Vocational Education and Training Regulations 1996

This part explains the Regulations’ core legal constructs and how they link together.

• Course and unit: The Regulations define course as a VET course and unit as a discrete component in which vocational training is provided (reg 3(1), definition of unit). Units are the practical charging and enrolment building blocks: fees are calculated per unit commenced (reg 11(1)), and enrolment is unit‑based (reg 17(2)(a)).
• Nominal hours: Nominal hours for a unit determine the number of hours an average student is expected to complete the unit and are the basis for calculating fees where the unit’s application for accreditation specifies hours, or where the Minister approves hours for listed units (reg 3AA(1)). The chief executive must publicly notify nominal hours (reg 3AA(2)). Fees in Schedule 1 are expressed as dollars per hour of unit (Schedule 1 heading), so fee quantum moves with nominal hours (reg 11; reg 3AA).
• Course classification: The chief executive must issue an annual instrument classifying courses into categories 1-6 and may vary the instrument during the year (reg 4(1), (3)). Categories are defined by policy attributes: e.g. category 1 courses are priorities and should generally attract higher fees; category 4 are foundation skills or promote equality of opportunity; category 5 is for targeted fee relief; category 6 attracts no fee (reg 4(2)(a)-(f)). The chief executive can classify courses differently for different persons (reg 4(2A)), and may specify that certain categories are fee‑free for concessional or youth students (reg 4(3A)). Category assignments are therefore a lever that translates policy priority into price signals facing students.
• Reclassification and transitional effect: The chief executive can reclassify courses mid-year (reg 4A(1)). Reclassification does not generally affect units already commenced before the amendment day (reg 4A(3)), but specific provisions address category 5 reclassifications and refund/adjustment entitlements where fees paid before amendment would, because of reclassification, exceed entitlements (reg 4A(4)-(6)). Colleges must therefore track commencement dates and amounts paid to determine refund obligations.
• Fee regimes and actors: There are multiple fee-setting authorities:
  • Unit fees for 2021-2026 are determined by reference to Schedule 1 (reg 11(1)), which sets per-hour rates by category and concession status.
  • The Minister may determine fees for students who are not Australian residents and may differentiate by course, unit, college, country of origin, prior qualifications, or other cost-related criteria (reg 15A(2)-(3)).
  • Colleges may determine other fees or charges for vocational education or related services (reg 16), and may set fee‑for‑service charges when services are provided on that basis under the Act (reg 16A). Determinations made by colleges must be published as directed by the Minister before they take effect (reg 16(2)-(3)).
• Concession classes and financial hardship: The Regulations set out an eligibility list for concessional rates (reg 20(2)), including Health Care Card holders, Pensioner Concession Card holders, some youth allowances, secondary school‑aged persons and dependants (reg 20). Governing councils may apply concessional rates or full exemptions on application where payment would cause financial hardship or severe financial hardship (reg 21, reg 23).
• Enrolment mechanics and refusals: Enrolment requires a completed enrolment form and payment or an arrangement satisfactory to the college (reg 17). Governing councils have limited grounds to refuse enrolment within 21 days and must give written reasons; grounds include prior breaches of discipline or non‑payment of fees (reg 18). Councils may cancel enrolment if funding via VET loans is not confirmed (reg 18(2)(c), (2A)).
• Refund mechanics: Colleges must provide full refunds where a unit is cancelled or scheduling changes post‑commencement cause a student to withdraw (reg 24). Students can withdraw within an allowed period (set by the college but not less than 20% of unit delivery) and obtain full refunds (reg 25(2)-(3)); pro rata refunds are available after the allowed period for unforeseen circumstances, and special rules apply to instalment payments (reg 26; reg 24A).

These concepts interlock: nominal hours feed into unit fees (reg 3AA, reg 11); course classification drives which unit rates apply (reg 4, Schedule 1); ministerial and college fee determinations operate alongside the Schedule; governing councils exercise discretion on hardship, instalments and refund satisfaction (regs 21-26), while the chief executive and the Minister set classification and overseas fee policy (reg 4; reg 15A).

The Regulations directly allocate financial obligations, decision rights and administrative burdens across several groups.

