Voluntary Assisted Dying Act 2021

1. First request — The person asks a doctor (verbally or by gesture) to start the process
2. First assessment — That doctor (now the 'coordinating practitioner') assesses eligibility
3. Consulting assessment — A second, independent doctor also assesses eligibility
4. Second request — A written, signed request witnessed by 2 independent people
5. Final request — A further verbal or gestured request after a minimum 9-day waiting period
6. Final review — The coordinating doctor confirms everything is in order
7. Administration decision — The person chooses to either take the substance themselves or have a doctor administer it

At any point, the person can stop the process — and restart it later if they choose.

What safeguards are in place?

• Two independent doctors must both assess and approve
• Mandatory waiting period (minimum 9 days from first request)
• Witnesses to the written request cannot be people who benefit from the person's death, facility managers, or the treating doctors
• Health workers cannot bring up assisted dying unprompted — patients must raise it first (or a doctor can mention it only alongside full information about all other treatment options)
• A Voluntary Assisted Dying Review Board oversees every case
• Coercion and exploitation are specifically prohibited and guarded against
• Doctors, nurses and other health workers who have a conscientious objection (moral or religious opposition) can refuse to participate, but must direct the patient to someone who can help

What does it mean legally?

• Death under this Act is not classified as suicide — it is recorded as death from the underlying illness. This means life insurance policies and similar contracts are not affected.
• Health practitioners who follow the Act are legally protected
• The Act binds the State — even government bodies must comply
