W.A. Marine (Load Lines) Regulations 1983

The instrument relies on three connected legal objects: the Western Australian Marine Act 1982, the Uniform Shipping Laws Code (the Code), and a set of administrative fees for survey work.

• Incorporation of model law. Section 7 of the Uniform Shipping Laws Code is incorporated into Western Australian subordinate law by regulation 4(1), with the Code defined as it stood on 1 October 2009 (r 3(1)). Incorporation means the operative provisions of that section have legal force in WA, subject to the express modifications listed at r 4(2).

• Local modification of the Code. The regulations do not adopt Section 7 of the Code verbatim. Regulation 4(2) specifies discrete textual modifications: it substitutes a new definition of “survey authority” to mean an authority appointed by the Governor under Section 31 of the Act (r 4(2)(a)), and it deletes several numbered Code clauses (clause 73.6; clauses 74.1, 74.2, 74.4, 74.5, 74.7 and 74.8) as listed at r 4(2)(b)-(e). The substitution ties the institutional actor designated by the Code to the Governor’s appointment power under the Act.

• Fee schedule for load line surveys and inspections. Regulation 6 is the principal operational section for fees. It defines the terms used for the fees regime (r 6(1)), prescribes fixed and time-based fees for initial and reissue load line surveys and for periodical inspections (r 6(2)-(4)), and establishes when additional attendance fees apply or are excluded (r 6(5)). It then fixes the attendance fee rates and specifies that travel and accommodation costs are payable where travel is required (r 6(6)).

• Inter-regulatory references. The concept of a “periodic survey” is linked to the separate W.A. Marine (Surveys and Certificates of Survey) Regulations 1983 regulation 6 (r 6(1)). The Code as incorporated is referred to in section 115 of the Act, per the definition in regulation 3(1). The new definition of survey authority references Section 31 of the Act (r 4(2)(a)). These cross-references mean the operation of these regulations is embedded in a small network of other statutory and regulatory provisions.

• Administrative detail and exceptions. The fee regime contains specific exceptions to attendance fees (r 6(5)(a)-(c)), and quantifies rates precisely in dollar figures and units (per metre of load line length, per half hour, per hour). The regulations therefore operationalise cost recovery for certain survey activity but do not set out collection mechanisms or explicit liability language within the text provided.

These are the central structural elements. The regulations are not a comprehensive maritime code; they are targeted to importing a portion of the Code and to setting fees for load line surveys and inspections, with precise numeric rates and a limited set of modifications and exceptions.

The text itself frames applicability at two overlapping levels: subjects of the Act, and users of load line survey services.

• Vessels and voyages within the Act’s scope. Regulation 4(1) states that the incorporated Section 7 of the Code "shall extend and apply to and in respect of all vessels and voyages to which the Act applies." The regulation therefore applies to the same universe of vessels and voyages covered by the Marine Act 1982. The regulations do not re-specify which vessels or voyages those are; to identify precise classes of vessels, one must consult the Act. The regulation makes the incorporated Code provisions operative for that statutory cohort.

• Persons seeking load line certificates or inspections. Regulation 6 sets fees for the initial survey required for the issue of a load line certificate and for surveys for reissue, as well as periodical inspections under the Code (r 6(2)-(4)). Anyone who needs an initial load line certificate, a reissued certificate, or a periodical inspection under the incorporated Section 7 will be affected by these fee provisions. The regulations do not state within their text who is liable to pay the fees, but they do state the amounts payable for specified services.

• Survey authorities and surveyors. The substituted definition at r 4(2)(a) identifies the "survey authority" as an authority appointed by the Governor under Section 31 of the Act. This places the power to designate the competent authority with the Governor, and limits who can validly act as the survey authority under the incorporated Code clauses. Surveyors engaged in load line surveys are given specific fee entitlements by r 6(3)-(6), including the right to recover travel and accommodation costs where applicable.

• The Department and public scheduling. Regulation 6(1) defines "scheduled time and place" as a time and place notified to the public by the Department at which a person may have a vessel surveyed or inspected without incurring travel or attendance fees (r 6(1)). This affects the Department’s administrative role: the Department decides scheduled times and places, and members of the public can use those slots to avoid attendance fees under r 6(5)(b).

• Geographic scope for attendance fee exceptions. Regulation 6(5)(a) provides that attendance fees are not payable if the survey or inspection is carried out within the Perth metropolitan area or at Geraldton. Owners, operators or persons arranging surveys in those locations will not be charged attendance fees under this regulation.

