Victorian Environmental Assessment Council Act 2001

The Act sets out a small set of core legal concepts and institutional mechanisms that structure environmental assessment and advice on public land. The central concepts are: investigations, assessments and advice; the Council as an independent advisory body; public land; procedures for consultation, transparency and parliamentary accountability; Ministerial control over scope and resources; and implementation obligations for Government entities.

Investigations are formal reviews requested by the Minister under Division 1, initiated after public notice of proposed terms of reference and a 28 day notification period (ss 15(1)-(3), 16(2)). An investigation typically involves the preparation of a discussion paper and a draft proposals paper unless the Minister specifies otherwise (s 15(4)(c); s 15(5) permits the Minister to direct that such papers not be prepared). Division 1 sets statutory notice requirements (s 20), mandatory Community Reference Groups (s 13(1)), public submissions (s 22), the content required in the Council’s final report including detailed rationale and copies of submissions (s 23(2)-(3)), and timeframes and extension processes (s 24).

Assessments and advice are distinct from investigations and are intended for matters that, in the Minister’s opinion, do not require a full investigation because of limited scale, scope or technical nature (s 26B(1)). Division 2 (inserted by the 2016 amendments) allows the Minister to tailor procedure for these matters, including directing what considerations the Council must have regard to, whether a Community Reference Group is required, and what public consultation is necessary (s 26B(2)(c)-(f)). The reporting and publication rules for assessments and advice closely mirror those for investigations (s 26E).

The Council is an independent statutory body with statutory objectives to provide independent and strategic advice on protection and ecologically sustainable management of the environment and natural resources of public land (s 5). Membership is appointed by the Governor in Council on Ministerial recommendation and must, collectively, cover a specified mix of skills and experience across environment, natural resource management, economics, tourism, indigenous issues, local government and community consultation (s 8(1)-(2)). Additional members can be brought in for particular matters and their voting rights are restricted to questions directly relating to that matter (ss 8(4), 10(8)-(9)).

Public land is defined broadly and references other statutes to identify categories such as unalienated Crown land, State forest as defined in the Forests Act 1958, and parks as defined in the National Parks Act 1975 (s 3). This cross‑reference anchors the Council’s remit to Crown and vested public land.

Transparency and parliamentary accountability are embedded through mandatory public notices, publication on the internet, tabling before each House of Parliament, and Government responses with specified content and timing: the Minister must cause Government responses to be prepared and tabled within six months after tabling of the Council’s report, and must publish both response and any later amendments along with reasons (ss 25(1)-(3), 26(2)-(5), 26G(1)-(4), 26H(2)-(5)). The Council itself must publish its annual report and account for resources used on each investigation and assessment (s 14(1)-(2)(d)).

Operation and resourcing are jointly controlled: the Council must submit a business plan and budget within a specified period (30 days unless the Minister specifies longer) after receipt of a request; the Minister consults with the Council on estimates and must ensure the Department Head makes available the resources the Minister considers are required (s 17(1)-(4)). Departments and public authorities must provide practicable assistance to the Council (s 19(2), s 26D(2)).

Implementation duties are important but qualified. Where a Government response identifies a Minister, Department or public authority responsible for action with respect to a recommendation, that entity must ensure the action is undertaken to implement the recommendation to the extent it is accepted in the response or subsequent statement (ss 26A, 26I). The Act therefore creates a statutory link between Council recommendations, Government responses and an administrative obligation to carry out accepted measures.

Finally, the Act contains transitional and saving provisions for earlier recommendations from the repealed Environment Conservation Council Act 1997 and the Land Conservation Act 1970, treating certain prior recommendations as Council recommendations and preserving acts done to effect them (ss 27-28).

The Act distributes decision, resource and compliance obligations across three groups: the Government (Minister, Department Heads, public authorities), the Council and its members, and third parties with interests in public land (leaseholders, licence holders, recreational users, industry groups, environmental groups, indigenous groups, local government and the general public). Each group bears different direct costs, administrative duties and rights under the statutory processes.