• Students and prospective students: The primary financial burden falls on students. Fees are charged per unit commenced (reg 11(1)), and total annual exposure is limited in specified ways (reg 12). Concessional students, secondary school students and certain categories of persons (e.g. state care) may be exempt or pay lower rates (regs 13-14, 20). Overseas students who are not Australian residents face a different fee regime that the Minister may set and vary by criteria such as course, college, or country of origin (reg 15A(1), (2), (3)). Students who fail to pay instalments may have enrolment cancelled (reg 22(3)-(4)), and unpaid amounts may be recovered in court as a debt (reg 22(5)).
• Colleges and governing councils: Colleges administer enrolment, collect fees, determine certain fees and instalment arrangements, assess concession and hardship applications, and keep operational governance records such as the seal book (regs 16-17, 20-23, 27-31). Governing councils decide hardship exemptions, instalment approvals, and may cancel enrolments on prescribed grounds (regs 21-23, 18(1)-(2)). Colleges must publish fee determinations as directed by the Minister (reg 16(2)-(3)). Colleges bear the administrative burden of verification of concession claims and of applying refund rules and reclassification adjustments (reg 20(3); reg 4A(6)).
• Chief executive and Minister: The chief executive has significant administrative authority to classify courses annually and to reclassify them (reg 4(1), 4A). The chief executive also must publicly notify nominal hours for each unit (reg 3AA(2)). The Minister has specific fee‑setting powers for non‑Australian residents (reg 15A(2)), and the Minister directs the manner of publication of college fee determinations (reg 16(2)). These offices decide policy that alters prices facing students and revenue flows to colleges.
• Employers and existing worker trainees: The Regulations explicitly allow different classification for persons who are parties to training contracts or are existing worker trainees (reg 4(2A)). Employers who support trainees may be affected by fee assignment changes and by reclassification rules for courses that could alter who pays.
• Schools and school‑age persons: Courses undertaken by persons enrolled at school are exempt from course fees (reg 13(3)), but there is an exception for final year students undertaking certain timing-sensitive courses after a specified school term cut-off (reg 13(4)). Colleges must therefore coordinate with schools to identify exemption eligibility.
• Commonwealth agencies: The Regulations interact with Commonwealth benefits and visa frameworks because concessional status references Commonwealth‑issued cards/allowances and the overseas student rules reference visa subclasses and Commonwealth letters (reg 20(2); reg 15A(1A)-(1B)). Commonwealth documentation thus functions as eligibility evidence.
• Courts and debt collectors: Where instalments remain unpaid, governing councils may recover amounts in a court of competent jurisdiction as a debt (reg 22(5)). Courts therefore become the enforcement channel for fee collection rather than the Regulations prescribing a specific penalty regime.

Who decides: the chief executive (course classification and nominal hours notification), the Minister (overseas student fees, publication directions), governing councils (hardship, instalments, refunds, enrolment refusals/cancellations), and colleges (other fees determinations subject to publication). Who pays: primarily students, with specific exemptions for concessional classes, school‑enrolled persons, state‑care students and students meeting the Minister’s Australian resident test (regs 11, 12, 13, 14, 15A, 20). Behaviour changes likely include altered course selection where fees differ by category (reg 4, Schedule 1), timing of unit commencement to lock in fee levels (reg 4A transitional rules), and increased use of instalments or financial hardship processes (regs 21-23) where fees are a barrier.

This section lists the principal duties the Regulations create and the substantive rights they afford, with citations to the source provisions.

Duties imposed on the chief executive and Minister

• Publish annual course classification instrument, and amend as necessary (reg 4(1), (3)). The classification instrument must be issued to all colleges not later than the beginning of a calendar year (reg 4(1)).
• Publicly notify nominal hours for each unit and determine them according to accreditation, Ministerial approval, or corresponding law (reg 3AA(1)-(2)).
• The Minister may determine course fees for non‑Australian resident students and set different fees based on multiple criteria (reg 15A(2)-(3)). These are duties/authorities to make binding determinations.

