What it does
The Voluntary Workers (Soldiers' Holdings) Act 1917 establishes a mechanism for the State to provide housing to disabled members of the Commonwealth naval or military forces and their dependents through voluntary labour associations. The central mechanism works as follows: the Governor may issue Crown grants of land to the Public Trustee (s 3). The Public Trustee may then, at the request of a Voluntary Workers' Association, acquire, hold, subdivide, alienate and mortgage lands for the purpose of providing homes for members of the forces and dependents (s 4). The Public Trustee may borrow money on the security of any land so granted or acquired, and on the security of any buildings, improvements and materials on that land, and must from time to time make advances to Voluntary Workers' Associations for the purchase of materials for constructing buildings and effecting improvements by voluntary labour on such land for homes for disabled members of the forces and dependents (s 5).
A Voluntary Workers' Association receiving money from the Public Trustee must apply it to those purposes, inform the Public Trustee of the portions of land on which it proposes to construct buildings and effect improvements, and give such other particulars as the Public Trustee may require (s 6). Once the association has constructed buildings and effected improvements on a portion, it gives the Public Trustee particulars of the materials used and its estimate of their value. The Public Trustee must, at the request of the association (or, if the association has disbanded or ceased to function, at the request of the Minister), convey that portion with all buildings and improvements to the member of the forces or dependent named by the association or the Minister (s 7(1)). The recipient must then execute a mortgage of that portion to the Public Trustee or a person named by the Public Trustee, to secure the payment by instalments of the value of the materials used for buildings and improvements (s 7(2)). The value is fixed by the Public Trustee. The Public Trustee or other mortgagee must apply an amount equal to the value of the materials to repay the moneys borrowed by the Public Trustee under s 4 (s 7(3)).
