W.A. Marine (Radiotelephony) Regulations 1981

The regulations revolve around several interlocking legal and technical concepts. The core definitional and organisational choices that structure the instrument are: installation, radio surveyor, seagoing ship/vessel, radio watch and silence periods, prescribed installation types and standards, survey/certification, and cross‑referenced maritime codes.

Installation is defined in the inserted term provision as any equipment required by the regulations to be fitted in a vessel (regulation 2A). The instrument treats installations as an integrated system: transmitter, receiver, radiation system (aerial and earth), main and reserve sources of electrical energy (regulation 5 and Schedules I and II). The Schedules provide granular, mandatory technical prescriptions for those components: transmitter power, emission types, receiver frequency coverage, aerial placement and protection, earth connections and battery performance and housing (Schedules I and II, Part I to III).

Radio surveyor is an approved person. The chief executive officer approves radio surveyors for the purposes of the regulations (regulation 2A). Radio surveyors perform statutory surveys, make reports to the Department and thereby trigger issuance, renewal or cancellation of certificates of survey (regulation 16(1), (3), (4), (5)). The Department and the chief executive exercise discretion over temporary certifications where a full survey is impracticable (regulation 16(3)).

Classification of vessels is bifurcated by date and by operational area. Part 2 addresses “seagoing ships” in existence before 1 October 2009 that are commercial vessels of Class 1, 2 or 3 (with specified exclusions) (regulation 3). Part 3 governs “vessels” that are new since 1 October 2009, and it expressly incorporates Section 12 of the Uniform Shipping Laws Code and selected NSCV provisions (regulations 19-22, 27). The Code and NSCV are therefore integrated into the regime for new vessels by incorporation by reference (regulation 22), so compliance can depend on documents external to the regulations themselves.

Operational concepts include radio watch and silence periods. Radio watch means listening on the appropriate distress frequency (regulation 2(1)). Silence periods are defined as the 3 minute windows commencing at each hour and at thirty minutes past the hour, Western Australian Standard Time (regulation 2(1)). The master must ensure a continuous radio watch while at sea subject to enumerated exceptions (regulation 14). These concepts determine operator behaviour at sea, including the obligation to test installations daily by communicating position to a coast or limited coast station and to record results in the radio logbook (regulation 15).

Maintenance, testing, ancillary fittings and spares are defined requirements that allocate different duties to owner and master. Owners are responsible for the fit, protection and prevention of electrical interference and for ensuring surveys occur (regulations 7, 8, 9, 16). Masters are responsible for daily maintenance tasks while at sea, carrying specified books and logs and making installations available for inspection (regulations 6, 10, 15, 17). The split of duties is explicit in the offence provisions (regulation 18).

Technical limits and safety features are highly prescriptive. For example, for VHF FM installations the transmitter power must be between 7.5 and 25 watts mean power with a ready reduction to 1 watt mean power (Schedule II, clause 2(b) and (c)). The product of antenna gain and transmitter power must not exceed 41 watts EIRP in the isotropic case (Schedule II, clause 7(3)). For single sideband (SSB) installations, the transmitter must cover specified carrier frequencies and emission types and deliver at least 15 watts unmodulated carrier power at 2182 kHz (Schedule I, clauses 2(1) and 2(2)). Reserve power sources are required to supply set currents for six hours (Schedules I and II, clause 5). Batteries cannot be dry cell types and must be rechargeable within prescribed periods with testing and isolation means (Schedules I and II, clause 6).

Procedural concepts include notice and application timings. Owners must lodge a written notice not less than 30 days before an installation is fitted (regulation 9). Survey applications for existing installations are tied to anniversaries and specific timing requirements and must be transmitted and accompanied by prescribed fees (regulation 16(1), (2a), (2b)). The Department publishes survey programmes for ports other than Fremantle and Swan River and notifies applicants of dates and times (regulation 16(2)).

Finally, the instrument imports external regulatory material into its operation. Section 22 expressly incorporates Section 12 of the Code into Part 3 by reference and regulation 27 requires compliance with specified NSCV clauses for new vessels, making those external standards enforceable under the state regulation. The schedules incorporate Commonwealth technical specifications RB 211B and RB 274. The integration of external codes and technical specifications is therefore a principal mechanism by which detailed requirements are imposed.

The regulations allocate duties and obligations among identifiable groups. The primary actors required to act under the instrument are owners of seagoing ships or vessels, masters, radiotelephone operators, radio surveyors, and the Department (chief executive officer). Secondary actors include coast stations and limited coast stations which are referenced as recipients for daily tests and communication checks.

Owners: Owners bear responsibility for fitting and protecting installations to the satisfaction of a radio surveyor (regulation 8). They must lodge notice of proposed fittings at least 30 days before installation (regulation 9). Owners must ensure installations are surveyed at prescribed intervals and pay the fees for original and further surveys (regulation 16(1), (2a), (2b)). Owners must also cause the installation to be so fitted and other electrical apparatus to be equipped to prevent electrical interference with reception (regulation 7). For vessels new since 1 October 2009, owners must provide radio surveyor reports at initial survey and when requested during periodic surveys (regulation 24). Owners are therefore the principal fee payers and capital cost bearers for equipment, spares and survey obligations.