Duties imposed on colleges and governing councils

• Designate an Admissions Manager to undertake selection where the Division applies (reg 7).
• Publish and implement college fee determinations in the manner directed by the Minister; determinations do not take effect until published (reg 16(1)-(3)).
• Ensure enrolment forms and payment arrangements are processed and that a person pays or has arranged payment to the satisfaction of the college (reg 17(2)(a)-(b)).
• Assess and verify concessional entitlements; it is the claimant’s responsibility to establish entitlement to the governing council’s satisfaction (reg 20(3)).
• Decide on concessional rates or exemptions where payment would cause financial hardship or severe hardship on application (reg 21; reg 23). Councils must exercise these discretions and record decisions.
• Offer and manage instalment schemes, give 21 days’ notice before withdrawing instalment allowances or cancelling enrolment for non-payment (reg 22(1)-(4)). Councils may recover unpaid instalments as a debt (reg 22(5)).
• Apply refund rules: provide full refunds where courses/units are cancelled or where students withdraw within allowed periods, and pro rata refunds after the allowed period where unforeseen circumstances are shown (regs 24-26).

Rights of students and applicants

• Right to be selected for courses under the Admissions Manager selection process when required; applications must be in writing (regs 7-8).
• Right to concession rates if they fall into prescribed categories (reg 20(2)) and right to seek concessional treatment on financial hardship grounds (reg 21).
• Right to exemption from course fees where regulation‑specified categories apply (reg 13) and exemption for students in State care per reg 14.
• Right to enrol and undertake units only if enrolled, with enrolment conditional on payment or satisfactory arrangement (reg 17(1)-(2)). The Regulations also provide a right not to be enrolled if a governing council refuses within 21 days on limited grounds and gives written reasons (reg 18(1)-(3)).
• Right to refunds: full refund where course/unit cancelled or scheduling changes force withdrawal; full refund if the student withdraws within the allowed period set at no less than 20% of unit delivery; pro rata refund for unforeseen circumstances after the allowed period on evidence to the governing council’s satisfaction (regs 24-26).

Procedural limits and requirements

• Enrolment refusals within 21 days must be in writing with reasons; service by post to address in enrolment form suffices (reg 18(1)-(3)).
• If a student receives VET FEE‑HELP or a VET student loan and confirmation is not received within the required period, enrolment may be refused or cancelled (reg 18(2)(c), (2A)).
• College fee determinations do not take effect until published as directed by the Minister (reg 16(2)-(3)). The chief executive must publish course classification instruments to all colleges (reg 4(1)).

Record-keeping and governance duties

• Colleges must maintain and keep in safe custody the common seal and seal book, ensure attestation procedures and entries (regs 27-31).
• Chief executive must give public notice of nominal hours (reg 3AA(2)).

Notice and timing obligations

• Annual classification instrument must be issued not later than the beginning of the calendar year (reg 4(1)).
• Allowed period for withdrawal must be set by the college and be no less than 20% of unit delivery (reg 25(3)).
• Governing councils must give 21 days’ written notice before exercising powers to require payment of unpaid instalments or cancelling enrolments for non-payment (reg 22(3)-(4)).

These duties and rights create discrete procedural and substantive entitlements: students have entitlements to concessions, refunds and reasons for refusal; colleges and governing councils have discretionary duties to assess hardship and manage instalments; the chief executive and the Minister hold policy levers over classification, nominal hours and non-resident fees.

The Regulations rely mainly on administrative enforcement levers and civil recovery; they do not specify criminal penalties or a detailed enforcement regime within the text of the Regulations themselves.

Enforcement mechanisms set out in the Regulations

• Refusal or cancellation of enrolment: Governing councils may refuse enrolment within 21 days for prescribed grounds (breach of discipline/by‑laws, non‑payment of fees, or where VET loan confirmation is not received) and must give written notice and reasons (reg 18(1)-(2)). Councils also may cancel enrolment after the 21‑day period if funding is not available (reg 18(2A)).
• Withdrawal of instalment allowances and cancellation: Councils may withdraw instalment arrangements or cancel enrolment where a student fails to pay instalments after 21 days notice and if instalments due before the notice remain unpaid (reg 22(3)-(4)). Those actions are administrative sanctions the college may take to secure payment or ensure conduct.
• Recovery of unpaid fees as debt: Unpaid instalments, or unpaid amounts specified under reg 22(3)(a), may be recovered in a court of competent jurisdiction as a debt due to the college (reg 22(5)). This civil enforcement step is the primary financial enforcement tool embedded in the Regulations.
• Operational compliance obligations: Publication requirements (reg 4(1) and reg 16(2)-(3)) impose administrative compliance obligations on the chief executive, Minister and colleges. Failure to publish may affect the legal operation of instruments (reg 16(3) states determinations do not have effect until published), thus publication is an implicit compliance mechanism.
• Refund obligations: Reclassification and refund rules create enforceable entitlements (reg 4A(6) entitles persons to a refund where reclassification reduces fee liability). A student with a statutory entitlement to a refund could enforce that entitlement through administrative review or civil proceedings, although the Regulations do not specify a mechanism for appeal.

