Volunteers Protection Act 2001

The Act establishes a compact of statutory definitions plus a rule-shift of civil liability. Its key statutory concepts are defined in s 3 and determine who receives immunity, what work is protected, and the conditions under which protection is available.

• Community organisation (s 3): defined as a body corporate that directs or co-ordinates the carrying out of community work by volunteers, and expressly includes the Crown. The definition therefore focuses protection on volunteers working for incorporated entities (or the Crown). The Act does not define unincorporated bodies as community organisations in the text supplied; consequentially, volunteers working for unincorporated associations may fall outside the statutory scheme unless regulations classify such work as "community work" or otherwise intervene (s 3 and s 6).

• Community work (s 3): defined by reference to purposes. Subsection (a) lists multiple purposes (religious, educational, charitable, arts, care of people with disabilities, sport and recreation, conservation and environment, heritage, political purposes, and protecting/promoting common interests of the community or a subsection thereof). Subsection (b) permits regulations to classify further forms of work as community work, while the definition also permits regulations to exclude work by express regulation. The Act thus creates a statutory purpose-based boundary for protected activity, with delegated rule-making power to refine or exclude activities.

• Volunteer and voluntary basis (s 3): a volunteer is a person who carries out community work on a voluntary basis. Voluntary basis is defined to include persons who receive no remuneration and persons who are remunerated but within regulatory limits. The Act excludes persons performing community work under a court order or as a condition of a bond from being volunteers.

• Recreational drug (s 3): defined to mean a drug consumed voluntarily for non-medicinal purposes, and the definition expressly includes alcohol. This term is used as the trigger for one of the immunity exceptions in s 4.

• Immunity standard (s 4): immunity applies only to acts or omissions done or made in good faith and without recklessness in the course of carrying out community work for a community organisation. The statutory standard therefore hinges on mental elements, good faith and absence of recklessness, rather than a simple negligence threshold.

• Liability transfer and procedural bar (s 5): s 5(1) transfers the liability that would have attached to the volunteer to the community organisation. Section 5(2) sets a procedural rule restricting personal suits against volunteers, allowing them only where it is clear immunity does not apply or where the injured person first sues the organisation and the organisation disputess liability in its defence.

• Regulation-making power (s 6): the Governor may make regulations for the purposes of the Act. That power is important because the Act permits regulations to specify work that counts as community work, to exclude work, and to set remuneration limits for the definition of "voluntary basis" (s 3(b); s 3 voluntary basis; s 6). The Act does not contain the regulations themselves in the text provided.

Together these concepts implement a legal structure in which volunteers acting in good faith within authorised scope are insulated from personal civil liability, with the community organisation bearing the legal risk instead. The text combines bright-line elements (e.g. inclusion of the Crown, remuneration treatment) with fact-intensive standards (good faith, recklessness, "clear from the circumstances", "ought to have known", and "significantly impaired") that will require judicial assessment in particular cases.

The Act affects three principal groups directly and a number of ancillary actors indirectly. The statutory text and definitions identify who is protected, who bears shifted liability, and who faces procedural constraints when seeking redress.

• Volunteers: defined in s 3 as persons who carry out community work on a voluntary basis. Volunteers who act in good faith and without recklessness while carrying out community work for a community organisation incur no personal civil liability for acts or omissions in that course, subject to exceptions enumerated in s 4. The immunity therefore materially changes the legal exposure of volunteers for negligence-type claims in the contexts captured by the definitions.

• Community organisations: defined in s 3 as a body corporate that directs or co-ordinates community work by volunteers, and includes the Crown. Section 5(1) transfers liabilities that would have attached to volunteers to the community organisation. The statutory mechanics therefore assign primary liability to the organisation, making it the first target for civil actions by injured persons under the Act’s procedural scheme. The inclusion of the Crown expressly exposes government entities to transferred liabilities when they fall within the definition.

• Injured persons (claimants): persons who suffer injury, loss or damage as a result of a volunteer’s act or omission are directly affected. Section 5(2) limits their ability to sue volunteers personally: they may not sue a volunteer unless it is clear the immunity does not apply (s 5(2)(a)), or they first bring action against the community organisation and the organisation then contests liability in its defence (s 5(2)(b)). The effect is to channel initial claims to the community organisation and to make suing volunteers personally an exception rather than the default.

Indirectly affected parties include insurers and legal service providers. Because liability is shifted to community organisations, those organisations will face the direct economic consequences of that liability. Although the Act does not mention insurance, the transfer of liability implies an increased risk profile for organisations that use volunteers, and insurers underwriting community organisations will face potential exposure. The inclusion of the Crown also implicates public liability budgets where government entities act as community organisations.