Government and Ministers: The initiating power for investigations, assessments and advice rests with the Minister (ss 15(1), 26B(1)). The Minister determines terms of reference, reporting timeframes and may amend or withdraw requests during the course of work (ss 15(4)(b), 15(6)(b), 26B(3)). The Minister must publish requests and any amendments, lay them before both Houses of Parliament within seven sitting days and publish statements responding to public comments on proposed terms of reference (ss 16(1)(a)-(c), 16(2), 26C(1)-(2)). The Minister approves resourcing by ensuring the Department Head makes available resources the Minister considers necessary (s 17(4)(b)). The Minister must also cause a Government response to a Council report to be prepared and tabled in Parliament within specified time limits and publish it (s 25(1)-(4), s 26G(1)-(4)). If recommendations are accepted, the Minister or the Department/public authority identified must ensure implementation to the extent accepted (ss 26A, 26I). This sets administrative obligations, political accountability and resource allocation responsibilities on Ministers and departmental leadership.

Departments and public authorities: They must give practicable assistance to the Council and confer with the Council if affected by the conduct or results of an investigation or assessment (s 19(1)-(2), s 26D(1)-(2)). They may be identified in Government responses as the agency responsible for implementing recommendations and thereby must ensure implementation to the extent accepted (ss 26A, 26I). They also host noticeboards for practical notification in the field where investigations may affect existing rights (s 20(4)(b), s 26C(3)(b)). Departments will therefore incur costs in providing staff time, records, site notices and operational actions necessary for implementation.

The Council and its members: The statutory Council is appointed by Governor in Council on a Ministerial recommendation, must collectively contain specified expertise and must adhere to internal procedural rules such as quorum and voting (ss 8(1)-(2), 10(5)-(9)). Members are subject to the Public Administration Act 2004 (except Part 3) in respect of their office (s 9(5)), and are entitled to remuneration fixed by the Minister (s 9(6)). The Council must prepare discussion and draft proposals papers unless excluded by the Minister (s 15(4)(c)-(5)), accept submissions, publish them with reports (s 23(3)-(4)), and establish Community Reference Groups for investigations and for assessments when directed (s 13(1), (1A)). The Council must also submit its annual report and include resource usage data (s 14(1)-(2)(d)). The Council thus bears the operational burden of conducting consultative processes, drafting papers, maintaining public records and meeting statutory deadlines.

Third parties with interests in public land: The Act provides standing to any person or body to make submissions on investigations, discussion papers and draft proposals papers (s 22(1)). Where investigations or assessments are likely to affect existing rights of leaseholders, licence holders or recreational users, the Council must make reasonable efforts to advise those persons and peak bodies, and place notices on Department noticeboards where practicable (s 20(4), s 26C(3)). Submissions become part of the public record and must be attached to the Council’s report (s 23(3), s 26E(3)), which has implications for confidentiality and commercial sensitivity. Interested parties thus face compliance choices about engaging in public processes, deciding whether to lodge submissions within specified times (default 60 days if not specified by the Minister, s 22(4)), and whether to protect or waive confidentiality given mandatory publication.

Other affected actors: Local government, industry, conservation groups and indigenous communities are specifically identified as interests for representation in Community Reference Groups and as areas of required expertise for Council membership (s 8(2), s 13(2)). Their inclusion in procedural mechanisms gives them institutionalised access to the Council’s deliberative stages and the public record.

Financially, the Act assigns the resource burden to the State via the responsible Department and Minister, because the Minister must ensure the Department Head provides the resources the Minister considers necessary (s 17(4)(b)). However, departments and public authorities will pick up significant incremental costs in providing practical assistance, hosting notices, and implementing accepted recommendations. Private parties bear the time and information costs of preparing submissions and may face operational consequences if recommendations adopted by Government affect their existing uses of public land.

This section sets out the statutory duties and rights that create enforceable or administrative expectations under the Act. The rights are largely procedural and informational, while duties fall on Ministers, the Council, Departments and public authorities.

Ministerial duties and rights:

• Initiation and specification: The Minister may request investigations and assessments in writing and must specify the reporting time and whether certain procedural stages (discussion paper, draft proposals) are required, subject to s 15(4)-(5) and s 26B(2). The Minister has the power to amend or withdraw requests at any time before completion (s 15(6)(b), s 26B(3)).
• Publication and parliamentary tabling: The Minister must cause copies of requests, amendments and withdrawals to be laid before each House of Parliament within seven sitting days, and published in the Government Gazette and on the internet within seven days (s 16(1), s 26C(1)-(2)). The Minister must also cause the Government response to the Council’s report to be prepared, identify responsibility for each proposed action, table the response within six months of tabling of the report, and publish the response (s 25(1)-(3), s 25(4); similarly s 26G).
• Resource approval: The Minister must consult with the Council on the resource estimate and ensure the Department Head makes available resources the Minister considers necessary (s 17(3)-(4)).
• Amendment statements: If a Government response is later amended, the Minister must prepare and table a statement identifying the amendment and rationale within seven sitting days and publish it (s 26(1)-(5), s 26H(1)-(5)).

