Attorney General’s consent and procedural certification are required (r 12-14). The Attorney General may, via the Minister, inform the prisoner and seek submissions (r 12(1)(a)-(2)) and must forward prescribed reports when consenting (r 13(3)).

• Court involvement and orders: The Magistrates Court and Supreme Court issue orders of transfer or orders to produce a prisoner in court (r 15-17). Applications must follow Form 5 (r 15(1)(b)) and be lodged in quadruplicate (r 15(1)(c)). The Magistrates Court issues orders for transfer for trial (Form 7) or welfare (Form 2 where appropriate), and the Supreme Court may review and re‑issue transfer orders (Form 8; r 17(2)).

• Return and post‑trial transfers: Part IV governs return of persons to the original participating State (Forms 9-11), the Minister’s enquiries before issuing return orders (r 21), and the circumstances under which a person may seek to serve their imprisonment in Western Australia instead (r 23-24).

• Custody and transit technicalities: The Regulations provide transit custody procedures (r 29), a warrant for return where a prisoner escapes while in transit (Form 13; r 30), and a revocation application format (Form 14; r 31). They require endorsement of custody transfer times on the order during transit (r 29(a)-(b)).

• Property and funds handling: Superintendents must allow prisoners to inspect property and prison money records before release for escort, handle complaints and investigations before escort (r 32(1)-(4)), remit money to the receiving prison for credit (r 33(1)-(2)), allow limited personal property to be taken on escort (r 33(3)), and forward or dispose of remaining property at prisoner’s risk and expense (r 33(4)).

• Cost allocation: Regulation 26 sets the default payer for escort costs in several scenarios, distinguishing State prisoners, Commonwealth prisoners and joint sentences (r 26(1) and the Table). Parties may agree otherwise (r 26(1)).

The Regulations treat forms as mandatory templates (r 4(2) and Schedule 1) and require completion according to directions (r 4(3)). The prescribed officer for certification of certain Attorney General consents is the chief executive officer of the Department of the Attorney General (r 14(2)), who must forward the certificate to the Department for a Magistrates Court application (r 14(3)). The Regulations repeatedly require that reports, assessments and additional information be included wherever a transfer request is made or considered (r 5(3)(c), r 7(2), r 9(d)-(e), r 13(2)).

Mechanically, the Regulations distinguish welfare transfers (Part II), trial‑related transfers (Part III) and returns/serving requests (Part IV). Each path has prescribed documentary steps, referral and consultation requirements, and operational protocols for custody, transfers, property and remittances. The Regulations also embed certain timing and repetition controls: a prisoner has 14 days to comment when the Attorney General provides notice of a trial transfer request (r 12(2)), and the Minister may refuse to entertain a repeated welfare request within one year unless there has been a substantial change (r 8).

The Regulations create obligations and affect the behaviour of multiple specific actors. Identify who pays, who decides, and who must act:

• Prisoners: They are required to make written requests in prescribed form (Form 1 or 3) and to sign and forward them via the prison superintendent (r 5(1)-(2), r 13(1)). Prisoners must provide factual statements about family support, accommodation, medical reasons, employment prospects and any other matters to support welfare requests (r 6). When transferred, prisoners are subject to the receiving jurisdiction’s rules, may be reclassified and will have their sentence deemed as imposed by the receiving State (Form 1). They have a right to make submissions when the Attorney General is considering a trial transfer (14 days to respond, r 12(2)) and may complain about property condition prior to escort (r 32(2)-(3)).

• Superintendents of prisons: They act as document handlers and investigators. When they receive a prisoner request they must attach a statement of convictions and sentences including any non‑parole period and an estimated date of release by remission, prepare a comprehensive report on conduct/behaviour, and forward the request with additional internal reports to the chief executive officer (r 5(3)(a)-(c)). They must enable prisoners to inspect property and records before escort (r 32(1)), investigate complaints (r 32(4)), endorse custody times on transfer orders during transit (r 29), remit prisoner funds to the receiving superintendent (r 33(1)-(2)), and arrange for property disposal or forwarding at prisoner’s risk and expense (r 33(4)).