In short, the regulations directly affect owners and operators of vessels requiring load line certification and the surveyors who carry out those surveys, while their indirect effect extends to the Department (which schedules public times and places) and to the Governor’s appointment power for survey authorities. The regulations do not, in themselves, assign fee liability language beyond stating amounts, nor do they alter the basic categories of vessels to which the Act applies.

The regulations create operative obligations and entitlements chiefly by incorporating the relevant Code provisions and by prescribing fee entitlements. The text provides specific duties by reference and specifies fee-based rights of surveyors.

• Duty to comply with incorporated Section 7 of the Code. Regulation 4(1) renders Section 7 of the Uniform Shipping Laws Code binding in Western Australia for vessels and voyages to which the Act applies. The result is that obligations contained in that incorporated Section 7 apply to those vessels and voyages, subject to the stated modifications in regulation 4(2). The regulations do not reproduce the content of Section 7, so the specific operational duties (for example, marking of load lines, survey intervals, certificate obligations) must be read from Section 7 as incorporated. Regulation 3(2) confirms that terms in the incorporated Code provisions carry the Code meanings.

• Governor’s appointment power for survey authority. By substituting the definition of “survey authority” to mean an authority appointed by the Governor under Section 31 of the Act (r 4(2)(a)), the regulations place a duty on the Governor (or the Governor’s delegate under the Act) to appoint an authority if the concept of survey authority is to be invoked under the incorporated Code provisions. The regulation does not itself specify appointment procedures or criteria; it only defines the institutional locus.

• Fee-paying obligation as a practical duty implied by the fee schedule. Regulation 6 sets precise fees for initial surveys, reissue surveys, periodic inspections and attendance. For example, the fee for an initial survey is $104.80 per metre of load line length (r 6(2)); the reissue survey fee is $151.70 if carried out in conjunction with a periodic survey, or $151.70 plus time-based components if not (r 6(3)). The regulations therefore create entitlements for surveyors to receive those fees. The regulations do not contain an explicit clause stating the legal obligation of owners or applicants to pay; however, by prescribing fees for statutory survey services the instrument operationally creates an expectation that those fees will be payable in connection with the relevant surveys and inspections.

• Rights to avoid attendance fees in defined circumstances. Regulation 6(5) and (6) together create a right for persons to avoid attendance fees where the survey is within the Perth metropolitan area or at Geraldton, where the survey is at a scheduled time and place notified by the Department, or where the survey is carried out in conjunction with a periodic survey of the vessel. The Department has an associated administrative obligation to notify scheduled times and places (r 6(1) definition of "scheduled time and place").

• Right to recover travel and accommodation costs. Regulation 6(6)(b) entitles the surveyor to recover reasonable travel and accommodation costs and expenses incurred in order to attend the vessel, in addition to the hourly attendance rate (r 6(6)(a)-(b)).

• Reliance on other regulations. The definition of "periodic survey" in r 6(1) ties an operative concept in these regulations to the W.A. Marine (Surveys and Certificates of Survey) Regulations 1983 regulation 6. That cross-reference creates duties and entitlements that move beyond the text here; the obligations for periodic survey timing and content are governed by the separate instrument.

Overall, the regulations impose duties primarily by importing the Code’s Section 7 obligations and by setting fees that grant surveyors recoverable entitlements. They create administrative rights for persons to mitigate fees by using scheduled times and places and by aligning work with periodic surveys. The regulations do not specify enforcement mechanisms or a payment-collection process in their own text.

The instrument as provided contains no express penalty provisions or detailed enforcement mechanisms. The regulations import Section 7 of the Uniform Shipping Laws Code and reference other provisions of the Marine Act and related regulations, but they do not themselves set offences, fines, or enforcement procedures.

• No penalty clauses in the text. A careful reading of regulation 1 through 6 reveals no sections that prescribe offences, penalties, or enforcement processes. The fee schedule in regulation 6 prescribes amounts and conditions for fee exemptions but does not provide for civil recovery, late-payment penalties, or enforcement processes within the regulation’s text.