Masters: Masters are assigned operational duties while the vessel is at sea. They must ensure installations are maintained to comply with Part 2 while at sea (regulation 6). Masters must ensure required logbooks and the Handbook are carried and entries are made for testing and distress calls (regulation 10). Masters must ensure a continuous radio watch while at sea subject to exceptions (regulation 14) and must cause installations and books to be available for inspection (regulation 17). For new vessels, masters must comply with the logbook requirement as if regulation 10 applied and must make equipment and documents available for inspection and testing (regulations 25 and 26). The offence provisions criminalise certain failures by masters with fines up to $500 (regulation 18(2)).

Radiotelephone operators: The instrument prescribes required qualifications for operators (regulation 13) and places daily testing obligations on operators to test installations and record the results (regulation 15). A radiotelephone operator who fails to make required records commits an offence subject to a fine (regulation 18(3)). The required qualifications are either a Restricted Operator’s Certificate of Proficiency under the Commonwealth Wireless Telegraphy Regulations or a certificate approved by the Commonwealth Department of Communications (regulation 13).

Radio surveyors: Radio surveyors are approved by the chief executive officer (regulation 2A). They conduct surveys, report to the Department, and their satisfaction triggers issue of a certificate of survey valid for 12 months (regulation 16(4)). The radio surveyor also has an evidentiary and gatekeeper role: the Department may cancel certificates upon receiving reports that regulations are no longer complied with (regulation 16(5)). Radio surveyors thus exercise technical judgement that affects operation legality and certification.

Department and chief executive officer: The Department administers surveys, receives applications and fees, issues certificates and temporary certificates, publishes survey programmes for ports and notifies applicants (regulation 16(2)). The chief executive officer approves radio surveyors (regulation 2A) and may determine that a survey is impracticable and accept an owner’s statement supported by an Overseas Telecommunications Commission (OTC) report in limited circumstances, issuing temporary certificates valid up to 90 days (regulation 16(3)). The Department therefore holds discretionary administrative powers that affect continued operation and certification.

Coast stations and limited coast stations: These are operational participants. The regulation defines coast station (including the historical role of the Overseas Telecommunications Commission) and refers to limited coast stations as persons licensed under earlier Commonwealth law (regulation 2(1)). Masters and operators must transmit test communications to a coast station or limited coast station for daily checks (regulation 15(1)). The requirement that certain vessels keep a continuous radio watch on 156.80 MHz (Channel 16) ties vessel operation directly to the presence and availability of coast/limited coast stations within range (regulation 5(b) and 14(4)).

Third parties and enforcement recipients: Radio surveyors inspect equipment and associated books on behalf of the Department (regulation 17). The Department may cancel certificates upon receiving adverse reports (regulation 16(5)). The regulations do not create private rights of action; compliance is enforced through administrative certification and monetary fines.

Geographic scope and vessel types: The coverage differs by vessel vintage and operational area: Part 2 applies to commercial vessels of Classes 1 to 3 in existence before 1 October 2009 (excluding Class 1E, 2E, 3E and hire and drive vessels) (regulation 3). Part 3 applies to new vessels as defined in Amendment List 7 to the Code adopted on 7 November 2008 (regulation 20). Vessels that operate exclusively within 20 nautical miles of a coast or limited coast station may be fitted with VHF FM installations instead of SSB, but only if they keep a continuous Channel 16 watch (regulation 5(b)).

In sum, the financial and operational burdens fall primarily on vessel owners for capital costs, spares and survey fees and on masters and operators for day to day compliance, testing and record keeping. The Department and approved radio surveyors are the decision makers who determine compliance outcomes and may suspend or cancel certification. The instrument thereby creates a structure of compliance obligations, administrative oversight and monetary penalties involving those actors.

The regulations allocate distinct duties to owners, masters and operators and create procedural rights for the Department and radio surveyors. These duties are specific, prescriptive and often time‑triggered.

Owners: Owners must ensure installations are fitted in a manner and at a position satisfactory to a radio surveyor and that fitting does not affect compasses or other navigational equipment (regulation 8(a)). Owners must protect installations against salt water and temperature extremes to the radio surveyor’s satisfaction (regulation 8(b)). Owners must prevent electrical interference by ensuring the installation and other electrical apparatus are equipped so as not to hinder effective reception (regulation 7). Owners must lodge written notice of proposed installation not less than 30 days before fitting (regulation 9). Owners must arrange and apply for statutory surveys within specified timeframes (regulation 16(1), (2)), pay the prescribed fees for original and any further surveys (regulation 16(2a), (2b)), and present vessels for survey at times and places notified by the Department (regulation 16(2)). For new vessels, owners must provide a radio surveyor’s report at initial survey and upon request during periodic survey (regulation 24).

Masters: Masters must ensure installations are maintained so that while the vessel is at sea the installation complies with Part 2 (regulation 6). Masters must ensure carrying of the radio logbook and the Commonwealth Handbook and entry of testing results and distress call information into the logbook (regulation 10). Masters must ensure continuous radio watch while at sea subject to listed exceptions, and if a VHF FM installation is fitted under regulation 5(b) the watch must be on 156.80 MHz as far as practicable (regulation 14). Masters must ensure the carrying of specified spares, including valves, fuses, globes and on non‑fishing seagoing ships a spare completely assembled antenna for distress frequency use (regulation 12). Masters must make installations and associated books available for inspection at all reasonable times (regulation 17). Under Part 3, masters must also comply with the logbook and inspection obligations and ensure sufficient power is available for testing (regulations 25 and 26).