• Chief executive officers and Departments: The chief executive officer of the Department of the Attorney General is the prescribed officer to sign certificates under r 14 (r 14(2)). The Department or chief executive officer receives the materials prepared by the superintendent and prepares reports and recommendations for the Minister (r 5(3)(c)-(d), r 7(1)). The Department may make the Magistrates Court application on behalf of the Department (r 15(1)(a)), must certify and forward documents when required (r 14(3), r 27), and retains transferred persons’ order and documents with warrant papers (r 28).

• Minister for Corrective Services: The Minister is the decision‑maker for welfare transfers and for issuing orders of transfer where consent has been received from a corresponding Minister (r 10), requests to corresponding Ministers must include prisoner request and supporting reports (r 9). The Minister also issues return orders under Part IV (Forms 9-11) and may enquire of the prisoner, Commissioner of Police and chief executive officer before issuing return orders (r 21). The Minister must give written notice and include records when agreeing to allow a person to serve imprisonment in Western Australia (r 24, r 23(4)).

• Attorney General(s): The Attorney General of Western Australia receives referrals of prisoner requests to be dealt with according to law in another State (r 12-13). The Attorney General may require reports (r 12(1)(b)), must forward reports and the prisoner’s request to the participating State Attorney General when consenting (r 13(3)), and requires certification of consent/requests by the chief executive officer (Form 4; r 14).

• Commissioner of Police: Consulted in several decision paths. The Minister may request the Commissioner of Police to furnish reports before considering incoming transfer requests (r 11(d)); the Commissioner is one of the persons the Minister may enquire of before issuing return orders (r 21).

• Courts: The Magistrates Court and the Supreme Court are involved in issuing transfer orders. Applications to the Magistrates Court for transfer (r 15) must be lodged in quadruplicate and served on the prisoner and the Attorney General (r 15(2)). The Magistrates Court issues orders to bring prisoners before court (Form 6; r 16) and transfer orders for trial (Form 7; r 17(1)). The Supreme Court can review and, if appropriate, issue a transfer order (Form 8; r 17(2)).

• Escorts and police: Escorts are directed to take custody under the written orders (Forms 2, 7, 8, 9, 10, 11). Regulation 26 allocates responsibility for costs of escort to Western Australia, the Commonwealth or the participating State depending on the transfer type. Form 13 (r 30) gives a senior police officer and other members specific powers to detain and return a person in specified escape scenarios and sets a 7‑day limit if an escort is not delivered.

• Receiving State/Territory and corresponding Minister: The corresponding Minister in the receiving (participating) State must give written consent to accept transfer (r 9, r 10). The receiving jurisdiction will then assume legislative authority for the sentence once transfer occurs (Form 1 text).

Collectively, these roles and obligations change behaviour: prisoners must prepare substantive supporting material, superintendents and departments must compile and forward multiple reports and certified documents, courts must process and issue orders in prescribed formats and copy counts, and police and escorts must execute orders that are drafted to be "sufficient authority" for custody and transfer (Forms 2, 7, 9). The allocation of escort costs (r 26) shifts financial responsibility according to the transfer category, which will influence intergovernmental negotiation and who arranges escort logistics in practice.

The Regulations impose specific duties on officials and set out rights and procedural opportunities for prisoners. These are concrete, documentable duties and rights:

Duties (express in the Regulations)

• Superintendent duties on receipt of prisoner request: When a prisoner makes a written request (Form 1), the superintendent must prepare and attach a statement of convictions and sentences with non‑parole period and estimated release by remission (r 5(3)(a)), prepare a comprehensive report on conduct and behaviour (r 5(3)(b)), seek additional detailed report(s) and an opinion on welfare transferability (r 5(3)(c)(i)-(ii)), and forward the request to the chief executive officer for Ministerial consideration (r 5(3)(d)).

• Information supply to Minister: The chief executive officer may, or must if requested by the Minister, supply medical, psychiatric or psychological reports or assessments (r 7(1)). Any report included must also contain any further information available that may assist the Minister (r 7(2)).

• Investigation of property complaints: Before escort, the superintendent must allow prisoners to inspect personal property and money records (r 32(1)), accept written complaints (r 32(2)-(3)), investigate complaints or cause investigation (r 32(4)(a)), and report the results to the prisoner before release for escort (r 32(4)(b)). If the prisoner remains dissatisfied or the investigation is incomplete, the superintendent must notify the Department without unnecessary delay (r 32(5)).