Council duties and rights:

• Conduct investigations, assessments and provide advice requested by the Minister (s 6(a)); carry out functions conferred by any other Act (s 6(b)); and use anything necessary or convenient to perform them (s 7(1)).
• Prepare discussion papers and draft proposals papers as specified by the Minister, hold public submissions, consider specified matters in carrying out investigations and recommendations (s 15(4)(c), s 18).
• Consult with Departments and public authorities that may be affected and receive practicable assistance from them (s 19(1)-(2), s 26D(1)-(2)).
• Publish notices for investigations, discussion papers and drafts in newspapers circulating throughout the State and on the internet, including details on how to obtain the Minister’s request and how to make submissions, with timelines and formats specified (ss 20(3), 21(3)).
• Provide to the Minister copies of final reports to be made publicly available and include copies of submissions with reports (s 23(3)-(5), s 26E(3)-(6)).
• Establish Community Reference Groups for investigations and for assessments when directed by the Minister, and determine their procedures (s 13(1), (1A), (3)).

Departmental and public authority duties:

• Give practicable assistance to the Council in conducting investigations and assessments (s 19(2), s 26D(2)).
• Make available resources the Minister considers required through the Department Head (s 17(4)(b)).
• Where notices are practicable, allow Department of Energy, Environment and Climate Action notice boards to host notices in and around relevant public land (s 20(4)(b), s 26C(3)(b)).

Rights of the public and interested parties:

• Any person or body is entitled to make a submission on an investigation, discussion paper or draft proposals paper (s 22(1)). The Council may allow extensions for particular submissions or classes of submissions (s 22(3)). The specified time for submissions is either that set by the Minister or, if not specified, 60 days or a longer period determined by the Council (s 22(4)).
• Persons whose existing rights in relevant public land may be affected (leaseholders, licence holders, recreational users) are entitled to reasonable efforts by the Council to advise them and, where practicable, to have notices posted on Department noticeboards (s 20(4), s 26C(3)).
• Submissions become part of the public record and must accompany the Council’s report (s 23(3), s 26E(3)), thereby granting public access to the arguments and evidence lodged.

Obligations on implementation:

• A Minister, Department or public authority identified in a Government response or an amendment statement is required to ensure that the action to implement recommendations is undertaken to the extent that the recommendations are accepted in that response or statement (s 26A for investigations, s 26I for assessments and advice). The duty is limited to agreed or accepted recommendations, not those rejected by government.

Internal governance duties:

• Members are subject to the Public Administration Act 2004 (except Part 3) in respect of their office (s 9(5)). Members may be removed for refusal or failure to carry out duties, inefficiency or misbehaviour; removal must be followed by a statement laid before Parliament within seven sitting days (s 9(10)-(11)).
• The Council must maintain minutes and regulate its own proceedings subject to statutory rules such as quorum and voting restrictions for additional members (s 10(7)-(11)).

Notably absent from the Act are criminal penalties or pecuniary fines tied to failure to perform particular duties, and the Act does not itself create property or tenure changes. Rights under the Act are largely procedural and informational, establishing access to the Council’s processes and public transparency of submissions and responses.

The Act does not create traditional criminal offences or express pecuniary penalties for failure to comply with most of its procedural requirements. Enforcement is therefore predominantly administrative, reputational and parliamentary rather than penal.

Administrative enforcement and obligations:

• Implementation obligations imposed on Ministers, Departments and public authorities are expressed as duties: where a Government response identifies an entity as responsible, that entity "must ensure" the action is undertaken to implement the recommendation to the extent accepted (ss 26A, 26I). These provisions create a statutory duty to pursue implementation where the Government has accepted recommendations; the Act does not specify sanctions for non‑compliance with ss 26A and 26I, but the duties are public and reportable to Parliament through tabling and publication requirements (s 25(3), s 26G(3), and the Minister’s obligation to lay amendment statements s 26(4), s 26H(4)).
• Removal of members: the Governor in Council may remove a member on the Minister’s recommendation for refusal, neglect or failure to carry out duties, or for inefficiency or misbehaviour (s 9(10)). If removal occurs, the Minister must cause a full statement of grounds to be laid before each House of Parliament within seven sitting days (s 9(11)). This creates an accountability mechanism using parliamentary scrutiny rather than a criminal sanction.