Radiotelephone operators: Operators must hold approved qualifications (either a Restricted Operator’s Certificate or a certificate approved by the Commonwealth Department of Communications) to satisfy section 44(b) of the Act (regulation 13). Operators must conduct daily tests while the vessel is at sea by communicating the vessel’s position to a coast or limited coast station and must record the results in the radio logbook (regulation 15). Failure to record testing results is an offence under regulation 18(3).

Radio surveyors and the Department: A radio surveyor conducts the survey, makes a report and, if satisfied, a certificate of survey is issued by the Department valid for 12 months from the date of survey completion (regulation 16(4)). The chief executive officer may approve radio surveyors (regulation 2A). Where a full survey is impracticable and the chief executive officer agrees, the Department may accept a master’s written statement supported by an Overseas Telecommunications Commission report and issue a temporary certificate for up to 90 days (regulation 16(3)). The Department may cancel temporary certificates or certificates of survey upon receiving a report that regulations are no longer being complied with (regulation 16(5)). The Department publishes programmes of surveys for ports and sets notification and timing obligations that the owner must follow (regulation 16(2)).

Technical duties: The regulations impose technical duties under the Schedules. Installations must meet the technical specifications set out in RB 211B for SSB or RB 274 for VHF FM as incorporated by the Schedules (Schedule I, clause 1; Schedule II, clause 1). Electrical energy requirements include a main source separate from a reserve source capable of running specified portions of the installation for six hours while at sea (Schedules I and II, clause 5). Batteries must not be dry cell types, must be housed and placed to a radio surveyor’s satisfaction and be capable of being fully charged within 16 hours (Schedules I and II, clause 6). Aerials must secure efficient radiation and be protected from mechanical damage and salt water, and earth connections must present minimum impedance and preclude electrolysis damage (Schedules I and II, clause 7 and Schedule I clause 8).

Procedural rights and powers: The Department has the administrative power to require surveys, to accept temporary certificates, to cancel certificates, to publish survey programmes and to charge and receive prescribed fees for original and further surveys (regulation 16). Radio surveyors have a gatekeeper function; their favourable report entitles the owner to a certificate of survey (regulation 16(4)). Owners and masters have the procedural duty to present vessels and installations for survey and to supply power for testing (regulation 16(2), (7)).

Penalties and enforcement mechanisms: Non‑compliance triggers fixed monetary fines up to $500 under Part 2 and specified $500 penalties under Part 3 for a range of failures (regulations 18, 25, 26, 27). The Department’s power to cancel certificates functions as an operational enforcement tool that can legally prevent a commercial vessel being navigated beyond smooth waters without a valid certificate (regulation 16(6)). This combination of monetary penalties and certification control creates both ex post and ex ante compliance pressure: fines penalise breaches, while certificate cancellation restricts legal operation.

Rights of procedural fairness or appeals are not specified in the text of these regulations. The instrument establishes administrative discretion (chief executive officer approvals, Department cancellations) and technical certification as the primary regulatory levers. The document requires owners and masters to keep records, present equipment for inspection and to follow notification and timing rules, creating audit trails that enforcement authorities may use to verify compliance.

Enforcement under the regulations relies on a combination of monetary fines, administrative certification controls and inspection powers exercised by approved radio surveyors and the Department. The instrument quantifies penalties and specifies which actor’s breach attracts a fine, and it endows the Department with certificate cancellation powers and the chief executive officer with approving authority for radio surveyors and temporary departures from survey timing.

Monetary penalties: Part 2 establishes tiered liability tied to the actor and offending regulation. The owner of a seagoing ship who breaches regulation 7 (electrical interference), regulation 8 (installation and protection), regulation 9 (notice before fitting), regulation 11 (ancillary fittings), or regulation 16(1) or (2) (survey application timing) commits an offence and is liable to a fine not exceeding $500 (regulation 18(1)). The master who breaches regulation 6 (maintenance), regulation 10 (books), regulation 12 (spares), regulation 14 (radio watches), regulation 15(1) (daily testing), regulation 16(6) or (7) (navigating beyond smooth waters without valid certificate, providing power for survey testing) or regulation 17 (availability for inspection) likewise commits an offence and is liable to a fine not exceeding $500 (regulation 18(2)). A radiotelephone operator who breaches regulation 15(2) (failure to record testing results) commits an offence and is liable to a fine not exceeding $500 (regulation 18(3)). Part 3 prescribes fixed penalties for specific breaches: failure by the master to comply with regulation 10 (via regulation 25) carries a penalty of $500; failures to make equipment and documents available for inspection or to ensure power for testing under regulation 26 carry fines of $500 each; and breaches of certain NSCV obligations in regulation 27 attract fines of $500 (regulations 25, 26, 27).

