#### 44 Witness to signing of written declaration 44 Witness to signing of written declaration > > (1) For the purposes of section 43(3)(b), a person is eligible to witness the signing of a written declaration if the person— > > > > > (a) is an adult, and > > > > > (b) is not an ineligible witness. > > > (2) For the purposes of subsection (1)(b), a person is an ineligible witness if the person— > > > > > (a) knows or believes the person— > > > > > > > (i) is a beneficiary under a will of the patient making the declaration, or > > > > > > > (ii) may otherwise benefit financially or in any other material way from the death of the patient making the declaration, or > > > > > (b) is a family member of the patient making the declaration, or > > > > > (c) is the coordinating practitioner or consulting practitioner for the patient making the declaration, or > > > > > (d) is a family member or employee of the coordinating practitioner or consulting practitioner for the patient making the declaration.