Transparency and parliamentary oversight as enforcement mechanisms:

• The Act applies a reporting and publication regime designed to expose actions and inaction to public and parliamentary scrutiny: requests, amendments, withdrawals, Council reports, Government responses and any statements amending responses must be laid before each House and published within prescribed timeframes (ss 16(1), 23(5), 25(3)-(4), 26(2)-(5), 26G(3)-(4), 26H(4)-(5), 26C(1)-(2)). The requirement that the Council include copies of submissions with its report (s 23(3)) further increases transparency. These mechanisms allow political and reputational pressure to act as a crude enforcement device.

Judicial enforceability:

• The Act does not itself identify a private right of action or specific remedy for citizens to compel the performance of duties under the Act. Whether a court would find ss 26A/26I or other provisions justiciable and enforceable through administrative law remedies such as mandamus is not addressed in the statute text. The Act contains no express civil penalties or judicial enforcement provisions. The Act’s validity protection clauses (s 11) preserve Council acts despite procedural defects in appointments, but do not create penalties.

Procedural remedies and administrative law:

• Where a Minister amends or withdraws a request (s 15(6)(b), s 26B(3)) or alters a Government response (s 26(1), s 26H(1)), the Act requires specific publication and tabling steps and statements of rationale. Failures to comply with those procedural publication or tabling requirements would ordinarily be subject to administrative remedies such as orders in the nature of mandamus or declarations, depending on judicial interpretation; the Act itself does not provide or preclude such remedies.

Removal and internal discipline:

• The Act provides internal removal procedures for members who fail to discharge duties or who demonstrate inefficiency or misbehaviour (s 9(10)), and requires public disclosure of grounds (s 9(11)). This is an internal governance enforcement tool binding on the appointing authority.

In short, enforcement under the Act operates through duties that are binding but monitored and made publicly observable via mandatory tabling and publication steps. The Act relies principally on accountability through Parliament, public disclosure and internal administrative actions rather than on criminal or monetary penalties. The absence of specified sanctions for non‑performance of certain duties means that enforcement will depend on political, reputational and administrative levers and on any remedies the courts may recognise under administrative law outside the Act.

The Act explicitly cross‑references and interacts with multiple Victoria statutes and the Public Administration Act, integrating the Council’s remit with existing land and administrative regimes, preserving prior recommendations, and subjecting members to public sector employment law.

Definitions and land regimes:

• The Act defines "public land" by reference to other statutes to anchor the Council’s subject matter to existing land categories. Section 3 defines public land to include unalienated Crown land, land reserved under the Crown Land (Reserves) Act 1978, State forest as defined in the Forests Act 1958, and parks within the meaning of the National Parks Act 1975, and land vested in a public authority other than a municipal council (s 3). This links the Council’s investigations and advice to those statutory land regimes without altering the substantive land laws.

Public Administration and membership:

• Members are subject to the Public Administration Act 2004 in respect of their office, other than Part 3 of that Act (s 9(5)). This subjects members to the public sector employment, conduct and administrative rules that govern other statutory officeholders, affecting appointment, conflict of interest, and possibly disciplinary processes.

Repeal and saving provisions:

• The Act repeals the Environment Conservation Council Act 1997 (s 27) but saves recommendations made under that repealed Act and under the earlier Land Conservation Act 1970 including any acts done to give effect to those recommendations (s 28(1)(a)-(d)). Recommendations under the earlier Land Conservation Act may be amended or revoked by the Governor in Council on the Minister’s recommendation, with associated tabling and publication obligations (s 28(2)-(2C)). Section 28(3) deems prior recommendations to be recommendations of the Council contained in a report under s 23(1), bringing them within the Act’s reporting and government response framework (s 28(3)).

Administrative and departmental interdependence:

• The Act requires the Department Head to make available resources the Minister considers necessary for an investigation (s 17(4)(b)) and obliges Departments and public authorities to give practicable assistance to the Council (s 19(2), s 26D(2)). These duties create operational linkages between the Council and departmental powers and resources under other administrative statutes. The Act does not displace departmental decision‑making frameworks but requires cooperation.