• Enforcement likely located elsewhere. The regulations rely on the Marine Act 1982 and the incorporated Code for substantive obligations (r 4(1), r 3(1)). Those instruments are the natural place where offences, penalties and enforcement authority typically appear. Regulation 4(2)(a) ties the survey authority to an appointment under Section 31 of the Act, and regulation 3 refers to Section 115 of the Act in relation to the Code. The absence of penalties in these regulations means enforcement mechanisms would ordinarily be found in the parent Act or in the Code provisions incorporated. The regulations do not themselves identify which agency or official enforces fee payment or compliance with the incorporated Section 7.

• Practical enforcement levers implied by the scheme. Although not stated in the regulations, the fee schedule creates practical levers: completion of surveys and issuance of load line certificates are necessary administrative steps for vessels to operate under the Act’s framework. In practice, the power to issue or withhold certificates is the usual administrative enforcement mechanism in maritime regulatory regimes. The text here, however, does not set out any link between non-payment and withholding of certificates, nor does it give authority for debt recovery.

• Dispute resolution and challenge. The regulations do not provide a statutory internal review or appeal process for disputes over fees, the application of attendance exceptions, or the appointment of survey authorities. Any such mechanisms would need to be sought in the parent Act, the Code, or administrative law remedies outside the regulations.

In short, this instrument defines substantive obligations by reference to the Code and prescribes fees, but it is silent on penalties and enforcement. Readers must consult the Marine Act 1982 and the Uniform Shipping Laws Code for the statutory offence and enforcement architecture relevant to load lines, surveys and certificates.

The regulations are an integrating instrument that connects the Western Australian Marine Act 1982, the Uniform Shipping Laws Code as external model law, and a separate WA regulation about surveys and certificates. The text contains several explicit cross-references.

• Incorporation of the Code as a component of the regulatory framework. Regulation 3(1) defines “Code” as the Uniform Shipping Laws Code referred to in Section 115 of the Act, as in existence on 1 October 2009. Regulation 4(1) incorporates Section 7 of that Code into these regulations for all vessels and voyages to which the Act applies. The incorporated material therefore operates as subsidiary law within the WA statutory architecture, subject to the modifications specified at r 4(2). The incorporated Code provisions carry their own internal definitions as preserved by r 3(2).

• Interaction with the Marine Act appointment powers. The substitution in regulation 4(2)(a) makes the “survey authority” an authority appointed by the Governor under Section 31 of the Marine Act. This ties the identity of the competent survey authority under the incorporated Code provisions to the Act’s appointment power and centralises the appointing power in the Governor under Section 31 of the Act. The regulation therefore aligns the institutional role envisaged in the Code with specific statutory appointment powers under the Act.

• Cross-reference to the W.A. Marine (Surveys and Certificates of Survey) Regulations 1983. Regulation 6(1) defines “periodic survey” by reference to regulation 6 of the W.A. Marine (Surveys and Certificates of Survey) Regulations 1983. That cross-reference creates operational dependence: whether a survey qualifies as a periodic survey for fee-exemption and aggregation purposes under regulation 6 here depends on the provisions of that other regulation. This links the fee schedule to the procedural timing and content established elsewhere.

• Administrative interplay with Department notifications. The definition of "scheduled time and place" in r 6(1) gives the Department the administrative role of publicly notifying times and places at which people may have vessels surveyed without incurring attendance fees. That creates a procedural interaction between this fees regulation and departmental administrative practice.

• Deleted Code clauses and legal gaps. Regulation 4(2)(b)-(e) deletes specific clauses of Section 7 of the Code (clause 73.6 and several clauses in the 74 series). The deletions are explicit but the regulation does not replicate or replace the deleted text. The practical effect is that the incorporated Section 7 applies in WA minus those specific clauses, which may create divergence between the WA regime and other jurisdictions that adopt the Code without those deletions. Readers must consult the original Code to identify the deleted material, but the regulations themselves show that Western Australia has chosen not to adopt those clauses.

• Reference to the Act’s Section 115. Regulation 3(1) ties the definition of the Code to the Code as referred to in Section 115 of the Act. This shows the Code’s incorporation depends on the Act’s referencing mechanism. The regulations therefore function as subordinate instruments implementing the Act’s cross-referential incorporation of model law.

• Amendment and temporal interaction. The compilation notes record a sequence of amendment instruments and reprints. The Code incorporated is frozen as it existed on a specified date (1 October 2009), which insulates the incorporated text from later amendments to the Uniform Shipping Laws Code unless reflected by subsequent regulatory amendment. The fee figures inserted and amended by Gazette notices are time-stamped in the marginal notes, creating a temporal link between fee rates and amendment history.