Other affected groups include unincorporated entities or volunteer arrangements that may not meet the "community organisation" definition. The Act’s definition of community organisation as a body corporate suggests that volunteers engaged by unincorporated clubs or informal groups could fall outside the statutory protection unless regulations bring those activities within the Act’s scope (s 3; s 6). The Act excludes volunteers performing community work under court order or as a bond condition from the definition of volunteer, so persons directed to perform work by judicial order are outside the protection.

Finally, the Act affects particular liability domains expressly: liabilities within the ambit of compulsory third-party motor vehicle insurance schemes and defamation liabilities remain outside the immunity (s 4, exceptions 1(a) and 1(b)). Volunteers and organisations involved in motor vehicle activity or communications that could give rise to defamation must therefore be aware that the statutory safe harbour does not apply in those areas.

The Act does not create affirmative duties in the sense of proactive statutory obligations like reporting or training. Instead, it creates rights and burdens by allocating civil liability and setting thresholds for immunity. The operative rules generate duties and practical obligations for both volunteers and community organisations through legal exposure and procedural mechanics.

Rights created by the Act

• Volunteer immunity right (s 4): Volunteers have the right not to be personally sued in civil actions for acts or omissions done or made in good faith and without recklessness in the course of community work for a community organisation, subject to the Act’s exceptions. This is a defensive legal right against civil liability.

• Organisation liability allocation (s 5(1)): Injured persons have the right to pursue the community organisation for liabilities that would otherwise attach to volunteers, because those liabilities are made to attach to the organisation by statute. The right to sue the organisation is a correlative right arising from the transfer provision.

Procedural constraints and obligations

• Procedural route to volunteers (s 5(2)): The Act restricts a claimant’s right to sue a volunteer personally. A claimant must either establish that the immunity clearly does not apply (s 5(2)(a)) or sue the organisation first and open the door to a personal action only if the organisation asserts in its defence that it is not liable (s 5(2)(b)). This creates a practical duty for claimants to target the community organisation initially, and to engage with the organisation’s pleaded defences if they later seek to include the volunteer.

Standards volunteers must meet to retain immunity

• Good faith and absence of recklessness (s 4): Volunteers must act in good faith and without recklessness. While the Act does not further define these terms, the language sets a mental element standard for immunity: negligent but non-reckless conduct done in good faith remains covered.

Situations that terminate the immunity

• Recreational drug impairment (s 4(2)): Immunity does not operate where the volunteer’s ability to carry out the work properly was, at the relevant time, significantly impaired by a recreational drug; "recreational drug" expressly includes alcohol (s 3).

• Acting outside authorised scope or contrary to instructions (s 4(3)): Immunity is lost where the volunteer was acting, and knew or ought to have known, that they were acting outside the scope of activities authorised by the community organisation, or contrary to instructions given by the organisation (s 4(3)(a)-(b)). These are fact-based controls: knowledge and constructive knowledge ("ought to have known") are elements in the exception.

Exceptions preserved (no immunity)

• Compulsory third-party motor vehicle insurance schemes and defamation liabilities: s 4’s exception list preserves the operation of statutorily mandated motor vehicle insurance schemes and common law defamation claims by excluding them from the immunity.

Regulatory delegation that affects duties and rights

• Remuneration limits and classification/exclusion of community work (s 3 and s 6): The definition of "voluntary basis" includes persons remunerated within limits fixed by regulation, and s 3(b) allows regulations to classify or exclude particular work as community work. These delegated powers will determine which activities and levels of payments retain the volunteer status that attracts immunity. Until regulations are consulted and applied, these aspects create uncertainty about who qualifies as a volunteer and what work is protected.

The practical effect is that the Act bestows defensive legal rights on volunteers meeting the mental element and scope conditions and creates a duty for organisations to bear and respond to civil claims that would otherwise hit volunteers. Claimants face procedural obligations to sue organisations first in most cases. The Act implicitly alters risk allocation, creating incentives to organisational risk management, and constrains claimants’ immediate access to volunteers as defendants.

The Volunteers Protection Act 2001 is chiefly a civil-law allocation statute and does not create criminal penalties or administrative sanctions within the text provided. Enforcement occurs through civil litigation rather than by regulatory enforcement or criminal sanction. The Act’s enforcement mechanisms and limits are therefore procedural and liability-focused rather than penal.