Parliamentary procedure and disclosure:

• Tabling and publication obligations require interaction with parliamentary practice and the Government Gazette. Section 16 requires certain documents to be laid before each House and published in the Government Gazette and on the internet. Similar tabling obligations apply to Council reports and Government responses (ss 23(5), 25(3), 26G(3)). Those interactions place the Council and Ministers within Victoria’s parliamentary accountability processes and public record systems.

National and international instruments:

• The matters the Council must have regard to include international treaties ratified by the Commonwealth that are relevant to an investigation, and national or inter‑governmental agreements into which the Government has entered (s 18(e)-(f), s 26B(2)(c)(v)-(vi)). The Act therefore requires the Council to consider commitments arising outside Victoria’s statutes, but it does not itself give those instruments direct effect.

Other Acts conferring functions:

• The Council may carry out additional functions conferred by other Acts (s 6(b)). The Act’s own powers allow it to “do anything reasonably necessary or convenient” to perform its functions (s 7(1)), but it does not create new statutory powers over land tenure or regulatory regimes; those remain governed by the relevant land and environmental statutes.

Amendments and consequential machinery:

• The Table of Amendments shows that the National Parks and Victorian Environmental Assessment Council Acts Amendment Act 2016 inserted Division 2 (ss 26B-26I) creating tailored processes for assessments and advice, and other Acts have made further refinements, including the Parks and Crown Land Legislation Amendment Act 2017 and the Statute Law Revision Act 2025. These amending Acts are part of the statutory environment and may have created consequential obligations or modified how the Council interacts with other statutes.

In practice, the Act is an overlay of procedural obligations and advisory mechanisms that must be implemented in conjunction with substantive land, conservation and public administration law. It does not itself alter land tenure or operational powers of departments except by requiring cooperation, resource allocation and public responses.

The version presented incorporates amendments through 22 October 2025. The Act has been amended multiple times; the Table of Amendments in the source lists the principal amending instruments and their relevant commencement dates. Key amendment milestones and their mechanical effects in the Act are as follows.

2004 and 2006 amendments:

• The Public Administration Act 2004 (No. 108/2004) is listed in the Table of Amendments and affects members by applying that Act to members’ offices (s 9(5) as substituted). This amendment came into effect with the Public Administration Act commencement provisions indicated in the Table (assent 21 December 2004, commencement 5 April 2005 for the schedule item cited).

2011 amendment:

• The Statute Law Revision Act 2011 (No. 29/2011) made style and technical changes that affected the Act (see Table of Amendments entry with assent 21 June 2011). One recorded effect is to s 17(4)(b) as noted in the consolidated text.

2016 substantive amendments:

• The National Parks and Victorian Environmental Assessment Council Acts Amendment Act 2016 (No. 44/2016) is the most consequential recent amending Act reflected in the consolidated text. Its commencement for ss 11-29 was 7 September 2016. The 2016 amendments:
  • Inserted Division 2 (ss 26B-26I) creating the separate pathway for Minister requests for assessments and advice, with tailored processes for notice, consultation, reporting and Government responses (see s 26B and following).
  • Amended membership and additional member provisions, including eligibility to vote and limits on additional members (see ss 8(4), 10(8)-(9) as amended).
  • Required Community Reference Groups for assessments in certain circumstances (s 13(1A)) and added reporting and resource transparency requirements to the Council’s annual report (s 14(2)(b)-(d)).
  • Added implementation duties s 26A and s 26I requiring Ministers or Departments identified in Government responses to ensure implementation of accepted recommendations.
  • Adjusted other procedural matters including publication, tabling and timeframes (multiple provisions across ss 15-26E).
• These amendments materially broadened the Act’s flexibility and created the assessments/advice pathway separate from the more formal investigation pathway.

2017 amendment:

• The Parks and Crown Land Legislation Amendment Act 2017 (No. 53/2017) inserted or amended a provision noted in the Table of Amendments with commencement date 15 December 2017. The consolidated text shows references to the Public Administration Act application to members were affected (s 9(5) as amended).

2025 revision:

• The Statute Law Revision Act 2025 (No. 41/2025) is recorded with assent dated 21 October 2025 and a commencement date of 22 October 2025 for the schedule item cited. The consolidated text reflects a small amendment in s 20(4)(b) and s 26C(3)(b) about notices on Department noticeboards (see note in s 20(4)(b) and s 26C(3)(b) indicating insertion/amendment by No. 41/2025). The Table of Amendments shows this as a statute law revision item.