Administrative enforcement: Certificates of survey are central to enforcement. A radio surveyor who reports compliance will trigger issue by the Department of a certificate of survey valid for 12 months from the survey completion date (regulation 16(4)). The Department may cancel temporary certificates or certificates of survey upon receiving a radio surveyor’s report that any regulation is no longer being complied with in respect of an installation (regulation 16(5)). The master of a commercial vessel must not cause or permit the vessel to be navigated beyond smooth waters unless a valid temporary certificate or certificate of survey is in force (regulation 16(6)). That provision ties the administrative certification mechanism directly to the vessel’s legal ability to carry out certain voyages, establishing an operational sanction beyond monetary fines.

Inspection powers and procedures: The master must make the installation and associated books available for inspection by a radio surveyor at all reasonable times (regulation 17). For vessels new since 1 October 2009, the master must make equipment and documents available for inspection and testing by a radio surveyor (regulation 26(1)) and ensure sufficient power for testing (regulation 26(2)). Owners must apply for surveys and present the vessel for survey at the port and time notified by the Department (regulation 16(2)). The regulations therefore give surveyors a statutory inspecting role and the Department a scheduling and oversight role. The requirement to transmit test communications daily to a coast or limited coast station and to record tests in the logbook provides a continuous documentary trail that may be checked at inspection time (regulation 15).

Discretion and temporary exceptions: The chief executive officer has discretion to accept alternative evidence and issue temporary certificates where it is unreasonable, too expensive or otherwise impracticable to survey within the prescribed times (regulation 16(3)). In such cases the owner or master must deliver a written statement supported by an Overseas Telecommunications Commission report indicating satisfactory reception on two carrier frequencies. The Department may issue a temporary certificate valid for up to 90 days, unless sooner cancelled (regulation 16(3)). This provision allows for administrative flexibility in cases where a formal survey cannot be conducted on time.

Fee‑linked enforcement: The survey process is fee based. Regulation 16(2a) establishes a fee of $478.30 for an original survey and regulation 16(2b) establishes a fee of $235.90 for a necessary further survey. Failure to apply, to present the vessel for survey, or to pay the prescribed fees can result in the vessel lacking a certificate and therefore being unable to lawfully navigate beyond smooth waters (regulation 16(6)). The fees therefore function both as administrative cost recovery and as a mechanism tied to legal authority to operate.

Non‑monetary compliance consequences: Beyond fines and certificate cancellation, the instrument imposes operational limits: a vessel may not legally be navigated beyond smooth waters without a valid certificate (regulation 16(6)). This is an operational prohibition that can be enforced by inspectors and has direct safety and commercial consequences for owners and masters.

No criminal imprisonment or higher penalties are specified in the provided text. All specified monetary penalties are relatively modest and capped at $500 in Part 2 and at $500 per specified breach in Part 3. The instrument therefore relies primarily on certification control and administrative oversight for operational enforcement, with monetary fines as secondary sanctions.

Finally, appeal or review mechanisms are not described in the text. The Department’s powers to issue and cancel certificates and the chief executive’s approval of radio surveyors are framed as administrative functions. Any remedies, review rights or further enforcement steps would have to be sought in other provisions of the Marine Act or administrative law mechanisms not contained within this instrument.

The regulations explicitly incorporate and cross‑refer to several external instruments and earlier Commonwealth specifications. These references create legal interdependence between the state regulation and external codes, Commonwealth instruments and technical specifications.

Incorporation of the Code and NSCV: For vessels defined as new since 1 October 2009, Part 3 incorporates Section 12 of the Uniform Shipping Laws Code into the regulations (regulation 22). Regulation 19 defines “Code” as the Uniform Shipping Laws Code as in existence on 1 October 2009 and declares that terms used in the incorporated provisions have their Code meanings in this Part (regulation 19(1) and (2)). Regulation 21 requires classification of vessels per clause 6 of Section 1 of the Code. Regulation 27 requires owners and masters of new vessels to comply with specified NSCV provisions, expressly tying certain NSCV clauses to state regulatory offences with $500 fines (regulation 27(1) and (2)). Thus for new vessels, compliance is not limited to the radiotelephony regulations themselves but extends to externally maintained codes, which are therefore legally enforceable under the state instrument.

References to Commonwealth technical specifications and repealed Acts: The Schedules adopt Commonwealth technical specifications RB 211B and RB 274 for SSB and VHF installations respectively (Schedule I clause 1 and Schedule II clause 1). The regulation text defines “coast station” as a land station used by the Overseas Telecommunications Commission established under the Overseas Telecommunications Act 1946, and “limited coast station” as a land station used by a person licensed under the Wireless Telegraphy Act 1905 (regulation 2(1)). The notes to the reprint, however, record that the Overseas Telecommunications Act 1946 was repealed by the Telecommunications (Transitional Provisions and Consequential Amendments) Act 1991 and that the Wireless Telegraphy Act 1905 was repealed by the Radiocommunications (Transitional Provisions and Consequential Amendments) Act 1983 (Notes 2 and 3). The regulations therefore reference historical Commonwealth institutions and licensing frameworks whose legislative basis has since been repealed, but the regulations retain the functional concepts of coast and limited coast stations.