Absence of criminal penalties or express regulatory fines

• The Regulations do not set out monetary penalties or prescribe offences for breach of the Regulations themselves. The only specified coercive measure is civil recovery of unpaid fees (reg 22(5)) and the administrative ability to refuse or cancel enrolment (reg 18 and reg 22(3)). Any other enforcement would derive from the Act or general administrative law, which the Regulations reference in places (e.g. Act s. 43(1) in reg 3A and section 58C in reg 3AA(1)(a)), but the Regulations do not themselves detail criminal sanctions.

Practical enforcement consequences and uncertainty

• Enforcement is primarily exercised by governing councils and colleges; that concentrates enforcement discretion at the college level (reg 21, reg 22, reg 23). Discretionary decisions (financial hardship exemptions, instalments, refund satisfactions) may be the subject of review under administrative law principles, though the Regulations themselves do not set internal appeal pathways.
• Recovering fees through the courts may impose collection costs and timing uncertainties for colleges, and debt recovery might be a last resort after internal administrative processes under reg 22(3)-(5).

In short, enforcement under these Regulations is administrative and civil rather than penal. Colleges and governing councils are the primary enforcers; courts are the forum for monetary recovery. The Regulations provide procedural constraints (notice requirements, grounds for refusal) to limit arbitrary decisions, but many substantive actions remain discretionary at college governance level.

The Regulations sit within a statutory framework and expressly reference or depend on provisions of the Vocational Education and Training Act 1996, the School Education Act 1999, the Children and Community Services Act 2004, Commonwealth migration legislation and Commonwealth social security/assistance instruments. The text specifies a number of cross‑references that determine eligibility, timing and operative effects.

Key cross‑references in the Regulations

• Vocational Education and Training Act 1996: The Regulations operate under the Act. Specific cross‑references include the chief executive’s obligation regarding strategic plans tied to Act s. 43(1) (reg 3A) and the concept of a course accredited by the Council tied to section 58C for nominal hours (reg 3AA(1)(a)). Fee‑for‑service supplies are specified to be under section 37(1)(bb) (reg 16A(1)). The Regulations therefore implement Act powers and are subordinate instruments under that Act.
• School Education Act 1999: Definitions of secondary school aged person and the timing rules for fee exemptions for persons enrolled at a school reference the School Education Act 1999 (reg 3(1) definition; reg 13(4) refers to the end of a school term determined under School Education Act s. 117). This linkage makes school enrolment status and school term dates legally significant for fee entitlement.
• Children and Community Services Act 2004: The special fee exemption for students in State care references the CEO in the meaning of the Children and Community Services Act s. 3 and section 30 of that Act (reg 14). That Act therefore is the statutory source of the state care status triggering fee exemption timing rules.
• Commonwealth migration law and Migration Regulations: The Australian resident test for fee purposes for overseas students expressly lists visa subclasses and references the Migration Act 1958 and Migration Regulations 1994 (reg 15A(1A)-(1B)). The Regulations therefore depend on Commonwealth visa classifications for residency status in fee determination.
• Commonwealth social assistance law: Concessional eligibility lists incorporate Commonwealth‑issued entitlements and cards, such as Health Care Card, Pensioner Concession Card, AUSTUDY, ABSTUDY and youth allowance categories, and refer to Centrelink as the agency (reg 20(2)). These Commonwealth instruments therefore act as evidence and preconditions for WA concessional treatment.
• Vocational Education and Training (General) Regulations 2009: For listed units of competency forming part of a listed training package, nominal hours reference Ministerial approvals as referred to in the General Regulations (reg 3AA(1)(b)). This ties unit hour determinations to the wider training package architecture.
• Publication and administrative directions under the Act: The Minister’s direction to colleges on how to publish fee determinations is given under Act s. 11 (reg 16(2)). That means the Act’s administrative powers shape how college determinations become operative.