• Remittance of prisoner funds: Where funds are in the control of the WA superintendent when a prisoner is to be escorted, they must be remitted to the receiving superintendent for credit to the prisoner’s account (r 33(1)), and the prisoner must be informed in writing of the remitted amount (r 33(2)).

• Certification and forwarding: Certificates under s 11(2) of the Act are to be in Form 4 (r 14(1)), signed by the chief executive officer of the Department of the Attorney General (r 14(2)), and forwarded to the Department to make application to the Magistrates Court (r 14(3)). When sending copies of orders or documents under s 24(1) of the Act to a corresponding Minister or person designated by that Minister, the copies must be certified by the chief executive officer or an authorised Department officer (r 27).

Rights and procedural opportunities (express in the Regulations)

• Right to make a written request: A prisoner may request transfer to a participating State for welfare (Form 1; r 5(1)) or to be dealt with according to law (Form 3; r 13(1)). The prisoner must sign and forward the request through the superintendent (r 5(2)).

• Right to be informed and to comment: For trial‑related transfers, the Attorney General may, via the Minister, inform the prisoner of the substance of the request and seek written comments, which must be made within 14 days of receipt (r 12(1)(a)-(2)).

• Right to inspection and complaint: Before escort, prisoners are entitled to inspect property and money records (r 32(1)) and lodge written complaints about condition, deficiency or record errors; they are to receive the result of any investigation before release for escort (r 32(2)-(4)).

• Right to be informed of remittance: Prisoners must be told in writing the amount remitted to the receiving prison for credit (r 33(2)).

• Procedural access to courts: An application to the Magistrates Court to authorize a court order to bring a prisoner before the court must be served on the prisoner personally and the Attorney General (r 15(2)). The rules prescribe forms for Magistrates Court and Supreme Court orders for transfer (Forms 7 and 8, r 17).

Discretion and limits

• Ministerial discretion over repetition: The Minister may refuse to entertain a request made within one year of a similar request if there has not been a substantial change in circumstances likely to benefit welfare (r 8).

• Matters the Minister may consider: The Minister may have regard to the status of appeals and prosecutions, pending inquiries, and the remaining term of imprisonment compared to estimated time to decide and implement transfer (r 7(3)(a)-(e)).

• Cost allocation discretion: Regulation 26 allows parties to agree otherwise to the default cost allocations for escorts: unless there is agreement to the contrary the Table applies (r 26(1)).

Legal effect of documents and orders

• The forms are drafted to function as commands to superintendents and escorts , for example Forms 2, 7, 8, 9, 10, and 11 include language commanding the superintendent to deliver the prisoner and the escort to take custody and describe the form as "your sufficient authority". Form 13 (warrant to return) directs police and the superintendent to receive and detain the prisoner and to deliver the prisoner to an escort within a 7‑day period (Form 13 text; r 30). Revocation of transfer orders is achieved through an application to the Magistrates Court using Form 14 (r 31).

Taken together, these duties allocate operational responsibility across prison superintendents, departmental officers, Ministers, Attorneys General, courts and police. The prisoner receives procedural rights to make requests, to be informed, to comment and to inspect property and records, but the Regulations also build in administrative discretion and thresholds (for repeated applications, Ministerial considerations and court determinations).

The Regulations primarily prescribe processes, forms, consultation and operational steps; they do not themselves create new criminal offences or specify penalties in the text provided. Enforcement is effected through administrative command, court orders and police warrants, and by statutory powers conferred under the Prisoners (Interstate Transfer) Act 1983 (as implemented by these Regulations). Key enforcement mechanisms and practical consequences in the Regulations are:

• Court orders as operational authority: Forms 2, 6, 7, 8, 9, 10 and 11 are framed as orders or commands directing the superintendent to deliver a prisoner into the custody of the escort and directing the escort to convey the prisoner to the receiving State and deliver them to the receiving superintendent. The forms explicitly state they "shall be your sufficient authority" (for example Form 2). Courts (Magistrates Court and Supreme Court) issue these orders after application (r 15-17). Compliance with such orders is therefore enforced as compliance with a court direction.