Interaction with the WA Marine Act 1982: These regulations operate under the Marine Act 1982, particularly section 44 which is the statutory hook for the installation requirements (regulation 5 refers to “for the purposes of complying with section 44 of the Act”). The text of the Marine Act itself is not included in this document, but regulation 5 explicitly links installation requirements to section 44 compliance. The reprint heading indicates that these are W.A. Marine (Radiotelephony) Regulations made under the Western Australian Marine Act 1982.

Interplay of state and Commonwealth regulatory domains: The Schedules and operator qualification provisions continue to rely on Commonwealth technical standards and operator certification frameworks (regulation 13 references Commonwealth departmental approval and the Wireless Telegraphy Regulations). This creates a mixed compliance landscape: operators and owners must satisfy state installation, survey and certification rules while also holding or meeting Commonwealth qualifications or standards incorporated by reference. The note that Commonwealth Acts have been repealed indicates that the historical textual references may not perfectly align with current Commonwealth licensing regimes; the regulation, however, maintains its own requirements by name.

Survey and certification cross‑links: The regulations make procedural use of reports from the Overseas Telecommunications Commission in exceptional cases where a timely survey is impracticable (regulation 16(3)(d)). That reliance on a Commonwealth entity for evidentiary support creates an operational interaction point between state administrative processes and Federal communications infrastructure bodies.

Temporal incorporation and fixed references: The instrument fixes its incorporation points in time: the Code and NSCV references apply “as in existence on 1 October 2009” (regulation 19(1)). That approach imports a static version of external instruments as of that date, rather than permitting automatic updating by later amendments. The Schedules reference Commonwealth specifications from 1973 and 1976, explicitly anchoring technical requirements to historical documents (Schedule I clause 1 refers to RB 211B June 1973; Schedule II clause 1 refers to RB 274 January 1976).

Absence of wider enforcement framework in the instrument: While the regulations create offences and monetary penalties, they do not set out broader administrative appeal mechanisms or prosecutorial processes; those functions are likely to be found in the parent Act or other legislation. Similarly, the regulations do not create direct civil remedies or private rights of action; they regulate conduct by owners, masters and operators and tie compliance to survey certificates issued by the Department and reports from approved radio surveyors.

In short, the instrument incorporates external maritime and technical instruments and invokes Commonwealth‑origin standards and bodies. It fixes incorporation points and references, creating a hybrid regulatory regime in which state enforcement leverages Commonwealth technical specifications and historical communications infrastructure concepts. That design makes compliance contingent on both state administrative processes and external technical standards.

The reprint and compilation materials included in the instrument record a long series of amendments stretching from the original 1981 regulations through numerous annual and periodic amendments up to the reprint date of 5 March 2010. The compilation table lists amendment regulations, their gazettal dates and commencement dates, and identifies three reprints.

Original enactment and early amendments: The W.A. Marine (Radiotelephony) Regulations 1981 were gazetted on 27 November 1981 and commenced the same day (Compilation table). An amendment followed in 1983 (Gazette 1 July 1983) which affected regulation 1 and other parts as indicated by the marginal note to regulation 1.

Ongoing updates through the 1980s and 1990s: The regulations were amended repeatedly: 1989 (gazetted 16 June 1989), 1990 (1 August 1990), 1991 (26 July 1991), 1992 (30 June and 11 August 1992), 1993 (29 June 1993), 1994 (14 June 1994), 1995 (11 July 1995), 1996 (25 June 1996), 1997 (27 June 1997), 1998 (12 May 1998). These amendments are recorded in the compilation table. Many of the amendments have effective dates on or around 1 July of the relevant year, reflecting usual annual regulatory cycles.

Reprints and later amendments: The document notes reprint 1 as at 16 February 2001 incorporating earlier amendments, a second reprint as at 3 November 2006, and a third reprint as at 5 March 2010 incorporating later amendments. Further amendments were made in 2000, 2001, 2002, 2003, 2004, 2005, 2006, 2007, 2008, and 2009 (Compilation table). Notably, Part 3 (requirements for vessels new since 1 October 2009) and the insertion of regulation 2A (terms used) appear to have been inserted by amendments gazetted 11 December 2009 (see marginal notes to Part 1 and Part 2 headings and regulation 2A insertion).

Specific recent structural amendments: The reprint notes that a heading for Part 1 was inserted on 11 December 2009 and regulation 2A (installation, radio surveyor) was inserted on that date (regulation 2A inserted: Gazette 11 Dec 2009 p. 5101). Part 2 and Part 3 headings were inserted on 11 December 2009 as well, indicating a reorganisation or clarification of the regulations’ structure at that time (see the heading insertions). The creation of Part 3 and the incorporation of Section 12 of the Code, plus the NSCV references, appear tied to the 2009 amendments which implemented distinct requirements for vessels new since 1 October 2009 (regulations 19‑27).

Fee updates and survey procedural detail: Regulation 16 has a long amendment history by date annotations, indicating periodic updates to survey fees and procedural detail over many years (regulation 16 amended many times from 1983 through 2009 per the marginal notes). The specified survey fees of $478.30 and $235.90 appear in the reprint as of 5 March 2010; those figures reflect the fee schedule current at the reprint date and are included in regulation 16(2a) and (2b). The multiple amendment entries for regulation 16 suggest fees and survey procedures have been adjusted historically.