Practical interactions and compliance implications

• Colleges must coordinate with Commonwealth agencies and adhere to Commonwealth documentation for eligibility verification and for overseas student status (reg 20(2); reg 15A(1A)). That requires administrative arrangements to check visa status and Centrelink documentation.
• The Regulations’ definitions tie school and state‑care status to other Acts, which means administrators must reference external registers or confirmations (regs 13-14). Colleges need processes to verify school enrolment dates and care status to determine fee exemptions.
• Accreditation and corresponding-law accreditation determine nominal hours for units (reg 3AA(1)(a), (c)). Changes in accreditation under other regimes can change fee exposure under these Regulations via nominal hours.

Taken together, these linkages mean the Regulations do not operate in isolation; fee and entitlement determinations require colleges and the Department to interact with Commonwealth programs, migration records, school systems and VET accreditation systems. Administrative systems must be designed to cross‑check and record evidence required under other legislation.

The compilation table and marginal notes in the text provide a clear chronology of amendments. Below are the notable mechanical changes recorded in the Regulations and the years in which they took effect, with references to the relevant amendments where the Regulations identify them.

• Original Regulations and early amendments: The Vocational Education and Training Regulations were first published 27 December 1996 (commencing 1 January 1997). Early amendments occurred in 1997-2005, reflected in several Amendment Regulations (1997, 1998, 1999, 2001-2004, 2005) and regular reprints noted in the compilation table.
• 2008-2009 package: Amendments in late 2008 and 2009 updated various provisions (see Gazette entries and reprint 4). Regulation 3 received multiple updates over the years (see marginal notes).
• 2013 developments: The nominal hours provision (reg 3AA) was inserted by Gazette 17 December 2013 (reg 3AA inserted: Gazette 17 Dec 2013 p. 6256-7), establishing how nominal hours are determined and requiring public notice (reg 3AA(1)-(2)). The 2013 amendments also adjusted course classification and other administrative features (reg 4 amendments reflected).
• 2014-2016 changes: The Regulations were amended in 2014 (Gazette 12 Dec 2014) with changes including enrolment and refund mechanics (regs 17, 25), and in 2016 the Schedule 1 fee framework was introduced for 2021-2026 by reg 11 (inserted Gazette 23 Dec 2016 p. 5907; schedule inserted Gazette 23 Dec 2016 p. 5909). Later 2016 amendments (reg changes and schedule) set per-hour unit rates and operationalised per-unit charging.
• 2017-2019 updates: Minor amendments in 2017 and 2018 occurred (Gazette entries). Important reform in 2019 introduced annual course fee caps and specific caps for category 5 courses and specified courses (reg 12 inserted: Gazette 22 Oct 2019 p. 3731-2). The 2019 amendments also made changes to Schedule 1 (per-hour rates) and other administrative detail (Gazette 22 Oct 2019 p. 3733).
• 2020 package and new categories: Several 2020 Statutory Laws made amendments (SL 2020/84, SL 2020/109, SL 2020/190, SL 2020/200). Regulation 32 was inserted as a transitional provision allowing the chief executive to classify courses as category 6 and make consequential amendments (reg 32 inserted: SL 2020/84 r. 10). New powers to reclassify and transitional rules (reg 4A) were added around this period (SL 2020/109 r. 6; SL 2020/200 r. 6).
• 2021-2022 adjustments: SL 2021/143 and SL 2021/168 made further amendments; there were multiple subsequent amending instruments in 2022 (SL 2022/132; SL 2022/203) that updated concession lists and fee rules including changes to overseas student provisions.
• 2024-2025 updates: SL 2024/1 and SL 2024/230 made further changes (including updates to the Australian resident tests in reg 15A(1A)), and SL 2025/186 updated commencement timing for some provisions, with some regulations commencing on 1 January 2026 (see compilation table final entry: SL 2025/186 12 Nov 2025 with various commencement dates).

Key mechanical introductions and their dates

• Nominal hours and public notice duty: reg 3AA , inserted 17 Dec 2013.
• Three‑year strategic plan period: reg 3A , inserted 22 May 2009.
• Unit fees and Schedule 1 framework for 2021-2026: reg 11 and Schedule 1 , inserted 23 Dec 2016 (with subsequent schedule amendments).
• Annual fee caps for specified courses and category 5 courses, and special caps for school‑aged students: reg 12 , inserted 22 Oct 2019; further amended SL 2020/84, SL 2020/190, SL 2022/203.
• Transitional category 6 and related reclassification powers: reg 32 and reg 4A , inserted/expanded in 2020 (SL 2020/84; SL 2020/109; SL 2020/200).

