What it does
These regulations incorporate specified parts of the Uniform Shipping Laws Code into Western Australian law for life‑saving appliances, fire appliances and miscellaneous equipment on vessels to which the Western Australian Marine Act 1982 applies. Regulation 3 defines the Code as the Uniform Shipping Laws Code as in existence on 1 October 2009 and provides that terms in provisions of the Code incorporated by the regulations have the same meaning as in the Code (r 3(1)-(2)). Regulation 4 incorporates Sections 10 and 11 of the Code and makes them applicable to all vessels and voyages to which the Act applies (r 4(1)). Regulation 5 incorporates Section 13 of the Code but does so in a two‑track way: it treats vessels that are “List 7 vessels” differently from vessels that are not List 7 vessels (r 5(2)-(4)). For non‑List 7 vessels, Section 13 is incorporated subject to the deletions listed in r 5(3)(a)-(c). For List 7 vessels Section 13 is incorporated subject to the exclusions specified in r 5(5)(a)-(b). Regulation 6 adopts the Code’s approach to classification of vessels by reference to clause 6 of Section 1 of the Code (r 6). The regulations commenced on 1 July 1983 and have been amended at various dates, with the current incorporated version of the Code fixed at 1 October 2009 (r 2; r 3(1)). The instrument itself does not set out technical standards or equipment lists; rather it imports particular Code sections into the WA regulatory framework and prescribes limited local modifications to how Section 13 operates for different vessel types (see r 4 and r 5).
Mechanically, the regulations operate by identifying the Code as a source of substantive obligations and by specifying modifications to that source for Western Australia. The regulations also classify vessels by adopting the Code’s classification clause (r 6). The net effect is that duties, rights and technical requirements relevant to life‑saving appliances, fire appliances and certain miscellaneous equipment in the incorporated Sections of the Code apply within WA, except where those Sections have been modified or certain cross‑references to the National Standard for Commercial Vessels are excluded for List 7 vessels (r 5(5)). The instrument fixes the point in time for the version of the Code that applies (1 October 2009) rather than dynamically adopting subsequent changes to the Code (r 3(1)). Any obligations, compliance burden, or standards that come from the incorporated Code Sections therefore derive from the Code as it stood on that date, subject to the deletions and exclusions set out in these regulations.