In summary, these regulations operate as an interface: they import and modify a portion of the Uniform Shipping Laws Code, connect to the Marine Act’s appointment powers, refer to separate WA survey regulations for procedural definitions, and depend on departmental notification for certain fee exemptions. The instrument is therefore not standalone; its operation depends on the Act, the incorporated Code, and other WA regulations and administrative practices.

The compilation and marginal notes in the text provide an explicit amendment trail for the regulations. Key changes and insertion dates are recorded in the marginal annotations adjacent to the relevant regulations and in the compilation table.

• Early instrument and reprint. The W.A. Marine (Load Lines) Regulations 1983 were originally gazetted to commence 1 July 1983 (r 1-2; compilation table). A reprint of the regulations as at 18 May 2001 is recorded in the compilation table.

• Amendments in the 1990s. The compilation table lists a series of amendment instruments in the 1990s: Amendment Regulations 1990 (gazetted 1 Aug 1990), Amendment Regulations 1991 (26 Jul 1991), Amendment Regulations (No. 2) 1992 Pt. 5 (30 Jun 1992), Amendment Regulations 1992 Pt. 9 (11 Aug 1992), Amendment Regulations 1993 Pt. 5 (29 Jun 1993), and Amendment Regulations 1994 Pt. 5 (14 Jun 1994). The reprint as at 18 May 2001 includes the amendments to that date.

• Amendments and insertions from 2008 to 2013. The marginal notes record key more recent changes:

  • Regulation 3 (terms used) was inserted by Gazette 11 Dec 2009 p. 5099, as indicated by the note after regulation 3, and this appears to reflect an update linking the Code definition to a specific date (1 October 2009).
  • Regulation 5 was deleted by Gazette 11 Dec 2009 p. 5099, as noted after the text "5. Deleted".
  • Regulation 6 (fees for surveys and inspections) was inserted by Gazette 20 May 2011 p. 1851-2, with subsequent amendments recorded as Gazette 21 Jun 2011 p. 2232; 15 Jun 2012 p. 2531; and 28 Jun 2013 p. 2773. The marginal annotation immediately after regulation 6 records those Gazette entries.

• Reprints documenting incorporated amendments. The compilation table records a second reprint as at 17 Feb 2012 that includes earlier amendments up to that date. Specific amendment instruments listed include Load Lines Amendment Regulations 2008 (24 Oct 2008), Marine Amendment Regulations 2009 Pt. 8 (11 Dec 2009), Load Lines Amendment Regulations 2010 (4 Jun 2010), and the Load Lines Amendment Regulations 2011 (20 May 2011) and a subsequent instrument in June 2011.

• Content of the amendments. The regulations show which provisions were added or deleted: r 3 was added in 2009, r 5 was deleted in 2009, and r 6 was inserted and amended between 2011 and 2013. The notes indicate the exact Gazette references for those changes. The compilation table lists the full set of amendment instruments going back to the 1980s and 1990s, but the marginal notes adjacent to each provision identify the specific insertions and deletions pertinent to the current text.

• Temporal locking of the Code. Regulation 3(1) states the Code is the Uniform Shipping Laws Code "as in existence on 1 October 2009." This demonstrates a legislative choice to incorporate a fixed historical version of the Code rather than a rolling or automatically updated version. That choice is itself part of the amendments that inserted regulation 3.

For practitioners wanting to trace textual changes, the Gazette citations in the marginal notes and compilation table provide the starting point for retrieving the amending instruments and verifying the historical text. The regulations present a clear documentary trail for the substantive insertions and deletions they record.

The instrument as provided contains no case law, citations to judicial decisions, or references to litigation arising under these specific regulations. The text does not mention any court decisions, appeals, or judicial interpretations of the provisions it contains. The compilation and marginal notes list statutory amendment instruments and reprints but do not include any litigation-related information.

Consequently, there is no litigation history recorded in these regulations. Any legal challenges, disputes about fee recoveries, or contestation of the incorporation and modification of Section 7 of the Code would be dealt with in jurisdictional case law and are not reflected in this text. Readers seeking reported decisions that interpret these regulations, the incorporated Section 7 of the Code as applied in Western Australia, or the operation of the fee regime must search external case law databases and administrative law records; such searches are outside the content of this instrument as printed.