The compilation table in the Regulations lists each amending instrument, the Gazette or SL number and commencement dates. For compliance and historical interpretation it is necessary to consult the compilation table entries corresponding to specific amendments because several provisions have been added, deleted or reworded across the period from 1996 to 2025. The marginal notes in the text show where particular regulations were inserted or amended and provide the Gazette/SL citations.

The Regulations’ text and compilation notes do not record judicial decisions or a litigation history. There are no cases named in the source material provided. The Regulations therefore present no built‑in case law references; any litigation history would need to be sourced from tribunal and court databases, administrative decisions, or reported judgments outside the Regulations.

Potential legal issues likely to generate litigation or administrative review (based on the text)

• Judicial review of classification or reclassification decisions: The chief executive’s power to classify and reclassify courses (reg 4, reg 4A) is discretionary and affects students’ fee liability. Administrative law challenges could arise if a course provider or affected person alleges that the chief executive failed to observe procedural fairness, acted beyond power, or made an irrational decision. The Regulations do not set an internal appeal path with merits review for classification decisions; the likely remedy would be judicial review.
• Disputes over nominal hours: Nominal hours determine the fee quantum per unit (reg 3AA; reg 11). Disagreement about the nominal hours adopted by the chief executive or Ministerial approvals could give rise to disputes where fees paid differ materially. The Regulations require public notice of nominal hours (reg 3AA(2)) which may be a procedural step relevant to review.
• Governing council discretion on hardship and refund satisfactions: The Regulations repeatedly make acceptance of financial hardship, unforeseen circumstances and eligibility for concessional rates subject to the governing council’s satisfaction (regs 21, 23, 24A, 26). That discretion could be the subject of review if a student alleges a denial of natural justice or unreasonable decision-making.
• Enforcement for unpaid fees and debt recovery: Courts may be engaged where colleges sue for unpaid instalments (reg 22(5)). Disputes could arise about whether a college followed the notice rules before recovery actions (reg 22(3)-(4)), or whether payments and instalment schemes were properly set up.
• Enrolment refusals and reasons: The requirement for written reasons when enrolment is refused within 21 days (reg 18(1)-(3)) creates a discrete procedural obligation. Challenges could arise where a student disputes the grounds or the sufficiency of reasons.

No specific litigation outcomes or decisions are supplied in the Regulations. Practitioners should therefore consult court and tribunal databases, and the Department’s administrative decisions, for any judicial interpretation or precedent on these Regulations. The text itself provides the statutory scaffolding but not a litigation corpus.

This section highlights provisions that commonly cause compliance headaches, practical traps for students and colleges, and timing or evidence risks. Each point cites the exact regulation.

1. Unit‑based charging depends on nominal hours and commencement date (reg 11(1); reg 3AA). Because fees are charged per unit commenced and unit fees are expressed per hour (Schedule 1), a change in nominal hours or the timing of unit commencement can change fee exposure materially. Colleges and students should track when a unit is regarded as commenced for fee purposes.

2. Chief executive classification can vary by person (reg 4(2A)). The same course can be placed in different categories depending on whether the student is a party to a training contract, an existing worker trainee or another class. That means identical course names do not guarantee identical fees for different students.

3. Reclassification transitional effects and refunds (reg 4A). While reclassification does not generally affect units commenced before amendment day (reg 4A(3)), complexities arise with category 5 reclassification (reg 4A(4)-(5)) and with amounts already paid that include units commencing after amendment day (reg 4A(6)-(7)). Colleges must reconcile payments to ensure refunds are made where reclassification reduces fee liability and must track commencement timing carefully.

4. Student enrolment is conditional on “satisfaction of the college” (reg 17(2)(b)). The phrase gives colleges a broad discretion to require payment or acceptable arrangements. Students relying on external funding (VET loans) may be refused if confirmation is not received in time (reg 18(2)(c), reg 18(2A)), and colleges can cancel enrolments where funding does not materialise (reg 18(2A)).

5. Allowed period for full refund is college‑set but must be at least 20% of unit delivery (reg 25(3)). Colleges set allowed periods but cannot make them shorter than 20%. However, the fact the college sets the period means students must check the college’s published allowed period; it is not uniform across colleges.