Key enforcement features in the text

• Civil liability shift and litigation pathway (s 4 & s 5): The principal enforcement mechanism is the statutory shifting of civil liability from volunteers to community organisations (s 5(1)). An injured person enforces rights by bringing a civil action against the community organisation for the injury, loss or damage caused by a volunteer’s act or omission. The procedural constraint in s 5(2) governs access to a volunteer as a defendant: claimants cannot proceed directly against a volunteer unless the immunity clearly does not apply or the organisation disputes liability in its defence (s 5(2)(a)-(b)).

• Exceptions where immunity does not apply (s 4): Immunity does not operate in a set of enumerated circumstances: liabilities within compulsory third-party motor vehicle insurance schemes; defamation; significant impairment by a recreational drug at the relevant time; acting outside authorised scope or contrary to instructions where the volunteer knew or ought to have known (s 4 and s 3 definition of recreational drug). In those cases, volunteer exposure to personal civil liability remains open, and claimants may enforce civil remedies directly against volunteers where the statutory pre-conditions for immunity failure are met.

Absence of administrative or criminal penalties

• No statutory fines or criminal offences created: The Act contains no sections creating offences, monetary penalties, or administrative sanctions for volunteers or organisations for breach of the Act itself. The Act’s scope is limited to civil liability allocation. Any enforcement consequences therefore arise from underlying civil causes of action (negligence, defamation, motor vehicle liability), not from contravening the Volunteers Protection Act.

Regulatory enforcement power

• Regulation-making (s 6): The Governor may make regulations for the purposes of the Act. The Act does not specify enforcement mechanisms for regulations made under s 6 within the supplied text. Consequently, the existence and content of regulatory compliance obligations, and any enforcement attached to them, depend upon subordinate instruments made under the Act and are not visible in the Act’s main text as supplied.

Practical enforcement consequences and litigation posture

• Litigation focus on organisations: The statutory structure concentrates enforcement activity on community organisations as defendants in civil litigation. Organisations will therefore be the parties principally responsible for defending claims, settling, and satisfying judgments that arise from volunteer conduct where immunity would otherwise have applied.

• Evidentiary issues: The Act creates fact-based exceptions, good faith, recklessness, significant impairment, knowledge/constructive knowledge of acting outside scope. These issues are matters for judicial determination in litigation. The Act does not specify burden of proof allocations for these issues; therefore courts will determine those evidentiary questions in proceedings under applicable civil procedure rules.

In short, the Act does not create an enforcement regime of penalties; it re-allocates civil liability and shapes litigation pathways. Enforcement is therefore indirect: through civil suits, defensive immunities, and the organisational obligation to answer claims transferred to it by statute.

The Act is designed to operate within the broader civil liability and insurance framework rather than as a freestanding code. The statutory text explicitly preserves the operation of certain existing legal regimes and creates delegated rule-making that can alter the Act’s interface with other laws.

Express cross-reference to compulsory third-party motor vehicle insurance and defamation

• Compulsory third-party motor vehicle insurance (s 4, exception 1(a)): The Act explicitly states that the immunity does not extend to a liability that falls within the ambit of a scheme of compulsory third-party motor vehicle insurance. That means the Act does not displace statutory or scheme-based motor vehicle liability frameworks. Where a volunteer’s liability is governed by such a statutory CTP scheme, the volunteer will not obtain immunity under s 4 and relevant motor vehicle insurance or statutory compensation mechanisms continue to apply.

• Defamation (s 4, exception 1(b)): The Act does not immunise volunteers from defamation liability. Defamation law remains separately applicable, and the Act preserves claimants’ rights in that domain. Volunteers and organisations must therefore remain conscious of separate duties, defences, and procedural rules that govern defamatory communications.

Interaction with civil negligence law

• Standard-setting via good faith and recklessness (s 4): The Act creates an immunity standard that sits alongside and modifies ordinary civil liability for negligence. Volunteers acting in good faith and without recklessness are immune from personal civil liability for acts or omissions in the course of community work. This statutory immunity does not abolish negligence causes of action; rather it bars personal liability in many cases, while making the organisation liable under s 5(1). Therefore civil negligence law remains relevant to determining causal facts and compensatory damages, but the defendant in typical cases will be the community organisation rather than the volunteer.

Interaction with common law doctrines

• Respondeat superior adapted by statute (s 5): The Act applies the doctrine of vicarious liability by transferring to the community organisation the liability that would have attached to the volunteer, effectively a statutory application or substitution of the doctrine. This is a statutory mechanism rather than an invocation of the common law doctrine in its ordinary form. The Act's application may coexist with common law principles of vicarious liability where appropriate, but the statutory text controls allocation in the contexts covered by the Act.