In the absence of recorded litigation within the regulations, users should assume that enforcement, disputes, and judicial interpretation will be governed by the broader statutory and administrative framework, the Marine Act, the Uniform Shipping Laws Code as incorporated, and general administrative law principles, none of which are detailed in this text. The regulations themselves provide no pointers to any tribunal, remedy or precedent.

Several practical and legal pitfalls are apparent from the text when read closely; these are matters of legal design, administrative operation and practical compliance rather than conclusions about policy.

• Fee amounts are fixed dollar figures. Regulation 6 contains specific monetary amounts (for example, $104.80 per metre for the initial survey, r 6(2); $151.70 for certain reissue surveys, r 6(3); $198.90 per hour travel/waiting for attendance, r 6(6)(a)). Those amounts are not expressed as index-linked and are recorded with the marginal note of insertion/amendment dates. The regulation does not provide an automatic mechanism for uprating these figures for inflation. Over time the real cost of services and the surveyor’s opportunity costs may diverge from the prescribed figures unless the regulations are amended.

• Liability to pay not expressly stated. The regulations prescribe fees and attendance charges but do not contain an express provision in the text that states who is legally liable to pay the fees. Regulation 6 specifies the amounts "for the initial survey" or "the fee for a survey" but does not specify the statutory debtor. Practitioners should note that the absence of explicit payor language could create uncertainty in collection and dispute scenarios. The statutory liability to pay may be set out in the Act, the incorporated Code, or in departmental practice, but those sources are not reproduced here.

• Dependency on external definitions. The fee for the initial survey is quantified "for each metre of the load line length" (r 6(2)). The meaning and measurement method for "load line length" are not set out in these regulations; regulation 3(2) indicates that in the incorporated provisions terms have the same meaning as in the Code. Consequently, the precise metric for fee calculation depends on the Code’s definitions as in force on 1 October 2009. Practitioners must consult the incorporated Code text to determine how to measure load line length for fee calculation.

• Attendance fee exceptions are limited and location-specific. Regulation 6(5) exempts attendance fees when the survey occurs within the Perth metropolitan area or at Geraldton, at scheduled times and places notified by the Department, or where the survey is carried out in conjunction with a periodic survey. The consequence is that surveys in other regional locations will carry attendance fees and travel/accommodation costs, potentially making surveys more expensive for remote operators. The definition of "scheduled time and place" depends on Departmental notification, which creates an administrative discretion with practical cost implications.

• Deletions of Code clauses without replacement. Regulation 4(2)(b)-(e) deletes specific clauses from the incorporated Section 7 (clause 73.6 and several 74-series clauses). The text does not replicate those clauses or explain the operational effect of their deletion. Without comparing the Code’s original text to the modified incorporation, one cannot be certain what legal rules were removed. That omission creates potential interpretive risk when trying to apply Section 7 as incorporated: practitioners must identify the deleted text in the Code and consider the consequences of its absence.

• Temporal locking of the Code. The Code is incorporated as it was on 1 October 2009 (r 3(1)). Subsequent amendments to the Uniform Shipping Laws Code after that date are not automatically incorporated. This creates the possibility of divergence between the WA regime and other jurisdictions that adopt later Code versions. Users must take care to consult the correct historical version of the Code.

• No enforcement mechanics for fee non-payment in the regulation. The instrument prescribes fees and entitlements for recovery of travel and accommodation costs but provides no express enforcement mechanism or procedural guidance on payment, invoicing, or consequences of non-payment. That silence shifts the burden to the parent Act, the Code, departmental practice, or the civil process.

• Departmental discretion in scheduling. The ability to avoid attendance fees by using "scheduled time and place" is conditioned on the Department’s public notification. The regulations do not constrain how frequently the Department must publish schedules or the geographic distribution of such scheduled events. This administrative discretion can materially affect cost burdens for owners.

These are concrete operational and interpretive issues that follow from the text. They do not require any external factual assertions, but they are potential points of friction for owners, surveyors and administrators relying on the regulations.

Compliance under these regulations is primarily procedural and financial: it requires applying the incorporated Section 7 of the Uniform Shipping Laws Code as modified here, and meeting the fee schedule and conditions set out in regulation 6. The following steps are strictly grounded in the text supplied.

1. Identify whether the vessel or voyage falls under the Marine Act’s coverage. Regulation 4(1) applies the incorporated Section 7 to "all vessels and voyages to which the Act applies." To know whether a vessel is covered, consult the Marine Act 1982. The regulations themselves do not redefine the Act’s scope.