6. Evidence thresholds left to governing councils’ satisfaction (regs 20(3), 21, 23, 26). Eligibility for concessions and refunds after the allowed period are both subject to the governing council’s satisfaction. That creates evidentiary and procedural uncertainty for applicants. The Regulations do not prescribe records or criteria, so consistency depends on college policy.

7. Overseas student residency test is granular (reg 15A(1A)). The list of visa subclasses and conditions is detailed and may be updated by Commonwealth law; colleges must maintain current visa‑checking processes. The resident test includes some bridging or temporary visas only where specific letters or conditions are met (reg 15A(1A)(d), (g)), requiring procedural interaction with Commonwealth departments.

8. College fee determinations do not take effect until published as directed by the Minister (reg 16(2)-(3)). Failure to publish means the fee has no effect. Administrative timing of publication can thus inadvertently invalidate fee imposition.

9. Instalment withdrawal requires 21 days’ notice and only applies if an instalment payable before the notice remains unpaid (reg 22(3)-(4)). If colleges fail to give proper notice they may lack a lawful basis to cancel enrolment or demand immediate payment.

10. No express internal appeal or merits review path in the Regulations. While administrative law remedies may exist, the Regulations themselves do not set out an appeal channel for students aggrieved by governing council decisions on hardship, refunds, or instalments.

11. Small late application and assessment fees are fixed: late application $75 (Schedule 1 item 1), assessment-on-experience fee capped at $70 (reg 10). These small numeric caps can be overlooked but are binding.

12. Concessions include dependants and a range of Commonwealth categories (reg 20(2)(g)). Colleges must verify dependant status and applicable Commonwealth cards; incorrect verification risks misapplied concessions.

13. Fee caps complexity (reg 12). Multiple caps apply depending on student age/ status and course category: $7,860 cap for specified Diploma/Advanced Diploma courses for non‑secondary school aged students (reg 12(4)); $1,200 cap for category 5 courses for non‑concessional students (reg 12(5)); $400 cap for concessional or youth students who are unenrolled secondary school aged or final year students for category 5 (reg 12(6)); and a $420 total annual cap across all courses for unenrolled secondary school aged persons or final year students (reg 12(7)). Misapplication may occur if colleges do not aggregate enrolments and track year‑to‑date totals.

14. Refunds for scheduling changes are full refunds only if student withdraws because the new day/time is unsuitable (reg 24(b)). Disputes may arise about whether the changed time is unsuitable; the Regulation presumes student withdrawal as the trigger.

15. Seal and attestation formalities (regs 27-31) impose specific governance steps; failure to follow those steps could affect validity of sealed documents in governance processes.

Practitioners should focus on recording commencement dates, payments allocation across units, publication timing for fee determinations, and clear written policies and evidence requirements for concessions and hardship to reduce disputes.

This section gives a practical compliance checklist for three principal actors: colleges/governing councils, the department/chief executive and the Minister, and students/applicants. Each item cites the controlling regulation.

For colleges and governing councils

• Publish and implement fee determinations only after following the Minister’s direction on publication. Reg 16(2)-(3) requires the Minister to direct how determinations are to be published and states a determination does not take effect until published. Maintain a publication log and date‑stamp determinations.
• Designate an Admissions Manager where Division 1 applies and ensure the Admissions Manager undertakes selection (reg 7). Ensure the handbook indicates whether certain selection requirements apply (reg 6(2)).
• Verify concessional entitlement: ask claimants to establish entitlement to the council’s satisfaction, and keep records of documentary evidence (reg 20(3)). Maintain checklists for Centrelink cards, Pensioner Concession Cards, ABSTUDY/AUSTUDY, youth allowance evidence and dependant status (reg 20(2)).
• Maintain clear hardship application procedures and internal records of decisions for reg 21 and reg 23. Record reasons and evidence for concessional determinations and severe hardship exemptions. Publish the process so applicants know documentary requirements.
• Establish instalment policies aligned to reg 22(1)-(5): determine instalment amounts and dates; establish 21‑day notice templates; record when notice is given; and ensure instalments due before notice remain unpaid before enforcing withdrawal or cancellation. Use a standard script and checklist for the 21‑day process to meet reg 22(4).
• Set allowed periods for withdrawal for each unit (reg 25(3)). Ensure the allowed period is no less than 20% of unit delivery and publish the allowed period in course/unit information and enrolment material. Track allowed period expiry dates to determine refund entitlements.
• Implement refund calculation processes: full refunds for cancellations or scheduling changes (reg 24) and pro rata calculations for unforeseen circumstances (reg 24A, reg 26). Where fees are collected by instalment, pro rata refunds must align with the payment period definition (reg 24A).
• Track payments by unit commencement dates for application of reg 4A reclassification rules. If a reclassification makes amounts paid exceed new entitlements, process refunds as required by reg 4A(6).
• Ensure enrolment acceptance procedures require a completed enrolment form and evidence of payment or a satisfactory payment arrangement (reg 17(2)(a)-(b)). Keep the enrolment form address for notices (reg 18(3)).
• Maintain governance records for seals and the seal book in accordance with regs 27-31. Ensure attestation signatures accompany affixing of common seal.
• For overseas students and residency testing, establish visa‑checking procedures aligned with reg 15A(1A) and record copies of visas or supporting letters where required (reg 15A(1A)(d), (g)). Apply Minister determinations where they exist (reg 15A(1)-(3)).