Delegated regulation-making and inter-legislative coordination

• Regulations can change the Act’s practical boundaries (s 3(b) and s 6): The Act allows regulations to classify certain work as community work, to exclude work from that definition, and to set remuneration limits relevant to the "voluntary basis" concept. Those regulations will interact with other statutory schemes (for example, employment law and taxation characterisations) by determining which persons are volunteers for the purposes of this Act. The text therefore envisages subordinate instruments that could harmonise or diverge from other legal regimes.

Implications for unincorporated entities

• Community organisation defined as body corporate and including the Crown (s 3): The Act’s protections explicitly target volunteers working for bodies corporate and the Crown. The statutory focus may leave volunteers working for unincorporated associations without the Act’s statutory immunity unless regulations extend coverage by classifying that activity as community work or otherwise providing a regulatory mechanism. That statutory wording creates a boundary between incorporated and unincorporated organisational forms for the purpose of this Act.

Limitations of statutory reach

• No displacement of other civil or statutory remedies beyond the specified exceptions: The Act does not purport to extinguish other rights to recovery against community organisations or other third parties, nor does it alter statutory rights and obligations outside the exceptions. Claimants retain recourse under creature-of-statute schemes (such as CTP) and under common law defamation rules, and organisations may face claims under other statutory or contractual regimes not addressed by this Act.

Overall, the Act positions itself as a statutory allocation mechanism within the existing civil and insurance architecture: it preserves specific statutory schemes (CTP) and entire subject areas (defamation), modifies the locus of civil suits for negligence by imposing liability on organisations, and leaves open the role of regulations to refine the Act’s intersections with employment, taxation, and other statutory regimes.

The legislative history supplied in the Act’s text is minimal. The Act was enacted as the Volunteers Protection Act 2001 (No 65), received assent on 6 December 2001, and commenced operation on 15 January 2002 (Gazette 15.1.2002 p188). The legislative history notes one textual alteration effected under a revision and publication regime: section 2 was omitted under the Legislation Revision and Publication Act 2002. The Act’s contents list references a Preamble and then the operative sections: short title (s 1), interpretation (s 3), protection from liability (s 4), application of doctrine of respondeat superior to volunteers (s 5), and regulations (s 6). The legislative history entry indicates no other amendments, insertions, or repeals recorded in the supplied text.

Because the Act delegates power to make regulations (s 6) and contemplates regulations that impact key definitions and thresholds (s 3(b) and the definition of "voluntary basis"), a substantial portion of the Act's practical operation can be changed or clarified at the regulatory level without an amendment to the principal Act. The legislative history as supplied does not list any such subordinate instruments or their content. The only explicit change to the Act’s text noted in the legislative history is the omission of s 2 under the Legislation Revision and Publication Act 2002; no dates or substantive content changes beyond that deletion are shown.

Users seeking to understand the Act’s contemporary effect should therefore check the relevant regulations made under s 6 and any subsequent amending Acts not recorded in the supplied legislative history. The principal Act text and the single noted revision entry constitute the full amendment record available in the supplied material.

The supplied text contains no judicial decisions, cases, or litigation summaries under the "Litigation history" heading. The Act’s text does not name any cases or identify court interpretations. Therefore, based on the instrument supplied, no litigation history is recorded or summarised in this material.

Practitioners should note that the Act raises several fact-sensitive issues that would typically generate case law, such as the meaning and proof of "good faith", the threshold for "recklessness", what constitutes being "significantly impaired" by a recreational drug (including alcohol), the boundaries of acting "outside the scope of the activities authorised" by an organisation, and how the procedural bar in s 5(2) operates in practice. Absent recorded cases in the supplied text, those interpretive questions remain matters for adjudication; researching reported decisions subsequent to commencement would be necessary to identify authoritative judicial interpretations. The Act itself provides no guidance on burden of proof allocations for the exceptions nor on evidentiary standards beyond the terms used.

Because the Act channels initial claims to community organisations and authorises regulations to define key terms and limits, litigation could also arise over the application of subordinate regulations, the definition and limits of "voluntary basis", and the status of unincorporated entities relative to the "community organisation" definition. Again, no such litigation is recorded in the supplied material.

In short, the supplied source contains no litigation history. To determine settled judicial approaches to the Act’s standards and procedural rules, practitioners must consult subsequent case law databases and court reports beyond the statutory text provided here.