• Police and warrant powers: Form 13 is a warrant ordering the return of a person to the participating State in which the order of transfer was issued (r 30(1) and Form 13). It directs the senior police officer and all members of police to receive and detain the prisoner and deliver them to the escort, with a 7‑day lapse proviso if an escort does not take custody. The warrant is a law enforcement instrument for execution by police and prison officers.

• Revocation and judicial oversight: An application to revoke an order of transfer may be made to the Magistrates Court using Form 14 (r 31(1)). An order can therefore be reviewed and revoked by judicial process, providing a mechanism for correction or cessation of a transfer once an order is in place.

• Administrative obligations with practical sanctions: Superintendents must investigate property complaints and report outcomes to the prisoner (r 32(4)-(5)). Failure to investigate or to notify might give rise to administrative consequence, complaint, or later legal challenge, but no express monetary fine or criminal penalty is set out in these Regulations for non‑compliance.

• Time‑limited warrants and discharge: Form 13 contains an explicit enforcement‑limiting mechanism: if the prisoner is not delivered into the custody of the specified escort within 7 days of the warrant, the warrant ceases to have effect and the prisoner is discharged in respect of that warrant (Form 13 text). This establishes a hard operational limit on the warrant’s enforcement window.

The Regulations therefore rely on existing judicial and policing powers for enforcement. They do not prescribe fines or offences for failure to perform duties described (for example a superintendent’s failure to prepare reports), but establish processes that must be followed for transfers to be validly effected. The "sufficient authority" language in transfer orders and the power to issue warrants create practical legal force that operational staff and police are required to follow. The primary enforcement risk is administrative or judicial exposure for failure to follow the prescribed forms or consultation steps; the Regulations create procedural prerequisites for valid transfer rather than standalone criminal sanctions.

The Regulations are expressly designed to operate in concert with the Prisoners (Interstate Transfer) Act 1983 and other statutes mentioned in the text. The interaction is largely procedural and documentary, but carries legal consequences concerning sentence recognition and custody. The Regulations and their Schedule repeatedly reference other laws and institutional arrangements:

• Primary enabling Act: The Regulations implement the Prisoners (Interstate Transfer) Act 1983. Many Regulations refer to specific sections of that Act (for example r 5 refers to section 5 of the Act; r 10 to section 6; Part III follows sections 10-17 processes). The Regulations provide forms and procedural templates mandated by or required under the Act.

• Sentence Administration Act 2003: Regulation 5(3)(a) requires that the statement of convictions and sentences attached to a prisoner’s request set out "any non‑parole period as defined in the Sentence Administration Act 2003 section 7(1) specified and the current estimated date of release by remission". The Regulations therefore rely on definitions and concepts contained in the Sentence Administration Act 2003 for accurate reporting of non‑parole periods and remission estimations.

• Prisons Act 1981 and departmental definitions: Regulation 4(1) defines "Department" to mean the department principally assisting the Minister administering the Prisons Act 1981 with the administration of that Act. The Regulations therefore coordinate administrative responsibilities with the departmental structure provided by the Prisons Act.

• Interstate laws and corresponding Ministers: The Regulations repeatedly refer to "interstate law" and the "corresponding Minister" of a participating State. They require written requests and consents between Ministers and the exchange of specified documentation (r 9, r 14). The receiving jurisdiction’s law governs the prisoner once transferred: Form 1 explicitly states that upon transfer (a) "the sentence(s) of imprisonment imposed upon me in Western Australia shall be deemed to have been imposed upon me in the participating State" and (b) the prisoner will be subject to "the provisions of any rules, regulations, etc., applying to prisoners in that State" and "may be subject to reclassification under those provisions". This creates an interaction where sentence administration and classification follow the receiving jurisdiction’s legislative and regulatory framework after transfer.

• Commonwealth interactions: Regulation 26 identifies cases where the Commonwealth (Attorney‑General of the Commonwealth) is party to an agreement concerning transfer of State prisoners to Territories or joint prisoners where Commonwealth sentences feature. The Table in r 26 allocates escort costs across Western Australia, the Commonwealth and participating States depending on sentence composition and purpose of transfer. This establishes procedural and financial interface with Commonwealth responsibilities.