Other adjustments:

• Earlier statute law revision Acts and technical amendments (Statute Law Revision Act 2007) appear in the Table of Amendments. These are principally editorial or style changes and their entries indicate commencement dates and schedule items.

Operational effect of amendments:

• The 2016 package is the most operationally significant, allowing the Minister to request assessments or advice that do not meet the threshold for a full investigation and giving the Minister more flexibility over consultation and process, while retaining public transparency and adding statutory implementation obligations for accepted recommendations. The 2016 changes also entrenched publication, tabling and community reference group mechanisms and clarified departmental assistance and resourcing duties.

How to read the consolidated Act:

• The consolidated version available indicates which subsections were inserted or amended by each instrument, with inline references in the text (for example “S. 26B inserted by No. 44/2016 s. 27”). The Endnotes and Table of Amendments serve as the primary record of those changes.

For practitioners, the amendment history is relevant because it alters the degree of Ministerial control, the procedural options available for less extensive matters, and the statutory obligation on government entities to ensure implementation of accepted recommendations. Always check the Table of Amendments and the text of the particular amending Acts for transitional arrangements or specific commencement provisions affecting implementation.

The Act and the consolidated text provided do not list judicial decisions or case law interpreting the Victorian Environmental Assessment Council Act 2001. The Endnotes include legislative history, second reading speech references and the Table of Amendments, but they do not record litigation or statutory interpretation judgments.

Because the statute does not itself include a schedule of case law or citations to judicial authorities, there is no litigation history reported within the source to cite. The Act creates administrative duties, publication and tabling requirements and implementation clauses (ss 26A, 26I) that could, in principle, give rise to litigation on enforceability or procedural compliance in the administrative law arena. However, the source material supplied contains no instances of such litigation, and no cases are named in the Act itself or in the Endnotes.

Practitioners seeking caselaw on matters such as the justiciability of implementation obligations, the scope of ministerial discretion under s 15 or s 26B to amend or withdraw requests, or judicial review of procedural failures would need to search Victoria’s court databases, AustLII and other legal research sources for decisions post‑dating the consolidated version. The Act’s silence in its text and Endnotes means that any contemporary litigation report must be sourced externally to the statutory text provided.

This Act contains multiple provisions that generate practical risks and operational pitfalls for Ministers, Council members, departments, stakeholders and submitters. The following are concrete points to watch, grounded in the statutory text.

Ministerial control over scope and procedures:

• The Minister can limit or omit core consultation stages for any particular investigation (s 15(5) permits the Minister to specify that a discussion paper and/or a draft proposals paper are not to be prepared). That power can accelerate processes but reduces opportunities for public engagement and can heighten political scrutiny. Practitioners should look for whether the Minister has exercised s 15(5) to exclude stages when advising clients on engagement opportunities.

Reporting timeframes and Ministerial discretion:

• The Minister sets the time within which the Council must report (s 15(4)(b), s 26B(2)(b)). Short statutory timeframes can constrain thorough technical processes. The Council can seek an extension (s 24), but the application must be made at least 30 days before the due date (s 24(2)(a)). Failure to file an extension in time could force rushed reporting.

Resourcing and who pays:

• The Council must submit a business plan and budget within the specified period (30 days unless the Minister grants a longer period) after a request (s 17(1)-(2)), and the Minister ensures the Department Head makes available resources the Minister considers required (s 17(4)(b)). The practical risk is that the Minister may not approve resources to the Council’s preferred level, constraining the Council’s capacity to undertake extensive field work or prolonged consultations. Departments will therefore pick up resource burdens for assistance and for implementing accepted recommendations (s 19(2), ss 26A/26I).

Publication of submissions and confidentiality:

• The Council must attach copies of each submission to its report (s 23(3), s 26E(3)). Submitters should be aware that submissions will become public record. The Act does not provide an express confidentiality regime or carveouts for commercially sensitive material. Parties seeking to protect confidential information will need to consider careful redaction or refrain from lodging sensitive materials in open submissions.