Schedules and technical references have remained anchored to historical Commonwealth specifications: Schedule I references RB 211B issued in June 1973 and Schedule II references RB 274 issued in January 1976. Those references have not been updated in the text of the reprint; the Schedules themselves have not been replaced by more recent Commonwealth specs within this instrument. The compilation notes indicate Schedules I and II were part of the original 1981 regulations and have remained in place with amendments to other parts of the instrument.

Repeals of referenced Commonwealth Acts: The notes record that the Overseas Telecommunications Act 1946 and the Wireless Telegraphy Act 1905 (both referenced in regulation 2(1)) were repealed by later Commonwealth legislation (notes 2 and 3). The regulations retain the functional references to “coast station” and “limited coast station” while the statutory foundations for those concepts at Commonwealth level have changed.

Reprint dates: The reprint history is explicit. Reprint 3 is noted as the reprint as at 5 March 2010, including amendments to that date (Compilation table final entry). Earlier reprints are dated 16 February 2001 and 3 November 2006. The compilation table therefore provides a clear chain of amendments and reprints up to March 2010.

In short, the regulations have been subject to continual amendment across three decades, culminating in a significant rework circa 2009 that introduced Part 3, incorporated the Code and NSCV elements for new vessels and inserted definitional material for installations and radio surveyors. The fee schedule and survey procedural requirements were updated repeatedly and are recorded in the amendment notes attached to regulation 16.

The instrument itself does not record any litigation history. The text contains no references to judicial decisions, case law, or appeals. The schedules, notes and compilation table list only statutory amendments, reprints and references to external legislation or Commonwealth specifications. There are no named cases or reported decisions in the document.

Because the regulations create statutory offences and administrative certification mechanisms, they are potentially subject to judicial review or prosecution in the ordinary course. However, the instrument does not supply examples or summaries of litigation, nor does it cite any administrative decisions or court cases that interpret its provisions. Any litigation history would therefore have to be sourced outside this document from court or tribunal records, judgments, or administrative appeal files.

The absence of litigation entries in the document is material for practitioners: the regulatory text alone embodies the statutory duties, penalties and procedural powers. To understand how courts have interpreted particular terms such as the scope of “reasonable times” for inspection (regulation 17), the meaning of “satisfactory to a radio surveyor” (regulations 8 and Schedules), or the limits of Departmental discretion in issuing temporary certificates (regulation 16(3) and (5)), one must consult external case law databases and tribunal decisions. The reprint does not purport to provide that interpretative context.

For compliance or enforcement strategies, practitioners should therefore treat the regulations as the starting legal document and seek out relevant adjudication or prosecutorial practice externally. If litigation exists, it is not embedded in or referenced by the regulatory text provided here.

Several specific traps, operational pitfalls and drafting features can cause non‑compliance risks or unintended consequences if overlooked. These are concrete, text‑based points for owners, masters and advisers.

1. Two regulatory tracks and static incorporation dates. The regime depends on whether a vessel is “new” since 1 October 2009 (Part 3) or an earlier seagoing ship (Part 2) (regulations 3 and 20). Part 3 incorporates Section 12 of the Code and specified NSCV clauses “as in existence on 1 October 2009” (regulation 19(1) and 22). That means that compliance obligations for new vessels are fixed to the version of the Code/NSCV on that date. Practitioners must determine the correct track and cannot assume later updates to the Code or NSCV automatically apply to a vessel regulated under Part 3.

2. Notice and survey timing traps. Owners must lodge written notice not less than 30 days before fitting an installation (regulation 9). For existing installations, surveyed under the former regulations, owners must apply for periodic surveys once every 12 months on the anniversary of the original certificate or within 14 days of the regulations coming into effect if no former certificate existed (regulation 16(1)(a)). Failure to apply within the prescribed windows may create an enforcement exposure and operational downtime, and may trigger survey fees for further surveys (regulation 16(2a), (2b)).

3. Certification as a condition of navigation. For commercial vessels, the master must not navigate beyond smooth waters unless a valid temporary certificate or certificate of survey is in force (regulation 16(6)). A lapsed certificate therefore directly limits lawful voyages. Owners and masters must track certificate validity and ensure timely surveys and any remedial works required following a failed survey to avoid being prevented from undertaking voyages.

4. Discretionary temporary certificates and evidentiary requirements. Where a survey cannot reasonably be conducted on time, the chief executive officer can accept a written statement by the master supported by an Overseas Telecommunications Commission report indicating satisfactory reception on two carrier frequencies and issue a temporary certificate valid up to 90 days (regulation 16(3)). This exception requires precise documentary support and reference to carrier frequencies as specified in the statement and implies reliance on an external Commonwealth report. If reliance on the OTC is impossible in practice, vessels may face non‑compliance risk.

5. Operator qualification reliance on Commonwealth approvals. The prescribed qualifications include a Restricted Operator’s Certificate issued under the Wireless Telegraphy Regulations or a certificate approved by the Commonwealth Department of Communications (regulation 13). Those Commonwealth Acts and regulations cited historically have been repealed (notes 2 and 3), so owners must ensure operator qualifications actually meet current Commonwealth certification regimes that functionally correspond to the stated requirements. There is risk that a literal reading of the text may point to a repealed legislative scheme; in practice, owners should ensure operator certificates align with current Commonwealth recognition mechanisms.