The Act contains a number of textual features that produce traps and unintended consequences for volunteers, organisations, and claimants if not carefully considered. These are concrete, statutory "gotchas" grounded in the definitions and operative rules.

1. Community organisation requires a body corporate and includes the Crown (s 3). Volunteers working for unincorporated clubs or informal groups may not be covered by the Act because the statutory definition confines "community organisation" to bodies corporate. If volunteers assume the Act protects them while their host is unincorporated, that assumption may be wrong. Unless regulations classify such work as "community work" or extend coverage by regulation (s 3(b) and s 6), the statutory immunity and the liability shift in s 5(1) will not apply to volunteers serving unincorporated entities.

2. Volunteers can be remunerated and still be volunteers (s 3). The Act’s definition of "voluntary basis" includes persons who are remunerated but within limits fixed by regulation. That means payment per se does not negate volunteer status; the statutory line is set by regulation. The absence of the particular regulatory limits in the supplied text means uncertainty until those regulations are consulted. Organisations that pay volunteers must check any regulatory ceilings to confirm whether payment will disqualify volunteer status.

3. Court-ordered community work excluded (s 3): Persons performing community work under a court order or as a bond condition are not "working on a voluntary basis" for the Act’s purposes. That extinguishes the immunity for court-ordered community service and may catch defendants and probation services off guard if they mistakenly assume volunteers in that category have statutory protection.

4. Immunity is mental-state qualified (s 4). The immunity applies only where acts or omissions are "done or made in good faith and without recklessness." This is not a blanket immunity against negligence; it protects non-reckless, good-faith errors. Volunteers and organisations should be aware that allegations of recklessness or bad faith will remove the shield.

5. Alcohol and recreational drugs are explicit triggers (s 3; s 4(2)). The definition of "recreational drug" expressly includes alcohol; immunity does not operate where the volunteer's ability was significantly impaired by such a substance at the relevant time. That is a narrow, consequential statutory exception that will be litigated on the facts of impairment, timing, and causation.

6. Acting outside authorised scope or contrary to instructions removes immunity (s 4(3)). The volunteer loses protection if acting outside the scope of permitted activities or contrary to instructions where the volunteer knew or ought to have known that fact. Organisations should maintain clear role descriptions and instructions; volunteers should stay within them. The "ought to have known" language raises constructive knowledge risks for volunteers.

7. Motor vehicle and defamation exceptions (s 4(1)(a)-(b)). The Act does not immunise volunteers against liabilities falling within compulsory third-party motor vehicle insurance schemes or against defamation claims. Volunteers involved in driving tasks or communications that could be defamatory remain exposed and cannot rely on the statutory shield in those domains.

8. Procedural hurdle for claimants (s 5(2)(b)). An injured person generally must sue the community organisation first; only if the organisation, in its defence, disputes liability may the volunteer be joined personally. That procedural channeling can create timing, forum and strategy complications for claimants, and may delay or increase costs for claimants seeking to include volunteers as defendants.

9. Delegated regulation uncertainty (s 3(b) and s 6). Because the Act contemplates that regulations will classify or exclude types of work and set remuneration limits, the Act’s practical boundaries depend on subordinate instruments not included in the supplied text. Users relying solely on the principal Act risk mis-applying the statute without consulting any relevant regulations.

10. No criminal or penalty regime for contraventions of the Act (entire Act). The Act reallocates civil liability but does not create penalty regimes or administrative enforcement mechanisms in the supplied text. Parties cannot rely on criminal enforcement or administrative sanctions under this Act to address misconduct; remedies operate via civil actions based on other heads of liability.

These points are statutory facts. Their practical significance is that actors assuming blanket volunteer immunity or assuming volunteers are always shielded will be wrong in specific, enumerated circumstances. The Act’s interaction with regulations and other statutory schemes requires careful cross-referencing before concluding a person or organisation is within the Act’s protective envelope.

The Act structures risk allocation by insulating volunteers subject to conditions and by making community organisations liable for volunteer-caused harms in most cases. Compliance therefore has two axes: (1) how volunteers should conduct themselves to retain immunity; and (2) what community organisations should do to manage the liabilities that the Act places on them. The Act places no positive statutory duties such as mandatory training, registration, or insurance purchase in the text provided, but practical compliance requires organisations and volunteers to adopt specific measures to operate within the statutory framework.