• Courts and judicial review: The Magistrates Court and the Supreme Court are given procedural roles under the Act and the Regulations (r 15-17). The Magistrates Court issues orders under section 12(1) of the Act and the Supreme Court reviews Magistrates decisions under section 14(6) (Form 8). The Supreme Court is a reviewing body interacting with the Act via the Regulations.

• Records and warrant retention: Regulation 28 requires orders and documents sent by the corresponding Minister when a person is transferred to be forwarded to the receiving prison superintendent and retained with the person's warrant papers. This creates an archival and records‑management interaction between interstate correspondence and local prison records.

Practical consequences of these interactions include: the receiving State applying its sentencing, remission and classification rules to transferred prisoners (Form 1); the necessity to compute non‑parole periods and estimated remission dates using definitions in the Sentence Administration Act 2003 (r 5(3)(a)); allocation of escort costs under intergovernmental arrangements (r 26); and the need for certified documentation and cross‑jurisdictional communications to be signed and forwarded as required (r 9, r 14, r 27). The Regulations do not displace the substantive sentencing or parole regimes of either jurisdiction but create the intergovernmental administrative bridge needed to move prisoners and for receiving States to assume custody and jurisdiction over sentences once transfer occurs.

The Regulations include an explicit compilation and amendment history in the Notes and the Compilation table. The Regulations were first gazetted as the Prisoners (Interstate Transfer) Regulations 1984 and commenced on 1 July 1984 (r 2; Compilation table entry). The principal amendments and reprints recorded in the instrument are:

• Prisoners (Interstate Transfer) Amendment Regulations 1985 , Gazette 26 Jul 1985 p. 2641 , commenced 26 Jul 1985. This amends parts of the Regulations (specific provisions altered are recorded in the marginal amendment notes, e.g. r 5 amended).

• Prisoners (Interstate Transfer) Amendment Regulations (No. 2) 1987 , Gazette 11 Dec 1987 p. 4369-70 , commencement 11 Dec 1987. This amendment appears to have updated references to the Departmental office and forms (r 4 amendment noted).

• Prisoners (Interstate Transfer) Amendment Regulations 1988 , Gazette 2 Sep 1988 p. 3396 , commencement 2 Sep 1988. This amendment inserted Regulation 26 (escort arrangements) and its Table (noted: "Regulation 26 inserted: Gazette 2 Sep 1988 p. 3396").

• Miscellaneous Amendments Regulations 1997 , Gazette 6 Jan 1998 p. 33 , commencement 6 Jan 1998. This entry indicates minor miscellaneous changes were consolidated.

• Reprint of the Regulations as at 15 Nov 2002 , a reprint incorporating amendments up to that date was produced.

• Prisoners (Interstate Transfer) Amendment Regulations 2008 , Gazette 9 May 2008 p. 1841-4 , r 1 and 2 commenced 9 May 2008; other Regulations commenced 10 May 2008. These amendments are reflected in the text (various regs amended; Schedule revised forms).

• Reprint 2 of the Regulations as at 20 Nov 2009 , reprint incorporating the amendments listed above.

The Notes also contain a statutory construction note about terminology: a reference to "Permanent Head" in earlier written law should be read as "chief executive officer" following the Acts Amendment (Public Service) Act 1987 s. 31(1)(f), and this was amended under the Reprints Act 1984 s. 7(5)(a) (Compilation notes). Several individual regulations show amendment annotations (for example "Regulation 5 amended: Gazette 26 Jul 1985 p. 2641; 11 Dec 1987 p. 4370; 9 May 2008 p. 1841"). Regulation 4 was amended to define departmental terminology (r 4 amended: Gazette 11 Dec 1987 p. 4370; 9 May 2008 p. 1841).

The amendment history is therefore dominated by administrative and procedural changes, the insertion (1988) of escort cost allocation (r 26), and later form and minor text updates (2008). The compilation table in the Regulations is the primary source for the dates and nature of these changes; it shows a pattern of periodic updates and two reprints (2002 and 2009) consolidating prior amendments. The text provided does not list any repeals of major parts of the instrument; instead it reflects incremental changes and clarifications to reporting, certification and procedural requirements over time.