2. Read and apply Section 7 of the Uniform Shipping Laws Code as it stood on 1 October 2009, subject to the modifications listed. Regulation 3(1) fixes the version of the Code. Regulation 4(1) incorporates Section 7; regulation 4(2) sets specific changes. Practically this means:

   • Use the Code’s substantive obligations in Section 7 for load line matters, but
   • Substitute the definition of "survey authority" with the Governor-appointed authority under Section 31 of the Act (r 4(2)(a)).
   • Do not rely on deleted Code clauses (clause 73.6; clauses 74.1, 74.2, 74.4, 74.5, 74.7 and 74.8) as they have been omitted from the WA-incorporated text (r 4(2)(b)-(e)).

3. Determine whether the survey is a "periodic survey" for aggregation and fee-exemption purposes. Regulation 6(1) defines "periodic survey" by reference to the W.A. Marine (Surveys and Certificates of Survey) Regulations 1983 regulation 6. Consult that regulation to confirm whether a proposed survey qualifies as a periodic survey. If it does, different fee treatment may apply under r 6(3) and r 6(5)(c).

4. Budget for and pay the correct fee as prescribed in regulation 6. The fee schedule is explicit:

   • Initial survey for issue of load line certificate: $104.80 for each metre of the load line length (r 6(2)). Ensure the load line length is measured according to the Code’s definitions and methods (r 3(2)).
   • Reissue survey: $151.70 if carried out with a periodic survey; otherwise $151.70 plus time-based fees (r 6(3)(a)-(b)).
   • Where time-based fees apply for reissue or periodical inspection, apply $103.90 per half hour (or part) during which the surveyor is engaged, or $300.00 per hour (or part) during overtime, weekend or public holiday engagement as specified (r 6(3)(b)(i)-(ii); r 6(4)).
   • Attendance fees apply unless an exception triggers (r 6(5)). When applicable, attendance fees are $198.90 per hour (or part) of travelling time or waiting time plus reasonable travel and accommodation costs (r 6(6)(a)-(b)).

5. Use scheduled times and places to avoid attendance fees where feasible. Regulation 6(1) defines "scheduled time and place" as a time and place notified to the public by the Department. If the Department has published such notifications and the survey is booked for that scheduled time and place, attendance fees are not payable under r 6(5)(b). Engaging with Departmental schedules may therefore reduce costs.

6. Where possible coordinate load line reissue work with periodic surveys. Regulation 6(3)(a) provides a lower fee for reissue surveys carried out in conjunction with a periodic survey. Planning to co-ordinate surveys may materially reduce total fees.

7. Be aware of geographic exceptions. Attendance fees are not payable for surveys carried out within the Perth metropolitan area or at Geraldton (r 6(5)(a)). If the vessel can be located for survey within those areas, attendance charges will not apply.

8. Anticipate recovery of travel and accommodation costs. When attendance fees apply, expect to pay reasonable travel and accommodation costs of the surveyor in addition to the hourly attendance rate (r 6(6)(b)). Ensure arrangements and invoices are examined against the reasonableness criterion in r 6(6)(b).

9. Confirm the identity of the survey authority. Regulation 4(2)(a) ties the survey authority to an authority appointed by the Governor under Section 31 of the Act. Before engaging a surveyor, verify that the surveyor is acting under the authority of the Governor-appointed survey authority, as required by the incorporated Code.

10. Keep records and receipts. The regulations provide fee amounts and exemptions but no payment enforcement or dispute process. Practically, maintain written evidence of the time and place scheduled, any Departmental notices, the basis for fee calculations (especially metres of load line length and time spent by the surveyor), and invoices for travel and accommodation to support requests or disputes.

11. Monitor amendment history. The marginal notes show that regulation 6 and regulation 3 were inserted and amended in specific Gazette notices between 2009 and 2013. Because the fee figures and the incorporated Code version are legislative choices, check for more recent amendments or departmental practice notes that may have altered fees, schedules or administrative procedures since the last noted amendments.

These steps are drawn from the text of the regulations. Where the regulations link to the Act or to other instruments (the Code, Section 31, the W.A. Marine (Surveys and Certificates of Survey) Regulations 1983), compliance requires consulting those instruments as well to obtain definitions, substantive obligations, and appointment mechanisms referenced but not reproduced here.