Additional members and voting limits:

• Additional members may be appointed for particular investigations or advice (s 8(4)), but they are eligible to vote only for questions directly relating to that matter (s 10(8)), and if the presiding officer is an additional member they lack casting or deliberative votes on unrelated questions (s 10(9)). This can cause procedural complexities where additional members attend for a narrow remit but a broader meeting agenda arises; minutes and voting records must reflect eligibility.

Implementation is limited to “accepted” recommendations:

• The obligation to ensure implementation applies only "to the extent that [recommendations] are accepted" in the Government response or amendment statement (ss 26A, 26I). The Government may accept recommendations fully, partially, or not at all, and the statutory duty flows only from the accepted portion. Parties assuming that all Council recommendations will be implemented should confirm the Government’s response and which elements are accepted.

Parliamentary tabling deadlines:

• The Minister must cause Government responses to be laid before each House not later than the first sitting day after the period of six months following the day the Council’s report was tabled (s 25(3), s 26G(3)). Practically, this requires Governments to schedule action and prepare inter‑departmental positions in a timely manner. Failure to table within the required window will be a breach of statutory process and subject to political scrutiny.

Notifications to existing rights‑holders:

• Where an investigation or assessment is likely to affect existing rights, the Council must make reasonable efforts to advise leaseholders, licence holders and recreational users and, where practicable, place notices on Department noticeboards (s 20(4), s 26C(3)). The statutory phrase "reasonable efforts" and "where practicable" introduces potential disputes about sufficiency of notice. Affected parties should monitor notices and the Government Gazette and not rely solely on field noticeboards.

No direct regulatory power:

• The Act does not itself change land tenure or statutory uses; it is advisory. The Council can recommend changes, but the legal effect is through Government acceptance and subsequent administrative or legislative action. Parties should not assume a Council recommendation is a change in law until the Government responds and implements it.

Public Administration Act obligations:

• Members are subject to the Public Administration Act 2004 (s 9(5)), potentially affecting conflicts of interest, disclosures and conduct. Appointments must be publicly advertised before an initial appointment (s 8(6)), which may signal selection processes subject to public and political scrutiny.

Amendments can occur mid‑process:

• The Minister may at any time amend or withdraw requests for investigations or assessments (s 15(6)(b), s 26B(3)). This can lead to sudden changes of scope partway through a Council’s work, with implications for resourcing and submissions already lodged.

Default timings:

• If the Minister does not specify submission times, the Council’s notices default to a 60 day submissions period unless the Council determines otherwise (s 22(4)). Practitioners should not assume a longer default period and should check each notice for the specific timeframe.

Saving of prior recommendations:

• Recommendations under the repealed Environment Conservation Council Act 1997 and under the Land Conservation Act 1970 are preserved and are deemed recommendations of the Council under s 23(1) for the purposes of this Act (s 28(1), (3)). This can complicate the legal landscape where historical recommendations already resulted in acts taken to give them effect.

These are not normative judgments but operational signals available in the statutory language. Users should map these statutory triggers to project timetables, confidentiality strategies, resource estimates and political risk assessments when planning engagement with Council processes.

Compliance under the Act is largely process and disclosure based. The following step‑by‑step guidance is grounded in the Act’s provisions and aimed at the principal actors: Ministers, the Council, Departments/public authorities and external stakeholders (leaseholders, licence holders, recreational users, industry, conservation and indigenous groups).

For Ministers and departmental policy teams:

1. Initiating a request: Before making a request under s 15(1), ensure you publish proposed terms of reference in newspapers circulating generally throughout Victoria and allow a 28 day notification period (s 15(2)-(3)). Record and publish how any comments received were dealt with within seven sitting days after the notification period (s 16(2)).
2. Prepare a clear written request: Make the request in writing, specify the reporting timeframe, and explicitly state whether the Council must prepare a discussion paper and draft proposals paper or whether these stages are to be omitted (s 15(4)(a)-(c), s 15(5)). If you plan to limit public consultation or require particular considerations, set those out in a request for an assessment under s 26B(2)(c)-(f).
3. Resource approval: Expect the Council to submit a business plan and budget within 30 days (or within a longer period you specify) after receiving the request (s 17(1)-(2)). Consult with the Council on resource estimates and then ensure the Department Head makes available resources the Minister considers necessary (s 17(3)-(4)).
4. Timetables and extensions: If a Council requests an extension, process applications in writing by the 30 day pre‑due date threshold (s 24(2)(a)). Be aware of the six month Government response tabling deadline after the report is tabled (s 25(3), s 26G(3)).
5. Tabling and publication: Ensure requests, amendments and withdrawals are laid before each House within seven sitting days and published in the Government Gazette and on the internet within seven days (s 16(1)). On receipt of Council reports, prepare and table Government responses identifying responsible Ministers, Departments or public authorities, and publish them promptly (s 25(1)-(4), s 26G(1)-(4)).
6. Implement accepted recommendations: Where a Government response identifies responsibility, arrange for the identified entity to ensure implementation of accepted recommendations (s 26A, s 26I). Keep records and progress reports that align with the Council’s report and the Government response.