6. Technical specificity and older Commonwealth specs. Schedules I and II incorporate RB 211B (June 1973) and RB 274 (January 1976) respectively (Schedules I and II, clause 1). These are detailed technical specifications from earlier Commonwealth departments. Procuring equipment and demonstrating compliance against older specifications may be operationally awkward. Practitioners should verify whether radio surveyors accept contemporary equipment certified to equivalent modern standards and should not assume that modern certified equipment automatically satisfies the older named specification without documented equivalence.

7. Battery and reserve power obligations. Reserve sources must supply for 6 hours specified fractions of transmitter current, receiver current and the emergency light current (Schedules I and II, clause 5). Batteries cannot be dry cell and must be rechargeable within 16 hours (Schedules I and II, clause 6). The reserve power formula requires calculation of current draw and ensuring one‑half of transmitter current is available for transmission purposes. Owners and operators must model electrical loads precisely, design isolating switches where equipment sharing exists and have test and charging facilities; casual assumptions about battery sufficiency can lead to survey failure.

8. Aerial and earth requirements may affect vessel structure. The aerial must be sited to prevent mechanical damage, exclude personnel danger, not interfere with navigation and be protected from salt water (Schedules I and II, clause 7). Earth connections must present minimum radio frequency impedance and preclude electrolysis damage (Schedule I clause 8). Retrofitting a vessel can therefore involve structural or bonding work that is not simply radio equipment installation. Owners should anticipate shipyard time and costs for proper aerial and earth installations.

9. Spares obligations and scope. The master must carry one spare valve of each type and 4 spare fuses of each type, spare globes and, for non‑fishing seagoing ships, a spare completely assembled antenna usable on a distress frequency (regulation 12). Those requirements mean owners must hold specific inventory onboard. Sourcing some spare parts for older SSB equipment might be non‑trivial.

10. Radio watch exceptions and silence periods. A continuous radio watch is required while at sea except during silence periods or specified operational exceptions (regulation 14). Silence periods are specific short windows (3 minutes at each hour and 30 minutes past each hour) (regulation 2(1)). Masters must ensure watch arrangements and loudspeaker provisions where installations are not at the navigation position (regulation 11(2)). Failure to observe watch or misinterpret the silence period rules could produce offences under regulation 18.

11. Small monetary fines, bigger operational impact. The monetary fines are modest, up to $500, but the operational consequence of lacking a certificate is significant: inability to navigate beyond smooth waters (regulation 16(6)). Practitioners should not focus solely on fines; loss of certificate can be commercially damaging.

12. Static reference to repealed Commonwealth Acts. The text references the Overseas Telecommunications Act 1946 and the Wireless Telegraphy Act 1905 as founding authorities for coast and limited coast station concepts (regulation 2(1)). The notes indicate those Acts were repealed. The practical effect is a potential mismatch between regulatory text and the contemporary Commonwealth telecommunications framework, creating interpretive uncertainty that may require administrative clarification or reliance on modern functional equivalents.

13. Incorporation but fixed time point. Part 3 incorporates Section 12 of the Code and NSCV clauses as they existed on 1 October 2009 (regulation 19(1) and 22). If owners rely on later versions of the Code or NSCV, that reliance is misplaced for vessels captured by Part 3. Practitioners must check historical versions and the Amendment List 7 referenced to determine whether a vessel is a “new vessel” under the regulation.

These are pragmatic, document‑anchored pitfalls that can be addressed by targeted compliance actions such as early engagement with radio surveyors, careful power budgeting, documentation of tests and survey applications, and verification that operator qualifications and equipment certification meet the Department’s practical expectations.

Compliance requires operational, technical and administrative steps mapped to the regulations’ specific duties. Below is a stepwise practical checklist, anchored to the relevant regulations and Schedules, to bring an owner or operator into compliance.

1. Determine which Part applies to your vessel. Establish whether the vessel is a seagoing ship in existence before 1 October 2009 subject to Part 2 (regulation 3) or a new vessel as defined in Amendment List 7 to the Code adopted on 7 November 2008 and therefore subject to Part 3 (regulation 20). Classify the vessel per the Code where applicable (regulation 21).

2. Identify the required installation type. If a vessel operates beyond 20 nautical miles from a coast or limited coast station, or is otherwise a seagoing ship of any kind under Part 2, prepare to fit a single sideband installation that complies with Schedule I (regulation 5(a) and Schedule I). If a vessel operates exclusively within 20 nautical miles of a coast or limited coast station and maintains a continuous watch on Channel 16, a VHF FM installation complying with Schedule II is permitted (regulation 5(b) and Schedule II). For new vessels, ensure compliance with Section 12 of the Code as incorporated (regulation 22).

3. Technical procurement and documentation. Procure equipment that meets the Schedules’ specifications. For SSB, ensure transmitter and receiver coverage of the specified frequencies and emission types and a minimum unmodulated carrier power of 15 watts at 2182 kHz (Schedule I, clauses 2 and 3). For VHF FM, ensure transmitter power between 7.5 and 25 watts mean with means to reduce to 1 watt and appropriate receiver coverage (Schedule II, clause 2 and 3). Ensure aerials and earth connections are designed and installed according to the Schedules (Schedule I clause 7 and 8; Schedule II clause 7).

