40D Contravening a civil penalty provision is not an offence To avoid doubt, a contravention of a civil penalty provision is not an offence. Part 7—Powers of authorised officers Division 1—Appointment of authorised officers 41 Appointment of authorised officers (1) The ESC may, in writing, appoint any of the following persons as an authorised officer for the purposes of this Part— (a) an employee of the ESC; (b) a person employed under Part 3 of the **Public Administration Act 2004**; (c) any other person employed by the State; (d) any other person who the ESC considers has appropriate skills, qualifications and experience. (2) The ESC must not appoint a person as an authorised officer unless the ESC is satisfied that the person has appropriate skills, qualifications and experience. (3) In exercising powers or performing functions as an authorised officer, an authorised officer must comply with any directions of the ESC.