For the Council and its secretariat:

1. Business plan and budget: Submit the business plan and budget within the specified period (default 30 days) after receiving a written request (s 17(1)-(2)). Identify required resources and consult with the Minister (s 17(3)-(4)).
2. Procedural compliance: Follow the notice obligations for investigations, discussion papers and draft proposals papers, publishing in a newspaper circulating generally through Victoria and on the internet, and including addresses for obtaining the Minister’s request and making submissions (ss 20(3), 21(3)). If further submissions are to be taken, publish an explicit notice (s 20(2)).
3. Community Reference Groups: Establish Community Reference Groups for each investigation and for assessments where directed (s 13(1), (1A)). Include representatives across the statutory list of interests where appropriate and determine procedures (s 13(2)-(3)).
4. Submissions and confidentiality: Inform prospective submitters that submissions will form part of the public record and will be attached to the Council’s report (ss 22(1), 23(3)). Offer pragmatic guidance on redaction where appropriate and consistent with transparent reporting obligations.
5. Reports: Prepare written reports within the Minister’s specified period, include detailed rationale for recommendations and set out how submissions were treated (s 23(1)-(2)). Provide copies of submissions with the report as required (s 23(3)). Provide copies to the Minister for public release and ensure timely publication and tabling by the Minister (s 23(4)-(5)).
6. Recordkeeping and minutes: Keep accurate minutes of Council meetings and track quorum and voting, particularly in respect of additional members whose voting is restricted (ss 10(5)-(9), 10(10)-(11)).

For Departments and public authorities:

1. Give practicable assistance: Cooperate and provide practicable assistance and access to information and staff when the Council confers with you (s 19(2), s 26D(2)). Plan for staff time and data requests.
2. Notices: Where investigations likely affect existing rights, facilitate Council notice placement and provide access to Department noticeboards in and around relevant public land where practicable (s 20(4)(b), s 26C(3)(b)).
3. Implementation planning: If your agency may be identified as responsible in a Government response, prepare implementation costings, timelines and reporting frameworks in advance and coordinate with the Minister’s office so the Government can meet the six month response tabling rule (s 25(3)).

For leaseholders, licence holders, recreational users and other third parties:

1. Monitor notices and the Government Gazette: The Council and Minister publish notices in newspapers and the Government Gazette and on the internet (ss 20(3), 16(1), 26C(2)). If your existing rights may be affected, the Council is required to make reasonable efforts to advise you and, where practicable, put notices on Department noticeboards (s 20(4), s 26C(3)).
2. Submissions: Any person or body may make submissions on investigations, discussion papers or draft proposals papers (s 22(1)). Note that submissions will be included in the public report (s 23(3)), so manage confidentiality and commercially sensitive material accordingly. If the Minister does not specify a submission period, the default is 60 days (s 22(4)).
3. Engage early with Community Reference Groups: Where Community Reference Groups are established, seek representation through peak bodies or direct membership to influence advice given to the Council (s 13(2)).

Practical recordkeeping and audit trail:

• Maintain copies of notices, submissions, business plans, budgets, correspondence with Council and Ministerial offices, and any implementation plans, as these documents are central to the tabling and publication regime and to demonstrating compliance with statutory duties.

Risk management:

• For those with potentially affected rights, consider legal advice before lodging submissions containing sensitive information because of the mandatory publication rule (s 23(3)). For agencies, be prepared to cost and resource implementation tasks early when engaged in Council processes because accepted recommendations create a statutory duty to effect agreed actions (ss 26A, 26I).

Following these procedural steps and anticipating the statutory publication and implementation obligations will align actions with the statutory framework and reduce the risk of missed deadlines, inadvertent disclosure or failures of communication that the Act makes material through parliamentary reporting.