The Regulations and their Schedule do not include references to judicial decisions or litigation history. The instrument itself names no cases. The only judicial roles identified within the Regulations are procedural: the Magistrates Court issues transfer orders and may be reviewed by the Supreme Court (r 15-17 and Forms 6-8). The Regulations also give a power to apply to the Magistrates Court to revoke an order of transfer (r 31; Form 14) and to seek review by the Supreme Court where a party is dissatisfied with a Magistrates decision (Form 8 text).

Because the provided text does not cite any judicial decisions, reported cases, or litigation outcomes, the source contains no litigation history to summarise. The Regulations do, however, embed court processes that are potential loci for litigation: an applicant or respondent could seek judicial review of a Magistrates Court decision (r 17(2), Form 8), an order of transfer could be challenged or revoked (r 31, Form 14), and the procedural safeguards in r 12 (the Attorney General informing a prisoner and allowing 14 days for comments) and r 32 (investigation of property complaints) are judicially reviewable processes in principle. None of these points are illustrated by named cases in the instrument.

Users seeking litigation history should therefore consult court records and legal databases for challenges to transfers under the Prisoners (Interstate Transfer) Act 1983 and these Regulations. The instrument itself provides the procedural framework courts use to authorise or review transfers, but it does not supply case law or judicial interpretation.

This section highlights practical pitfalls and specific provisions that commonly cause delay, cost, or operational friction. Each item is grounded in the Regulations and the Schedule of Forms:

• Prisoner signatures and forwarding channel: A prisoner’s request must be signed by the prisoner and forwarded through the superintendent of the prison where detained (r 5(1)-(2)). A failure to follow this channel or to properly sign the prescribed form (Form 1 or Form 3) will likely result in rejection or delay.

• Attachments required of superintendents: When a prisoner request is received, the superintendent must attach a statement of convictions and sentences including any non‑parole period and the current estimated date of release by remission, and a comprehensive conduct report (r 5(3)(a)-(b)). These are detailed documents; incomplete or non‑standard sentencing estimates (which must use the Sentence Administration Act 2003 definition for non‑parole period, r 5(3)(a)) will stall the Minister’s consideration.

• Medical and psychological reports: The chief executive officer may, and must if the Minister requests, supply medical, psychiatric or psychological reports (r 7(1)). Obtaining such reports can take time and resources and can materially affect the Minister’s decision.

• One‑year repetition bar: The Minister may refuse to entertain a prisoner’s request made within one year of a similar request where there has not been a "substantial change in circumstances" likely to benefit welfare (r 8). Prisoners and counsel often overlook this timeframe; repeated applications within a year risk administrative refusal.

• Broad Ministerial considerations: The Minister can consider whether appeal periods have expired, whether appeals are final, whether prosecutions are pending, and term of imprisonment remaining relative to the estimated time to decide and execute transfer (r 7(3)(a)-(e)). A long procedural timeline can render a transfer impractical for short remaining sentences.

• Transfer changes jurisdiction and conditions: Form 1 requires prisoners to acknowledge that upon transfer (a) their sentence will be deemed to have been imposed in the receiving State; (b) they will be subject to the receiving State’s rules, regulations and reclassification. Prisoners may face different remission regimes and classification rules; neither the Regulations nor the forms guarantee preservation of time off or classification status.

• Costs of escort: Regulation 26’s Table allocates escort costs by transfer type. For example, escort costs for a State prisoner transferred to a participating State for welfare fall on Western Australia, while escorts for transfer to a participating State for trial are payable by the participating State (r 26 Table). Misunderstanding the Table can produce unexpected financial liabilities; the Regulation does permit agreement to the contrary (r 26(1)), but absent agreement the Table applies.

• Quadruplicate and triplicate filing requirements: Applications to the Magistrates Court must be lodged in quadruplicate (r 15(1)(c)). Form 14 states that revocation applications are to be filed in triplicate (Form 14 note). Failure to supply the required number of copies can delay court processing.