4. Plan for power and battery requirements. Design main and reserve power systems per Schedules I and II. Reserve sources must supply the specified currents for six hours while at sea (Schedules I and II clause 5). Batteries must not be dry cell, must be housed to a radio surveyor’s satisfaction and be chargeable within 16 hours; provide charging and testing means and, if batteries supply other equipment, include an isolating switch to cut off other equipment in an emergency (Schedules I and II clause 6).

5. Ancillary fittings and spares. Fit a reliable clock visible to the operator, a simple written notice explaining use to an unskilled person, and an emergency electric light illuminating controls and the clock and notice; the light must be operable both from the installation and from every access means (regulation 11(1)). If the installation is not at the navigation position, fit a loudspeaker with gain control sufficient for effective radio watch (regulation 11(2)). Stock spares required by regulation 12 (one spare valve per type, four spare fuses per type, spare globes and for non‑fishing vessels a spare completely assembled antenna usable on a distress frequency).

6. Arrange operator qualifications. Ensure at least one operator holds the prescribed qualifications under regulation 13: the Restricted Operator’s Certificate of Proficiency in radiotelephony or a Commonwealth‑approved certificate. Confirm that certificates in use are accepted by the Department in practice given historical references to repealed Commonwealth Acts.

7. Prepare logbook and handbook. Keep a radio logbook onboard and a copy of the Commonwealth “Handbook for Radiotelephone Ship Station Operators” as required by regulation 10. Ensure daily test results and all distress calls with relevant details are entered as required (regulation 10).

8. Radio watch and testing procedures. Put in place procedures to maintain a continuous radio watch while at sea subject to exceptions in regulation 14. For vessels required to keep Channel 16 watch, establish Channel 16 monitoring as far as practicable (regulation 14(4)). Implement daily testing by a radiotelephone operator who will communicate the vessel’s position to a coast or limited coast station and record the results in the logbook (regulation 15).

9. Survey scheduling and applications. For vessels under Part 2, apply for survey as required: historic installations already fitted before the regulations’ operation must be surveyed once every 12 months on the anniversary of the former certificate or within 14 days of the regulations’ commencement where no former certificate existed (regulation 16(1)(a)). Newly fitted installations require application within 14 days of fitting and thereafter annual surveys (regulation 16(1)(b)). Transmit applications and fees to a Department office 14 days before the required survey date for Fremantle/Swan River or according to the Department’s published programme for other ports (regulation 16(2)). Pay the fee of $478.30 for original survey and $235.90 for further surveys where applicable (regulation 16(2a), (2b)).

10. Facilitate surveys and inspections. Present the vessel and ensure sufficient power is available for testing during surveys and inspections (regulation 16(7) and 26(2)). Make installations and books available for inspection by radio surveyors at all reasonable times (regulation 17 and regulation 26(1)). Ensure the installation’s physical fitting and wiring are in positions satisfactory to the radio surveyor and do not affect navigation equipment (regulation 8).

11. Temporary certificate contingencies. If a timely survey is impracticable, be prepared to supply a written statement indicating the installation is in good condition and backed by an Overseas Telecommunications Commission report showing satisfactory reception on two carrier frequencies, so that the Department may issue a temporary certificate up to 90 days (regulation 16(3)). Recognise that this option is discretionary and document preparedness to obtain OTC or equivalent evidence in advance where feasible.

12. Compliance with Code/NSCV where applicable. For new vessels under Part 3, ensure compliance with Section 12 of the Code (incorporated into the regulations) and with the specified NSCV clauses named in regulation 27. Provide the radio surveyor’s report to the chief executive officer at initial survey and on request during periodic surveys (regulation 24). Ensure masters make required logbook entries consistent with regulation 10 via regulation 25.

13. Recordkeeping and audit readiness. Maintain complete and contemporaneous records of survey applications, surveyor reports, test communications and logbook entries, notices of fitting and maintenance records. These records are the primary documentary evidence relied upon by radio surveyors and the Department during inspections and in the event of enforcement action.

14. Liaise with the Department and radio surveyors early. Given the Department’s scheduling and discretionary powers and the radio surveyor’s role in certifying compliance, engage early with the Department and an approved radio surveyor to confirm acceptance of proposed equipment, installation plans and equivalence of modern equipment to the Schedules’ historical specifications.

15. Monitor certificate validity and compliance deadlines. Track the anniversary dates for survey and certificate expiry and ensure timely applications for surveys to avoid certificate lapse and the resulting restriction on navigation beyond smooth waters (regulation 16(6)).

16. Legal and technical due diligence. For vessels operating under Part 3, review the specific NSCV clauses cited in regulation 27 and the incorporated Section 12 of the Code as they existed on 1 October 2009. Obtain or procure technical evidence that your equipment meets the Schedules by demonstration to the radio surveyor, and preserve supplier certificates and technical documentation to present at survey.

Following this checklist maps the statutory duties to concrete operations. Where the regulations reference Commonwealth approvals, OTC reports or historical technical specifications, obtain contemporaneous administrative confirmation from the Department or a radio surveyor about acceptable modern equivalents and the Department’s practical expectations to avoid compliance surprises.