Practical steps for volunteers

• Act in good faith and without recklessness (s 4): Volunteers should document role instructions and follow them. Good faith conduct and avoiding reckless behaviour are statutory preconditions for personal immunity. Volunteers should err on the side of seeking supervisory direction where uncertain.

• Stay within authorised activities and instructions (s 4(3)): Volunteers should have clarity about authorised activities; if unsure whether an activity is authorised, seek recorded authorisation. Avoid acting in ways that might be characterised as outside the organisation’s scope or contrary to instructions, because such conduct negates immunity where knowledge or constructive knowledge is established.

• Avoid substantial impairment by recreational drugs, including alcohol (s 3; s 4(2)): Volunteers should not perform community work while significantly impaired by recreational drugs. Organisations should adopt and communicate impairment policies. Volunteers who perform while significantly impaired lose the immunity.

• Be aware of excluded domains (s 4(1)): Volunteers should not assume immunity for motor vehicle liabilities that fall within compulsory CTP schemes or for defamatory statements. Separate compliance and risk controls are needed for driving tasks and communications.

Practical steps for community organisations

• Understand that statutory liability attaches to the organisation (s 5(1)): Organisations should recognise that liabilities that would have attached to volunteers are made to attach to the organisation by statute. That reality creates a commercial need to manage that legal risk proactively.

• Insurance and risk financing: While the Act does not mandate insurance, organisations should evaluate and secure appropriate public liability or professional indemnity insurance to cover liabilities arising from volunteer activities. The statutory shift of liability materially changes the organisation’s exposure to third-party claims.

• Governance and supervision: Organisations should implement clear role descriptions, written instructions, supervision structures and incident-reporting mechanisms to reduce the risk that volunteers will act outside scope or contrary to instructions, which removes immunity (s 4(3)). Training and supervision reduce factual disputes over knowledge and reckless behaviour.

• Impairment and drug/alcohol policies: Because immunity ceases where volunteers are significantly impaired by recreational drugs (including alcohol), organisations should set and enforce impairment standards and testing or reporting processes to mitigate exposure.

• Clarify remuneration arrangements: If an organisation remunerates volunteers, it should confirm that payments are within any regulatory limits that preserve "voluntary basis" status; consult the regulations made under s 6 for the relevant thresholds. Absence of clarity on remuneration limits in the principal Act means organisations must consult subordinate instruments to confirm volunteer status.

• Legal strategy and coordination: Organisations should prepare to be the initial defendant in suits arising from volunteer conduct (s 5(2)). They should establish procedures for responding to claims, evaluating coverage, and deciding whether to accept vicarious responsibility or to dispute liability, since a dispute in defence may trigger personal claims against volunteers under s 5(2)(b).

For lawyers advising clients

• Check regulations under s 6: The Act’s practical contours depend on regulations classifying or excluding community work and fixing remuneration limits. Advisers must locate and read any relevant subordinate instruments to give accurate advice about volunteer status.

• Client counselling: For volunteers, advise on the evidentiary and fact-sensitive standards (good faith, recklessness, impairment, scope of authorisation). For organisations, advise on insurance, governance, policies, and potential exposure to motor vehicle and defamation claims excluded from the statutory immunity.

For claimants and litigators

• Target the organisation first (s 5(2)(b)): In most cases, a claimant must sue the community organisation first; only if the organisation disputes liability in its defence may a volunteer be sued personally. Plan pleadings and discovery to test whether immunity applies and to generate facts relevant to exceptions.

• Proof issues: Prepare to litigate fact-sensitive issues such as recklessness, good faith, significant impairment by recreational drugs, and knowledge or constructive knowledge that a volunteer was acting outside authorised scope. The Act does not specify burden of proof allocations; standard civil evidentiary rules will apply.

Administrative and practical points

• Incorporation as a mitigation step: If a volunteer-hosting group is unincorporated and wishes to attract the protections of the Act for its volunteers, incorporation may be a route to creating a "community organisation" within the Act’s terms (s 3). Organisations should seek legal advice on whether incorporation and insurance provide the desired risk profile.

• Record-keeping: Detailed records of volunteer roles, authorised activities, training, supervision, instructions, incident reports and any intoxication or impairment observations will be critical if litigation ensues and the exceptions to immunity are litigated.

In short, legal compliance under the Act is avoidance of the factual circumstances that extinguish immunity and proactive organisational risk-management to bear the statutory liability the Act imposes on community organisations. Because the Act contemplates subordinate regulations and preserves other statutory schemes, checking those instruments and maintaining cross-compliance with employment, taxation, insurance and safety laws is necessary.