• Certification and prescribed officer: Certification under s 11(2) must be in Form 4 and signed by the chief executive officer of the Department of the Attorney General (r 14(1)-(2)). If the certificate is not signed by the prescribed officer, a Magistrates Court application may be defective.

• Property disposal at prisoner’s risk and expense: Any personal property left behind may be disposed of or forwarded "at the prisoner’s risk and expense" (r 33(4)). This phrase shifts both financial risk and loss risk to the prisoner; counsel and prisoners should prepare instructions for disposal or forwarding in writing before escort.

• Remittance and notification of funds: Money under a WA superintendent’s control must be remitted to the receiving prison for credit (r 33(1)), and the prisoner must be informed in writing of the amount remitted (r 33(2)). Accurate accounting is required; disputes must be investigated before escort and reported if unresolved (r 32(4)-(5)).

• Transit endorsement requirement: When a superintendent receives a person in transit, the superintendent must endorse the copy of the order of transfer with time and date of receipt and delivery to the escort (r 29). Failure to make these endorsements may create evidentiary gaps around lawful custody during transit.

• 7‑day warrant lapse: Form 13 provides that a warrant for return lapses if the prisoner is not delivered to the designated escort within 7 days, and in that event the prisoner is discharged "in respect thereof". This strict timeframe can frustrate return operations if logistics are not rapidly arranged.

• Departmental and interagency reporting obligations: When the Minister receives a request from another jurisdiction to accept the transfer of a person (r 11), the Minister may request reports from the Prisoners Review Board, the Department and the Commissioner of Police (r 11). These additional consultations may extend the decision timeline.

• No express penalties for procedural non‑compliance in the Regulations: While the forms and court orders carry operational force, the Regulations do not specify criminal penalties for failure to observe the administrative steps. That does not immunise procedural lapses from judicial remedy, but it does mean enforcement is primarily via courts and administrative processes rather than express penal sanctions in these Regulations.

These points are practical "gotchas" because they create risks of delay, unexpected cost, or loss of rights if not carefully addressed in advance of any transfer process.

This section sets out step‑by‑step, role‑specific checklists based on the text of the Regulations and Schedule 1 forms. Compliance requires adherence to form, signature, reporting and certification steps.

For a prisoner seeking transfer for welfare (Part II)

• Use Form 1 (r 5(1), Schedule 1). Ensure the form is fully completed, signed by the prisoner and forwarded through the superintendent (r 5(2)).
• Prepare and attach statements required by regulation 6: family support and accommodation availability in the participating State, social circumstances that may benefit welfare, medical reasons, employment prospects and any other supporting matters (r 6).
• Anticipate that the superintendent will attach a statement of convictions and sentences showing the non‑parole period and estimated date of release by remission (r 5(3)(a)) and a comprehensive conduct/behaviour report (r 5(3)(b)). Provide any authorisations needed for medical/psychiatric reports to be obtained (r 7(1)).

For the superintendent receiving a prisoner’s request

• On receipt of Form 1, prepare the statement of convictions/sentences with non‑parole period and estimated release date (r 5(3)(a)), and a comprehensive report on conduct and behaviour (r 5(3)(b)).
• Forward a copy of the request to the chief executive officer or appropriate internal person to prepare a detailed report and an opinion on whether transfer is in the prisoner’s welfare interests (r 5(3)(c)(i)-(ii)).
• Forward the complete package to the chief executive officer for Ministerial consideration (r 5(3)(d)).
• Allow the prisoner to inspect property and money records prior to release for escort (r 32(1)). If the prisoner complains, accept written complaint and investigate; report results to the prisoner before release (r 32(2)-(4)). Notify the Department without unnecessary delay if the prisoner remains dissatisfied or the investigation is incomplete (r 32(5)).
• If transferring, remit prison money to the receiving superintendent for credit and inform the prisoner in writing of the amount remitted (r 33(1)-(2)). Arrange for the prisoner to take reasonable clothing and personal items as assessed by the escort (r 33(3)). Obtain written instructions for disposal or forwarding of remaining property; warn the prisoner that forwarding is at their risk and expense (r 33(4)).