For the Department / chief executive

• Issue the annual classification instrument to all colleges not later than the beginning of the calendar year (reg 4(1)). Keep a version control and distribution log. If reclassifications are necessary, follow reg 4A and document amendment day and transitional arrangements for fees and refunds (reg 4A(1)-(7)).
• Publicly notify nominal hours for each unit in a clear, accessible format and maintain archival records (reg 3AA(1)-(2)). Coordinate with the Council accreditation records (section 58C references) and with listings under corresponding laws (reg 3AA(1)(c)).
• Issue and maintain clear instructions to colleges about publication requirements for fee determinations (reg 16(2)). Consider providing standard templates and publication mechanisms to reduce the administrative burden and legal uncertainty.
• When making classification changes that affect fee entitlements, provide clear transitional guidance to colleges, including example calculations for refunds under reg 4A(6).

For the Minister

• Where determining fees for non‑Australian residents (reg 15A), publish determinations clearly and provide the rationale and criteria, since the Regulations allow differentiation by course, college, country of origin and prior qualifications (reg 15A(3)). Work with the Department to coordinate public notices and college implementation.
• Provide directions to colleges under Act s. 11 for publication of fee determinations (reg 16(2)), and consider timing buffers so determinations are published before fee liabilities attach.

For students and applicants

• Understand that enrolment requires a completed enrolment form and payment or an arrangement satisfactory to the college (reg 17(2)). Retain proof of payment and of any instalment arrangements made.
• Check whether a course is fee‑exempt under the college’s classification instrument, particularly if you are a concessional, youth, school‑enrolled or state‑care student (reg 4(3A); reg 13; reg 14). Where claiming exemption, provide the documentary proof the college requires (reg 20(3)).
• Be aware of the allowed period for withdrawal for each unit (set by the college no less than 20% of unit delivery , reg 25(3)). If you withdraw within that period, you are entitled to a full refund (reg 25(2)). If withdrawing after the allowed period, be prepared to show unforeseen circumstances to the governing council’s satisfaction for a pro rata refund (reg 26).
• If relying on VET loans or Commonwealth assistance, ensure confirmations are obtained within required periods; absence of confirmation can lead to enrolment refusal or cancellation (reg 18(2)(c), (2A)).
• For overseas students, confirm your Australian resident status per the applicable visa subclasses listed in reg 15A(1A) and keep documentary evidence, including any letters from Commonwealth departments where specified (reg 15A(1A)(d), (g)).
• If facing severe financial hardship, apply to the governing council under reg 23 and be ready to provide comprehensive financial evidence; decisions are discretionary but must be applied by the council.

Administrative checklists and systems recommended

• A payments ledger that allocates receipts to specific unit commencements and tracks instalment periods (to satisfy reg 11, reg 24A, reg 4A).
• A concessions and hardship decision register with evidence, reasons and dates, to provide a paper trail for reg 20(3), reg 21 and reg 23 decisions.
• Publication protocols with timestamps for fee determinations and chief executive instruments (reg 4(1); reg 16(2)-(3)).
• An enrolment acceptance workflow that records the 21‑day refusal window and reasons provided where enrolment is refused (reg 18(1)-(3)).

Following these steps aligns internal practices with the Regulations’ procedural and substantive requirements and reduces the risk of successful disputes or debt unrecoverability due to procedural error.