For the Department and chief executive officer

• When requested, supply medical, psychiatric and psychological reports (r 7(1)). Include any further available information likely to assist the Minister (r 7(2)).
• If the Attorney General’s certificate is to be signed under s 11(2) of the Act, ensure it is in Form 4 and signed by the chief executive officer (r 14(1)-(2)). Forward the signed certificate to the Department for application to the Magistrates Court (r 14(3)).
• When sending copies of transfer orders or documents to a corresponding Minister, certify them as required by r 27 (certification by the chief executive officer or authorised officer) and retain copies with warrant papers (r 28).

For the Minister considering a welfare transfer

• Ensure the supporting package includes the prisoner’s written request, the superintendent’s statements and reports, and any further reports prepared or furnished under r 7 (r 9(c)-(d), r 5(3)).
• Check the matters the Minister may consider under r 7(3) , whether appeal periods have expired, whether appeals or inquiries are pending, whether other prosecutions remain outstanding, and whether the remaining term of imprisonment is compatible with the time needed to process transfer.
• If the Minister decides to request acceptance from a corresponding Minister, include a statement setting out the matters upon which the opinion is based, and forward copies of the prisoner’s written request and the reports relied upon (r 9(c)-(e)).

For trial transfers and the Attorney General

• If the Attorney General receives a request from a participating State for transfer for trial, the Attorney General may, through the Minister, inform the prisoner of the request and obtain their written comments within 14 days (r 12(1)(a)-(2)). Obtain the report required under r 12(1)(b) (the same format as a report required under s 24(1)(c) of the Act).
• If the prisoner initiates a request to be transferred to be dealt with according to law, use Form 3 (r 13(1)). When the Minister refers this to the Attorney General, include the report required under r 13(2) and, on consent, forward the report and the prisoner’s request to the participating State Attorney General (r 13(3)).

For court applications

• Where an application to the Magistrates Court is needed under s 12(1) of the Act, it may be made by or on behalf of the Department, must be in Form 5 and lodged in quadruplicate (r 15(1)(a)-(c)). Ensure the certificate required under s 11(2) is attached (r 15(1)(c)).
• Serve the application and notice of hearing on the prisoner personally and on the Attorney General (r 15(2)).
• When a court issues an order to bring a prisoner before it (Form 6; r 16), arrange secure conduct and transport in accordance with the order’s date and location instructions.

For escorts and police

• Execute transfer orders (Forms 2, 7, 8) as commanding documents. Escorts should ensure they receive the prisoner together with the order and deliver the prisoner to the receiving superintendent (Forms 2, 7, 8, 9, 10, 11).
• For transit through WA, the receiving superintendent who temporarily holds the prisoner must endorse the order with receipt and delivery times (r 29). If a person in transit escapes or attempts escape and a justice orders return, the senior police officer and members must detain and deliver the prisoner to the escort; note the seven‑day lapse rule in Form 13 (r 30(1), Form 13).

For requests to serve imprisonment in Western Australia (incoming requests)

• If a person imprisoned in a participating State requests to serve imprisonment in WA, the request must be in writing, signed and forwarded through the superintendent (r 23(1)). Apply the same superintendent reporting requirements as for prisoner welfare requests (r 23(2)-(3)). On agreement, the Minister must give written notice to the corresponding Minister and attach the same reports (r 23(4) and r 24).

Documentation and record keeping

• Follow r 4(2)-(3): forms in Schedule 1 are the prescribed templates and must be completed per directions. Maintain copies, attach required reports and preserve records with warrant papers as required by r 28.

Practical compliance tips

• Build templates and internal checklists to ensure the statement of convictions, non‑parole calculations (using the Sentence Administration Act 2003 definition), and conduct reports are completed before the prisoner signs a request.
• Anticipate timelines for psychiatric and medical reports and for departmental and Police consultations to avoid procedural refusals on timing grounds (r 7(3)(e), r 11, r 21).
• Clarify financial responsibility for escort under r 26 early in negotiations and document any contrary agreements in writing.
• Prepare prisoner instructions for property disposal or forwarding prior to transfer to avoid disputes and to ensure the superintendent fulfils r 32 and r 33 obligations.

Following these role‑specific steps, and using the prescribed forms and certificates, will align practice with the Regulations’ mandatory document, certification and procedural requirements.
